The move has been triggered by the decision of a senior politician Sharad Pawar which is in the opposition in the state-- to visit the Enforcement Directorate in connection with a corruption case at Maharashtra State Cooperative Bank. The ED <a href="https://www.moneycontrol.com/news/business/ed-registers-case-against-sharad-pawar-70-others-in-maharashtra-cooperative-bank-fraud-case-4471211.html" target="_blank">registered a case</a> against Nationalist Congress Party (NCP) chief Sharad Pawar -- an opposition leader in the state assembly-- and his nephew Ajit Pawar, among 70 other officials of the Maharashtra State Co-operative (MSC) Bank for an alleged fraud pegged at ₹25,000 crore.

 What are the restrictions imposed under Section 144? Section 144 of the Criminal Procedure Code (CrPC) of 1973 prohibits the assembly of four or more people in an area. According to the law, every member of such 'unlawful assembly' can be booked for engaging in rioting. The law also disallows carrying any weapon in the areas mentioned and people can be detained for violating it. The maximum punishment for such an act is three years. The cops can detain people for protesting or engaging in any activity that may be considered as intended to cause unrest. And, in spite of Modis promise that normalcy will return to the valley during the festival, food and ration shops are open only in certain areas. The same applies to ATMs as well. Nonetheless, the government is trying to ensure that people have round the clock access to basic amenities, like electricity and water, with staff on standby in case there’s a breakdown. Students protest Nearly 250 students at the Aligarh Muslim University (AMU) have stated that they will not be attending the festivities organised at the university’s guest house. Other students in the Kashmir Valley have also stated that they will be staying away from any kind of festivities on campus. Jammu and Kashmir governor, Satya Pal Malik, recently sanctioned ₹1 lakh to organise Eid festivities in the valley. But according to the students at AMU, the money is given to buy their consent. "We take this as an opportunity to reject Delhi's authoritarianism and drama played in Parliament on August 5," they said in a statement. Restrictions and Section 144 The Jammu and Kashmir administration had eased the prohibitory orders in Kashmir Valley for the past few days for people to make purchases for Eid. And, while there have been no reports of violence on Sunday, Section 144 has been reinstated in certain areas. Even in Srinagar, restrictions were reinstated on Sunday afternoon. As tensions in Kashmir escalate, the Opposition Congress is making a move on the central government’s actions. According to ANI, Congress MPs — Adhir Ranjan Chowdhury, K Suresh, <keyword id="119952" type="PERSON" weightage="20" keywordseo="Manish-Tewari">Manish Tewari</keyword>, Ghulam Nabi Azad, Anand Sharma, Ambika Soni, and Bhubaneswar Kalita — have given adjournment motion notice over the Kashmir issue. What is an adjournment notice? An adjournment motion notice is given when a government policy is strongly disagreed. This will draw the attention of the government and criticise its decision in an urgent matter before it’s too late, <a href="http://www.prsindia.org/administrator/uploads/general/1408616558_Primer%20on%20Parliamentary%20Procedures.pdf">according to PRS Legislative</a>. If the adjournment motion is accepted, the House adjourns after voting. The adoption of an adjournment motion is seen as a strong disagreement with government policy, although there is no compulsion on the government to resign. Notice of an adjournment motion is required to be given before 10 am on the day on which the motion is proposed. Kashmir issue Since Friday, Kashmir has been on a high alert. In 2012 and 2013, a girl from Palghar, Maharashtra was arrested for criticising <keyword id="6371377" type="PERSON" weightage="20" keywordseo="Bal-Thackeray">Bal Thackeray</keyword>'s state funeral on <keyword id="6354576" type="ORGANIZATION" weightage="20" keywordseo="Facebook">Facebook</keyword>, another girl for merely "liking" that comment; a professor from <keyword id="6354925" type="COMPANY" weightage="20" keywordseo="Kolkata">Kolkata</keyword> was arrested for forwarding a cartoon about Mamata Banerjee; as was a man who tweeted about <keyword id="497730" type="PERSON" weightage="20" keywordseo="Karthi-Chidambaram">Karthi Chidambaram</keyword>'s disproportionate wealth. But now, even though Section 66A is gone, the muzzling of speech continues unabated. India, like every other country in the world, places reasonable fetters on free expression. These include a threat to public order, dangerously stirring up religious sensitivities, caste slurs, defamation, child pornography, and so on. Other sections of the IT Act, including clauses on obscenity and morphing, are being used to arrest people like in the case of morphing of images, which may be a concern when women are misrepresented, but by itself, a morphed image in a political caricature or piece of satire is not an illegal or criminal act. Similarly, lying and cussing are human activities that also exist online; they do not inherently deserve criminal sanction. Even rumours are not illegal by themselves, the CrPC should kick in only in instances where they might incite violence or have other criminal implications. WhatsApp is where these tensions are strongest. Given that the technology can be used to make trouble on a wide scale, the police has good reason to keep an eye on the platform. But increasingly, WhatsApp administrators have been booked even for harmless remarks. There's a trend of using Section 144 of the CrPC, which applies to unlawful assemblies, to WhatsApp discussions. Curious are the cases of Indore collector who invoked it to deter any conversation about demonetisation, or the Varanasi DM who said that any false content on a WhatsApp group which were treated grounds for arrest. These arrests create a chilling effect on speech and the likelihood of someone, somewhere, taking legal action constrains you to watch your words more than necessary. Rather than a lively, democratic public sphere, we could end up with the hushed, wary conversations of a police state.

A WhatsApp message could get you arrested in India

The <keyword id="6356172" type="UNKNOWN" weightage="20" keywordseo="Maharashtra-government">Maharashtra government</keyword> on Thursday extended the lockdown-like restrictions in the state till June 1 to break the chain of COVID-19. Chief Secretary Sitaram Kunte in an order said the curbs will remain in force till 7 am on June 1. As per the order, additional restrictions include mandatory negative RT-PCR test report for any person entering the state by any mode of transport. The test report will have to be issued within 48 hours before the time of entry into the state. All restrictions enforced as per earlier orders for people arriving from places of "sensitive origin" will be applicable to anyone arriving from any part of the country into the state, the order said. In case of cargo carriers, not more than two people will be allowed to travel in those vehicles. If the carriers are originating from outside <keyword id="13126" type="COMPANY" weightage="20" keywordseo="Maharashtra">Maharashtra</keyword>,they will be allowed with a negative RT-PCR test report issued within 48 hours before the time of entry into the state and will be valid for seven days, the order said. The lockdown-like curbs were earlier imposed in the state on April 5. The curbs were further tightened on April 15 with Section 144 of the CrPc, banning assembly of five or more people, imposed in theentire state.
