Prior to this temporary policy change, those applying to work in Canada would typically need to apply for their initial work permit before they came to Canada. If they were already in Canada with visitor status when they were approved for a work permit, they would need to leave the country to be issued their work permit. With this policy in place, leaving Canada isn't necessary. Those looking to benefit from this temporary public policy must have valid status in Canada as a visitor on the day they apply, and have a job offer that is supported by a labour market impact assessment (LMIA) or an LMIA-exempt offer of employment. An LMIA is an application that an employer makes to Employment and Social Development Canada (ESDC) to evaluate if hiring foreign workers will have a positive, neutral or negative impact on the Canadian economy. If ESDC deems the impact is negative, the employer will not be eligible to hire foreign nationals, according to CIC News. Under the policy, applicants must also submit an application for an employer-specific work permit no later than February 28, 2025. IRCC said that continuing this policy makes visitors an option for employers in Canada, many of whom are facing significant labour shortages during a period of economic expansion. There was an overall decrease in the number of vacancies to 848,000 from over one million, according to Statistics Canada data from December 2022. However, key sectors like healthcare, food and social assistance still need more employees to fill in-demand positions.

New Delhi, July 15 () Students of National Institutes of Design (NID) will be able to apply easily for work permits in Germany now as its centres have been included in the European country's Anabin database, the commerce and industry ministry said on Wednesday. It said Germany has opened a Central Office for Foreign Education (ZAB) which acts as the sole authority for the evaluation of foreign qualifications there. As part of their service, they maintain a database called Anabin that lists foreign degrees and higher education qualifications in relation to German diplomas and degrees. Recognition of foreign university-level qualifications in Germany is often an essential prerequisite for securing a German Work Visa, Job Seekers Visa or German Blue Card. It said often the success of visa application is dependent on the proof that the university-level qualification acquired outside Germany is considered on par with equivalent German qualification. "NID Ahmedabad was included in the Anabin list in 2015 and the other new NIDs have also been incorporated in this database recently. Now that all NIDs are a part of this list, its students will be able to easily apply for work permits in Germany for working in the fields relevant to their education," it said. The Department for Promotion of Industry and Internal Trade (DPIIT), under the ministry, has established five National Institutes of Design (NID) in India for imparting world-class design education. While NID Ahmedabad (with campuses in Ahmedabad, Gandhinagar and Bengaluru) commenced its activities in 1961, four new NID's in Andhra Pradesh, Haryana, Assam, and Madhya Pradesh came up in the last few years. The <keyword id="2743235" type="ORGANIZATION" weightage="20" keywordseo="United-States-Citizenship-and-Immigration-Services">United States Citizenship and Immigration Services</keyword> (USCIS) has backed that claim reasserting that they plan on getting rid of the provision that allows H-4 visa holders to work in the country. H-4 visa holders are basically dependents of the H-1B visa holders. And, currently, the largest beneficiaries of H-4 visas are Indians. They constitute <a href="https://www.theguardian.com/technology/2016/may/19/silicon-valley-wives-women-visa-immigration-work">80 percent</a> of the 125,000 H-4 visas issued back in 2015. It was a metaphor for being able to live in the US but without the right to work within the country or get a social security number. The situation was corrected two years ago, when the <keyword id="16284" type="PERSON" weightage="20" keywordseo="Obama">Obama</keyword> administration passed a ruling that gave H-4 visa holders the provision to seek employment while they waited for their green card to be approved. Reports <a href="https://qz.com/1260345/h-4-visa-the-trump-administration-reiterates-itll-scrap-work-permits-for-h-1b-spouses/">suggest</a> that visa trouble won’t stop with H-1B and H-4 visas but also spill over onto the L-1B visa, which is issued to professionals with specialised knowledge. New Delhi, Mar 24 () The Department of Telecom on Tuesday reached out to state governments over difficulties faced by personnel of service operators in their movements due to lockdowns imposed by authorities to contain coronavirus outbreak. Telecom Secretary Anshu Prakash in a letter to chief secretaries of state and advisors to administrators of union territories has noted that telecom infrastructure is critical for maintaining communication, use of broadband, encouraging e-commerce and facilitating work from home during the ongoing restrictions to curb the spread of coronavirus. While telecom services have been listed within the essential services, employees maintaining the network and managing operations have complained of facing problem in their movement. "Instances are being reported where the local authorities have asked the personnel of the telecom service providers at network operation centres and call centres to shut down operations in the view of the restrictions. "Hence, it will be necessary that instructions reach the field level to permit personnel maintaining and providing telecom services to continue their work without interruption," the letter said. Employees of all organisations, that do not fall under list essential services, have been asked to work from home for business continuity using their phone and broadband connections. Prakash has requested to state governments and UT administration designate nodal officer with the name and phone number who can be contacted by the telecom operators and internet companies in the event of any difficulty. Telecom companies like Reliance Jio have announced free broadband service to new customers and doubled data limit for all existing customers to support work from home in fight against coronavirus. State-owned telecom companies BSNL and MTNL took lead last week to announce free broadband plans and additional data for their customers to support work from home. While addressing the reporters, Minister of Immigration, Refugees and Citizenship of Canada Sean Fraser announced that his department is extending work permits to family members of temporary foreign workers on Friday. Prior to this announcement, spouses were only eligible for a work permit if the principal applicant was working in a high-skill occupation. This temporary measure aims to improve the emotional well-being, physical health and financial stability of workers by keeping families together. As a result, it is expected that the worker will better integrate into their overall work environment and community, according to the press statement released by Immigration, Refugees and Citizenship Canada. Starting in January 2023, through a temporary 2-year measure, Canada will expand eligibility to work in Canada to spouses and working-age children through a phased approach for workers at all skill levels. This would include families of workers in health care, trades and hospitality, for example. As a result of this new approach, it is estimated that family members of more than 200,000 foreign workers could begin working in Canada, offering a greater opportunity for both foreign workers seeking to work in Canada and for employers addressing their labour needs. "Everywhere I go, employers across the country continue to identify a lack of workers as their biggest obstacle. Today's announcement will help employers find the workers they need to fill their labour gaps by expanding work permits to family members at all skill levels, resulting in family members of over 200,000 foreign workers being able to work in Canada. Family members of Indian workers now eligible to work in Canada

By Lalit K Jha Washington, May 7 () In a major development, the Trump administration has urged a federal district court not to block an Obama-era rule allowing certain categories of spouses of H-1B visa-holders to work in the United States.In a submission before the US District Court, District Washington this week, the Department of Homeland Security (DHS) argued that the American technology workers, who had challenged the 2015 ruling on giving work permits to H-4 visa-holders, have not been irreparably harmed by such work authorisation.An H-4 visa is issued by the US Citizenship and Immigration Services (USCIS) to the immediate family members (spouse and children under 21 years of age) of the H-1B visa-holders, most of whom are Indian IT professionals. It is normally issued to those who have already started the process of seeking employment-based lawful permanent resident status.The DHS, in its submission on May 5, said the argument by Save Jobs USA on behalf of American technology workers "only speculates about potential economic harm to its members, based on five-year-old affidavits".In its lawsuit filed in 2015, Save Jobs USA had argued that the regulation issued by the Obama administration to provide employment authorisation for certain H4 dependent spouses harms their members, who are American technology workers.After coming to power, the Trump administration in December 2017 informed the court that it plans to rescind the Obama-era regulations in this regard. Since then, it told the court about half-a-dozen times about its intention to issue a Notice of Proposed Rulemaking (NPRM). However, the DHS has not rescinded "Employment Authorisation for Certain H-4 Dependent Spouses" of 2015.The DHS's court submission was in response to the one by Save Jobs USA, which sought a preliminary injunction to stop the H-4 rule from providing qualifying H-4 visa-holders with temporary employment authorisation. Save Jobs USA had argued that the longer the case remains in abeyance, greater the harm to US workers. The DHS disagreed, asserting that there is no such indication.In an 11-page argument, the DHS asserted that Save Jobs USA failed to establish that its members' speculative economic injuries were sufficient to satisfy the DC Circuit's "high standard for irreparable injury".The claim of irreparable harm by Save Jobs USA relied on the H-4 rule eliminating or significantly reducing employment opportunities, meaning that the number of available information-technology jobs would significantly decline due to the H-4 rule, it said."But this relationship has not been shown to be 'certain' and 'actual', rather than merely 'theoretical'," the DHS argued.As such the DHS urged the court to deny the motion of Save Jobs USA, seeking a preliminary injunction enjoining the H-4 rule. Save Jobs USA had sought a stay on the H-4 ruling.An H-4 visa is issued to the spouses of H-1B visa holders, a significantly large number of whom are high-skilled professionals from India. They had obtained work permits under a special order issued by the previous Obama administration in 2015.As of December 2017, the USCIS had approved 1,26,853 applications for employment authorisation for H-4 visa-holders. According to a 2018 report by the Congressional Research Service (CRS), 93 per cent of approved applications for H-4 employment authorisation were issued to individuals born in India and five per cent to individuals born in China. Garaufis also ordered the Department of Homeland Security to publicly notify people on Monday that it will begin to accept new applications for DACA and make certain that the work permits issued are valid for two years.Today's ruling also solidified the challenge to a memo acting Homeland Security Sec. Chad Wolf issued in June, which reduced DACA work permits to one year and affected about 65,000 Dreamers. Garaufis had challenged Wolf's role as acting DHS secretary and voided the memo last month.In court, Garaufis said, "The court believes that these additional remedies are reasonable," and later confirmed the DHS would publicize the changes. "Indeed, the government has assured the court that a public notice along the lines described is forthcoming," Garaufis added. Although the news was well-received by advocates for immigrants' rights, many are wary of changes that could still be implemented before January 21, as states like Texas are seeking legal challenges to declare DACA unlawful. The Department of Justice could also appeal Friday's decision.President-elect Joe Biden has pledged to fully restore the DACA program within his first 100 days.
