New Delhi [India], November 8 (ANI): The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Monday observed that education is not the business to earn profit and tuition fees shall always be affordable as it noted that the Andhra Pradesh Government's decision to enhance fee to Rs 24 lakhs per annum, which is seven times more than the fee fixed earlier is not justifiable at all. A bench of justices MR Shah and Sudhanshu Dhulia on Monday made these remarks while upholding Andhra Pradesh High Court's order which set aside the State Government's decision to enhance the tuition fee payable by the MBBS students. Andhra Pradesh government by its Government Order dated September 6, 2017, enhanced the tuition fee payable by MBBS students. "We are of the opinion that the High Court has not committed any error in quashing and setting aside the Government Order dated September 6, 2017, enhancing the tuition fee for the block years 2017-2020," the court said. "To enhance the fee to Rs 24 lakhs per annum i.e., seven times more than the fee fixed earlier was not justifiable at all. Education is not the business to earn profit. The tuition fee shall always be affordable," the court said. The court observed that the determination of fee/review of the fee shall be within the parameters of the fixation rules and shall have direct nexus on the factors mentioned in Rule 4 of the Rules, 2006, which include the location of the professional institution; the nature of the professional course; the cost of available infrastructure; the expenditure on administration and maintenance; a reasonable surplus required for growth and development of the professional Institution; the revenue foregone on account of waiver of fee, if any, in respect of students belonging to the reserved category and other Economically Weaker Sections of the society. The court noted that these factors are required to be considered by the Admission and Fee Regulatory Committee (AFRC) while determining/reviewing the tuition fees. The court also opined that Andhra Pradesh High Court has not committed any error in issuing directions to refund the amount of tuition fee collected under the Government Order dated September 6, 2017. "Therefore, the High Court is absolutely justified in quashing and setting aside Government Order dated September 6, 2017," the court said. "The management cannot be permitted to retain the amount recovered/collected pursuant to the illegal Government Order dated 06.09.2017. The medical colleges are the beneficiaries of the illegal Government Order dated September 6, 2017, which is rightly set aside by the High Court," the court said as it noted that medical colleges have utilized the amount for a number of years and kept with them for a number of years on the other hand students paid the exorbitant tuition fee after obtaining a loan from the financial institutions and banks and paid the higher rate of interest. "Therefore, even the directions issued by the High Court to refund the amount of tuition fee collected pursuant to Government Order dated September 6, 2017, after adjusting the amount payable as per the earlier determination is not required to be interfered with," the court said. With these observations, the top court dismissed the appeals filed by the medical college against the Andhra Pradesh High Court order. (ANI)

The Tamil Nadu government on Thursday warned the self-financing medical and dental colleges in the state of stringent action if the students are charged above the prescribed fee. More than 50 students approached the state health department and medical education department of the government with a complaint that colleges were asking for fees higher than the prescribed rates. The state health secretary, <keyword id="220787" type="General" weightage="80" keywordseo="senthil-kumar" source="Orion">Senthil Kumar</keyword> called upon the self-financing medical and dental colleges not to overcharge or else face stringent action, including cancellation of their licenses. Based on the complaint, the health secretary sent a two-page caution note to the self-financing medical colleges affiliated with the <keyword id="836711" type="General" weightage="80" keywordseo="tn-dr-mgr-medical-university" source="Orion">TN Dr MGR Medical University</keyword>. It may be noted that during the present academic year, the fee for MBBS/BDS has increased by Rs 1 lakh. With the new fee structure, the students admitted to self-financing medical colleges under government colleges have to pay fees between Rs 4.35 lakh and Rs 4.50 lakh. The fee for <keyword id="48426" type="General" weightage="80" keywordseo="mbbs" source="Orion">MBBS</keyword> seats in the management quota is Rs 13.5 lakh per year and in the <keyword id="11904949" type="General" weightage="80" keywordseo="nri" source="Orion">NRI</keyword> quota admission, it will be Rs 24.5 lakh. The fee includes tuition fees, admission fees and special laboratory fees. It also includes charges for internet usage, sports fee, etc. The fee does not include hostel or mess charges. In addition to this, the colleges can collect an amount of Rs 40,000 per head as a development fee. It is to be noted that admission to medical colleges affiliated with TN Dr MGR Medical University is done through online counselling based on merit ranks. TN govt warns medical, dental colleges against overcharging students

Getting admission into a medical college in Tamil Nadu has just gone doubly expensive, costing students close to Rs 2 crore. 
 
After the results of National Eligibility-cum-Entrance Test (NEET) were declared by CBSE, the private medical colleges and deemed universities in Tamil Nadu increased their fees for MBBS courses, making the average cost of studying at a premier college as high as Rs 1.85 crore, with Rs 1 crore as tuition fee and Rs 85 lakh as capitation fee. 
 
These private medical colleges and deemed universities will only be able to admit their students on the basis of merit, but still, some colleges have discreetly said that they would charge a capitation fee ranging from Rs 40 lakh to Rs 85 lakh. 
 
"I argued it should be based on merit, but the college administration says it wasn't specified in the SC order," a parent told TNN. 
 
Selva Ganapathy, whose son secured more than 90 percentile in NEET but missed a government medical college by 0.25 cut-off points said that "I have to pay at least Rs 1 crore as tuition fee. The total cost may go up by another Rs 25 lakh." 
 
When contacted, state health department officials said that private colleges had independence of deciding their fee structures.

During this time, she woke up at 4 a.m. and studied for at least 10-12 hours each day.Some prefer to take an easier route.The Journal found that several students had paid $15,000-20,000 to illegally look at the question paper before the exam. BI could not independently verify the figures.The police made multiple arrests related to exam cheating after results showed that 67 people received perfect scores in the NEET exams this year."Question papers are sold at extravagantly high prices," Ashok Rathore, a police officer who investigated cheating linked to India's medical school exam, told the Journal. "It's a nexus of desperate students, parents, tuition centers and printing presses."<h2 id="378edaf6-be36-458e-8847-661e66638c81">Leaked questions</h2>One student told BI that several Telegram channels dedicated to exam prep saw messages encouraging students "struggling with exams and don't have time for studies" to get in touch for "help.""My friend said he was asked to pay around 15,000 rupees ($180) to enter the private channel where they shared the questions," she said.BI reached out to the Telegram account offering "help". The person said they can provide next year's medical entrance exam questions for around 1 lakh rupees ($1,200).High ranks in these exams mean coveted "seats" in medical colleges operated by the state and national governments. Those with money can still legally obtain places in private medical colleges if they pay fees ranging from $115,000 to $145,000.However, some students with the financial capacity prefer cheating and getting a government seat instead."It makes very good economic sense," a senior medical advisor with knowledge of the matter told BI. "The question paper will be given for about 25 lakh rupees (around $29,000). For that much, they get a free seat in a government college where they only have to pay around 16,000 rupees ($190) per annum.""For the entire five-year degree, that still only comes to around one lakh rupees ($1191), so of course rich students would rather do that instead of paying their way into private medical schools."<h2 id="4ff61c3d-756d-47c9-8f47-2f6be9f1f6a0">Earning a 'merit' seat</h2>The advisor — who preferred to remain anonymous but whose identity is known to BI — also said there is a significant amount of respect that comes with having "earned" a merit seat instead of paying their way into a private "management" seat."Unfortunately, there are very few objective metrics that people have as outsiders to judge the competence of their doctors, especially at a time when everybody in India sits with an MBBS board outside their clinic," agreed Asish George, a doctor who cleared the entrance exam in 2014."For those people, the fact that someone cracked a highly competitive entrance exam and got in would inspire more confidence than someone who paid their way through the whole thing."According to the Journal, authorities in India have tried to install video cameras inside exam halls and increased their monitoring of social media to catch cheaters. But many are still finding ways to illegally gain the upper hand, at a high price. The NTA did not immediately respond to a request by BI for comment.
