The Enforcement Directorate filed its first charge sheet in connection with its money laundering probe against Chinese smartphone maker Vivo-India and some others, official sources said on Thursday. The prosecution complaint has been filed before a special court here on Wednesday under the criminal sections of the Prevention of Money Laundering Act and vivo-India has been named an accused apart from those arrested in this case, the sources told PTI. The federal probe agency arrested four persons, including the MD of the Lava International mobile company Hari Om Rai, in this investigation. The others who were taken into custody were Chinese national Guangwen alias Andrew Kuang, Chartered Accountants Nitin Garg and Rajan Malik. The ED had then claimed in its remand papers before a local court here that the alleged activities of the four enabled vivo-India to make wrongful gains that were detrimental to the economic sovereignty of India. It had raided vivo-India and its linked persons in July last year, claiming to have busted a major money laundering racket involving Chinese nationals and multiple Indian companies. The ED had then alleged that a whopping Rs 62,476 crore was "illegally" transferred by vivo-India to China to avoid payment of taxes in India. The company had said that it "firmly adheres to its ethical principles and remains dedicated to legal compliance." Rai had recently told a court here that though his company and vivo-India were in talks to launch a joint venture in India a decade ago, he had nothing to do with the Chinese firm or its representatives since 2014. "He has not derived any monetary benefit, nor has he engaged in any transaction with vivo-India or any entity allegedly related to vivo, let alone having been associated with any alleged 'proceeds of crime'," Rai's lawyer told the court. The agency filed an enforcement case information report (ECIR), the ED equivalent of a police FIR, on February 3 after studying a Delhi Police FIR of December last year against an associated company of vivo-India, Grand Prospect International Communication Pvt Ltd (GPICPL), its directors, shareholders and some others professionals. The police complaint was filed by the Corporate Affairs Ministry alleging that GPICPL and its shareholders used "forged" identification documents and "falsified" addresses at the time of incorporation of the company in December 2014.

The ED action comes almost more than a year after it carried out searches at 48 locations across the country belonging to <keyword id="3180567" type="General" weightage="20" keywordseo="vivo-mobiles" source="Orion">vivo Mobiles</keyword> India Private Limited and its 23 associated companies such as Grand Prospect International Communication Pvt Ltd (GPICPL). According to the ED, vivo Mobiles India Pvt Ltd was incorporated on August 1, 2014 as a subsidiary of Multi Accord Ltd, a Hong Kong based company and was registered at ROC Delhi. GPICPL was registered on December 3, 2014 at ROC Shimla, with registered addresses of Solan, Himachal Pradesh and Gandhinagar, Jammu. "The said company was incorporated by Zhengshen Ou, Bin Lou and Zhang Jie with the help of Nitin Garg, CA. Bin Lou left India on April 26, 2018. Zhengshen Ou and Zhang Jie left India in 2021," the financial probe agency had said. The ED probe had revealed that the PMLA investigation by ED was initiated by registering a money laundering case on February 3, 2022 on the basis of an FIR registered at the Kalkaji police station in the national capital by the Delhi Police under sections 417, 120B and 420 of IPC, 1860 against GPICPL and its Director, shareholders and certifying professionals, etc., on the basis of complaint filed by the Ministry of Corporate Affairs. As per the FIR, GPICPL and its shareholders had used forged identification documents and falsified addresses at the time of incorporation. The allegations were found to be true as the investigation revealed that the addresses mentioned by the directors of GPICPL did not belong to them, but in fact it was a government building and house of a senior bureaucrat.

The Enforcement Directorate (ED) has told Delhi High Court through an affidavit that <keyword id="215177" type="General" weightage="20" keywordseo="vivo" source="Orion">Vivo</keyword> India indulged in money laundering to destabilise the financial system and challenge the integrity and sovereignty of the country. The affidavit was filed before the Delhi High Court last week. The anti-money laundering agency has said in the affidavit that they were scanning the suspicious financial transactions of 22 firms owned by Hongkong based foreigners and entities. These firms transferred huge money to China. It is also probing a money laundering case against Grand prospect International Communication private limited, a Jammu and Kashmir based distributor of Vivo. The firm was reportedly incorporated on the basis of forged documents and it was claiming to be a subsidiary of Vivo India. The firm used an email peter.ou@vivoglobal.com, indicates connection with Vivo India and it is in record of Ministry of Corporate Affairs. Delhi-based Chartered Accountant firm had helped in incorporating J&amp;K based firm. This firm has been in touch with Vivo India since 2014. The ED has mentioned that Vivo India incorporated 22 firms in different states which allegedly laundered money. The Delhi based CA firm helped Vivo India in incorporating 22 firms. Earlier, Vivo India had said that they were following all rules of the land of India. ED to Delhi court: Vivo indulged in money laundering, challenged the integrity and sovereignty of the country

Vivo needs to follow the law of the land, says external affairs ministry

As the <keyword id="6357808" type="General" weightage="50" keywordseo="enforcement-directorate" source="Orion">Enforcement Directorate</keyword> (ED) continued searches at the premises of <keyword id="36918" type="General" weightage="20" keywordseo="chinese" source="Orion">Chinese</keyword> companies, including smartphone maker <keyword id="215177" type="General" weightage="100" keywordseo="vivo" source="Orion">Vivo</keyword>, at 44 locations in 22 states on Wednesday, the directors of one of the companies associated with Vivo have fled <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword>. According to sources, two of the Chinese directors of Solan, Himachal Pradesh-based company, that was associated with Vivo, have likely fled India, as ED registered a prevention of <keyword id="6355008" type="General" weightage="20" keywordseo="money-laundering" source="Orion">money laundering</keyword> case. The Chinese nationals were made directors in the Indian entities with fake documents. The enforcement agency has so far received information about money laundering worth Rs 10,000 crore during the raids, according to ED sources. Chandramouli said that IPL 2021 will not be able to beat 2019. He said, “It is unlikely that either viewership or ad volume records will be broken this year. While the advertising budgets of brands are beginning to get better, they are nowhere close to what they used to be in mid-2019. Even IPL is likely to see smaller and newer advertisers with a few of the bigger brands that will remain a part of IPL due to FOMO.”

The enforcement agency has so far received information about money laundering worth Rs 10,000 crore during the raids, according to ED sources. China unhappy with Vivo raids, says frequent probes 'chill' investor confidence

Nine of the new patients are workers of Chinese phone maker Oppo and two construction workers at a factory site of its sister-concern Vivo in Greater Noida, the officials said. Eight of the Oppo workers are locals, while one is from Ghaziabad, they said. Also, 15 contacts of a 39-year-old man, who works at a media firm in Noida Sector 16A and was detected with the infection on May 15, have been found positive on Monday, District Magistrate Suhas L Y said. "The man lives in Delhi's Laxmi Nagar but works at Zee Media office in Sector 16A Noida. He was found COVID-19 positive on May 15. His 51 contacts were tested at Max Lab in Delhi. His 15 contacts, who are employees in the same organisation, residing in Gautam Buddh Nagar have tested positive," the DM said in a statement. Another 13 contacts of the man who reside in Delhi, Faridabad and Gurgaon have tested positive for coronavirus and the administrations of their respective districts were doing the needful, as per protocols. Among other patients are five contacts of a man from Sector 5 Harola village, who was earlier detected with the infection and a 40-year-old woman from Sector 78 Noida, he said. "Total 1,679 test results were obtained on Monday of which 1,648 were negative and 31 positive. Total 286 positive cases have been recorded so far. Three patients were discharged on Monday, taking the number of recoveries so far to 194 and active cases are 87," according to the statement. Guatam Buddh Nagar adjoining Delhi in western UP has so far recorded five deaths -- all males aged above 60, according to officials. The number of samples collected till Monday stood at 8,245, according to the official statement. Oppo has got 3,321 employees tested for COVID-19 at a private lab in Gurgaon, Haryana and result of 1,581 of them have been sent to the health department, Gautam Buddh Nagar, while others were awaited, it stated. Vivo got 18 employees tested at a private lab in Gurgaon, Haryana and 16 of them resulted negative, while two positive, the administration said. Specific areas of the premises of Oppo and Vivo in Greater Noida and Zee Media office in Noida have been sealed for sanitisation work, according to the statement. A Vivo spokesperson said, "No Vivo employee has tested positive till date and we are taking all precautionary measures adhering to all government guidelines." "Our current operational factory, 15 kms away from the construction site, is running at 30 per cent of its capacity as per the norms stated by Greater Noida authorities," the spokesperson added. The items imported by Oppo were reportedly used for the manufacture of mobile phones in the country. The DRI has claimed that Oppo mis-declared the items to avail ineligible duty exemption benefits. It has claimed that the company availed an exemption of ₹2,981 crore. Oppo comes under DRI scanner for alleged customs duty evasion of ₹4,389 crore

Chinese smartphone maker <keyword id="874458" type="General" weightage="80" keywordseo="xiaomi" source="Orion">Xiaomi</keyword> on Friday said the ongoing investigations and allegations in <keyword id="3658" type="General" weightage="100" keywordseo="india" source="Orion">India</keyword> could take a long period of time to settle, and the company could receive judgments or enter into "settlements that may adversely affect its operating results or cash flows". The company, which registered around 20 per cent drop in its global sales at $10.31 billion in the June quarter (Q2), said that "it is not practical to quantify" related financial effects (of India probes) "at this stage". "The management assessed the aforesaid matters related to <keyword id="2210169" type="General" weightage="80" keywordseo="xiaomi-india" source="Orion">Xiaomi India</keyword>, taking into consideration opinions from professional advisors and concluded Xiaomi India has valid grounds to respond to the relevant Indian authorities," the group said in its quarterly financial statement. In April, the Enforcement Directorate (ED) had said they seized Rs 5,551.27 crore of Xiaomi India, lying in the bank accounts under the provisions of Foreign Exchange Management Act, in connection with the illegal outward remittances made by the company. Finance Minister Nirmala Sitharaman had informed the Rajya Sabha, in the recent Monsoon session, that five cases of customs duty evasion have been registered against Xiaomi India by the Directorate of Revenue Intelligence (DRI). The company said in its quarterly results that since December 2021, Xiaomi India has been involved in various investigations and notifications initiated by relevant Indian authorities including the Income Tax Department, the Directorate of Revenue Intelligence and the Directorate of Enforcement "in relation to compliance of relevant income tax regulations, custom duties regulations as well as foreign exchange regulations". Xiaomi India further received an order on August 11, "whereby certain of its bank deposits were continued to be restricted, alleging Xiaomi India has inappropriately deducted certain costs and expenses, including purchase costs of mobile phones and royalty fees paid to third parties as well as companies within the Group". The government is looking into cases of alleged tax evasion by three Chinese mobile companies -- OPPO, Vivo India and Xiaomi. A show-cause notice demanding Rs 4,403.88 crore has been served to OPPO Mobiles India Ltd based on an investigation conducted by the DRI. The DRI also detected customs duty evasion of around Rs 2,217 crore by Vivo India. For Chinese enterprises that originally tried to make India an overseas product-processing centre, if it is indeed increasingly difficult and unprofitable to operate in the country, then withdrawing from India is also an available option, state-run Global Times said earlier this month. The Zee News team has been shifted to an alternative facility for the time being," Zee Media said.
