Nonetheless, Twitter endeavors at all times to comply with local law and Twitter’s action in this case is consistent with local legal standard," the social networking platform said with respect to IFF's letter. This is believed to be the first case against the leading social media platforms for facilitating spread of hatred and anti-national content in the country. The case against the social media platforms was registered under various sections of the Indian Penal Code (IPC), including for promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony, conspiracy to wage or attempt to wage war, or abetting waging of war against Indian government, obscene acts and songs in public, statements <keyword id="8818833" type="PERSON" weightage="20" keywordseo="conducing">conducing</keyword> to public mischief and criminal conspiracy. Silveri Srishailam, who had filed the petition in a Nampally court seeking action against the three social media apps, claimed that more than 1,200 groups were created after the protests against CAA, NRC and NPR began in the country, which were spreading anti-national content. Though the FIR was registered on February 18, the issue came to light on Thursday. A police officer said that notices would be issued to the respondents seeking their comments. "There's been a lot of discussion this week about Twitter's perceived bias in India. The social media giant further added that in its training, they extensively cover topics such as religion and caste to provide teams with necessary local context they need to evaluate content. Regarding the verification process, Twitter India said their public verification process is closed. “While we are reviewing the entire program, on a limited case-by-case basis we do verify public figures who are active in the public conversation,” the company said. Twitter India users are leaving to ‘create their own social media’ platform on Mastodon

Microblogging platform Twitter has "withheld" the accounts of Punjabi singer JazzyB, hip-hop artist L-Fresh the Lion and two others in response to a legal demand in <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword>, even as it draws flak over delay in complying with the <keyword id="649076" type="PERSON" weightage="20" keywordseo="new-IT-rules">new IT rules</keyword> in the country. According to an information on Lumen database, Twitter received legal request from the Indian government on June 6 for actioning four accounts, including that of JazzyB. Requests received by Twitter for withholding content are published on Lumen database - an independent research project studying cease and desist letters concerning online content. Users checking <keyword id="789829" type="COMPANY" weightage="20" keywordseo="Jazzy-B">Jazzy B</keyword>'s account are shown a message saying "account has been withheld in India in response to a legal demand". When contacted, a Twitter spokesperson said when it receives a valid legal request, it reviews it under both the <keyword id="3877745" type="COMPANY" weightage="20" keywordseo="twitter-rules">Twitter Rules</keyword> and local law. "If the content violates Twitter Rules, the content will be removed from the service. If it is determined to be illegal in a particular jurisdiction, but not in violation of the Twitter Rules, we may withhold access to the content in India only," the spokesperson added. The spokesperson noted that in all cases, it notifies the account holder directly so that they're aware that the company has received a legal order pertaining to the account. "We notify the user(s) by sending a message to the e-mail address associated with the account(s), if available... Twitter is committed to the principles of openness, transparency, details of the requests to withhold content have been published on Lumen," the spokesperson said. Reports suggest that Jazzy B had frequently tweeted in support of farmers' protests. Earlier this year, more than 500 accounts were suspended and access to hundreds of others in India blocked after the government ordered the microblogging platform to restrain the spread of misinformation and inflammatory content related to farmers' protests. Over the past many months, Twitter has been embroiled in a number of issues. Twitter had drawn flak after it marked several tweets by ruling BJP leaders on an alleged strategy document of the Opposition to target the government over <keyword id="8764262" type="COMPANY" weightage="20" keywordseo="covid">COVID</keyword> as containing 'manipulated media', triggering a sharp rebuke from the government. The row over Twitter's handling of certain messages had recently blown up into all-out war of words between the Centre and the social media platform. Last week, the government issued a notice to Twitter giving it one last chance to "immediately" comply with the new IT rules and warned that failure to adhere to the norms will lead to the platform losing exemption from liability under the IT Act. Twitter has an estimated 1.75 crore users in India, as per data cited by the government recently. The new IT rules for social media companies that came into effect last month mandate large platforms like Facebook and Twitter to undertake greater due diligence and make these digital platforms more accountable and responsible for the content hosted by them. The rules also require significant social media intermediaries - providing services primarily in the nature of messaging - to enable identification of the "first originator" of the information that undermines the sovereignty of India, the security of the state, or public order. The new IT rules require significant social media intermediaries - those with other 50 lakh users - to appoint a grievance officer, nodal officer and a chief compliance officer. These personnel are required to be resident in India. Under the new rules, social media companies will have to take down flagged content within 36 hours, and remove within 24 hours content that is flagged for nudity, pornography etc. The Centre had said the new rules are designed to prevent abuse and misuse of platforms, and offer users a robust forum for grievance redressal. Non-compliance with the rules would result in these platforms losing their intermediary status that provides them immunity from liabilities over any third-party data hosted by them. In other words, they could be liable for criminal action in case of complaints. The notice sent by the ministry noted that in view of <keyword id="308642" type="COMPANY" weightage="20" keywordseo="Twitter-Inc">Twitter Inc</keyword>'s non-compliance with the rules which came into effect on May 26, 2021, "<keyword id="150070" type="CITY" weightage="20" keywordseo="consequences">consequences</keyword> follow". "However, as gesture of goodwill, Twitter Inc is hereby given one last notice to immediately comply with the rules, failing which the exemption from liability available under section 79 of the IT Act, 2000 shall stand withdrawn and Twitter shall be liable for consequences as per the IT Act and other penal laws of <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword>," it said. The ministry said that it is clear from the responses of the company that till date it has not informed about the details of the Chief Compliance Office as required under the Rules. Further, it also said that the Resident Grievance Officer and Nodal Contact Person nominated by the platform are not its employees in India as required under the new rules. "The office address of Twitter Inc as mentioned by you is that of a law firm in India, which is also not as per the rules." It said that the refusal to comply demonstrates Twitter's lack of commitment and efforts towards providing a safe experience for the people of India on its platform.
