However, the government has given Twitter one last opportunity to comply with the new Information Technology (IT) rules. According to a <a href="https://economictimes.indiatimes.com/tech/technology/twitter-india-given-last-chance-to-follow-it-rules/articleshow/92532677.cms">report</a> by Economic Times, the government has warned Twitter that it will lose its intermediary status if it does not comply with the country’s IT rules. The Ministry of Electronics and Information Technology (MeitY) has taken this step as Twitter has repeatedly failed to comply with content take-down notices issued under the IT Act. This is due to “repeated failures to act on the content take-down notices sent under Section 69 A of the IT Act,” an official familiar with the matter told ET. The government, in its notice, has mentioned that Twitter failed to comply with notices sent on June 6 and 9. “Despite repeated notices and chances being given to them to act, Twitter remains in violation. Therefore, appropriate action is being taken. All intermediaries that operate in India must follow the IT Rules in letter and spirit,” a senior official added. MeitY has also warned Twitter that if it continues to violate the IT Rules, it will have to face significant consequences under the IT Act, including the loss of immunity available to intermediaries. “If Twitter Inc. continues to be in violation of these Directions and therefore the IT Act, significant consequences under the IT Act shall prevail.” Consequences may include “loss of immunity as available (to) an intermediary under subsection (1) of section 79 of the IT Act and (will be) liable to punishment to offenses as prescribed in the IT Act 2000.” <cmsannotation type="cmsannotation" annotationid="What is an intermediary?" comment="subhead" text="What is an intermediary?">What is an intermediary?</cmsannotation> The amended IT Rules have granted social media platforms the tag of intermediaries. These companies must appoint a compliance officer responsible for ensuring compliance with the IT Rules. In addition, the intermediaries must take down posts for which a notice has been received within 24 hours. If the company loses its intermediary status, it will be equally responsible for unlawful content posted on its platform as the person who has posted it. Do note that this is not the first time the Indian government has threatened Twitter about it losing its intermediary status. Twitter will lose its intermediary status if it does not comply with the new IT rules by July 4

<ul><li>Yesterday, Twitter lost its legal indemnity in India for failing to fully comply with new IT rules that came into force on May 25.</li><li>We speak to digital experts to understand how this decision could impact the platform and brands in India.</li></ul>The global microblogging platform Twitter lost its legal protection in India on June 16 over its failure to comply with the government’s new IT rules. Twitter has now lost its ‘intermediary’ status in India, which gave it immunity from liabilities over any third-party data hosted by the platform. The Jack Dorsey-owned platform will be held accountable for every single ‘objectionable’ tweet under the <keyword id="6433641" type="UNKNOWN" weightage="20" keywordseo="information-technology-act">Information Technology Act</keyword>, 2000 and the country’s penal laws. With this, Twitter has become the first US-based social media platform to lose legal protection in India. We reached out to digital experts from the advertising industry to understand the implications of this development, to understand what it means for Twitter and brands in India. And Twitter isn’t quite on board, yet. The two have been locked in a battle of national interest versus freedom of speech, both with an intent to protect users. Today, on May 28, a plea has been filed in the Delhi High Court against Twitter and its non-compliance with the IT rules. Twitter is at odds with the Indian government over new laws — reigniting the age-old battle of national interest versus freedom of speech

Amid tensions with the government, <keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> has appointed a Resident Grievance Officer, days after it designated a chief compliance officer, as it also released its first India Transparency Report to meet the new IT rules. The US social media giant's website has listed Vinay Prakash as the new grievance officer, providing contact details and procedure for users to report potential violations of its rules and terms. Twitter had previously appointed Dharmendra Chatur as its interim grievance officer for India after the new IT rules came into force on May 26. However, Chatur stepped down within weeks of taking over the key role. California-based Jeremy Kessel was named as India's grievance redressal officer, on the platform's website - although the appointment did not meet the requirements of IT rules that clearly mandate key officers - grievance officer, chief compliance officer and nodal officer - to be resident in India. Twitter's website on Sunday showed Vinay Prakash as the Resident Grievance Officer (RGO). Users can contact him using an email ID listed on the page. "Twitter can be contacted in India at the following address: 4th Floor, The Estate, 121 Dickenson Road, Bangalore 560 042," the page further said. Prakash's name appears along with Kessel, who is the Global Legal Policy Director, and is based in the US. Twitter did not share additional details of the new resident grievance officer. Twitter has also published its maiden compliance report. In its India Transparency Report: User Grievances and Proactive Monitoring July 2021 report, Twitter said it had received 94 grievances and "actioned" 133 URLs between May 26 and June 25, 2021. Twitter said the majority of complaints received via Grievance Officer - India channel during the reporting period fell into categories including defamation (20), Abuse/Harassment (6), Sensitive Adult Content (4), Impersonation and privacy infringement (3 each), IP-related Infringement (1), and Misinformation/Synthetic and Manipulated Media (1). In addition to this, Twitter processed 56 grievances which were appealing Twitter account suspensions. In a separate category - '<keyword id="11616040" type="UNKNOWN" weightage="20" keywordseo="proactive-monitoring-data">Proactive Monitoring Data</keyword>', Twitter said 18,385 accounts were suspended over the issue of Child Sexual Exploitation, Non-Consensual Nudity, and similar content, while 4,179 accounts were suspended for <keyword id="3208352" type="PERSON" weightage="20" keywordseo="Promotion-of-Terrorism">Promotion of Terrorism</keyword>. However, the 'Proactive Monitoring Data' -- content proactively identified by employing internal tools and industry hash sharing initiatives -- represents global actions taken, and not just actions related to content from India. Twitter noted that going forward, it will publish this report on a monthly basis and that it will make improvements over time, based on feedback received from the government, or in accordance with internal changes that allow it to provide more granular data. Under the new IT rules, large digital platforms (with over 50 lakh users) are required to publish periodic compliance reports every month, mentioning the details of complaints received and action taken thereon. The new IT rules are designed to prevent abuse and misuse of digital platforms, and offer users a robust forum for grievance redressal. Under these rules, social media companies will have to take down flagged content within 36 hours, and remove within 24 hours content that is flagged for nudity and pornography. Non-compliance with the IT rules would result in these platforms losing their intermediary status that provides them immunity from liabilities over any third-party data hosted by them. The rules also mandate appointment of three key personnel - grievance officer, chief compliance officer and nodal officer. These officials need to be resident in India. The Indian government had confronted Twitter over deliberate defiance and failure to comply with the IT rules, despite repeated reminders. Twitter -- which has an estimated 1.75 crore users in India -- lost its legal shield as an intermediary in India, becoming liable for users posting any unlawful content. Ashwini Vaishnaw, who has recently taken charge as Information Technology Minister, had on Thursday said all those who live and work in India will have to abide by the rules of the country. On the same day, Twitter had informed the Delhi High Court that it has appointed an interim chief compliance officer (CCO), who is a resident of India, and that it will make an endeavour to fill the regular position within eight weeks as per the IT rules. In an affidavit, Twitter had said "Twitter has posted publicly a job announcement for a CCO as a direct employee and is accepting applications at this time. Twitter will endeavour in good faith to make an offer of employment to a qualified candidate to fill this position within 8 weeks". Earlier, Twitter had advertised for filling the positions of Chief Compliance Officer, Nodal Officer and Resident Grievance Officer in India on the careers section on its website. The Delhi High Court had granted two weeks' to <keyword id="308642" type="COMPANY" weightage="20" keywordseo="Twitter-Inc">Twitter Inc</keyword> to file an affidavit, notarised in the US, on compliance with the IT rules and had made it clear that it was not extending any protection to the microblogging platform. But, if it loses that protection, the platform could directly responsible for all the posts on its platform. This means that if tomorrow the government decides that a particular tweet is not compliant with the law of the land, the social media platform will have to explain its role. In addition to the user who posted the tweet, Twitter itself could be liable for the content under the Information Technology Act, 2000 and the country’s penal laws. However, according to the Internet Freedom Foundation (<a href="https://twitter.com/internetfreedom/status/1405039411008442370" id="docs-internal-guid-29418c41-7fff-f748-cf57-062e3020459f">IFF</a>), the intermediary status of social media platforms is only a 'technical' qualification. According to Section 79 of the IT Act, Twitter and other intermediaries will still be immune from liability they comply with the legal takedown requests of user posts from courts and public authorities. Moreover, organisations like the Software Freedom Law Center (SFLC) and individuals like musician TM Krishna, have challenged the new IT rules for being unconstitutional. Twitter may now directly be held responsible for every single tweet in India

<keyword id="790242" type="COMPANY" weightage="20" keywordseo="WhatsApp">WhatsApp</keyword> banned two million Indian accounts while it received 345 grievance reports between May 15 and June 15, the company said in its maiden monthly compliance report as mandated by the IT rules. The new IT rules require large digital platforms -- with over five million users -- to publish compliance reports every month, mentioning the details of complaints received and action taken. "Our top focus is preventing accounts from sending harmful or unwanted messages at scale. We maintain advanced capabilities to identify these accounts sending a high or abnormal rate of messages and banned two million accounts in India alone from May 15-June 15 attempting this kind of abuse," WhatsApp said on Thursday. WhatsApp clarified that more than 95 per cent of such bans are due to the unauthorised use of automated or bulk messaging (spam). "We expect to publish subsequent editions of the report 30-45 days after the reporting period to allow sufficient time for data collection and validation," WhatsApp said in the report. The Facebook-owned company explained that the number of accounts banned have risen significantly since 2019 as the sophistication of systems has increased, and "so we are catching more accounts even as we believe there are more attempts to send bulk or automated messages". The vast majority of these accounts are banned proactively, without relying on any user reports, it added. About eight million accounts are banned/disabled globally on an average per month. WhatsApp said besides the behavioural signals from accounts, it relies on available "unencrypted information" including user reports, profile photos, group photos and descriptions as well as advanced AI tools and resources to detect and prevent abuse on its platform. In the report, WhatsApp said it had received 345 reports in total, cutting across categories such as ban appeal, account support, product support, safety issues and others. Against this, 63 accounts were "actioned" by WhatsApp during May 15-June 15, 2021. WhatsApp said user reports received by the platform via the grievance <keyword id="11650763" type="UNKNOWN" weightage="20" keywordseo="channel/s">channel/s</keyword> are evaluated and responded to. Majority of users who reach out to WhatsApp are either aiming to have their account restored following an action to ban them or reaching out for product or account support, it added. 'Accounts Actioned' denotes reports where WhatsApp took remedial action based on the report. Taking action denotes either banning an account or a previously banned account being restored as a result of the complaint. The IT rules -- which came into effect on May 26 -- mandate that significant digital platforms include the number of specific communication links or parts of information they proactively remove by using automated tools. Other platforms like <keyword id="6355629" type="DEFINITION" weightage="20" keywordseo="google">Google</keyword>, Koo and <keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> have already submitted their compliance reports. The IT rules have been designed to prevent abuse and misuse of digital platforms, and offer users a robust forum for grievance redressal. Under these rules, social media companies will have to take down flagged content within 36 hours, and remove within 24 hours content that is flagged for nudity and pornography. The rules also mandate appointment of three key personnel -- grievance officer, chief compliance officer and nodal officer. These officials need to be residents in India. Non-compliance with the IT rules would result in these platforms losing their intermediary status that provides them immunity from liabilities over any third-party data hosted by them. WhatsApp banned two million Indian accounts during May 15-June 15 period

Microblogging platform Twitter has "withheld" the accounts of Punjabi singer JazzyB, hip-hop artist L-Fresh the Lion and two others in response to a legal demand in <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword>, even as it draws flak over delay in complying with the <keyword id="649076" type="PERSON" weightage="20" keywordseo="new-IT-rules">new IT rules</keyword> in the country. According to an information on Lumen database, Twitter received legal request from the Indian government on June 6 for actioning four accounts, including that of JazzyB. Requests received by Twitter for withholding content are published on Lumen database - an independent research project studying cease and desist letters concerning online content. Users checking <keyword id="789829" type="COMPANY" weightage="20" keywordseo="Jazzy-B">Jazzy B</keyword>'s account are shown a message saying "account has been withheld in India in response to a legal demand". When contacted, a Twitter spokesperson said when it receives a valid legal request, it reviews it under both the <keyword id="3877745" type="COMPANY" weightage="20" keywordseo="twitter-rules">Twitter Rules</keyword> and local law. "If the content violates Twitter Rules, the content will be removed from the service. If it is determined to be illegal in a particular jurisdiction, but not in violation of the Twitter Rules, we may withhold access to the content in India only," the spokesperson added. The spokesperson noted that in all cases, it notifies the account holder directly so that they're aware that the company has received a legal order pertaining to the account. "We notify the user(s) by sending a message to the e-mail address associated with the account(s), if available... Twitter is committed to the principles of openness, transparency, details of the requests to withhold content have been published on Lumen," the spokesperson said. Reports suggest that Jazzy B had frequently tweeted in support of farmers' protests. Earlier this year, more than 500 accounts were suspended and access to hundreds of others in India blocked after the government ordered the microblogging platform to restrain the spread of misinformation and inflammatory content related to farmers' protests. Over the past many months, Twitter has been embroiled in a number of issues. Twitter had drawn flak after it marked several tweets by ruling BJP leaders on an alleged strategy document of the Opposition to target the government over <keyword id="8764262" type="COMPANY" weightage="20" keywordseo="covid">COVID</keyword> as containing 'manipulated media', triggering a sharp rebuke from the government. The row over Twitter's handling of certain messages had recently blown up into all-out war of words between the Centre and the social media platform. Last week, the government issued a notice to Twitter giving it one last chance to "immediately" comply with the new IT rules and warned that failure to adhere to the norms will lead to the platform losing exemption from liability under the IT Act. Twitter has an estimated 1.75 crore users in India, as per data cited by the government recently. The new IT rules for social media companies that came into effect last month mandate large platforms like Facebook and Twitter to undertake greater due diligence and make these digital platforms more accountable and responsible for the content hosted by them. The rules also require significant social media intermediaries - providing services primarily in the nature of messaging - to enable identification of the "first originator" of the information that undermines the sovereignty of India, the security of the state, or public order. The new IT rules require significant social media intermediaries - those with other 50 lakh users - to appoint a grievance officer, nodal officer and a chief compliance officer. This is Amazon's first step toward entering the $350 billion ocean freight market.This is a smart and long overdue move for the company. By offering ocean freight services, Fulfillment by Amazon (FBA) will make it easier for its customers to move goods into the company's logistics network.The official name on the FMC registry is Beijing Century JOYO Courier Service Co. Ltd, with the trade name "Amazon China" listed on its license. In 2004, CNET <a href="http://www.cnet.com/news/amazon-buys-into-chinese-market/" target="_blank">reported</a> that Amazon bought JOYO, then one of China's largest online retailers. A 2006 SEC <a href="http://www.sec.gov/Archives/edgar/data/1018724/000119312506034166/dex211.htm" target="_blank">filing</a> reveals JOYO to be a "significant subsidiary" of Amazon.com Inc., and we see that it's currently doing business as Amazon China.<h2>Why does becoming an ocean freight forwarder make sense for Amazon China but not for Amazon itself?</h2>Because Amazon's ocean freight services will be far more attractive to Chinese sellers than to American buyers. Chinese suppliers would love direct access to Amazon's vast American customer base. But the idea of buying ocean freight is far less appealing for U.S. companies selling on the Amazon Marketplace. As the freight forwarder on a company's shipments, Amazon would see both the name of the supplier and the wholesale price paid by the importer. For most of the more than 40,000 sellers currently earning over $1 million per year selling products on Amazon, this data is too sensitive to entrust with a company that is both a primary distribution channel and a ruthless competitor. It would be too easy for Amazon to use that data against them, either as an anchor in price negotiations, or worse, to purchase directly from the supplier, cutting the U.S. merchant out altogether.On the other hand, Amazon China can provide freight forwarding services to Chinese companies looking to move products directly into FBA warehouses, or perhaps even by cross-docking the goods for direct injection into Amazon's courier network. Sharing the invoice price and supplier name is a non-issue for Chinese companies selling to Amazon or directly to its customers.We should note that receiving this license from the FMC is only the very first step that Amazon has taken to become an ocean freight forwarder. It's laying the groundwork now; actual operations may not begin for a few years.<h2>Here's a reason for investors to be excited</h2>This may be Amazon's answer to <a href="http://wish.com/" target="_blank">Wish</a>, the worldwide mobile commerce phenomenon. That company's achievement as the number one ecommerce app in more than 30 countries has shown that Chinese merchants are eager to sell directly to global shoppers and that many consumers are happy to wait longer for delivery if they can save enough money.Wish's CEO <a href="http://recode.net/2015/12/28/meet-wish-the-3-billion-app-that-could-be-the-next-walmart/" target="_blank">recently told Recode</a> that his company is in a race with Amazon and Alibaba to be the first company to surpass $1 trillion in annual gross merchandise sales. Entering the ocean freight market to create a streamlined, vertically-integrated system for Chinese factories to sell directly through Amazon would be a classic Bezos response to Wish's threat.<h2>Why Amazon will make a fantastic ocean freight forwarder</h2><a href="https://www.flexport.com/blog/why-are-ocean-freight-rates-so-low/" target="_blank">Ocean freight is cheap right now. </a>As of January 2016, Flexport's ocean freight customers were paying less than $1300 to ship a 40-foot container from Shenzhen to Los Angeles. More than 10,000 parcels can fit in a single container, so the price for the ocean freight leg could be as low as $0.135 per parcel. Here's another way to think about that figure: Right now it costs under $10 to ship a flat screen television across the Pacific.With ocean freight itself so low, a considerable portion of logistics costs come through labor costs-particularly compliance and coordination of cargo handoffs between different players in the chain. It's here that automation, something no traditional freight forwarding company can do even one percent as well as Amazon can, becomes the key competitive advantage over legacy freight forwarders. By using software to eliminate additional transaction costs associated with government filings, status updates, pricing, booking and more, Amazon will be able to cut their costs significantly. At the same time, fulfilling products directly from China to consumers in the U.S. will cut handling costs at U.S. warehouses.If we've learned anything from Amazon's strategic playbook over the last two decades, we can expect that it will price freight as close to marginal costs as it can get.With the integration of its worldwide network of fulfillment centers and the combination of<a href="https://www.flexport.com/blog/amazons-new-jets-threat-to-fedex-and-ups/" target="_blank"> its new fleet of cargo jets</a>, Amazon will be able to build a world class logistics platform for small and medium sized Chinese businesses.***Amazon's ocean freight offering could be a huge hit for Chinese merchants. American companies will simply not be willing to turn over such sensitive supply chain data to a major competitor and channel partner.
