A division bench of Justices Suresh Kumar Kait and Neena Bansal Krishna directed the Transport Department to refrain from taking any coercive measures against Rapido and other ride-sharing platforms until a comprehensive policy is formulated. In February, the app-based aggregators were prevented from plying bike taxis on the road without commercial permits. The Transport Department, ordering an immediate halt to the bike taxi services provided by these platforms, had warned that any violation will result in penal action. The public notice by the Transport Department said that the companies defying the orders will be fined up to Rs 1 lakh, as the use of bikes for commercial purposes violated the Motor Vehicles Act, 1988. Following the High Court decision, Uber has expressed its gratitude towards the court's order providing protection to the company against coercive actions regarding its bike taxi service in the capital city. "We welcome the High Court's order to give Uber protection from coercive action on bike taxis in Delhi. This will bring relief to drivers on our platform whose livelihood had been impacted by the ban as also to the hundreds and thousands of riders who choose to ride on Moto for affordability and last mile connectivity. At the same time, passengers have rearranged travel plans, taking advantage of travel waivers issued by the airlines allowing changes and cancellations without fees.When a passenger cancels a ticket under the travel waiver, they can typically get a credit for the value of the ticket to use toward a future flight. Typically, customers will have about a year to use the credit - on Friday, Delta extended that to two years for customers who were originally scheduled to travel in March, April, or May.But when an airline, rather than the customer, cancels the flight, US Department of Transportation rules require the airline to offer a refund to passengers. While there is some leeway if the airline can provide another flight within the same day, most airlines will still allow a refund if the rescheduled flight is much earlier or later than the original.The rule applies to every US airline, and on flights to or from the US operated by a foreign airline.However, as airline revenue has taken a serious hit during the outbreak, some passengers have complained that getting refunds for canceled flights is becoming a challenge.According to an official enforcement notice issued by the DOT, the department has received "an increasing number of complaints and inquiries from ticketed passengers, including many with nonrefundable tickets, who describe having been denied refunds for flights that were canceled or significantly delayed."In most cases, passengers said they were told by the airline that they would only receive vouchers or credits for future travel which, due to the current travel reductions and restrictions, couldn't be used anytime soon."The obligation of airlines to provide refunds, including the ticket price and any optional fee charged for services a passenger is unable to use, does not cease when the flight disruptions are outside of the carrier's control (e.g., a result of government restrictions)," the Department said in a statement.It added that the extreme nature of the current crisis for the industry was not an excuse to suspend the refund rule."Airlines have long provided such refunds, including during periods when air travel has been disrupted on a large scale, such as the aftermath of the September 11, 2001 attacks, Hurricane Katrina, and presidentially declared natural disasters," the enforcement notice said. "Although the COVID-19 public health emergency has had an unprecedented impact on air travel, the airlines' obligation to refund passengers for canceled or significantly delayed flights remains unchanged."Airlines that have already issued vouchers in lieu of offering a refund are required to contact passengers and offer the alternative.Several airlines have recently changed their refund policies in an effort to hold onto liquidity rather than offering refunds, where possible.For instance, JetBlue <a href="https://thepointsguy.com/news/jetblue-no-cancel-fee-coronavirus/">implemented a temporary policy</a> in which it would no longer offer refunds if an alternative flight was available within 24 hours, according to The Points Guy. United <a href="https://thepointsguy.com/news/united-schedule-change-policy/">began offering credits</a> instead of refunds for cancellations, saying it would provide a refund if the credit was not used within a year. US Transportation Department to airlines: Don't 'forget' to refund customers if a flight is canceled

<keyword id="461594" type="ORGANIZATION" weightage="60" keywordseo="regional-transport-offices">Regional Transport Offices</keyword> in the national capital are set to go cashless from January when fees for all services including driving licence, auto permit and fitness certificate can be paid electronically. 
 The <keyword id="62110" type="ORGANIZATION" weightage="20" keywordseo="transport-department">Transport Department</keyword> has started installing Point of Sale (PoS) machines at its zonal offices and the trial run of the cashless transaction system is being carried out at some places. 
 "From January, people coming to <keyword id="48945" type="ORGANIZATION" weightage="20" keywordseo="RTO">RTO</keyword> offices can pay fee of various services -- permits, driving licence, fitness certificates - using their debit, credit cards. Applicants won't be required to make payments in cash," a senior government official said. 
 
There are 14 zonal offices of the Transport Department in the city. The official said that the move would ensure hassle-free services for the people of Delhi. 
 
The step is in line with the Delhi government's plan to bring all departments under cashless transaction system. 
 
"At present, e-PoS machines are being installed at all zonal offices. Besides, computer software of the department is also being updated in view of the cashless transactions," the official said. 
 Earlier this month, Transport Minister <keyword id="6374609" type="UNKNOWN" weightage="20" keywordseo="Satyendar-Jain">Satyendar Jain</keyword> had directed his department to start accepting fees and payments in the form of bank drafts and pay orders for all transport services in view of cash crunch after demonetisation.

RTOs to go cashless
by next month

The Delhi High Court will today hear the appeal of <keyword id="1042120" type="PERSON" weightage="100" keywordseo="Uber">Uber</keyword> and <keyword id="6362049" type="UNKNOWN" weightage="100" keywordseo="Ola-Cabs">Ola Cabs</keyword> against the ban imposed on them by Delhi’s <keyword id="62110" type="ORGANIZATION" weightage="60" keywordseo="transport-department">Transport Department</keyword>. On January 1, the Transport Department had refused to lift the ban, saying “there are no grounds to review the ban imposed.” 
 
The Delhi government had banned all web-based taxi operators in December last year after a taxi driver working with Uber allegedly raped a woman. Uber and Ola had approached the Delhi High Court requesting quashing of the ban orders. 
 
The Transport Department had said in its order: "They (web-based taxi operators) provide a simple taxi service by transporting people from one point to another through a vehicle driven by a driver for a fee, which is collected by the petitioner company directly from the passenger. Being a taxi service provider they are required to follow the law of the land and by using an AITP (All India Tourist Permit) taxi for local point to point drop, as in the present case, the petitioner has violated the prevailing law of the land and as it was not registered, which again was a violation.”

Delhi High Court To Hear Uber And Ola Cabs Appeals Today

A three-day deadline has been has been set by the <a href="http://www.businessinsider.in/searchresult.cms?query=Transport+Department&amp;sortorder=effectivedate">Transport Department</a> for app-based cab aggregators to stop offering <a href="http://www.businessinsider.in/searchresult.cms?query=carpool&amp;sortorder=effectivedate">carpool</a> or shared services to consumers as the services are in violation of the <a href="http://www.businessinsider.in/searchresult.cms?query=Motor+Vehicles+Act&amp;sortorder=effectivedate">Motor Vehicles Act</a> and hence cannot be allowed. 
 
According to the Transport Commissioner MK Aiyappa after holding an hour-long meeting with the representatives of aggregators and sections of drivers, told the media that the cabs cannot pick up from and drop passengers at multiple locations before closing each trip. 
 
He also said that the aggregators have asked for three days to make changes in the software that powers the app t which the ministry has conceded the demand and said the transport officials will start booking the violators after the period. 
 The department's decision also follows strong protests from the city's transport utility <keyword id="6371543" type="COMPANY" weightage="100" keywordseo="BMTC">BMTC</keyword>. The letter from BMTC managing director Ekroop Caur says revenues have been hit because of carpool offered by aggregators as well as by other private operators. 
 
"They are also offering services with fixed schedules on specific routes - for example Hebbal to Marathahalli. That is not allowed at all," she told ET. 
 
The cab aggregators, operates under the contract carriage licence which doesn’t allow others to board the cab midway. The stage carriage permit, on the other hand, allows the vehicle (bus) to pick up and drop passengers along its scheduled route. 
 
So this means that BMTC has the exclusive right to pick up and drop a pool of commuters in the city and the permits are issued under the Motor Vehicles Act which is a Union Government legislation. 
 The aggregators also have plans to approach the Union Government to amend <keyword id="54414" type="ORGANIZATION" weightage="100" keywordseo="Motor-Vehicle-Act">Motor Vehicle Act</keyword>. 
 
At the meeting with the Transport Commissioner, drivers also requested the department's intervention with the aggregators on the minimum trips they are required to make and the drop in incentives.

NEW DELHI: The Delhi transport department has issued a show-cause notice to <keyword id="42747" type="DOMAIN" weightage="20" keywordseo="Tata-Motors">Tata Motors</keyword>, seeking its reply in connection with a complaint that one of its electric car models failed to meet the specified range on a single charge, officials said. The complainant claimed that the model (Nexon EV) of the electric car purchased by him from a dealer at the <keyword id="6412146" type="COMPANY" weightage="20" keywordseo="safdarjung-enclave">Safdarjung Enclave</keyword> and registered on December 3, 2020 has failed to provide the specified 312-km range on a single charge, a <keyword id="1389125" type="POSITION" weightage="20" keywordseo="senior-transport-department-officer">senior transport department officer</keyword> said."It has been informed that while the <keyword id="4215553" type="PERSON" weightage="20" keywordseo="vehicle-model">vehicle model</keyword> is specified to provide a 312-km range on a single charge, the vehicle owned by the said customer has never provided a range of more than 200 km," the show-cause notice issued to Tata Motors read. The vehicle owner, a resident of Najafgarh, also claimed that he has "duly followed" various advices of the dealer but no improvement was noticed, despite best efforts."Therefore, a show-cause notice is issued as the vehicle has failed to provide an optimal range to the consumer as promised by the OEM (original equipment manufacturer," the notice said. The notice has directed the OEM to depute its representative to appear before a transport department officer at 12 noon on February 15.In case no representative of the OEM appears before the transport officer on the designated date and time, further action including "delisting" of the said model from the subsidy-eligible e-vehicles' list can be considered, the notice stated. According to the Delhi Electric Vehicle (EV) Policy, notified by the transport department on August 7, 2020, a purchase incentive of ₹10,000 per kWh of battery capacity is provided on buying an electric four-wheeler with a cap of ₹1,50,000 per vehicle.The owners of the first 1,000 e-cars to be registered in Delhi after the issuance of the policy will be eligible for the incentive, officials said. The electric car model under question was approved under the eligibility conditions of the Delhi EV Policy .A Tata Motors spokesperson said the notice was received and "all possible measures" are being taken to address the concern.The range specified on a single full charge (312 km) for Nexon EV is on the basis of the certification received from the <keyword id="131330" type="COMPANY" weightage="20" keywordseo="Automotive-Research-Association-of-India">Automotive Research Association of India</keyword> (ARAI), which is the official body that independently tests all mass-produced vehicles under standard test conditions, before those can be offered to customers, he said.The actual range achieved in EVs is dependent on the usage of the air-conditioner, individual driving style and the actual conditions in which the vehicle is driven. Delhi Government issues notice to Tata Motors over complaint from Nexon EV owner

<div class="KonaFilter image-container float_right"><div class="image">NTSB</div></div>Asiana Airlines has been penalized $500,000 for failing to assist family members of passengers on a flight that crashed last year at San Francisco airport, federal transportation officials said Tuesday.
The fine announced by the US department of transportation was a first: No airline has broken US laws that require prompt and generous assistance to the loved ones of crash victims.
Three people died and dozens were injured on 6 July, 2013 when Asiana Flight 214 clipped a seawall while landing.
An investigation by the department of transportation concluded that some family members had not been contacted two days after the crash, and it took five days to reach the families of all 291 passengers.
"The last thing families and passengers should have to worry about at such a stressful time is how to get information from their carrier," US transportation secretary Anthony Foxx said in a prepared statement.
Many of the families live in South Korea or China, meaning the airline was their main source of information on the crash half a world away.
In a statement emailed to the Associated Press, Asiana spokeswoman Hyomin Lee said, "Asiana provided extensive support to the passengers and their families following the accident and will continue to do so."
According to a consent order the airline signed with the department, Asiana will pay $400,000 in a fine and gets a $100,000 credit for "costs in sponsoring multiple industry-wide conferences and training sessions in 2013, 2014 and 2015, to provide lessons learned".
Federal investigators also said Asiana did not actively encourage contact from families, failing to widely publicize a toll-free help line until the day after the crash. When family members did call, they were initially routed to a reservations line rather than a crisis hotline.
Asiana also lacked translators and personnel trained in crash response, the transportation department found.
In the late 1990s, after airlines were roundly criticized for ignoring desperate requests for information after crashes, Congress required carriers to dedicate significant attention to families of passengers.
Last fall, the AP reviewed plans filed by two dozen foreign airlines and found cases in which carriers had not updated their family assistance plans as required.
Since AP's story, several airlines have updated family assistance plans and filed new paperwork with the department of transportation. Among them is Asiana's bigger rival, Korean Air.

<ul class="summary-list"><li>A Russian businessman claimed the UK detained his superyacht to look "tough," Bloomberg reported.</li><li>The $50 million vessel was detained by the UK last March, though its owner hasn't been sanctioned.</li></ul>A wealthy Russian businessman who wasn't featured on any sanctions lists following Russia's invasion of Ukraine has claimed <a href="https://www.businessinsider.com/russian-businessman-superyacht-seized-uk-government-awards-ceremony-2022-3">the UK detained his luxury superyacht</a> to look "tough," <a href="https://www.bloomberg.com/news/articles/2023-07-13/russian-tycoon-says-uk-seized-his-canary-wharf-superyacht-just-to-look-tough?srnd=wealth">Bloomberg</a> reported.Phi, a 192-foot superyacht worth around $50 million, was detained by the UK government last March after Russia invaded Ukraine and the UK banned all Russian-owned or -operated ships from its ports.The UK's National Crime Agency had declined to name Phi's owner, merely saying that he was a Russian businessman who kept his ownership of the vessel "deliberately well hidden" and who hadn't been sanctioned by the UK.Court filings say that Sergei Georgievich Naumenko, a Russian property developer, is the beneficial owner, though <a href="https://www.ft.com/content/b6a478a0-e82a-4fb9-93cf-c0c41b4b4737" target="_blank" rel="nofollow noopener">The Financial Times</a> previously reported the vessel was ultimately owned by Vitaly Vasilievich Kochetkov, the founder of Motiv Telecom.Phi has been moored in Canary Wharf, London's financial hub, since the end of 2021. Its detention last year <a href="https://www.businessinsider.com/russia-superyacht-sanction-phi-phantom-london-captain-italy-ukraine-boat-2022-4">means</a> that it remains the property of the owner but isn't allowed to leave. In late March this year, <a href="https://www.businessinsider.com/russia-sanction-ukraine-superyacht-phi-london-uk-suing-2023-5">Naumenko sued the UK's transport department</a>, asking the court to let him move vessel and award him undisclosed damages.<div type="image" title="Phi superyacht London" height="3120" width="4160" msid="101833306" hostid="261"></div>Naumenko's lawyers have argued that by detaining the vessel, the UK government is trying to push him to criticize the Russian government, Bloomberg reported."Disproportionate action against individuals cannot be justified by a generalized desire to appear tough, whether that message is intended for consumption by the domestic electorate or elsewhere," his lawyer Nigel Giffin said in court filings viewed by Bloomberg.Naumenko has said that he has no connections with Russian President Vladimir Putin.But the UK's Department for Transport disagrees. "The system of patronage under President Putin's regime means that Mr. Naumenko was unlikely to have made and retained such a level of wealth without showing loyalty and directly or indirectly benefiting from the Russian regime," Jason Pobjoy, a lawyer for the department, said in court documents, per Bloomberg.At the time of Phi's detention, Grant Shapps, the UK's then-secretary of state for transport, <a href="https://www.tiktok.com/@grantshapps/video/7080487162440928518" target="_blank" rel="noopener">said</a> that Phi belonged to a "Russian oligarch" and "friends of Putin."Pobjoy said that detaining a superyacht could influence whether other wealthy Russians continue showing political support to Putin, per Bloomberg.
