The shooting death of Ahmaud Arbery: A timeline of a case that has gripped the nation

Arbery died of his gunshot wounds at the end of the altercation, police said.</li><li>"The probable cause was clear to our agents pretty quickly," Vic Reynolds, director of the <keyword id="6224030" type="ORGANIZATION" weightage="60" keywordseo="georgia-bureau-of-investigation">Georgia Bureau of Investigation</keyword>, said at a <keyword id="6355005" type="UNKNOWN" weightage="100" keywordseo="news">news</keyword> conference on Friday.</li><li>The pair faces charges of felony murder and <keyword id="9189571" type="UNKNOWN" weightage="60" keywordseo="aggravated-assault">aggravated assault</keyword>, Reynolds said.</li><li><a href="https://www.insider.com/?hprecirc-bullet">Visit Insider's homepage for more stories</a>.</li></ul><p>Agents with the Georgia Bureau of Investigation found enough probable cause to arrest two white men in the <keyword id="3132479" type="PERSON" weightage="60" keywordseo="shooting-death">shooting death</keyword> of <a href="https://www.insider.com/ahmaud-arbery-shooting-killed-jogging-travis-gregory-mcmichael-georgia-justice-2020-5">Ahmaud Arbery</a>, a 25-year-old black man, within 36 hours of being handed the case.</p><p>"The probable cause was clear to our agents pretty quickly," the agency's director Vic Reynolds said at a news conference on Friday.</p><p>Arbery was out jogging in the neighborhood around 1 p.m. on February 23 in the Satilla Shores neighborhood of Brunswick, Georgia, when he was pursued by Gregory McMichael, 64, and Travis McMichael, 34. They were armed and Arbery was killed by the younger McMichael, according to investigators.</p><p>The agency <a href="https://gbi.georgia.gov/press-releases/2020-05-06/ahmaud-arbery-death-investigation">announced</a> that the pair face charges of <a href="https://www.insider.com/gregory-mcmichael-travis-mcmichael-arrested-for-ahmaud-arbery-killing-2020-5">felony murder and aggravated assault</a>. They were taken into custody on Thursday evening and booked into the Glynn County Jail.</p><p>"There's sufficient probable cause to charge the McMichaels with felony murder and aggravated assault," Reynolds said. "I can tell you that if we didn't believe it, we wouldn't have arrested them. If we believe it, then we're going to put the bracelets on them and that's exactly what we did yesterday evening."</p><p>The case is being investigated by District Attorney Tom Durden, a prosecutor in a neighboring county. In the two months since Arbery died, two district attorneys have recused themselves over potential conflicts of interest, <a href="https://www.reuters.com/article/us-shooting-georgia/georgia-grand-jury-to-consider-charges-in-shooting-of-unarmed-black-man-idUSKBN22I02R">Reuters reported</a>.</p><p>Arbery was <a href="https://www.insider.com/ahmaud-arbery-shooting-killed-jogging-travis-gregory-mcmichael-georgia-justice-2020-5">unarmed during the incident</a>, which was captured on video by a witness in a nearby car and was shared on social media. The footage has prompted uproar across the country, with politicians, athletes, and celebrities, decrying Arbery's death and seeking justice. The Bureau of Investigation is also looking into the video being leaked and the person who filmed the footage.</p><p>A <a href="https://int.nyt.com/data/documenthelper/6915-arbery-shooting/b52fa09cdc974b970b79/optimized/full.pdf">Glynn County police report</a> said that the McMichaels decided to grab a shotgun and a .357 Magnum and follow Arbery because he looked like a suspect in a series of break-ins in the area.</p><p>However, the <a href="https://thebrunswicknews.com/news/local_news/dispatcher-what-was-he-doing-wrong/article_fe51cdd4-3bb6-5815-9dec-ddcdc8f879f8.html">Brunswick News</a> reported that only one burglary was reported in the area between January 1, 2020, and the day Arbery died. The item stolen was a gun from Travis McMichael's unlocked pickup truck.</p><p>"You look on that video, and it's like it was a hunting party," Ben Crump, one of the attorneys representing Ahmaud's father, Marcus Arbery, Sr., <a href="https://www.businessinsider.com.au/lawyer-ahmaud-arbery-father-arrest-shooters-2020-5">told Insider</a>.</p><p>Gregory McMichael worked as an investigator for the Glynn County District Attorney's office until May 2019, when he retired. Before that, he also worked as a police officer. These ties to local law enforcement and the absence of an arrest since February hint at "impropriety," Crump said.</p><p>"When we believe if this was any other citizen, especially a citizen of color, they would have been arrested because you have an unarmed man in a jogging attack," Crump said. "He doesn't have any burglary outfit or burglary tools or anything like that. I mean, he's jogging and this guy kills them, and they just take his word for it."</p><p>For his part, Arbery's father, Marcus Arbery, Sr., has characterized the shooting as a "hate <keyword id="39494" type="ORGANIZATION" weightage="60" keywordseo="Crime">crime</keyword>."</p><p>"My young son wasn't doing nothing — minding his own business, running and working out. Bryan has lost his job, his lawyer added.</p><p>"It was Mr. Bryan who videotaped the incident in question, disclosed the existence of the videotape, and invited a responding Glynn County Police Officer to sit with him in his truck where they watched the video together," Bryan's lawyer, Kevin Gough, said.</p><p>Gough said his client had cooperated with the investigation, beginning when he showed officers the footage and when he later went to the police station so officers could download the video from his cell phone, CNN reported.</p><p>The video, recorded on February 23 in Brunswick, Georgia, shows two men approach Arbery from their pickup truck while he was jogging before the altercation ends in the shooting death of Arbery.</p><p>Gregory McMichael, 64, and Travis McMichael, 34, who are white, were arrested Thursday and face charges of murder and aggravated assault in Arbery's death. The men cannot be charged with committing a hate <keyword id="39494" type="ORGANIZATION" weightage="60" keywordseo="Crime">crime</keyword> because <a href="https://www.insider.com/mcmichaels-cant-face-hate-crime-charge-2020-5">a hate crime law does not exist in the state of Georgia.</a></p><p>Gough said his client is not connected to either of the McMichaels, other than being members of the same community. Bryan was doing yard work when he noticed an unfamiliar man being chased by a car that he recognized, his lawyer said, according to CNN. </p><p>The suspects have said they confronted Arbery because he resembled a suspect in recent burglaries, though there was just one reported burglary in the area from the start of 2020 until the day Arbery died," according to The Brunswick <keyword id="6355005" type="UNKNOWN" weightage="100" keywordseo="news">News</keyword>.</p><p>As Insider previously noted <a href="https://www.insider.com/video-of-ahmaud-arbery-killing-leaked-by-defense-lawyer-2020-5">the video of the shooting was leaked — months after it was filmed —</a> by a defense attorney who had consulted with the suspects who were arrested on Thursday. The lawyer, who is representing the suspects, said he did not believe the video would either "exonerate them or convict" the men, The New York Times reported.</p><p>The investigation into Arbery's death is ongoing, police told reporters, according to CNN. </p><p>"Mr. Bryan videotaped what was going on and because he did that there is a prosecution," Gough said. "If he had not videotaped that incident, the only person who really could speak to what happened is dead and we'll never have that opportunity. Gunshots then ring out and Arbery stumbles and falls to his death. </p><p>In a police report from the day of the shooting, Gregory McMichael said that he pursued Arbery because he resembled a man believed to be responsible for local break-ins. </p><p><a href="https://thebrunswicknews.com/news/local_news/dispatcher-what-was-he-doing-wrong/article_fe51cdd4-3bb6-5815-9dec-ddcdc8f879f8.html">The Brunswick News,</a> however, reported that only one burglary was reported in the area from the start of 2020 to the day Arbery died.</p><p>"This murderous father and son duo took the law into their own hands," Arbery's family's attorney, <a href="https://www.ajc.com/news/local/father-son-charged-with-murder-brunswick-shooting/tWjmSXAeWlD2LKIN1dSmfK/">Benjamin Crump, said</a>. "It's a travesty of justice that they enjoyed their freedom for 74 days after taking the life of a young black man who was simply jogging."</p><h2><div type="image" title="ahmaud arbery protest" height="1667" width="2222" msid="75638271" hostid="261"></div></h2><h2>Arbery's killing has sparked new pressure for a state hate crime in Georgia</h2><p>In 2004, the Georgia Supreme Court struck down a hate crimes law passed four years earlier, saying it was "unconstitutionally vague" and so broad that it would even apply to a rabid sports fan picking on somebody wearing a rival team's cap, according to the Associated Press. </p><p>Bills that would have brought Georgia in line with a federal statute, which was passed in 2009, failed to make it through the state legislature.</p><p>A <a href="https://legislativenavigator.ajc.com/#bills/HB/426">hate crime bill</a> passed the Georgia House last year by a 96-64 vote with the support of several influential suburban Republicans. But it was stalled in the state senate, according to the <a href="https://www.ajc.com/blog/politics/georgia-governor-open-state-hate-crimes-law/BMDRFhIJPoanuCwKH70zKK/">Atlanta Journal-Constitution</a>. Conservative critics said they were skeptical about the need for additional penalties for crimes that already carry hefty sentences, the paper reported. </p><p>Arbery's killing, however, reignited calls for hate crime legislation in the state. </p><p>In a statement to the Journal-Constitution, Gov. Brian Kemp said that "conversations about legislation are already underway, and we will work through the process when the General Assembly reconvenes" in June. </p><p>"If this doesn't show us that we ought to have a hate-crimes law, I don't know what will," state Sen. Harold Jones, an Augusta Democrat and member of the Georgia Legislative Black Caucus, told the Journal-Constitution. <ul class="summary-list"><li>Three white men will stand trial in the February <keyword id="3132479" type="PERSON" weightage="60" keywordseo="shooting-death">shooting death</keyword> of <keyword id="9174117" type="UNKNOWN" weightage="60" keywordseo="ahmaud-arbery">Ahmaud Arbery</keyword>, a 25-year-old black man, in Brunswick, <keyword id="6385073" type="LOCATION" weightage="60" keywordseo="georgia">Georgia</keyword>, a judge ruled on Thursday. </li><li><keyword id="9184798" type="UNKNOWN" weightage="60" keywordseo="gregory-mcmichael">Gregory McMichael</keyword>, 64, and his son, <keyword id="9184800" type="UNKNOWN" weightage="60" keywordseo="travis-mcmichael">Travis McMichael</keyword>, 34, face felony murder and aggravated assault charges. The younger McMichael pulled the trigger during an altercation with Arbery.</li><li>William Bryan, a witness who helped the McMichaels corner Arbery and also filmed the fatal encounter, was arrested for felony murder and criminal attempt to commit false imprisonment.</li><li>In a probable cause hearing Thursday, a Georgia Bureau of Investigation special agent testified that Bryan said Travis McMichael said the words 'f---ing n-----" after Arbery was shot and killed.</li></ul><p><a href="https://www.insider.com/ahmaud-arbery-shooting-killed-jogging-travis-gregory-mcmichael-georgia-justice-2020-5"></a>Travis McMichael, one of the three people charged with killing Ahmaud Arbery, used a racist slur just after firing three shots from a pump-action shotgun, according to William Bryan, who filmed the encounter and is a co-defendant in the criminal case.</p><p>The detail was revealed by Georgia Bureau of Investigation Special Agent Richard Dial, who testified about various aspects of the case in a court hearing Thursday.</p><p>"Mr. Bryan said that after the shooting took place, before the police's arrival, while Mr. Arbery was on the ground, that he heard Travis McMichael make the statement: 'F---ing n-----," Dial said.</p><p>Magistrate Court Judge Wallace Harrell ruled that there is sufficient evidence for the cases against all three defendants to go to trial, <a href="https://apnews.com/7122aaf2c54ed22590a5b8d32565a58f">according to the Associated Press</a>.</p><p>"Ahmaud Arbery was chased, hunted down and ultimately executed at the hands of these men," said Cobb County prosecutor Jesse Evans. "He was on a run on a public road in a public subdivision. He was defenseless and unarmed."</p><p><a href="https://www.insider.com/ahmaud-arbery-shooting-killed-jogging-travis-gregory-mcmichael-georgia-justice-2020-5">Arbery went out for a jog</a> in Brunswick, Georgia, around 1 p.m. on February 23, only to catch the attention of Gregory McMichael and Travis McMichael, who pursued the 25-year-old black man.</p><p>They had help from Bryan, who also lived in the neighborhood, who joined in the hunt and filmed the deadly encounter. </p><p>Dial described how Travis McMichael and Bryan used their trucks to chase down and corner Arbery, who tried repeatedly to switch directions and even leaped into a ditch in a bid to escape.</p><p>Investigators found a palm print on the rear door<strong> </strong>of Bryan's truck, a dent, and white cotton fibers that "we attribute to contact with Mr. Arbery," Dial said.</p><p><div type="image" title="Ahmaud Arbery" height="540" width="720" msid="76203212" hostid="261"></div></p><h2>'I don't think it was self-defense by Mr. McMichael — I think it was self-defense by Mr. Arbery.'</h2><p>When Arbery wound up sandwiched between the two vehicles, Travis McMichael got out of his truck — which was parked to block a street in the Satilla Shores neighborhood — and confronted Arbery.</p><p>He told police that he opened fire in self-defense because Arbery ignored his orders to stop and get on the ground, and instead "squared up"  as if he was going to attack. After seeing Travis McMichael standing by the driver's side door, Arbery skirted around and they met in front of the truck. </p><p>"There's a statement that he might have had his hand on his shirt," Dial said. "Travis McMichael said his adrenaline was pumping and it all happened very quickly."</p><p>That's when Travis McMichael opened fire.</p><p>The first shot was to Arbery's chest, the second was to his right wrist, and the third was also to his chest, Dial said. "Mere seconds after the first shot" was fired by Travis McMichael, the front of Arbery's white cotton T-shirt was "saturated with blood," he testified.</p><p>Dial also told Jason Sheffield, Travis McMichael's attorney, that the younger McMichael had raised his shotgun and pointed it Arbery's direction when the two were nearly 90 feet apart.</p><p>"I don't think it was self-defense by Mr. McMichael — I think it was self-defense by Mr. Arbery," said Dial.</p><p>He continued: "I believe Mr. Arbery was being pursued, and he ran till he couldn't run anymore, and it was [either] turn his back to a man with a shotgun or fight with his bare hands against the man with the shotgun. He chose to fight. I believe Mr. Arbery's decision was to just try to get away, and when he felt like he could not escape, he chose to fight."</p><p>After Arbery stumbled and fell facedown, Gregory McMichael rolled the man over to check if he was armed, a police report said. He wasn't.</p><p>Travis McMichael and Gregory McMichael, both wearing face masks, attended the hearing virtually from the Glynn County Detention Center. Bryan waived his right to appear.</p><p>And attorneys for the McMichaels insisted they are innocent.</p><p>"Travis has been vilified before his voice could even be heard," <a href="https://www.cnn.com/2020/06/04/us/mcmichaels-hearing-ahmaud-arbery/index.html">his legal team in a statement, CNN reported</a>. "The truth in this case will exonerate Travis."</p><p>Gregory McMichael's attorney, Laura Hogue added: "So often the public accepts a narrative-driven by an incomplete set of facts, one that vilifies a good person.</p><p><div type="image" title="Ahmaud Arbery 1" height="1667" width="2500" msid="76203218" hostid="261"></div></p><h2>A 'gut feeling' that Ahmaud Arbery may have been responsible for prior break-ins</h2><p>For more than two months after that deadly encounter between Arbery and the McMichaels, the white father-and-son duo — aged 64 and 34 respectively — roamed free. Two district attorneys recused themselves over conflicts of interest, with one telling police that there were "no grounds for an arrest."</p><p>Video of the altercation that ended Arbery's life emerged on social media on May 5, sparking outrage, protests, and calls for justice. </p><p>The Georgia Bureau of Investigation took over the case on May 5. Agents arrested the McMichaels on May 7 and Director Vic Reynolds announced on May 8 that there was "sufficient probable cause" to charge the pair with felony murder and aggravated assault. They were booked into Glynn County Jail and denied bond.</p><p>Bryan, 50, was arrested on May 21 for felony murder and criminal attempt to commit false imprisonment, the GBI said in a <a href="https://gbi.georgia.gov/press-releases/2020-05-21/ahmaud-arbery-murder-investigation">statement</a>. He saw the McMichaels when they passed his house while chasing Arbery — they told police they thought he resembled a burglary suspect — so he got into his car and helped corner Arbery.</p><p>Dial spoke about a phone call made to Gregory McMichael when he was in custody that shed light on the way he views Bryan.</p><p>"Gregory McMichael is on the phone with a caller and the caller asks him about Mr. Bryan," Dial said. "At first, Mr. McMichael says he can't talk about it and then he says that Mr. Bryan is an ally."</p><p>Dial testified also that Arbery enjoyed running. Gregory McMichael was working on a boat outside the McMichael residence when he saw Arbery jog by. Recognizing him from surveillance footage of a house that's under construction nearby, the elder McMichael followed his "instinct" when enlisting his son to follow Arbery through their neighborhood, Dial said.</p><p><div type="image" title="ahmaud arbery 3" height="1667" width="2222" msid="76203221" hostid="261"></div></p><p>Gregory McMichael told police that "he didn't know if Mr. Arbery had stolen anything or not, but he had a gut feeling that he may have been responsible" for recent burglaries in the neighborhood, Dial added.</p><p>Dial also testified that investigators found a Confederate sticker on a toolbox in Travis McMichael's truck. Reviewing his cell phone data and social media footprint led them to even more racial slurs.</p><p>In one case, he responded to a social media video saying, "That would've only been better if he had blown that f---ing n-----'s head off," Dial said. Also, Travis McMichael, who worked as a boarding officer with the US Coast Guard, said in texts that "he loved his job because he was out on a boat and there were no n-----s anywhere," he testified.</p><p>Georgia doesn't have a hate <keyword id="39494" type="ORGANIZATION" weightage="60" keywordseo="Crime">crime</keyword> law. The U.S. Department of Justice said on May 11 that it is "assessing all the evidence to determine whether federal hate crime charges are appropriate." Dial's testimony could play a part in a federal investigation into whether hate crime charges should be leveled against the defendants.</p><p>Arbery's death sparked peaceful protests in Georgia, which were followed by <a href="https://www.insider.com/breonna-taylor-shot-dead-louisville-house-police-narcotics-bust-2020-5">the March shooting death of Breonna Taylor</a> in Kentucky. But <a href="https://www.insider.com/george-floyd-autopsy-cause-death-asphyxia-neck-back-compression-ben-crump-2020-6">George Floyd's police killing on May 25 in Minneapolis</a> escalated racial tensions to a fever pitch. Since then, demonstrations, often devolving into chaos, vandalism, arson, and looting, have erupted from coast to coast in the United States. <a href="https://www.insider.com/global-george-floyd-black-lives-matter-protests-photos-2020-5">Thousands around the world are protesting in solidarity with the Black Lives Matter movement</a>.</p><p><a href="https://www.insider.com/four-minneapolis-police-officers-criminal-charges-george-floyd-death-2020-6">Prominent civil rights attorney Ben Crump</a> is on the legal team for both the Arbery and Floyd families. </p><p>A crowd gathered outside the courthouse in Brunswick on Thursday, and <a href="https://twitter.com/BethANJax/status/1268535252298981390">stood in the rain, chanting "No bond."</a> Gov.
