The Indian government has formally asked the United Kingdom to deport <a href="http://www.ndtv.com/topic/Vijay-Mallya">Vijay Mallya</a>, the former Indian liquor baron who owes state-run banks over Rs 9000 crores of unpaid loans, but <a href="http://www.businessinsider.in/A-little-too-late-Mallya-flew-out-of-India-before-banks-could-take-a-stay-order-against-him/articleshow/51323634.cms">fled to London</a> on March 2nd. 
 
The 60-year old <a href="http://www.businessinsider.in/Vijay-Mallyas-personal-Airbus-jet-to-be-auctioned-to-recover-governments-dues/articleshow/51406790.cms">businessman</a> inherited a fortune from his father at the age of 28, and took it to new heights with his vision and successful brands like Kingfisher beer. As per reports, he would also be expelled from his <a href="http://www.businessinsider.in/Vijay-Mallya-asked-for-Rs-20000/articleshow/51943521.cms">post of a Member of Parliament</a> next week, after the government cancelled his passport a few days back. 
 "As of today, the ministry has written to the High Commission of the UK in Delhi requesting the deportation of Sri <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>," Foreign Ministry spokesman Vikas Swarup said, adding that the British authorities are yet to respond. 
 
The Supreme Court recently granted banks the access to <a href="http://www.businessinsider.in/Vijay-Mallya-foreign-assets/articleshow/51994174.cms">his foreign assets</a>, and an arrest <a href="http://www.businessinsider.in/Four-more-NBWs-against-Mallya-in-Hyderabad-court/articleshow/51412039.cms">warrant</a> has also been issued against him by a Mumbai court.

<keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>, who is under immense pressure from Indian state-run banks to repay the loans worth Rs 9000 crores that he had taken for the now defunct Kingfisher Airlines, has stated that he wishes to honour his commitments, and has <a href="http://www.businessinsider.in/Vijay-Mallya-makes-another-attempt-this-time-he-is-offering-Rs-6000-crore-settlement/articleshow/51822342.cms">offered a new settlement</a> to the main lender SBI. In a United Breweries Ltd board meeting that he attended by a video-conference, he also stated that he hopes to make a quick progress on the matter. 
 
Enforcement Directorate of India is looking forward to <a href="http://www.businessinsider.in/UK-refuses-to-deport-debt-laden-Vijay-Mallya-money-lenders-grope-in-dark/articleshow/52217798.cms">extradite Mallya from the United Kingdom</a>, the country that he fled to, but in the meeting, he said that the chairman of UBL has the support of the board and strategic partner Heineken.

"We expressed concerns over the various issues and Mallya has assured us that he is in serious negotiations with the banks to repay the loans as soon as possible. He has said he is willing to return to India to answer all questions but he has to be assured of his safety and freedom," said Kiran Mazumdar-Shaw, an independent board member. 
 
"Performance of the company has been extremely good and there is no corporate governance issue that has impacted it owing to Mallya," he added. 
 
Executives aware of the matter said that Heineken has chosen to stand by Vijay Mallya in his tough times. 
 
"Mallya told us he has been <a href="http://www.businessinsider.in/Vijay-Mallya-safe-in-UK/articleshow/52041381.cms">wrongly accused</a> and has every intent to repay loans," said Sunil Alagh, also an independent board member. "For now, the board stands by him and sees no corporate governance issues and would monitor progress until the next (board) meeting in August." 
 
Mallya told the board he had been wrongly accused of money laundering and there was no evidence to justify the allegations. He said he was willing to return immediately if he was assured of<a href="http://www.businessinsider.in/SC-says-Vijay-Mallya-will-have-to-declare-all-his-assets-to-the-Banks-including-that-of-his-wifes-and-childrens/articleshow/51994174.cms"> safe passage</a>. "We all unanimously expressed our concerns to Mr Mallya and he told us that he is making serious efforts to repay the banks," said CY Pal, independent board member. 
 
"He also told us he had tried to repay Kingfisher Airlines' employee dues through United Breweries Holdings but was delayed since the Karnataka High Court has frozen accounts and assets." He expressed his keenness to return to India if safe passage was assured, Pal added.

UK had denied India’s request to deport debt-ridden <a href="http://www.businessinsider.in/searchresult.cms?query=VIJAY+MALLYA&amp;sortorder=effectivedate">Vijay Mallya</a>, whose Indian <a href="http://www.businessinsider.in/ED-says-Vijay-Mallya-is-un-cooperative-seeks-revocation-of-his-diplomatic-passport/articleshow/51811500.cms">passport</a> has also been revoked over <a href="http://www.businessinsider.in/searchresult.cms?query=money+laundering&amp;sortorder=effectivedate">money laundering</a> charges. 
 
Britain said it could consider an extradition request for him. 
 Mallya has been booked under Prevention of <keyword id="6355008" type="UNKNOWN" weightage="40" keywordseo="money-laundering">Money Laundering</keyword> Act 2002 and a non-bailable warrant has also been issued against him.

"The UK government has informed us that under the 1971 Immigration Act, the UK does not require an individual to hold a valid passport in order to remain in the UK if they have extant leave to remain as long as their passport was valid when leave to remain or enter the UK was conferred,” said spokesperson of Ministry of External Affairs Vikas Swarup. 
 
"At the same time the UK acknowledges the seriousness of the allegations and is keen to assist the Government of India. They have asked GoI to consider requesting mutual legal assistance or extradition," Swarup added. 
 
The extradition can happen under the 1993 treaty or any other necessary assistance under the Mutual Legal Assistance Treaty (MLAT) signed in 1992 between India and the U.K. 
 
However, India was hoping to get the liquor baron, who is facing arrest over allegations of defaulting bank loans of over Rs 9,400 crore, through the expeditious route of deportation and not go through the lengthy process of extradition.

UK refuses to deport debt-laden Vijay Mallya, money lenders grope in dark

Former Indian liquor baron <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>, who <a href="http://www.businessinsider.in/Vijay-Mallya-out-of-India-while-banks-seek-stay-order/articleshow/51323634.cms">fled India in March </a>and owes billions of dollars to Indian banks, has said that he is in a "forced exile" and would not return to India right now, because here, things are been thrown at him "fast and furious". 
 
Mallya, whose passport has been cancelled by the Indian government, said that he wants a "reasonable" settlement with creditor banks for the now defunct Kingfisher Airlines, but by taking his passport or arresting him, they won’t get any money. 
 
"I definitely would like to return to India. Right now, things are flying at me fast and furious. My passport has been revoked. I don't know what the government is going to do next," he told the Financial Times. 
 
The 60-year old says that he continues to be an Indian patriot, who is "proud to fly the Indian flag", but he feels safe in the UK and has no plans to leave that country amidst the outcries against him. 
 
"It is important to understand the environment in India today. The electronic media is playing a huge role not just in moulding public opinion, but in <a href="http://www.businessinsider.in/Vijay-Mallya-foreign-assets/articleshow/51994174.cms">inflaming the government</a> to a very large extent," he said in a four-hour interview in Mayfair, Central London. 
 
It was yesterday that the Indian government had formally asked the UK to <a href="http://www.businessinsider.in/Indian-wants-Vijay-Mallya-deported/articleshow/52027466.cms">deport Mallya</a>, who also has <a href="http://www.businessinsider.in/Four-more-NBWs-against-Mallya/articleshow/51412039.cms">several NBWs </a>against him. 
 
Mallya added that he was "absolutely not guilty of any of these preposterous charges of diverting funds from Kingfisher, buying <a href="http://www.businessinsider.in/Vijay-Mallyas-Airbus-to-be-auctioned/articleshow/51406790.cms">properties </a>or stuff like that".

He added that the government can appoint the world's best forensic auditor, but even he won’t find anything wrong in the accounts of Kingfisher as far as bank loans utilization is concerned. 
 
When asked who he thinks is behind his woes, he said, "I wish I knew," and "All I can say is the manner in which my passport was first suspended and then revoked was done in an extraordinary haste." 
 
"First, notice of suspension came on a public holiday last week... I replied. And my reply was not considered and the passport was revoked on Saturday," he concluded.

Cancelling my passport won’t get you back your money, cries Mallya

Indian government has tried several methods to bring loan defaulter <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword> back to India, but to no avail. This forced the <keyword id="6357808" type="ORGANIZATION" weightage="100" keywordseo="Enforcement-Directorate">Enforcement Directorate</keyword> to think of a 21-year-old treaty, called <keyword id="507869" type="ORGANIZATION" weightage="100" keywordseo="Mutual-Legal-Assistance-Treaty">Mutual Legal Assistance Treaty</keyword> (<keyword id="513083" type="UNKNOWN" weightage="100" keywordseo="MLAT">MLAT</keyword>) to bring him back. 
 
As per an ET report, ED has written to Ministry of External Affairs (MEA), asking for MLAT to be invoked, hoping that the treaty can be used to bring Mallya back. 
 
It was only a few days back that CBI has registered a fresh case against Mallya for allegedly cheating several Indian banks of Rs 6,027 crore. 
 
The 1995 MLAT allows countries to seek "transfer of persons, including persons in custody, for the purpose of assisting in investigations or giving evidence in proceedings". 
 
Here is why India is forced to use MLAT to bring Mallya back: 
 
a) Mallya cannot be deported under UK laws because under the 1971 Immigration Act, UK does not require an individual to hold a valid passport in order to remain in the country. That means, Mallya can legally stay in Britain if his passport was valid when he entered the country. He left India on March 2 and the Indian government revoked his passport only after that, which means his passport was valid when he entered the UK. 
 
b) Extradition is possible only if Mallya is recognised as a criminal by both countries. 
 
c) Mallya can challenge India's extradition move in UK courts.

The <keyword id="48510" type="ORGANIZATION" weightage="100" keywordseo="Rajya-Sabha">Rajya Sabha</keyword> Ethics Committee has rejected former liquor baron <a href="http://www.businessinsider.in/VijayMallya-the-escapee-who-didnt-escape-apparently/articleshow/51344981.cms">Vijay </a><a href="http://www.businessinsider.in/VijayMallya-the-escapee-who-didnt-escape-apparently/articleshow/51344981.cms">Mallya</a>'s resignation, saying that because of him not fulfilling what was expected from his end, he needs to be <a href="http://www.businessinsider.in/These-are-the-14-MPs-that-have-ever-been-expelled-from-the-Parliament-Know-why/articleshow/52026584.cms">expelled with immediate effect</a>. 
 
"Since I do not want my name and reputation to be further dragged in the mud and since <a href="http://www.businessinsider.in/Vijay-Mallya-safe-in-UK/articleshow/52041381.cms">recent events</a> suggest that I will not get fair trial or justice, I am hereby resigning as a member of Rajya Sabha with immediate effect," Mallya had written in his resignation. 
 
Not only this, he had also said that he has been targetted by the media and is disappointed by fellow colleagues. 
 
"That I am facing trial by media and a lynch mob mentality is all too apparent," he wrote. "I have no faith that in the current climate prevailing in the country that I will get any justice even at the hands of my colleagues."

The resignation, however, was rejected by the panel, stating that it was required by their end to expel him, so that an example is set. Moreover, since Mallya never declared his liabilities in the past 10 years, which a RS member is supposed to do annually, he deserves to be handled with strictness. 
 
"Having considered the whole matter, including Mallya's letter, the Committee of Ethics unanimously decided to recommend to the House that Vijay Mallya be expelled with immediate effect. The committee adopted draft report to that effect. The panel hopes that by taking such a stern action, a message would reach to the general public that Parliament is committed to take such steps as are necessary against erring members to uphold the dignity and prestige of this great institution," the panel wrote in a letter to the Rajya Sabha.

Expel Vijay Mallya, Parliament’s Ethics Committee says on receiving his resignation

The <keyword id="6357808" type="ORGANIZATION" weightage="100" keywordseo="Enforcement-Directorate">Enforcement Directorate</keyword> (ED) and the Central Bureau of Investigation (CBI) are looking at around 40 companies in which <a href="http://www.businessinsider.in/searchresult.cms?query=vijay+mallya&amp;sortorder=effectivedate">Vijay Mallya</a> is said to have a stake, directly or indirectly. 
 
Most of these companies) are based abroad, including in the Netherlands, the United Kingdom, South Africa, China and Nepal, and it is being suspected that the money allegedly embezzled by him from bank loans was routed to these companies. Mallya, the ED and the CBI have found, also owns a large number of immovable properties in many countries, which are being investigated. 
 
"The worth of properties owned by him, including some palatial houses and his shares in the companies is being estimated," said a source to ET. 
 
The ED alone is probing 25 companies where it is suspected that Mallya has either 100 per cent or part stake. "We also have information and details of his movable properties, including his yacht and vehicles in some of these countries. We need to question him about his investments/shareholding in many companies but since he has refused to join the probe, we are gathering evidence through different channels and taking assistance from agencies abroad," said an ED official. 
 
At least six countries, sources said, were approached for information. Sources said the Financial Intelligence Unit, which looks into suspected investments by Indians, has gathered information about these companies and has shared it with CBI, ED and the income tax department. 
 Mallya fled to London in March, a move which has irked the government and investigation agencies. The government has since revoked his passport and has officially requested the UK to deport him to India. Both CBI and ED have registered separate cases of cheating and <keyword id="6355008" type="UNKNOWN" weightage="100" keywordseo="money-laundering">money laundering</keyword> against Mallya in the Rs 900 crore loan taken by now defunct <a href="http://www.businessinsider.in/searchresult.cms?query=kingfisher+airlines&amp;sortorder=effectivedate">Kingfisher Airlines</a> from <keyword id="6357560" type="CITY" weightage="100" keywordseo="IDBI-Bank">IDBI Bank</keyword>.

Now, 40 companies tied to Vijay Mallya under scrutiny

The Enforcement Directorate (ED) has sought revocation of debt-ridden <keyword id="14678" type="PERSON" weightage="40" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>’s diplomatic passport over non-cooperation in a <keyword id="6355008" type="UNKNOWN" weightage="40" keywordseo="money-laundering">money laundering</keyword> probe. 
 The ED had asked Mallya to appear before the law enforcement agency by April 9 in Rs 900 crore <keyword id="6357560" type="CITY" weightage="40" keywordseo="IDBI-Bank">IDBI bank</keyword> loan fraud case. 
 
It has written to the Ministry of External Affairs to take action under the Passport Act, 1967 and ask the Regional Passport Office (RPO) here to revoke the diplomatic passport of the beleaguered businessman as he has turned out to be "un-cooperative" with its investigators probing a criminal case under the Prevention of Money Laundering Act (PMLA) at its zonal office in Mumbai. 
 
Apparently, Mallya left India on March 2 on a diplomatic passport issued to him by virtue of him being a sitting Rajya Sabha Member of Parliament. 
 
Under the Passport Act, when a person is issued a diplomatic passport, their regular international travel document gets deposited and when a revocation is sought for the former is sought, the latter too gets cancelled. 
 
They said once the ED request is okayed, the MEA will inform UK authorities about the same and seek for his deportation to India. 
 
Mallya had thrice failed to appear before the ED IO in Mumbai in connection with the Rs 900 crore IDBI loan fraud case which the central probe agency is investigating under PMLA. 
 
Once Mallya's Passport is revoked, ED still is left with the option to approach a competent court and get issued a non-bailable warrant against him and also ask the Interpol to issue a Red Corner Notice (RCN) against him and apprehend him anywhere across the globe. 
 
Mallya, who is facing legal proceedings for alleged default of loans worth over Rs 9,000 crore from various banks, was also directed by the Supreme Court to disclose all assets owned by him and his family in India and abroad by April 21.
