Kaylen Barker filed her suit against Tesla and staffing company Staffmark Tuesday. Barker, who is a <keyword id="11940579" type="UNKNOWN" weightage="60" keywordseo="black" source="Orion">Black</keyword>, <keyword id="11911132" type="UNKNOWN" weightage="60" keywordseo="gay" source="Orion">gay</keyword> woman, says in the suit Tesla failed to address racist abuse directed towards her by a coworker and that it retaliated against her when she tried to report the abuse."I was violated physically, mentally, and emotionally because I am an African American lesbian," Barker said in a statement provided to Insider via her attorney.Barker's suit alleges that one of her coworkers — named as Joanne in the suit — started directing racist abuse at her after Barker gained a promotion, including muttering the N-word under her breath as Barker walked by. Barker's suit claims that she repeatedly flagged Joanne's behavior to HR but was never notified of any action against Joanne.The suit alleges that in September, after Barker asked Joanne to step back from some machinery for safety reasons, Joanne called Barker the N-word and threw a hot grinding tool at her. She said that the tool hit her in the thigh.Barker reported the incident to HR and Joanne was fired but the suit claims Tesla rehired Joanne two weeks later. The suit also says HR informed Barker shortly after the incident that she was under investigation.In mid-September, the suit says Tesla HR started summoning Barker for meetings on a "near-daily basis" and demanding she sign a document stating she had been "insubordinate." Following these meetings, Barker would be sent home for the afternoon, meaning she would lose out on roughly five hours of pay.Barker's suit says she was terminated on October 29. According to the lawsuit, Tesla withheld five of Barker's paychecks from her final months at the factory.Tesla and Staffmark did not immediately respond when contacted by Insider.Barker is being represented by J. Bernard Alexander, III, the same attorney who represented Owen Diaz, a former Tesla elevator operator who successfully sued the company for racial <keyword id="11894215" type="UNKNOWN" weightage="60" keywordseo="harassment" source="Orion">harassment</keyword> in October 2021. Per <a href="https://www.cnbc.com/2021/10/05/tesla-must-pay-137-million-to-ex-worker-over-hostile-work-environment-racism.html">CNBC</a>, he told the court that colleagues would verbally abuse him and other Black workers, for example telling him to "go back to Africa." So Tesla's internal view of the facts is just not relevant at this point."Many large companies would have just published a generic statement of their intent to appeal, she added. Roe did not view Tesla's response as particularly extraordinary, however, and said it signaled that the company will likely appeal.In an email to Insider, Diaz's attorney J. She added that their "voices go unheard because corporations like Tesla use a two-tiered system and hire contracted workers who do not receive the same benefits or protections as full-time staff."Diaz is not the only Black worker to have brought a racial harassment lawsuit against Tesla. In August, the company was <a href="https://www.insider.com/former-tesla-worker-awarded-1-million-racist-slurs-at-work-2021-8">ordered to pay $1 million to a Black former employee, </a>who alleged he was called racial slurs in 2015.Even if Tesla successfully gets Diaz's payout cut, the verdict has been damaging for the company. "Tesla and our supplier network will continue operations that directly support factory production, vehicle deliveries and service," Tesla's North American head of human resources, Valerie Capers Workman, told employees in an email obtained by <a href="https://finance.yahoo.com/news/musk-signals-tesla-fremont-plant-052407184.html">Bloomberg</a> this week. The Fremont factory, which employs roughly 10,000 workers, remains in operation despite a <a href="https://www.businessinsider.com/san-francisco-coronavirus-stay-home-order-what-can-i-do-2020-3">"shelter in place" order</a> issued by six Bay Area counties on Monday. The directive requires residents to stay inside their homes and forces most businesses to close, but excludes "essential businesses" such as healthcare facilities, gas stations, banks, grocery stores, laundromats, and pharmacies. Alameda County, where the Fremont plant is based, has deemed Tesla an "essential business," according to a county spokesperson who spoke with <a href="https://www.latimes.com/business/story/2020-03-16/coronavirus-tesla-fremont-factory-musk">The Los Angeles Times</a>. In an <a href="https://www.businessinsider.com/coronavirus-elon-musk-tesla-workers-can-stay-home-covid-19-2020-3">earlier email on Monday</a>, Tesla CEO Elon Musk told employees that they may stay home if they feel sick or are concerned about coming to work amid the outbreak. "I'd like to be super clear that if you feel the slightest bit ill or even uncomfortable, please do not feel obligated to come to work," Musk said in an email provided to Business Insider. "I will personally be at work, but that's just me. Totally ok if you want to stay home for any reason."In the email, Musk also reiterated his belief that the fear surrounding the coronavirus is disproportionate to the threat of the virus. "My frank opinion remains that the harm from the coronavirus panic far exceeds that of the virus itself," he said. "If there is a massive redirection of medical resources out of proportion to the danger, it will result in less available care to those with critical medical needs, which does not serve the greater good."Musk has drawn criticism lately for downplaying the seriousness of the coronavirus, which has resulted in <a href="https://www.businessinsider.com/china-virus-everything-we-know-deadly-2019-ncov-wuhan-spread-2020-1">close to 7,500 deaths worldwide</a>, including 94 in the US, as of this publishing. Tesla's Fremont factory will be allowed to keep building cars despite "shelter in place" lockdown order in the Bay Area

<ul class="summary-list"><li><keyword id="107096" type="COMPANY" weightage="60" keywordseo="Tesla">Tesla</keyword>'s newest factory could likely be headed for <keyword id="114148" type="CITY" weightage="60" keywordseo="AUSTIN">Austin</keyword>, Texas.</li><li>While Tesla hasn't Tesla announced its final decision, it proposed a 5 million square foot plant in Austin that would eventually produce its much-hyped <keyword id="8303602" type="UNKNOWN" weightage="60" keywordseo="cybertruck">Cybertruck</keyword> and result in about 5,000 jobs in the area.</li><li>But in a heated public meeting, labor advocates and citizens sparred over the incentives laid out by <keyword id="4124306" type="PERSON" weightage="60" keywordseo="travis-county">Travis County</keyword>. </li></ul>Tesla is <a href="https://www.businessinsider.com/tesla-reveals-potential-austin-texas-location-new-gigfactory-near-airport-2020-6">zeroing in on Austin, Texas</a> for a new Gigafactory to build its Cybertruck and even a new headquarters. Nothing is official yet, but the electric automaker has made its case to local officials in the Texas capitol as to why it should receive some $7 million in tax relief from Travis County to locate there. And<a href="http://traviscountytx.iqm2.com/Citizens/SplitView.aspx?DVR&amp;Mode=Video&amp;MeetingID=2018gID=2018"> in a public meeting on Tuesday</a>, company executives and economic development officials pitched a deal that could see Elon Musk hire tens of thousands of workers.But of course, nothing the company does comes without criticism and, in many cases, a fight. While dozens of citizens wrote and dialed in to support the new factory and resulting jobs, plenty of others voiced concern over what have been, in their view, past grievances by Tesla and "billionaire playboy" Musk. <h2>Here's Tesla's pitch: </h2><a href="https://www.businessinsider.com/tesla-reveals-potential-austin-texas-location-new-gigfactory-near-airport-2020-6">As Business Insider reported earlier in June,</a> Tesla has filed a land-use application for a plot of land near Austin's airport that's currently a concrete and mining operation. The company, in conjunction with county officials, reached an agreement for massive tax refunds, and presented it for the first time at the public meeting. Under the terms of the not-yet-final deal, Tesla would get about $1.64 million in tax rebates over the next decade, with the county still receiving $7 million, in exchange for $1 billion in new investment. Tesla officials touted plans to hire more than 5,000 workers for the 5 million square foot plant, in a move that could attract new companies that supply Tesla's components to the area. <div type="image" title="Tesla Austin Tax Rebate Deal" height="668" width="1154" msid="76662050" hostid="261"></div>Rohan Patel, Tesla's senior director for global business development and public policy, said there were three main reasons why Austin caught the company's eye: availability of workers, partnerships with the local school district for talent, and the site's riverfront location. "There's great potential for recreation and beauty," he said, "in transforming the old mining site into a sustainable factory with recreation opportunities. That's a vision that fits perfectly with our mission."Another Tesla executive, HR chief Valerie Capers Workman, said the company's first hire after inking a deal would be to hire a community liaison to ensure a seamless integration with the local surroundings. She also touted partnerships with the school district near Tesla's Nevada factory and with criminal justice reform advocates. "Unlike other tech companies who come in and have to make up programs and build it on the fly," she said, "I'm talking about programs that are already established and things we're already doing in the community." Community members and current Tesla employees phoned in to voice their support for Tesla's arrival and the deal with Travis County."This is an opportunity to make sweeping, generational change," one person said. "If they open a plant here I'll certainly buy one. Another attendee told the leaders to "invest with capital in the future that you want." And three Tesla employees called in to say how much they love their jobs. "As a service technician at the Austin Pond Springs location," one said, "I have excellent, affordable health care, dental, and vision. At my previous employer it would have taken me eight years to accrue this much time off."Tesla said in its presentation that most of the jobs at the factory are low-skill, requiring only a high school degree, and have a wage floor of $15 an hour — double the state's minimum wage. Median salaries would be $68,303 annually, Tesla said.<h2>'Google it' </h2>Plenty of other citizens phoned in to warn officials against what they perceived as past deception by Tesla, and to urge them to require the company pay all of its taxes, given its $181 billion market cap and billionaire boss. "It's too easy to find when Tesla has broken the law continuously," said a student attendee. "You can Google it. Elon Musk has repeatedly put his workers at risk." In May, Musk tussled with local official in California, opening Tesla's factory amid shelter-in-place orders, which resulted in multiple workers getting sick. Labor advocates pointed to instances of "union busting." <a href="https://www.bloomberg.com/news/articles/2019-09-27/tesla-committed-unfair-labor-practices-nlrb-judge-rules?sref=LspfQlRv">In 2017, a judge ruled</a> in favor of the National Labor Relations Board, saying Musk and Tesla broke the law by threatening and retaliating against workers attempting to unionize. The company was required to offer a fired worker their job back and revoke a formal warning given to another."We've said all along that ultimately it's up to our employees to decide they want union representation," Tesla's workman said. "We've awarded contracts to multiple vendors that are union vendors." But it did little to assuage concerns. "I urge you to, at a minimum, at least pay the county's own living wage," said one attendee. "Do not just view Texas as a cheap labor and anti-union region. It will enshrine a race to the bottom here." MIT's living wage calculator <a href="https://livingwage.mit.edu/counties/48453">estimates</a> the living wage for a single working adult in Travis County to be $25.70 per hour. Housing in Austin is some of the most expensive in Texas after experiencing some of the nation's highest population growth for <a href="https://cbsaustin.com/news/local/austin-leads-nation-in-population-growth-for-8-consecutive-years">years</a>. "I heard someone in this meeting say they've never heard anything bad about Tesla," one attendee said, "and respectfully, I'd ask where have you been? Elon Musk has a net worth of $42 billion. If he wants a rebate I suggest he use his own money. Tesla will cut every corner when it comes to worker pay and dignity standards. When they back out of the agreement like they did in Alameda, they will do so with better attorneys than we could ever afford."Tesla did not immediately respond to a request for comment on the meeting minutes.It's unclear when Tesla might make a decision between Austin, its other close contender of Tulsa, or another site.
