Here, it was all about super high monetary stakes, lightning-fast trade deals, and bucketloads of money shifting hands every single second. This wilderness lured millions of individuals with the promise of super duper high returns. But, at what cost? Welcome to the unforgiving, ultra-risky wild west of <keyword id="19991165" type="General" weightage="20" keywordseo="Indian-equity-markets" source="keywords">Indian equity markets</keyword> called the <keyword id="145718" type="General" weightage="100" keywordseo="Futures-and-Options" source="Orion">futures and options</keyword>. Here, everyone seems to just fly right through the bright red-flagged warnings of financial risks to earn even a fraction of these promised returns. Most burn themselves in the process, but carry on nevertheless, as if nothing ever happened. <h2>Chasing the cloudy profits</h2>The data conclusively proves that every 9 out of 10 individuals only lost their hard-earned money in this land. But hey, what do the numbers know? Some hide their losses out of shame, some out of fear. The proponents, meanwhile, proudly boast unusually high returns on their investments, some open social media channels while others encourage their friends and family to take the plunge. Naturally, news of this unstoppable and humongous en-masse migration to the F&amp;O (futures and options) town has reached sheriff <keyword id="19901201" type="General" weightage="20" keywordseo="SEBI" source="keywords" meta.keywordsubtype="org" meta.entityname="SEBI" meta.hostid="261" meta.entityid="SEBI">SEBI</keyword>, galvanising them into action. After all, it was time to put a leash on this madness and save the common man. The inhabitants of this town doubled in the last 2 years, from 51 lakh in FY22 to 96 lakh in FY24—99.8% of whom were small and mid-income traders. But profits? Well, that's a different, rather completely absent story. <h2>Que Sera Sera, much?</h2>A recent report by SEBI (Securities and Exchange Board of India) that studied profits and losses made by traders in the equity derivatives segment between FY22-24 exposed the mad mania of futures and options trading in India, especially since the pandemic. Per the report, 91.1% of individual traders, or about 73 lakh traders had only lost money trading in futures and options in FY24. Between FY 22-24, over 1 crore traders, or about 92.8% of individual traders, had lost Rs 2 lakh each. But once bitten, twice shy? Well, not in this case. More than 75% of individuals, who had only made losses trading in F&amp;O in FY22 and FY23, continued to trade vigorously in FY24 as well, without any changes in the bottom line, which remained deep in red and negative. So, then all these traders must be uber-rich, with tons of cash and not much care to spare? Nope. 76% of traders in the F&amp;O space in FY24 had an annual income of less than Rs 5 lakh. 2 years ago, their share stood at 71%. And their choice of poison? Options! In FY24, 60% of traders made losses trading in futures, but a whopping 91.5% burnt their funds trading in options. Mind you, futures are riskier than options. With futures, which require significant capital investment, the buyer and seller both are contractually bound to adhere to the pre-determined strike price of the futures or options contract, irrespective of whether the prevailing prices are higher or lower (and thus, resulting in losses for either the buyer or seller). With options, since this adherence ain't necessary, individuals end up taking debt to take highly leveraged positions while trading here. <h2>Scale of the explosion</h2>Anyone who trades even infrequently will tell you that a demat account is the mitochondria or powerhouse of the trading cell. As of August 2024, India had over 17.1 crore <keyword id="20957284" type="General" weightage="20" keywordseo="demat-accounts" source="keywords">demat accounts</keyword>, which are a prerequisite for trading in the markets. India is the 9th biggest country in the world, in terms of total demat accounts. Did you know that our demat accounts are at par with the entire population of Bangladesh? Talk about scale! Just 4 years ago, in March 2020, this number was a mere 4 crore. Naturally, the total F&amp;O turnover on both <keyword id="20004725" type="General" weightage="20" keywordseo="NSE" source="keywords" meta.keywordsubtype="org" meta.entityname="NSE" meta.hostid="261" meta.entityid="NSE">NSE</keyword> and BSE has hit the roof, and also broken it. As of October 4, 2024, the total futures and options turnover on NSE stood at a massive Rs 4,78,27,27,750.30 crore. As of September 2024, India's STT mop-up had gone past Rs 26,000 crore. Traders have to pay STT whenever they buy or sell any security in the market. So, more trading brings in more STT, and hence, more revenue for the government, so they're not really complaining. After all, this is certainly what they'd call enviable growth. As of August 2023, our STT collection stood at about Rs 21,599 crores. And in FY20-21, India's STT collection had been Rs 16,000 crore. If only our salaries also managed to grow at this rate! <h2>So, what's happening?</h2>Two things. One, it's the big bulls who are raking in all the moolah. And it's the younger lot (those aged under 30) who are propping them up for this. In FY24, 43% of individual traders in the market were less than 30 years of age. In just one year, this number has swelled by 12 percentage points from just 31% of individual traders. But who says ageing is bad? Wrinkles and silver hair seemingly have a propensity of incurring lesser losses in the market. In FY24, only 79% of traders aged above 60 years made losses, as compared to 93% of those aged below 30. Small and mid-income traders, which make up 98% of the total trader base, witnessed average losses per person of Rs 65,000 and Rs 1.5 lakh in FY24 in futures and options, respectively. The winner here? Clearly, the big bulls, who declared an annual income of over Rs 1 crore, ended up with average profits of Rs 96,000 per person this year. <h2>What’s the sheriff up to?</h2>The government has finally swung into action, hiking the STT rate for F&amp;O during this year’s budget. Effective October 1, 2024, the STT on futures stands at 0.02%, up from 0.0125%. For options, it was upped to 0.1% versus 0.0625% previously. Small margins, but huge impact oncoming. Says Puneet Sharma- CEO and Fund Manager at Whitespace Alpha, “SEBI aims to enhance market stability while safeguarding investor interests, reflecting the regulator's intent to balance risk management with market participation”. But this might come with its own share of challenges, too. “Stricter norms around leverage, transparency, and capital adequacy could limit the ability of investors to determine their own risk appetite, thereby stifling innovation in trading strategies. Over-regulation in an environment that thrives on strategic flexibility and creativity could dampen the market’s dynamism, affecting India's competitiveness in the global derivatives landscape”, he observes. SEBI recently came out with a set of guidelines that aim to thwart <keyword id="19972907" type="General" weightage="20" keywordseo="retail-investors" source="keywords">retail investors</keyword>' participation in futures and options and hinder them from taking undue risks. Here's a quick recap of what's to come for the residents of the F&amp;O town Margin Requirements: To battle the high volatility and chaos which is generally seen on expiry days(i.e the last mandated date, post which an option becomes invalid), SEBI will put in place an extreme loss margin (ELM) of 2% for all open short options on the day of expiry. Translation? Traders will need to pony up more cash upfront, leaving them with fewer funds to take on risky bets. It ain't a choice: No more of one expiry every single day! Going ahead, an exchange like BSE or NSE will just be able to offer weekly expiries, that too, only on one benchmark index, as opposed to an entire buffet it currently offers. At present, NSE offers weekly options contracts for its financial index, bank and midcap indices. But say goodbye to this, and hello to derivatives on only 1 index per exchange. Raising the bar: Effective November 30, 2024, the minimum contract value for index derivatives will be upped to Rs 15 lakh, from the present Rs 5-10 lakh. The hope is that by making it ultra-expensive to enter these trades, investors will be dissuaded from taking on risky trades. Pay upfront: Starting February 2025, those trading in options will have to pay the entire options premium upfront, even before their trades are executed. This is because options generally carry very high leverage, and paying a significant sum upfront can force traders to think twice. Invigilation Pro Max: Starting April 1 2025, to make sure that the number of positions for equity index derivatives does not slyly slip over the mandated limit, especially on expiry days when trade volumes are huge, the exchanges will have to take a minimum of 4 position snapshots randomly. The question is, will these injections of sobriety be enough to calm down the steroid-fed bull of the futures and options market in India? Well, only time and market turnover will tell! According to a <a href="https://zeenews.india.com/auto/indian-govt-directs-ola-uber-to-improve-cab-quality-services-stop-unfair-trade-practice-2462130.html">report</a>, the consumer affairs ministry held a meeting with companies such as Uber, Ola, Rapido, Meru Cabs and Jugnoo and warned the companies of strict action. The main issues under discussion included the surge pricing, frequent cancellation of rides by drivers over trivial issues such as the destination and payment mode, refusal to turn on air conditioners in cabs, different pricing for different users and more. Cab aggregators have announced <a href="https://www.businessinsider.in/business/auto/news/uber-announces-a-price-hike-of-12-for-cab-rides-in-delhi/articleshow/90793725.cms">price hikes</a> in several cities across the country. One of the reasons announced for the price hike was the <a href="https://www.businessinsider.in/india/news/petrol-and-diesel-prices-hiked-for-the-13th-time-in-15-days/articleshow/90655551.cms">increasing</a> cost of petrol and diesel in the country. "The authority is likely to issue an advisory to ensure that unfair trade practices by cab aggregators are not carried on in violation of consumers' rights," said Nidhi Khare, chief commissioner, Central Consumer Protection Authority (CCPA). "The number of complaints is very high and therefore we have called the cab aggregators for an explanation of their policies," Khare said. “We are engaged with the Department of Consumer Affairs and deeply appreciate the feedback provided by them and will continue to provide our inputs. "It appears that cab aggregators are using algorithms to lure new customers, putting old customers at a disadvantage. This is an unfair practice," Khare added. As per the regulator, cab aggregators are charging a premium to their existing customers and offering discounts to lure new customers. Differential pricing for the same location has been termed as an “unfair practice” by the regulator. Khare has added that aggregators will be called upon to reveal their algorithms and policies that are used to determine prices, cancellation charges and surge prices. The aggregators have also been asked to reveal the steps taken by them to safeguard customer’s personal data on their platforms. Indian government accuses Ola, Uber and other aggregators of inflating cab prices for older customers

<ul><li>Section 80JJAA of the Income Tax Act gives deduction for three years to employers for hiring new people.</li><li>The current limit of this provision is ₹300,000 a year that effectively means that the compensation of these people should be less than ₹25,000.</li><li>If the limit is increased, it could help in boosting the salaries of and the number of jobs for gig workers.</li></ul>One of the major concerns raised by the gig workers — such as <keyword id="4235145" type="General" weightage="20" keywordseo="delivery-partners" source="Orion">delivery partners</keyword>, drivers and more — who work for companies like Zomato, Swiggy, BigBasket and Blinkit (Grofers), is <a href="https://www.businessinsider.in/business/startups/news/bigbasket-flipkart-and-urban-company-may-have-paid-fair-wages-but-it-wasnt-enough-to-earn-a-living/articleshow/88946309.cms">the lack of decent compensation</a>. But what if we were to tell you that if an existing provision of the Income Tax Act is clarified and amended, it could raise salaries for the gig workers. Under Section 80JJAA provision of the Indian Income Tax Act, companies can get a tax deduction for hiring new people. If a company’s workforce increased by 50, the salary paid to these employees would make the company eligible for an additional deduction of 30% for the next three financial years, Hemal Zobalia, Partner at Deloitte Haskins &amp; Sells LLP explains. For example, if the company is paying ₹1000 annually to each of these 50 employees, it will get ₹300 as tax deduction for each of them for each of the next three years. Essentially, 90% of the first year’s salary, for each of the new employees, will be deducted from the company’s taxable profit. The goal of this provision is to create more permanent employment for those who are “low-skilled”, according to Jimit Devani, a partner at Deloitte Haskins &amp; Sells. The provision is applicable for employees whose salaries are ₹25,000 per month or less.Increasing the salary limit to ₹35,000-₹40,000 may push more companies to hire permanent employees instead of contractual ones. Meanwhile, Zobalia is of the belief that this would also help in further increasing their payout and salaries. But there is a bigger challenge here. This is not a widely availed incentive by the companies for several reasons. First, companies prefer to hire people on contract and keep them on a third party’s payroll. Such companies cannot avail tax benefit under the 88JJAA provision. Bringing people on to the payroll makes them eligible for other benefits like pension, insurance, and severance to name a few, Devani said. The third parties, however, do avail these tax benefits for employees that have been on their payroll for at least eight months, Devani added. The second issue with this provision is that the benefit is available only on the net addition of employees. Say, a company has a total of 10 employees. Five of them quit the company in a year, and six more are hired in the same year. While the company has six new employees, the net addition to the workforce is only one. And, so, the tax rebate is available only for one additional employee, and not all six. Improving this provision under the income tax law may go a long way in creating sustainable employment for people with less-valued skills, across a range of industries including the gig economy of which the likes of Zomato, Swiggy, Amazon and Flipkart are part of. The current state of salaries in the gig economy As per <a href="https://www.businessinsider.in/business/startups/news/urban-company-ola-uber-are-not-the-best-places-for-gig-workers/articleshow/88561764.cms">Fairwork India report of 2021</a>, most newage digital platforms — including Zomato, Swiggy, Uber, Dunzo, PharmEasy and Ola — do not offer fair wages to the contractual workers associated with them. This has made matters worse for the Indian gig workers like delivery partners and drivers, the Fairwork report adds. Uber hikes fare across the country, starts showing destination and payment mode to drivers before they accept the trip

The plan may be extended beyond cars to apply <keyword id="1741372" type="PERSON" weightage="20" keywordseo="ride-sharing">ride sharing</keyword> on auto rickshaws and bikes as well. The introduction of ride-sharing facilities in India brought about a big change in how people choose to travel from point A to point B. And, the numerous cab driver strikes have already showcased how it’s not an easy life on the other side of the steering wheel. Reports also suggest that Uber and Ola are already applying pressure to avoid such a regulation from going through. This is despite the fact that rumours have been speculating that the entire program might be implemented through aggregators like them. The government is apparently applying due diligence and reviewing international laws before deciding on how it will go about with this endeavour. Is it the solution? It specifically looked at ride sharing options like UberPool and Lyft Line only to find that such services might actually be making <keyword id="6361065" type="UNKNOWN" weightage="20" keywordseo="traffic">traffic</keyword> worse. Rather than reduce congestion, ride-sharing services end up giving competition to public transport systems like the metro and buses. And, in terms of efficiency, results found that there wasn’t much of a difference between ride sharing and its solo counterpart. All in all, the conclusion stated that ride sharing has only resulted in more driving in general. The situation, is of course, different in India but also relatively new in comparison. Either way, before such a measure is implemented, the impact of ride sharing so far should be assessed by an unbiased agency to determine whether or not such a measure will even achieve the desired result.

Unclogging the congestion: Indian government mulls over limiting shared rides by private car owners

The government of India had submitted 128 requests, making up for 35% of such legal requests in the same time frame. India was followed by Turkey, Pakistan and Russia. Overall, Twitter had received over 38,500 legal demands in the second half of 2020, specifying 131.9 Lakh accounts. Japan was the top requester, with 43% (16,600) of all global requests received. India was next in line with about 7,000 demands, making up for 18% of the total legal demands received by the platform. 94% of the total global volume of legal demands originated from only five countries — Japan, India, Russia, Turkey and South Korea. Twitter shared these insights in its transparency report for the second half of the 2020, between July and December. The <keyword id="44734" type="ORGANIZATION" weightage="20" keywordseo="Indian-Government">Indian government</keyword> has also pitched itself as the frontrunner in issuing the most number of information requisitions on Twitter. The country has issued 3,600 information requests, of the total 14,561 such information requests Twitter received. It was followed by the United States, Japan and France in this criteria. Even though India took a lead in these information requests in the second half of 2020. The US was the top demander of user information in the first half of last year. Overall, In 2020, between January to December, the US had issued the most number of information requests. Indian government issued Twitter 128 takedown requests against journalists and news organisations

<ul><li>The Indian Federation of App-based Transport workers (IFAT) have filed a petition in the Supreme Court seeking social security benefits.</li><li>They demanded that gig workers should be considered as “unorganised workers”, which will make their employers liable to pay them certain benefits.</li><li>The lack of employment contracts between gig workers and new age platforms does not mean there is no employer-employee relationship, the petition read.</li></ul>Some of India’s gig workers — associated with new age firms like Uber, Ola, Zomato and Swiggy — are seeking government intervention to help them overcome the impact of the pandemic and make their employers pay for it. The Indian Federation of App-based Transport workers (IFAT) filed a public interest litigation (PIL) in the Supreme Court two days ago, seeking their inclusion as “unorganised workers” or “wage workers” within the Unorganised Workers Social Welfare Security Act, 2008. The association, in collaboration with concerned individuals and organisations, noted that the denial of social security to gig workers and “platform workers’ has resulted in their exploitation through forced labour. The transport gig workers, in the petition accessed by Business Insider, noted that the failure to register them as unorganised workers or provide them with social security is violating their right to life and personal liberty as well as right to equality. They also added that app-based companies — Zomato, Swiggy, Uber, Ola and others — currently claim that they are in partnership with gig workers, therefore there is no contract of employment between the two parties. Hence, they want their hands off any responsibility or accountability over the lives and livelihood of the contractual workers associated with them. “The mere fact that their employers call themselves “aggregators” and enter into the so-called “partnership agreements” does not take away the fact that there exists a jural relationship of employer and employee; master and servant and worker within the meaning of all applicable laws,” the petition read. IFAT added that the contracts were made in a way to disguise the nature of the relations between the gig workers and these apps. They also cited a recent Supreme Court ruling in the United Kingdom, which <a href="https://www.businessinsider.com/uber-reclassify-uk-drivers-minimum-wage-benefits-supreme-court-defeat-2021-3">stated</a> that Uber Drivers are in fact workers in the company and are entitled to certain benefits. The workers’ association added that the transport gig workers in India are struggling with decreasing income, increasing fuel prices, immense pressure from loan recovery agents as well as state officials, who too are trying to make a living in this pandemic. Gig workers move Supreme Court seeking social security benefits from Zomato, Swiggy, Ola and Uber

The drivers are now entitled to minimum wage and other employment protections, ruled the top court. “When a ride is booked through the Uber app, it is Uber that sets the fare and drivers are not permitted to charge more than the fare permitted by the app. It is therefore Uber that dictates how much the driver is paid and the work they do,” said the Supreme Court during its ruling. Uber has been fighting the case in the UK for almost five years now, where in 2016 a tribunal court had ruled in favour of <keyword id="6364641" type="UNKNOWN" weightage="20" keywordseo="Uber-drivers">Uber drivers</keyword> Yaseen Aslam and James Farrar. “I am overjoyed and greatly relieved by this decision which will bring relief to so many workers in the gig economy who so desperately need it. During the six years of these proceedings, we have watched the government commission and then shelve a review of the gig economy yet do nothing to help us. I hope in future the government will choose to carry out its duty to enforce the law and protect the most vulnerable from exploitation,” Aslam said in a statement today after the verdict. This ruling could impact all ride-hailing companies like Uber, Ola, Lyft, Bolt etc., who all call their drivers as ‘mini entrepreneurs’ or independent contractors, which gives them the flexibility to also switch between apps. However, Farar called this a false dream of endless flexibility and entrepreneurial freedom. “The reality has been illegally low pay, dangerously long hours and intense digital surveillance. I am delighted that workers at last have some remedy because of this ruling, but the government must urgently strengthen the law so that gig workers may also have access to sick pay and protection from unfair dismissal,” he said in a statement today. This could also impact Uber’s case across the globe, where it is often put under scrutiny for its treatment of its driver partners. Earlier, Uber and Lyft had lost a similar case in <a href="https://www.nytimes.com/2020/10/22/technology/uber-lyft-california.html#:~:text=OAKLAND%2C%20Calif.,California%20appeals%20court%20ruled%20Thursday.&amp;text=%E2%80%9CThis%20is%20dollars%20and%20wages,by%20virtue%20of%20the%20misclassification.%E2%80%9D">California </a>where the court had ruled that they must treat their drivers as employees, giving them benefits and wages they are entitled to under state labor law. In India too, Uber and Ola drivers have often gone on strikes demanding better compensation from the ride-hailing companies. Most recently, in September 2020, Uber and Ola drivers in Delhi NCR had gone on a strike demanding hike in their per kilometre fare as well as a reduction in the commission that the companies take. While foreign judgements have no authoritative value on Indian courts they do have persuasive value. “There is nothing under law that requires Indian courts to uphold foreign law, however foreign judgements can be applied as having persuasive value if there are structural similarities in the facts of a case (between the foreign and domestic cases). For example, in the Aruna Ramchandra Shaunbag v. In a number of cases concerning constitutional law, the courts have quoted foreign judgements and principles for persuasive value. Within the common law tradition, its common to borrow and cite foreign judgements for persuading a case,” a lawyer told Business Insider. In a report evaluating the benefits offered by the likes of Uber and Ola during the COVID-19 pandemic, the <a href="https://www.orfonline.org/research/covid-19-and-indias-gig-economy-the-case-of-ride-hailing-companies-69044/">Observer Research Foundation</a> had said, “The current scenario, in which livelihoods and health of an entire workforce are threatened, proves that flexibility cannot come at the cost of most basic protections. All workers – irrespective of their unemployment arrangements – need to be able to access health care, to choose to stay home when unwell, and benefit from income support in case of a crisis-related reduction of working time or job loss.” In the recent Budget, Finance Minister Nirmala Sitharaman too had said that gig economy workers in India would come under ESIC (Employee State Insurance Corporation) scheme and minimum wages will apply to all such workers. Uber loses a major case in UK which rules its drivers are workers, a ruling that could impact the ride-hailing giant everywhere including India

In the ten years from 2012 to 2021, assets under management have increased more than three-fold from SGD1.6 trillion (USD1.2 trillion) to SGD 5.4 trillion, according to data from Singapore's central bank, MAS (Monetary Authority of Singapore). In just one year, 2021, it grew 16 per cent, the last year's data is available. Three-quarters of this came from outside Singapore, with just under a third from Asia-Pacific countries. Indeed, some call Singapore the Switzerland of the East. Recently, the trend of setting up family <keyword id="47357" type="General" weightage="20" keywordseo="offices" source="Orion">offices</keyword> has been growing and has accelerated since the start of the pandemic and Singapore has managed to take a large slice of this market as well. Family offices are privately held companies set up to manage the wealth and investments of the uber-rich. These family offices are usually set up with the objective of managing the financial and investment needs of affluent families or individuals including providing financial solutions, budgeting, insurance, charitable giving, wealth transfer and succession planning, and tax services. Between 2020 to 2021, Singapore has seen the number of family offices set up in the city-state climb from 400 to 700. Chung Ting Fai, a lawyer who helps set up family offices, told Reuters that in late 2022, he had one enquiry a week from people who want to move at least USD20 million into Singapore. He is in good company. The likes of ultra-rich individuals like hedge fund billionaire Ray Dalio and co-founder of Google Sergey Brin have chosen Singapore to establish their family offices. So have British inventor James Dyson famous for his bladeless fans and hair dryers and vacuum cleaners, and Zhang Yong, founder of China's Haidilao hotpot restaurant chain. As it started to significantly ease COVID restrictions, being the leading Asian country to do so, Singapore has seen a fresh wave of affluent foreigners looking to park their wealth here. This is especially so among the Chinese as they became disenchanted by their government's draconian COVID policies. These mainlanders have become impatient and are keen to look at alternative destinations for their wealth. Although China has now abandoned its zero-COVID policy, these wealthy Chinese are expected to continue to explore options outside of their home country, in part also due to concern about President Xi Jinping's common prosperity drive that aims to reduce inequality. Besides the Chinese, Malaysian and Japanese citizens are also looking to set up family offices in Singapore. What attracts ultra-rich foreigners to Singapore to set up family offices is its tax-friendly regime and comparatively safe and secure environment. It is also seen as politically stable with clear transparent rules and an incorruptible system. Singapore also is an international financial centre which allows investment firms the ability to offer their clients a varied range of products and investment opportunities to suit their needs. The arrival of the wealthy is leading to Singapore's resident population growing again after many expatriates left at the height of the pandemic. In 2022, the island received 30,000 more permanent residents and 97,000 more foreigners on work or long-term visas, lifting its population to 5.64 million. However, the flood of the global rich squeezing onto the tiny island is causing some pain to the local population. Prices of cars, housing and other goods have escalated significantly. Deputy Prime Minister Lawrence Wong signalled in August last year that the wealthy may face more taxes to boost inclusive growth. Singapore's new residents have sent rents surging 21 per cent in the first nine months of last year. Home prices have also jumped over the past two years with mainland Chinese buyers continuing to be the top foreign buyers of expensive private properties.
