New Delhi [India], May 14 (ANI): Actor <keyword id="19956789" type="General" weightage="100" keywordseo="Jackie-Shroff" source="keywords">Jackie Shroff</keyword> has approached the <keyword id="19895875" type="General" weightage="20" keywordseo="Delhi-High-Court" source="keywords">Delhi High Court</keyword> to seek protection of his personality and <keyword id="21653032" type="General" weightage="20" keywordseo="publicity-rights" source="keywords">publicity rights</keyword>. The suit has been filed against various entities using his name, photographs, voice and word "<keyword id="19960424" type="General" weightage="20" keywordseo="Bhidu" source="keywords">Bhidu</keyword>" without his consent. Through this suit, actor Jackie Shroff seeks direction to protect the Plaintiff's name, voice, image, likeness, and all other elements of the Plaintiff's persona which are distinctive and the unauthorized use by third parties is likely to create confusion and deception amongst the public. The bench of Justice Sanjeev Narula on Tuesday issued a summons on the actor's suit and said it will consider the case tomorrow on the interim injunction application. The actor seeks a permanent injunction restraining the defendants from infringing the Plaintiff's personality rights and publicity rights by the use of the Plaintiff's name 'Jackie Shroff", "Jackie', '<keyword id="21052256" type="General" weightage="20" keywordseo="jaggu-dada" source="keywords">Jaggu Dada</keyword>', 'Bhidu' voice, image and any other attribute which is exclusively identifiable with him for any commercial or personal gain. The plea asks the court to pass a decree of permanent injunction restraining Defendant Bhidu Shawarma restaurant and its associates, servants, agents, affiliates, holding companies, and representatives, from infringing the Plaintiff's registered trademark by using the same as part of its trade name 'Bhidu Shawarma &amp; Restaurant' or any other trade name/trade mark which is deceptively similar to the Plaintiff's registered trademark numbers. The suit also pertains to the violation of the Plaintiff's moral rights in his performances conferred upon him by virtue of section 38B of the <keyword id="21653033" type="General" weightage="20" keywordseo="copyright-act" source="keywords">Copyright Act</keyword>, 1957. The Plaintiff, as an actor has acted in many cinematographic films and thus enjoys moral rights in his performances in such films and is entitled to restrain any third party from distorting, mutilating or making other modifications to his performance that are prejudicial to his reputation. In the context of the claims in the present proceedings, the Defendants are extracting clips of movies or other cinematographic works which contain performances of the Plaintiff, for the purpose of creation, communication of graphic/ interchange formats (GIFs), etc. The suit states that Plaintiff has not been informed prior to the creation and dissemination of such GIFs, nor has his consent been sought or secured. The Defendants, by reproducing clips containing the Plaintiff's performance, and that too in a manner which brings disrepute to the Plaintiff and makes him the subject of unsavoury humour, are violating his moral rights in his performances. The misappropriation of any attribute of the Plaintiff's persona without his express permission for a commercial purpose is liable to be restrained not only on the basis of the traditional conception of publicity rights namely the exclusive right to commercially exploit one's persona but also on the basis of the tort of dilution, more particularly tarnishment. Recently, the Delhi High Court also restrained the unauthorised use of actor Anil Kapoor's personality or name for commercial purposes. As a next step, they have already taken steps to withdraw all oppositions against each other in the trademark registry which will help them to proceed with the registration of their respective marks. BharatPe and PhonePe amicably settle all trademark disputes over 'Pe' suffix

Chinese mobile manufacturer <keyword id="215177" type="General" weightage="20" keywordseo="vivo" source="Orion">Vivo</keyword> on Friday mov<keyword id="12163" type="General" weightage="20" keywordseo="ed" source="Orion">ed</keyword> a plea in the Delhi High Court challenging the freezing of its various bank accounts by the Enforcement Directorate (ED) under the Prevention of Money Laundering Act (PMLA), 2002. In the writ petition, Vivo said the orders against it are in stark contravention to the mandate of Section 17 of the PMLA, as the same do not entail any reasons for freezing, let alone cogent "reasons to believe" as to why the bank account should be frozen. It is a generic order passed mechanically without any application of mind. It said the total non-application of mind and arbitrariness is manifest from the fact that even the amount in question has not been quantified by the respondent and blanket orders for freezing all the bank accounts have been passed causing substantial and irreparable hardship to the petitioner and gravely impacting its business and reputation. It further said the freezed accounts are utilised for the payment of salaries and statutory dues, opening of letter of credits for the petitioner's operations and for all kinds of expenses necessary for day-to-day functioning of the petitioner. "Monthly payments of around Rs 2,826 crore have to be made towards statutory dues, salaries, rent, monies for daily business operations. Due to the freezing of the bank accounts, the petitioner will be unable to honour its aforesaid obligations not only towards various statutory authorities, but also towards its employees and customers," it said further. Vivo has told the court that the circulation of the news about the ED searches has maligned its image among its suppliers and customers, "leading to reputational and financial loss, and irreparable damage to the years of goodwill developed" by it. "The freezing of the bank accounts will not only impede the existing/prospective business operations of the petitioner conducted through the bank accounts but will bear an adverse effect on the petitioner's operations across the globe," it added. Vivo moves Delhi HC challenging freezing of its bank accounts by ED

Delhi Chief Minister <keyword id="19901384" type="General" weightage="100" keywordseo="Arvind-Kejriwal" source="keywords">Arvind Kejriwal</keyword> will return to <keyword id="56350" type="General" weightage="20" keywordseo="tihar-jail" source="Orion">Tihar jail</keyword> on Sunday as his interim bail in a money laundering case linked to the alleged Delhi liquor policy scam ends on Saturday (June 1). Kejriwal was given interim bail by the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> to campaign for the Lok Sabha elections on May 10 and was asked to surrender to Tihar jail on June 2. The Delhi CM had earlier moved the Supreme Court for an extension of interim bail. On Wednesday, the Supreme Court rejected his plea, stating that since he was given liberty to move the trial court for regular bail, the plea here is not maintainable. Meanwhile, Delhi's Rouse Avenue Court on Saturday reserved the order on the interim bail plea moved by Kejriwal, citing medical reasons in a money laundering case related to the alleged excise policy scam. The court fixed June 5 for the pronouncement of the order on the plea seeking 7-day bail, while refused to pass the order today itself as requested by Kejriwal's Lawyer. Senior Advocate N Hariharan, who appeared for Kejriwal, submitted that the interim bail was to campaign for his party (the Am Aadmi Party), which is a national party. "I am out for 20 days and had I not done it, you would've said see he didn't campaign and fell ill. It was a lot of stress due to the campaigning and you know that stress is a aggrevator of diabetes. What was alarming was that keto levels rose in the urine. The aspect of concern is the high level of sugar and the keto numbers," Kejriwal's advocate submitted in the plea. Appearing for the Directorate of Enforcement (ED), Solicitor General Tushar Mehta and Additional Solicitor General SV Raju submitted that Arvind Kejriwal suppressed facts including about his health conditions. During preliminary arguments, ED lawyers stated that they have objections to filing interim bail as well. This court cannot modify the Supreme Court order. He's on interim bail because the SC granted it, what he is asking here is an extension of the Supreme Court order," the ED lawyers submitted. "This interim bail plea is required to be dismissed as it is full of suppression of facts. The Supreme Court had granted Liberty to him that he can file regular bail but the liberty to seek an extension of interim bail was not granted to him. He has said that these tests require 7 days, but the nature of the test has been suppressed," they further stated. ED also raised maintainability issues on interim bail plea and submitted that instead of getting a medical test done, he was travelling across. Medical tests would take more than one hour. ED further submitted that the applicant in fact has gained 1 kg weight and falsely claimed that he has lost 7 kg weight. The Registrar of the Supreme Court has passed a speaking order and the same has been suppressed by them. There is a reason for suppression and it is because he had been travelling for campaigning purposes, but he didn't get the tests done then, ED said. Recently Kejriwal through his legal team filed two different bail applications before the concerned court. His regular bail plea is listed for a hearing on June 7, 2024. Earlier, Arvind Kejriwal posted an emotional message on Friday and said that he is proud that he is going to jail to save the country from dictatorship. In his video message, Kejriwal said, "Tomorrow the 21 days are getting over, the day after tomorrow I have to surrender. I don't know how long they will keep me in jail this time. But my spirits are high. I am going to jail to save the country from dictatorship. I am proud of this. They tried to break me many times, tried to make me bow down but I didn't." Kejriwal was arrested by the ED on March 21 in connection with a money laundering probe relating to alleged irregularities in the now-cancelled <keyword id="20106989" type="General" weightage="20" keywordseo="Delhi-Excise-Policy" source="keywords">Delhi excise policy</keyword> 2021-22.

Delhi excise policy case: Arvind Kejriwal to return to Tihar Jail today, no relief from Court

The Enforcement Directorate (ED), the country’s financial watchdog, had raided the premises of Vivo and its associates. The ED had claimed that Vivo had transferred ₹62,476 crore to its parent company in China over a five-year period to avoid paying taxes in the country. The agency had also accused the company of violating the Prevention of Money Laundering Act (PMLA). Delhi High Court allows Vivo to operate its bank accounts if it’s ready to furnish a ₹950 crore bank guarantee

The Enforcement Directorate (ED) has told Delhi High Court through an affidavit that <keyword id="215177" type="General" weightage="20" keywordseo="vivo" source="Orion">Vivo</keyword> India indulged in money laundering to destabilise the financial system and challenge the integrity and sovereignty of the country. The affidavit was filed before the Delhi High Court last week. The anti-money laundering agency has said in the affidavit that they were scanning the suspicious financial transactions of 22 firms owned by Hongkong based foreigners and entities. These firms transferred huge money to China. It is also probing a money laundering case against Grand prospect International Communication private limited, a Jammu and Kashmir based distributor of Vivo. The firm was reportedly incorporated on the basis of forged documents and it was claiming to be a subsidiary of Vivo India. The firm used an email peter.ou@vivoglobal.com, indicates connection with Vivo India and it is in record of Ministry of Corporate Affairs. Delhi-based Chartered Accountant firm had helped in incorporating J&amp;K based firm. This firm has been in touch with Vivo India since 2014. The ED has mentioned that Vivo India incorporated 22 firms in different states which allegedly laundered money. The Delhi based CA firm helped Vivo India in incorporating 22 firms. Earlier, Vivo India had said that they were following all rules of the land of India. Chinese smartphone company Vivo's top executives, directors Zhengshen Ou and Zhang Jie, had fled from India via Nepal. In February, the ED initiated a Prevention of Money Laundering case against them on the basis of an FIR lodged with Kalkaji Police Station of Delhi under sections 417, 120B and 420 of IPC, 1860 against Grand Prospect International Communication Private Limited (GPICPL) and its Director, shareholders and certifying professionals etc on the basis of complaint filed by Ministry of Corporate Affairs. As per the FIR, GPICPL and its shareholders had used forged identification documents and falsified addresses at the time of incorporation. The allegations were found to be true as the investigation revealed that the addresses mentioned by the directors of GPICPL did not belong to them, but was a government building and house of a senior bureaucrat. ED has said that out of the total sale proceeds of Rs 1,25,185 crore, Vivo India remitted Rs 62,476 crore. i.e, almost 50 per cent of the turnover is out of India, mainly to China. ED to Delhi court: Vivo indulged in money laundering, challenged the integrity and sovereignty of the country

On June 22, <keyword id="19956758" type="General" weightage="20" keywordseo="Finance-Minister" source="keywords">Finance Minister</keyword> Nirmala Sitharaman said that the next meeting of the GST Council will take place in mid to late August. The aim of this meeting will be to discuss the pending issues of the last meeting. The council is expected to discuss rate rationalisation and compliance, among others. The GST Council, consisting of the Union Finance Minister and representatives from all States and Union Territories, was established to make decisions on various aspects of GST, including <keyword id="20452955" type="General" weightage="20" keywordseo="tax-rates" source="keywords">tax rates</keyword>, exemptions, and administrative procedures. It played a crucial role in shaping the GST framework in India. The last meeting of the GST Council was held on 22 June 2024 this year. During the meeting, the council recommended relaxation to taxation, Input Tax Credit (ITC) claims and demand notices. The GST Council proposes exemptions for specific services offered by Indian Railways to the general public, as well as for intra-railway transactions. To curb government litigation, the Council has recommended setting monetary thresholds for filing appeals by departments: Rs 20 lakh for the GST appellate tribunal, Rs 1 crore for high courts, and Rs 2 crore for the Supreme Court. In a move to assist small taxpayers, the Council, in its last meeting, extended the deadline for furnishing returns from April 30 to June 30 for the fiscal year 2024-25 and subsequent years. The Council, in its last meeting, recommended the phased rollout of biometric-based Aadhaar authentication for GST registration applicants across India. The Council recommended a uniform GST rate of 12 per cent on all milk cans, regardless of their material (steel, iron, or aluminium), to eliminate disputes. The Finance Minister, during the last GST meeting, reiterated the central government's intent to bring petrol and diesel under the Goods and Services Tax (GST) framework. She highlighted that the groundwork for this inclusion was laid during the initial implementation of GST and emphasized that the decision now lies with the state governments. The central government has long maintained that incorporating petrol and diesel into GST would streamline tax rates and potentially reduce prices for consumers.

54th GST Council meeting to take place on September 9 in New Delhi

New <keyword id="19900881" type="General" weightage="20" keywordseo="delhi" source="keywords">Delhi</keyword>: Delhi Chief Minister <keyword id="19901384" type="General" weightage="20" keywordseo="arvind-kejriwal" source="keywords">Arvind Kejriwal</keyword> was arrested by the <keyword id="19895344" type="General" weightage="20" keywordseo="enforcement-directorate" source="keywords">Enforcement Directorate</keyword> (ED) on Thursday night in an excise policy-linked money laundering case, officials said. The arrest, the first of a sitting chief minister, came hours after the Delhi High Court refused to grant protection to the <keyword id="19914482" type="General" weightage="20" keywordseo="aap" source="keywords">AAP</keyword> national convenor from any coercive action by the agency. The 55-year-old leader's arrest, amid campaign for the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> elections, drew angry reactions from his Aam Aadmi Party (AAP). Soon after the high court order, an ED team reached his residence and carried out searches. Subsequently, he was arrested, officials said. Officials said the ED would produce the chief minister before a court here on Friday and seek his custody for interrogation. As the ED officials carried out their action inside, additional Delhi Police personnel and Rapid Action Force (RAF) and CRPF teams were deployed around the chief minister's residence. The additional deployment was made as the ED sought extra security measures in anticipation of protests by AAP supporters, sources said. A large number of AAP workers and leaders gathered near the chief minister's residence and shouted slogans against the ED action. During the day, <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> moved the Supreme Court against the high court's order denying him any relief in the matter. The ED's action is virtually a replay of what transpired during the arrest last week of Bharat Rashtra Samithi (BRS) leader <keyword id="19987244" type="General" weightage="20" keywordseo="k-kavitha" source="keywords">K Kavitha</keyword>, who is now in ED custody in the same case.
