New Delhi, Dec 14 (IANS) The Centre on Monday informed the Supreme Court that since December 3, stubble burning is not an issue for air pollution in Delhi. The top court asked the Centre to apprise it of the steps taken so far by the Commission of Air Quality in the National Capital Region and adjoining areas to address air pollution. Additional Solicitor General Aishwarya Bhati, representing the Centre, submitted before a bench headed by Chief Justice S. A. Bobde that since December 3 stubble burning is not an issue for air pollution and the government will file a detailed affidavit on the steps taken by the commission so far to address air pollution. Apparently stubble burning had stopped after that date. The bench also comprising Justice A. S. Bopanna and V. Ramasubramanian asked Bhati to file an affidavit elaborating the steps taken so far. Bhati said the affidavit will be filed by Wednesday. The top court has scheduled the matter for further hearing on Thursday. During the hearing senior advocate Vikas Singh, appearing for a petitioner, submitted that the commission has done nothing so far and the matter at hand is similar to a public health emergency. He added that the commission has 14 members, but they have done nothing, and an affidavit should be filed detailing the actions taken so far to check pollution. Singh was representing petitioner Aditya Dubey, who has raised the stubble burning issue which contributes majorly to air pollution in the Delhi- NCR region. He added that some concrete steps need to be taken as stubble burning takes place every year. Senior advocate Siddharth Bhatnagar, representing another petitioner, submitted that stubble burning has increased by five per cent. Bhati replied "We are readying a comprehensive affidavit." The top court on November 6, had asked the Centre to ensure there is no smog in the national capital, after it was told that the commission has started functioning that day. Centre to SC: Since Dec 3 stubble burning not an issue for pollution

Solicitor General Tushar Mehta on Monday informed the Supreme Court that the Centre has taken a holistic view of the issue of <keyword id="755878" type="PERSON" weightage="20" keywordseo="air-pollution-in-Delhi">air pollution in Delhi</keyword> NCR, which also includes pollution due to stubble burning, and it intends to bring out a legislation in next three to four days to tackle this issue. A bench headed by Chief Justice S.A. Bobde told Mehta, representing the Centre, it welcomes the Centre's decision to establish a body to address the menace of air pollution. "Everybody is choking in the city, it must be curbed", said the Chief Justice citing the menace of air pollution in the national capital. Mehta replied the Centre will come out with the legislation in three to four days and the government is keen to establish a permanent body of experts to address air pollution. "We can come out with the legislation in three to four days", submitted Mehta, insisting that the top court should keep its earlier order, which directed formation of a panel headed by retired judge Justice Madan B. Lokur to monitor steps taken to curb the stubble burning issue in the neighbouring states of <keyword id="66" type="COMPANY" weightage="20" keywordseo="Delhi">Delhi</keyword>, in abeyance. The top court reiterated that it welcomes this step by the Centre, in which it will create a permanent body by enacting a legislation to deal with the annual air pollution problem, which includes pollution from stubble burning in Punjab, Haryana and Uttar Pradesh. The bench asked the counsels opposing this submission by Mehta saying that why must the court interfere if the Centre intends to bring out a comprehensive legislation to tackle air pollution. Senior advocate Vikas Singh, representing the petitioner who filed PIL to address stubble burning, contended before the bench, "I don't understand the interest of Union of India in getting the order suspended." Mehta reiterated that the legislation will be brought within 3-4 days. After a detailed hearing in the matter, the top court agreed to keeps in abeyance it's order of appointing Justice Lokur as one-man commission to monitor steps to prevent stubble burning. The top court is likely to hear the matter again on Thursday this week. Indian government to bring a new law addressing air pollution issues due to stubble burning

Senior advocate Rajeev Dhavan, representing the Muslim parties in the Ram-Janmbhoomi-Dabri masjid land dispute case, tore up a pictorial map showing the exact birthplace of Lord Ram during the hearings in the Supreme Court on Wednesday. The reference to the pictorial map showing the exact birthplace of Lord Ram at the disputed site in Ayodhya by Senior advocate Vikas Singh, representing the All India Hindu Mahasabha, was objected to by Dhavan. Dhavan then asked the bench as to what he should do with it, to which the bench said that he can shred it into pieces. Dhavan then tore the pictorial map, provided by the counsel for All India Hindu Mahasabha, in the courtroom. During the arguments, Singh referred to various aspects of the <keyword id="48834" type="ORGANIZATION" weightage="20" keywordseo="Allahabad-High-Court">Allahabad High Court</keyword> judgement and said there has been long faith and belief on the part of Hindus with regard to the scared nature of the birthplace of Lord Ram. Dhavan had also objected to Singh's attempt to refer to a book on Ayodhya, written by former IPS officer <keyword id="207684" type="PERSON" weightage="20" keywordseo="Kishore-Kunal">Kishore Kunal</keyword>, saying such attempts should be disallowed. New Delhi, Apr 6 () Court hearing in congregation must become an "exception" during the "extraordinary outbreak" of COVID-19 pandemic and it is necessary that all courts respond to the call of social distancing to ensure they do not contribute to the spread of virus, the Supreme Court said on Monday.Passing a slew of directions for all courts across India, it said that the apex court and all the high courts are authorised to adopt measures required to ensure robust functioning of judicial system through the use of video conferencing.Observing that "technology is here to stay", the top court passed the directions by exercising its plenary power under Article 142 of the Constitution and said that all the measures which shall be taken by the courts to reduce physical presence of stakeholders within its premises "shall be deemed to be lawful".A bench headed by Chief Justice S A Bobde said, "consistent with the peculiarities of the judicial system in every state and the dynamically developing public health situation", every high court would be authorised to determine the modalities suitable to the temporary transition to the use of video conferencing technologies."All measures that have been and shall be taken by this court and by the high courts, to reduce the need for the physical presence of all stakeholders within court premises and to secure the functioning of courts in consonance with social distancing guidelines and best public health practices shall be deemed to be lawful," said the bench, also comprising Justices D Y Chandrachud and L Nageswara Rao.The bench said the outbreak of coronavirus or COVID-19 in several countries including India has necessitated immediate adoption of measures to ensure social distancing to prevent transmission of the virus, and the apex court as well as the high courts have adopted measures to reduce physical presence."Access to justice is fundamental to preserve the rule of law in the democracy envisaged by the Constitution of India. The challenges occasioned by the outbreak of COVID-19 have to be addressed while preserving the constitutional commitment to ensuring the delivery of and access to justice to those who seek it," the bench said, adding, "Court hearings in congregation must necessarily become an exception during this period."The top court directed that district courts in each states shall adopt the mode of video-conferencing prescribed by the concerned high court."The concerned courts shall maintain a helpline to ensure that any complaint in regard to the quality or audibility of feed shall be communicated during the proceeding or immediately after its conclusion failing which no grievance in regard to it shall be entertained thereafter," it said.The bench directed that courts shall duly notify and make available the facilities for video-conferencing for such litigants who do not have the means or access to such facilities. "If necessary, in appropriate cases courts may appoint an amicus-curiae and make video conferencing facilities available to such an advocate," it said, adding, "Until appropriate rules are framed by the high courts, video conferencing shall be mainly employed for hearing arguments whether at the trial stage or at the appellate stage."The apex court made it clear that in "no case shall evidence be recorded without the mutual consent of both the parties by video-conferencing".The bench said if it is necessary to record evidence in a courtroom, the presiding officer shall ensure that appropriate distance is maintained between any two individuals in the court.It directed that the presiding officer shall have the power to restrict entry of persons into the courtroom or the points from which the arguments are addressed by the advocates. "No presiding officer shall prevent the entry of a party to the case unless such party is suffering from any infectious illness. However, where the number of litigants are many the presiding officer shall have the power to restrict the numbers. The presiding officer shall in his discretion adjourn the proceedings where it is not possible to restrict the number," the bench said.While making it clear that "these directions shall operate until further orders", the top court said that these directives have been issued in "furtherance of the commitment to the delivery of justice."It said that cooperation of all the concerned stakeholders, like judges, lawyers and litigants, is indispensable in successful implementation of these directions to ensure that the judiciary rises to face the unique challenge presented by the outbreak of COVID-19. The bench has listed the matter for hearing after four weeks.It said that every individual and institution is expected to cooperate in the implementation of measures designed to reduce the transmission of coronavirus and the scaling down of conventional operations within the precincts of courts is a measure in that direction. It said that modern technology has enabled courts to enhance the quality and effectiveness of the administration of justice and Indian courts have been "proactive in embracing advancement in technology in judicial proceedings".It has taken suo motu (on its own) cognizance of a letter written by senior advocate and former Supreme Court Bar Association (SCBA) president Vikas Singh, who has suggested measures for use of technology for conducting hearings in the courts.
