It won’t be an easy task to get Mallya back from British Courts

The Indian government has formally asked the United Kingdom to deport <a href="http://www.ndtv.com/topic/Vijay-Mallya">Vijay Mallya</a>, the former Indian liquor baron who owes state-run banks over Rs 9000 crores of unpaid loans, but <a href="http://www.businessinsider.in/A-little-too-late-Mallya-flew-out-of-India-before-banks-could-take-a-stay-order-against-him/articleshow/51323634.cms">fled to London</a> on March 2nd. 
 
The 60-year old <a href="http://www.businessinsider.in/Vijay-Mallyas-personal-Airbus-jet-to-be-auctioned-to-recover-governments-dues/articleshow/51406790.cms">businessman</a> inherited a fortune from his father at the age of 28, and took it to new heights with his vision and successful brands like Kingfisher beer. As per reports, he would also be expelled from his <a href="http://www.businessinsider.in/Vijay-Mallya-asked-for-Rs-20000/articleshow/51943521.cms">post of a Member of Parliament</a> next week, after the government cancelled his passport a few days back. 
 "As of today, the ministry has written to the High Commission of the UK in Delhi requesting the deportation of Sri <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>," Foreign Ministry spokesman Vikas Swarup said, adding that the British authorities are yet to respond.

Modi is the subject of two sets of criminal proceedings, with the CBI case relating to a large-scale fraud upon PNB through the fraudulent obtaining of "Letters of Understanding" (LOUs or loan agreements), and the ED case relating to the laundering of the proceeds of that fraud. Mallya left India and moved to the UK in early 2016 after the banks filed a case against him with the Debt Recovery Tribunal. The Fugitive Economic Offenders Ordinance applies to individuals who have defaulted on payments over ₹1 billion. The ordinance defines a ‘fugitive economic offender’ as a person against whom an arrest warrant has been issued for a money-related crime, and has left the country so as to avoid a criminal trial or refuses to return to face the music. Once the ED files the case against Mallya in court, he has six weeks to present himself at a trial in a pre-specified location, where he will be tried under the Prevention of Money Laundering Act. If he does not show up, he will be declared a “fugitive economic offender”, which in turn will allow the ED to seize his domestic and international assets, even without being convicted in a trial, in order to pay back his creditors. These assets include Mallya’s shares in United Breweries as well as real estate properties in Alibaug and Bengaluru. If the case leads to successful resolution of Mallya’s unpaid dues, it will establish an important precedent in India’s legal landscape. The next case filed under the Fugitive Economic Offenders Ordinance could very well be against a famous diamond merchant.

Banks have rejected debt-ridden <keyword id="14678" type="PERSON" weightage="20" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>’s offer and now the Supreme Court has directed him to make a full disclosure of all assets. 
 
Not only this, the apex court has also sought reply on when Mallya would appear personally in the court after 17 lenders moved the court for the same.

"There's no liquid money. Everything is tied up in contingencies. We will need court orders to pay," one of Mallya’s lawyers CS Vaidyanathan said. 
 
The next hearing of the case is on April 26.

Meanwhile, the Enforcement Directorate had also asked Mallya to be present on April 9 regarding a Rs 900-crore loan from IDBI Bank. 
 The banks are seeking more than Rs 9,000 crore in dues from loans given to <keyword id="6373962" type="CITY" weightage="20" keywordseo="Kingfisher-Airlines">Kingfisher Airlines</keyword>, which is grounded since 2012. Mallya had left India last month for the UK.

Vijay Mallya to disclose assets, fly back to India as banks reject settlement offer

Indian government has tried several methods to bring loan defaulter <keyword id="14678" type="PERSON" weightage="100" keywordseo="Vijay-Mallya">Vijay Mallya</keyword> back to India, but to no avail. This forced the <keyword id="6357808" type="ORGANIZATION" weightage="100" keywordseo="Enforcement-Directorate">Enforcement Directorate</keyword> to think of a 21-year-old treaty, called <keyword id="507869" type="ORGANIZATION" weightage="100" keywordseo="Mutual-Legal-Assistance-Treaty">Mutual Legal Assistance Treaty</keyword> (<keyword id="513083" type="UNKNOWN" weightage="100" keywordseo="MLAT">MLAT</keyword>) to bring him back. 
 
As per an ET report, ED has written to Ministry of External Affairs (MEA), asking for MLAT to be invoked, hoping that the treaty can be used to bring Mallya back. 
 
It was only a few days back that CBI has registered a fresh case against Mallya for allegedly cheating several Indian banks of Rs 6,027 crore. 
 
The 1995 MLAT allows countries to seek "transfer of persons, including persons in custody, for the purpose of assisting in investigations or giving evidence in proceedings". 
 
Here is why India is forced to use MLAT to bring Mallya back: 
 
a) Mallya cannot be deported under UK laws because under the 1971 Immigration Act, UK does not require an individual to hold a valid passport in order to remain in the country. That means, Mallya can legally stay in Britain if his passport was valid when he entered the country. He left India on March 2 and the Indian government revoked his passport only after that, which means his passport was valid when he entered the UK. 
 
b) Extradition is possible only if Mallya is recognised as a criminal by both countries. 
 
c) Mallya can challenge India's extradition move in UK courts.

MLAT, the 21-year-old treaty that could bring Vijay Mallya back to India

The Enforcement Directorate (ED) has sought revocation of debt-ridden <keyword id="14678" type="PERSON" weightage="40" keywordseo="Vijay-Mallya">Vijay Mallya</keyword>’s diplomatic passport over non-cooperation in a <keyword id="6355008" type="UNKNOWN" weightage="40" keywordseo="money-laundering">money laundering</keyword> probe. 
 The ED had asked Mallya to appear before the law enforcement agency by April 9 in Rs 900 crore <keyword id="6357560" type="CITY" weightage="40" keywordseo="IDBI-Bank">IDBI bank</keyword> loan fraud case. 
 
It has written to the Ministry of External Affairs to take action under the Passport Act, 1967 and ask the Regional Passport Office (RPO) here to revoke the diplomatic passport of the beleaguered businessman as he has turned out to be "un-cooperative" with its investigators probing a criminal case under the Prevention of Money Laundering Act (PMLA) at its zonal office in Mumbai. 
 
Apparently, Mallya left India on March 2 on a diplomatic passport issued to him by virtue of him being a sitting Rajya Sabha Member of Parliament. 
 
Under the Passport Act, when a person is issued a diplomatic passport, their regular international travel document gets deposited and when a revocation is sought for the former is sought, the latter too gets cancelled. 
 
They said once the ED request is okayed, the MEA will inform UK authorities about the same and seek for his deportation to India. 
 
Mallya had thrice failed to appear before the ED IO in Mumbai in connection with the Rs 900 crore IDBI loan fraud case which the central probe agency is investigating under PMLA. 
 
Once Mallya's Passport is revoked, ED still is left with the option to approach a competent court and get issued a non-bailable warrant against him and also ask the Interpol to issue a Red Corner Notice (RCN) against him and apprehend him anywhere across the globe. 
 
Mallya, who is facing legal proceedings for alleged default of loans worth over Rs 9,000 crore from various banks, was also directed by the Supreme Court to disclose all assets owned by him and his family in India and abroad by April 21.

Liquor baron <a href="http://www.businessinsider.in/searchresult.cms?query=Vijay%20Mallya%20&amp;sortorder=score">Vijay Mallya</a> on Friday sought exemption from personal appearance in a court here and said he is unable to return to the country and face trial in a case of alleged violation of <a href="http://www.businessinsider.in/searchresult.cms?query=foreign%20exchange&amp;sortorder=score">foreign exchange</a> rules as the <keyword id="579134" type="UNKNOWN" weightage="100" keywordseo="Indian-authorities">Indian authorities</keyword> had suspended his <keyword id="17514" type="CITY" weightage="100" keywordseo="passport">passport</keyword>. 
 
On July 9, the court had asked Mallya to personally appear before it on September 9, after allowing the <a href="http://www.businessinsider.in/searchresult.cms?query=Enforcement%20Directorate%20&amp;sortorder=score">Enforcement Directorate</a> (ED) plea to withdraw the exemption given to him from personal appearance in the case. 
 
Mallya's counsel Ajay Bhargava moved a plea seeking exemption from personal appearance and told Chief Metropolitan Magistrate Sumit Dass that his client is living in London. 
 
Defence counsel apprised the court that Mallya passport had been suspended by <a href="http://www.businessinsider.in/searchresult.cms?query=Indian%20passport%20authorities&amp;sortorder=score">Indian passport authorities</a> in April. 
 
On April 23, his passport was revoked without even affording a personal hearing which he had requested for, the court was told. 
 
"... ever since the revocation of his passport, the applicant (Mallya) has been staying in London and is not in possession of any requisite travel document which could possibly enable him to travel to India," Mallya's counsel said. 
 
The counsel said that Mallya had urged the court to allow him to be represented by his lawyer to continue with the final arguments and save the court's precious time. 
 
Public Prosecutor Navin Matta told the court that Mallya is evading questioning and proceedings in other matters pending against him. 
 The court allowed Mallya's plea for exemption for today (Friday) and sought a reply from the <keyword id="6357808" type="ORGANIZATION" weightage="100" keywordseo="Enforcement-Directorate">Enforcement Directorate</keyword>. It fixed October 4 for further hearing in the case. 
 
During the last hearing, the court had allowed the ED plea to seek recall of a court order that granted permanent exemption from appearance to Mallya, who is in the UK and faces money laundering charges in India. 
 The court was hearing the final arguments in the 2000 case related to alleged violation by Mallya of provisions of the erstwhile <keyword id="6368276" type="COMPANY" weightage="100" keywordseo="Foreign-exchange">Foreign Exchange</keyword> Regulation Act (FERA) in arranging funds to advertise his company's liquor products abroad. 
 
According to ED, Mallya had allegedly paid $200,000 to a British firm for displaying the Kingfisher logo in the Formula One World Championships in London and some European countries in 1996, 1997 and 1998. 
 
The agency had claimed that the money was allegedly paid without prior approval from the Reserve Bank of India, in violation of FERA norms. 
 
Mallya was summoned and tried in the case. He was granted exemption from personal appearance by the Delhi court on December 20, 2000. 
 
The ED has sought withdrawal of exemption granted to Mallya and sought the court's direction asking him to personally remain present in court on each and every date of final arguments of the case.

An application for his international arrest warrant is still pending with Interpol. </li></ul>Ever since the $2 billion <keyword id="38935" type="PERSON" weightage="20" keywordseo="Fraud">fraud</keyword> case at <keyword id="62034" type="CITY" weightage="20" keywordseo="Punjab-National-Bank">Punjab National Bank</keyword> came to light in February 2018, the protagonist behind the scam, <keyword id="571991" type="ORGANIZATION" weightage="20" keywordseo="Nirav-Modi">Nirav Modi</keyword>, has remained a free man. Following a request to Interpol from the Central Bureau of Investigation (CBI) to issue a red corner notice, or an international arrest warrant, against him, the absconding billionaire was reported to be seen in Brussels in June. Like fellow wilful defaulter Vijay Mallya, Modi was subsequently confirmed to be living in the UK, where he has reportedly applied for political asylum. And now, it looks like he could soon be arrested, even as early as this week, according to a report by the Indian Express. Last week, Interpol’s bureau in Manchester asked the CBI to issue an extradition request and provisional warrant for Modi’s arrest. A spokesperson for the CBI, Abhishek Dayal, confirmed to news outlets that the extradition request was sent yesterday to authorities in the UK via the Ministry of External Affairs. The extradition request paves the way for Modi to be immediately arrested in the UK and eventually stand before a court. Earlier this month, India’s Enforcement Directorate, a federal agency tasked with fighting economic crimes, also sent an arrest warrant and extradition request to UK authorities in relation to the Nirav Modi scam. Modi is not the only person of interest in the case. The CBI has also filed chargesheets against his fellow conspirator, Mehul Choksi - whose also his uncle, as well as his wife, Ami Modi and son, Nishal. All left India in January, shortly before the scam was revealed. Despite the revocation of his passport, Modi was believed to be travelling on a passport issued by Singapore. Meanwhile, Choksi is said to have taken up citizenship of Antigua, an island in the Caribbean. A request for his extradition was handed over to officials in Antigua and Barbuda at the beginning of August. However, given the absence of a extradition treaty between India and Antigua, the only way for Indian authorities to extradite Choksi is to get Interpol to issue a red corner notice against him. The application for Choksi’s international arrest warrant is reported to be still pending with Interpol. Separately, on August 20th, a special CBI court granted bail to Usha Ananthasubramanian, who was the managing director and CEO of Punjab National Bank when the scam took place. Prior to the fraud case coming to light, Ananthasubramanian was the MD and CEO of Allahabad Bank, a role which she was eventually forced to relinquish. She was named in a chargesheet for failing to properly prevent the fraudulent letters of undertaking from being issued by the bank.
