The ban appears to only apply to sponsored content, not general videos discussing cryptocurrencies and investments. <a href="https://www.tiktok.com/@errol_coleman?lang=en">Errol Coleman</a>, a TikTok financial content creator with 264,000 followers, said the recent news that a <a href="https://www.insider.com/faze-clan-save-the-kids-cryptocurrency-scam-controversy-2021-7">large esports organization was promoting a token that could have been a scam</a> on social media may have propelled TikTok to tighten its policies."There are many accounts now promoting questionable cryptos and other investments," he added. "I believe that is where TikTok is seeing the issue." Coleman doesn't post sponsored investment content and therefore won't be affected by the ban. TikTok's ban comes as financial regulators warn investors to watch out for fraudulent investing advice and information. ‘Blockchain gamers have the same potential as YouTube streamers, TikTok/Instagram influencers’

<a href="https://www.scmp.com/topics/india/">Indian</a> courts and political parties are calling for Chinese company ByteDance's most popular mobile app <a href="https://www.scmp.com/tech/apps-social/article/3001893/how-short-video-app-tiktok-became-first-chinese-made-app-take">TikTok</a> to be banned. On Tuesday, The Economic Times newspaper reported that India's Ministry of Electronics and Information Technology had asked Google and Apple to pull video social media platform <keyword id="6762469" type="UNKNOWN" weightage="20" keywordseo="TikTok">TikTok</keyword> from its mobile application stores. The South China Morning Post was unable to independently verify the report. The news follows an order of the <keyword id="6360667" type="UNKNOWN" weightage="20" keywordseo="madras-high-court">Madras High Court</keyword>, located in the southern state of Tamil Nadu, on April 3 that banned TikTok over concerns about children using the app being vulnerable to exploitation by sexual predators. TikTok is rated 12+ on the Apple app store and has a "teen maturity" rating on Google Play, but United States-based Common Sense Media, which reviews tech products for families, recommends that children be at least 16 years old to use the app. In February, the US Federal Trade Commission <a href="https://www.scmp.com/news/china/article/2187990/chinese-owned-video-sharing-tiktok-app-pay-us57-million-fine-settle">fined TikTok US$5.7 million</a>, the largest such sum in a child privacy case, for illegally collecting personal information from children under the age of 13. Meanwhile, the Delhi state unit of India's ruling Bharatiya Janata Party (BJP) complained to the country's Election Commission on March 29 that ByteDance, which it identified as a Chinese company, was "interfering in the Indian election process through its social media applications". The BJP cited Facebook's takedown of 11,000 advertisements from another of the company's apps - Helo - for violation of its rules concerning transparency in political spending. Helo's adverts featured doctored images of politicians accompanied by sensationalised text. In a statement, ByteDance said it was committed to respecting local laws and regulations and maintaining a safe and positive in-app experience for its users in India. "We have faith in the Indian judicial system and we are optimistic about an outcome that would be well received by over 120 million month active users in India, who continue using TikTok to showcase their creativity and capture moments that matter in their everyday lives," the company said. ByteDance denied that its Helo platform has been sharing any political adverts, saying the company had promised India's Election Commission it would abide by the country's code of conduct. "We are not serving any paid political advertisements during this election period and are not proactively onboarding any political figures or parties on our platform." Out of all adverts generated from Helo since its launch last June, ads related to politics amounted to "less than 0.1 per cent", said the company. ByteDance is the world's largest internet start-up - valued at US$75 billion in its latest funding round, knocking US-based Uber, valued at US$72 billion, into second place. According to mobile app intelligence company Sensor Tower, 88.6 million of TikTok's 188 million new users in the first quarter of 2019 were from India - a more than eightfold year-on-year increase. By comparison, just 13.1 million new TikTok users over the same time period were based in the US. TikTok was also the third most downloaded app in the world during the first quarter of 2019. As of Tuesday, it was the second most popular free Android app in the Google Play store in India, while Helo was ranked 11th. ByteDance also offers short video product Vigo Video to Indian users. Helo, launched in June, is a social media platform created with Indian small towns and rural areas in mind - offering content in 14 languages. It is currently the subject of a legal case filed by the makers of ShareChat, which describes itself as the largest "Indian-language social media platform" and ranks seventh on Google Play store in India. "We believe Helo is a copycat app of ours," said Berges Y Malu, head of ShareChat's public policy team. ByteDance denies the allegation and the case is still being heard by the Delhi High Court. A representative for Helo said that the number of original adverts cited by the BJP in its complaint to the Election Commission that <a href="https://www.scmp.com/topics/facebook">Facebook</a> had found problematic amounted to 770, with translations across multiple languages increasing that number to 11,000. The app, which has brought entertainers, journalists and news organisations on board by providing them verified handles, has decided not to do the same for politicians and political entities. The representative said the idea was to promote entertainment-related content. Helo has not placed adverts featuring political content since the Indian electoral process began. "Out of all the ads that have been generated from Helo since we launched in June 2018, unique ads citing political mentions amount to less than 0.1 per cent. These ads were all generated prior to the declaration of general elections by the Election Commission of India and the enforcement of the Model Code of Conduct," said Helo in a statement. The first major call to ban TikTok in India was made in February by the Tamil Nadu government, citing obscenity as the reason. However, responses from politicians indicated that they were already annoyed at the political content being generated by the app's users, who had posted lip-synched videos to political speeches. "I will be the happiest if TikTok is banned. They mock someone like me most on that platform. The app may have been designed to make people happy, but it is often crossing the limits of decency," said Tamilisai Soundararajan, who heads the BJP - the party of Prime Minister <a href="https://www.scmp.com/topics/narendra-modi">Narendra Modi</a> - in Tamil Nadu state. After Tamil Nadu banned TikTok on April 3, the app's makers appealed to the Supreme Court of India, which refused to suspend the ban immediately but will hear the matter again on April 22. Meanwhile, the Madras High Court on Tuesday appointed an independent counsel to assist with the case as the app's lawyers appeared before it to appeal. The lawyers told the court that TikTok had removed 6 million videos based on a review of its Indian users; the court responded by saying that the ban will remain in place for now. In a statement, TikTok said it welcomed the decision of the Madras High Court to appoint an independent counsel. "We have faith in the Indian judicial system and we are optimistic about an outcome that would be well received by over 120 million monthly active users in India, who continue using TikTok to showcase their creativity and capture moments that matter in their everyday lives," it said. Indian politicians accuse China-made app Helo of election interference and call for TikTok to be banned

Indian short-video making apps like <keyword id="6393600" type="PERSON" weightage="20" keywordseo="Josh">Josh</keyword>, <keyword id="8678883" type="UNKNOWN" weightage="20" keywordseo="moj">Moj</keyword>, <keyword id="9555198" type="UNKNOWN" weightage="20" keywordseo="MX-TakaTak">MX Takatak</keyword> and <keyword id="2368386" type="COMPANY" weightage="20" keywordseo="Roposo">Roposo</keyword> have brought back 97 per cent of TikTok user base in the country onto their platforms, largely from small cities and towns, a new report showed on Thursday. Indian short-form apps have also successfully retained 67 per cent of the TikTok era users and have onboarded around 30-35 per cent new users over the past year. This has been a result of increased supplier push and aggressive marketing by platforms, according to the latest report by Bengaluru-based RedSeer Consulting. "Daily active users (DAUs) increased upto 97 per cent of June 2020 levels as a result of aggressive marketing and user acquisition by platforms. However, the time spent on the other hand has gradually increased, reaching 55 per cent of June 2020 levels," the report mentioned. Josh leads both on influencer and user-end driven by strong performance in the Hindi belt and Tier-2+ cities. Moj, has been a strong gainer across consumer and business metrics, when compared to the last quarter. "On the other hand, Roposo has shown strong performance in Tier-1 cities compared to the smaller ones," said the report. MX <keyword id="7638068" type="COMPANY" weightage="20" keywordseo="Takatak">Takatak</keyword> lead in the net promoter score (NPS) in the metro cities. The platform has held challenges and hashtag events similar to TikTok, to gain market share. Overall, 60-62 per cent of the shortform users are from tier 2+ cities. While Indian platforms have come a long way in the last few months, they have more scope to improve their content quality and product experience. The study shows that 75 per cent current short-form video users will likely stick to these domestic apps and are unlikely to switch back to Chinese apps even if the ban was lifted. "In less than one year post-Tik Tok ban, Indian platforms have shown a strong V-shaped recovery, bouncing back to 100 per cent of pre ban daily user base," said Ujjwal Chadhury, associate partner at RedSeer Consulting. But the job is far from done. "The players still have to reach the global and cross sector benchmarks on engagement and retention- which will further grow the monetisation potential for the entire ecosystem," Chadhury added. With strong network effects, the user base is growing fast, fuelling ecosystem growth, leading to a large monetisation potential for both influencers and platforms. Elite influencers with more than 10 million followers have a monthly earning of around $20,000-40,000. "Influencers with 1 million followers can earn upto $1000-2.500 while budding creators with less than 1 million followers can earn $40-200," the report said. Josh, Moj, Roposo and other short video apps lap up 97% of TikTok's user base in India

<ul class="summary-list"><li>Posting videos showing the before-and-after stages of rhinoplasty has become a viral trend on <keyword id="6762469" type="UNKNOWN" weightage="60" keywordseo="TikTok">TikTok</keyword>.</li><li>#NoseJobCheck has over one billion views on the social media platform.</li><li>Videos promoting rhinoplasty are appearing on the For You Page of teenagers as young as 14.</li><li>Plastic surgeons are enlisting the help of marketing agencies to ensure that these videos reach a younger audience.</li><li>Charities have expressed their concern that minors are seeing "completely unacceptable" videos.</li><li>TikTok has banned <keyword id="21893" type="PERSON" weightage="60" keywordseo="cosmetic-surgery">cosmetic surgery</keyword> adverts but these videos appear to bypass those rules.</li></ul>TikTok, the viral video-sharing app that is famously popular with young teenagers, claims to have banned <keyword id="6397377" type="UNKNOWN" weightage="60" keywordseo="plastic-surgery">plastic surgery</keyword> adverts.Cosmetic surgeons, however, have found a way to bypass the app's existing rules and regulations and promote major surgery that can be psychologically damaging to TikTok's youthful audience. So many have been successful in doing this that videos promoting various plastic surgery procedures - particularly rhinoplasty, changing the shape of the nose - are widely available and incredibly popular.Many <keyword id="6354750" type="UNKNOWN" weightage="60" keywordseo="health">health</keyword> professionals find this deeply troubling and even predatory.To test how readily these videos were available to minors, Insider created a TikTok account, set the age at 14-years-old, and used the application to see how long it would take for one of these videos to appear.After just eight minutes of scrolling, a promotional video for a US-based plastic surgeon was posted on our For You Page - TikTok's personalized feed of relevant videos.<div type="image" title="tiktok plastic surgery" height="3152" width="1500" msid="80201297" hostid="261"></div><h2>The popularity of plastic surgery videos on TikTok</h2>Plastic surgery videos are endemic on TikTok. The hashtag #plasticsurgery has over 3.8 billion views.One particular procedure, however, has become a viral trend on the app - rhinoplasty.The hashtag #nosejobcheck, which mainly consists of videos showcasing before-and-after clips of nasal surgery, has accumulated over one billion views on the platform. The hashtag #nosejob, which hosts similar videos, has over 1.6 billion views.There's even a unique '<keyword id="26784" type="PERSON" weightage="60" keywordseo="nose-job">nose job</keyword> check' sound. Over 120,000 videos using this sound have been published on TikTok since last October.The platform's most popular user, 16-year-old <keyword id="9054776" type="UNKNOWN" weightage="60" keywordseo="charli-damelio">Charli D'Amelio</keyword>, used the sound after getting reconstructive surgery on her nose in July. She broadcast her transformation video to her fanbase, which has now received 14.8 million likes. The videos, typically only 15 seconds in length, show the patient's pre-surgery nose, post-surgery bandages, and - finally - the reshaped nose.This trend's popularity means that these videos are appearing on the For You Pages (FYP) of millions of TikTok users. The FYP is a personalized feed of content, where a combination of popular and recommended content appears.<h2>TikTok's young users are being exposed to plastic surgery videos</h2>While #nosejobcheck is primarily used by creators sharing their experiences of getting nose jobs, plastic surgeons are also using it to market their work and appear on the FYPs of potential patients. Some of those on the receiving end of these marketing videos are inevitably very young, given TikTok's target audience.Teenagers and children make up the largest group of active TikTok users, according to the consumer data agency <a href="https://www.statista.com/statistics/1095186/tiktok-us-users-age/">Statista.</a> Statista estimates that under-19s make up 32.5% of all users. According to <a href="https://www.nytimes.com/2020/08/14/technology/tiktok-underage-users-ftc.html">The New York Times</a>, a third of its' users may even be 14 or under.The app requires TikTok users to be 13 but a lack of age verification makes this easy to bypass.While the app has an infrastructure to prevent minors from seeing unsuitable content, cosmetic surgery videos that aren't paid adverts and don't violate TikTok's <a href="https://www.tiktok.com/community-guidelines?lang=en">community guidelines</a> are technically allowed.As long as the videos are not "graphic" and don't contain "gore," they do not appear to breach TikTok's rules. <h2>Plastic surgeons are promoting these procedures to teenagers</h2>Dr. Kim Patrick Murray, a Miami-based plastic surgeon, is one of the medical practitioners who uses the app to promote his followers' surgery. In recent months, he has seen an uptick in preliminary consultation thanks to social media.Some of these consultation requests are coming from under-18s.This doesn't bother him."Rhinoplasty is a relatively tame topic compared to a lot of other stuff on TikTok," he told Insider. "If you want to look at the negatives, you have worse things like teenagers dancing in bikinis." Murray performs the surgery on patients as young as 14."Operating on somebody that young could be a little controversial," he said. "But for me, the advantages of considering rhinoplasty at that young age allow the person to grow and be comfortable in their own skin and that far outweighs the negatives," Murray added.The plastic surgeon said that if a teenager was struggling with their self-esteem due to an overly-pronounced nose, saw one of his TikToks, and decided to seek surgery, he'd view that as a "positive" thing.Dr. Antonis Kousoulis, a director at the Mental Health Foundation, disagrees. He believes the promotion of cosmetic surgery to minors is deeply troubling.He told Insider: "Whether it's through paid promotion or medical practitioners using hashtags, we think it's completely unacceptable and inappropriate that videos like these are reaching young people under the age of 18."Kousoulis continued: "A lot of the time, these operations are promoted based on wellbeing, saying that they will improve how you will feel about yourself. I would like medical practitioners to be more conscious of who might see their content and to show more thoughtfulness to psychological reasons as to why people are seeking these operations.""We know that a lot of these clinics use fairly predatory techniques when it comes to self-promoting their work and that is a concern," he added.<h2>Some plastic surgeons enlist the help of marketing firms</h2>Plastic surgeons are enlisting marketing firms' help to aggressively promote their procedures to as wide an audience as possible. Frank Olivo, the digital marketing agency sagapixel, advises plastic surgeons on how to go viral on the application.Olivo's company's website offers a<a href="https://sagapixel.com/social-media/tiktok-plastic-surgery/"> guide for plastic surgeon</a>s on how to use Tik Tok effectively. In the guide, plastic surgeons are advised on how to reach a younger audience.It reads: "You always want to tailor content to what will provide value to its audience, so procedures that are most popular for younger audiences will perform the best on TikTok."Olivo thinks TikTok is a great marketplace for plastic surgeons to reach all kinds of clients, including young people. "It lends itself to highly visual marketing like plastic surgery," he told Insider.But he admits that, personally, he'd prefer his children not to be exposed to #nosejobcheck videos.He said: "As a parent, I'm not crazy about my daughter growing up and seeing these sorts of videos."Ashton Collins, the director of the responsible plastic surgery charity Save Face, shares these concerns. She told Insider: " The process of getting plastic surgery is being glorified. These videos are absolutely damaging and trivializing."She added: "You'd expect regulated plastic surgeons to have more accountability having first-hand seen the negative impacts that plastic surgery can have on someone's psychology."<h2>The negative impact of videos promoting plastic surgery</h2>One person who has experienced plastic surgery's negative impacts is Mariamane Akopyan, a college student from San Jose, Ca.As a minor, she wanted to get plastic surgery after seeing "perfect nose jobs" online. At 18, she went to Ukraine to get rhinoplasty surgery. This resulted in a botched job, which left her unable to breathe properly and with a "bit of a crooked nose."Akopyan had to get corrective surgery and shared the video on her TikTok. "It was honestly terrifying that so many of the people that were asking questions about getting a nose job were really young girls," she told Insider.Ruby Mann, who had rhinoplasty surgery three months after seeing #nosejobcheck videos on TikTok, agrees."These videos make nose jobs look easier than they actually are. Major surgeries, like mine, are not to be taken lightly. I had a painful nose for two weeks, it hurt even with medication, and it can take almost a full year to recover," she told Insider.Mann continued: "I think the hashtag could make someone want to get a nose job after watching them. Both the <a href="https://www.collins.senate.gov/newsroom/collins-blumenthal-introduce-bill-ban-pfas-chemicals-cosmetics">No PFAS in Cosmetics Act</a> and the<a href="https://www.congress.gov/bill/115th-congress/senate-bill/1113"> Personal Care Products Safety Act</a> would amend the FDA to have further regulatory power over the chemicals used in cosmetic products. The No PFAS in Cosmetics Act would ban the intentional use of PFAS chemicals in cosmetics. The Personal Care Products Safety Act would require companies to submit their ingredients to the FDA, allowing the agency to determine potential <keyword id="6354750" type="UNKNOWN" weightage="60" keywordseo="health">health</keyword> risks. Exposure to <a href="https://www.epa.gov/pfas/basic-information-pfas">PFAS is linked to health concerns</a> such as cancer, hormone imbalances, fertility issues, and obesity. According to the study, the cosmetic products most likely to contain PFAS are waterproof mascara and liquid lipstick. It's unclear which products were purchased from which store. Alexandra Kowcz, chief scientist at The Personal Care Products Council, <a href="https://www.personalcarecouncil.org/statement/statement-by-alexandra-kowcz-chief-scientist-personal-care-products-council-on-pfas-in-cosmetics-and-personal-care-products/">said in a statement</a> that PFAS chemicals are used in small amounts for product consistency and texture, but that the association does support banning certain PFAS from use in cosmetics. Ulta Beauty includes a section on its website called <a href="https://www.ulta.com/conscious-beauty/clean-ingredients/">clean ingredients</a>. Products listed within this category are <a href="https://www.ulta.com/conscious-beauty/clean-ingredients/made-without-list.html">made without</a> 24 potentially harmful ingredients, including PFAS chemicals. Sephora also launched a <a href="https://www.sephora.com/beauty/clean-beauty-products">"Clean at Sephora"</a> program in 2019. All brands marked with the program's green seal are made without 32 types of chemicals. PFAS chemicals are not included on this list. Similarly, Target adheres to an <a href="https://corporate.target.com/corporate-responsibility/planet/chemicals">unwanted chemicals list</a> for what they call their 'essential businesses:' beauty, personal care, baby care, and household cleaning. This list does not include PFAS chemicals. The Cyber Crime <keyword id="48675" type="COMPANY" weightage="20" keywordseo="police-station">Police Station</keyword> registered the case following the direction from a city court on a petition filed by a local journalist. This is believed to be the first case against the leading social media platforms for facilitating spread of hatred and anti-national content in the country. The case against the social media platforms was registered under various sections of the Indian Penal Code (IPC), including for promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony, conspiracy to wage or attempt to wage war, or abetting waging of war against Indian government, obscene acts and songs in public, statements <keyword id="8818833" type="PERSON" weightage="20" keywordseo="conducing">conducing</keyword> to public mischief and criminal conspiracy. Silveri Srishailam, who had filed the petition in a Nampally court seeking action against the three social media apps, claimed that more than 1,200 groups were created after the protests against CAA, NRC and NPR began in the country, which were spreading anti-national content. He even claimed that some Pakistanis were members in these groups. He made <keyword id="8842132" type="COMPANY" weightage="20" keywordseo="twitter-communications-india-limited">Twitter Communications India Limited</keyword> and its India MD Manish Maheswari, WhatsApp Inc and its India head Abhijit Bose, and Tik Tok and its head Nikhil Gandhi the respondents in the case. When asked, a WhatsApp spokesperson shared an earlier statement that the company cared deeply about the safety of its users in India. "WhatsApp has made significant product changes and worked with partners across civil society, engaged with relevant government authorities and other technology platforms to help address the harmful consequences of misinformation," the spokesperson said. Inside sources told IANS that Twitter has not received any information on any such development so far. TikTok said it is looking into the matter. While WhatsApp has 400 million users in India, TikTok has crossed 200 million users. According to Statista, Twitter had nearly 35 million active users in India in 2019. Though the FIR was registered on February 18, the issue came to light on Thursday. A police officer said that notices would be issued to the respondents seeking their comments. The petitioner also sought ban on 42 apps, which he claimed were working against India.

Hyderabad police file criminal case against TikTok, Twitter and WhatsApp for spreading hate

The backlash comes days after Gutman announced her resignation from JLM in a <a href="https://www.instagram.com/p/CJD7CIbn7UN/">video</a> Monday.</li><li>JLM sued Gutman over her personal use of social-media accounts including the @misshayleypaige account affiliated with her brands.</li><li>A complaint, viewed by Insider, said Gutman used the account for personal and promotional posts "as if she were an influencer."</li></ul><keyword id="6" type="ENTERTAINMENT" weightage="60" keywordseo="fashion">Fashion</keyword> company JLM Couture is facing backlash from Hayley Paige fans on social media after sharing a statement addressing its ongoing legal battle with the wedding-dress designer on Wednesday.JLM, which owns Hayley Paige brands, <a href="https://www.insider.com/video-wedding-dress-designer-hayley-paige-banned-from-instagram-account-2020-12">sued the designer</a> - whose full name is Hayley Paige Gutman - over her personal use of social-media accounts affiliated with her brands, including the Instagram account <a href="https://www.instagram.com/misshayleypaige/">@misshayleypaige</a>. The December 15 complaint, viewed by Insider, alleges that Gutman began operating the account, which has 1.1 million followers, "as her own business platform as if she were an influencer" this summer. On Monday, Gutman shared a video on a secondary account, <a href="https://www.instagram.com/p/CJD7CIbn7UN/">@allthatglittersonthegram</a>, announcing her resignation from JLM. In the video, Gutman claimed she had been locked out of her main social-media accounts and barred from using her own name amid legal proceedings with the company.According to the complaint, when she signed an employment agreement in 2011, Gutman granted JLM "the exclusive world-wide right and license to use her name 'Hayley', 'Paige', 'Hayley Paige Gutman', 'Hayley Gutman', 'Hayley Paige', or any derivative thereof [...] in connection with the design, manufacture, marketing and/or sale of bridal clothing, bridal accessories, and related bridal and <keyword id="6358814" type="UNKNOWN" weightage="60" keywordseo="wedding">wedding</keyword> items."Gutman said in her video that the legal battle to negotiate a new contract has been going on for a year and a half, and that, when she signed the agreement in 2011, she did not have a lawyer review the document - a claim that has been refuted by a JLM spokesperson. Speaking to Insider, a JLM representative said "Hayley had a lawyer and the lawyer helped negotiate the contract. She had legal counsel for each and every contract she negotiated."In <a href="https://www.insider.com/video-wedding-dress-designer-hayley-paige-banned-from-instagram-account-2020-12">a separate statement previously sent to Insider</a>, a JLM representative said Gutman is not banned "from accessing the brand's social media accounts."JLM doubled down on these points in its latest statement shared publicly on Instagram.<h2>JLM's statement about its legal battle with designer Hayley Paige Gutman hasn't been received well by her fans, and there was a mix-up when the company posted it to Instagram</h2>According to <a href="https://pagesix.com/2020/12/23/jlm-couture-posts-response-to-designer-hailey-paige-then-deletes-it/">Page Six</a>, JLM shared a statement to @misshayleypaige, the main Instagram account affiliated with Hayley Paige brands, on Wednesday. Page Six reports that the statement was quickly deleted and reposted on JLM's corporate Instagram account."Like many things that glitter and shine, the issues between JLM Couture and Hayley Paige Gutman are multifaceted," the statement says."While we were shocked and heartbroken to see Hayley's video, we feel that the correct negotiations she referred to are a private matter between those parties - in this case between Hayley and Joe," the statement continued, referring to JLM's CEO Joe Murphy. "But in light of some of Hayley's comments in the video, we feel compelled to address a few points.""First, it is documented that Hayley had a lawyer help her review her employment contracts. She consulted with her lawyer prior to signing the contracts," the statement reads. "There were multiple rounds of negotiations between Hayley and JLM until both parties settled on an agreement each felt was fair and mutually beneficial.""Second, Hayley has access to the social media accounts and JLM encourages and would welcome Hayley to continue contributing content that is supportive of the Hayley Paige brands," it says.The statement adds: "Third, we respectfully ask that you allow Hayley, Joe and their attorneys to discuss the details of negotiations privately."Fans of Gutman have left a stream of negative comments under JLM's post."Give her back her Instagram and go your separate ways," one person wrote under the Instagram post."Hayley's name is HER birth right, not JLMs <a href="https://www.instagram.com/explore/tags/canceljlmcouture/">#canceljlmcouture</a>," another added."I'm in business, so I understand contract negotiations and when things go wrong. But to not allow her to use or keep personal things like her name is just wrong," someone else wrote.A representative for JLM told Insider it didn't delete the initial post on @misshayleypaige because of any negative comments, and that the Instagram mix-up was down to "human error.""The statement was posted to @misshayleypaige, the JLM Couture-owned Instagram account for its Hayley Paige wedding gown collection," they said. "It was posted there for a few minutes before the mistake was noticed.""When it was quickly discovered to be posted to the wrong account, JLM deleted it and instantly reposted it to the corporate site," the representative added. "While it was posted on the brand's account, zero replies were received by the company."<h2>Gutman publicly announced her resignation from JLM and addressed their legal dispute in a viral Instagram video</h2>"It is with a heavy heart that I have resigned from my role as head designer of my labels with JLM Couture," Gutman wrote in the caption of her Instagram video, which has been viewed over 2.3 million times since it was posted Monday. "Going forward, I will no longer be associated with any of their products, including the designs and dresses which bear my name."In the video, Gutman said JLM convinced a court to temporarily prevent her from using her name publicly and in a business context."I feel violated and angry," Gutman said. "I think that demanding I turn over an account full of my personal photos and messages was deliberately intended to pressure me."She said JLM was also awarded complete control over her main social-media accounts. The <keyword id="6377259" type="UNKNOWN" weightage="60" keywordseo="Lawsuit">lawsuit</keyword>, however, says JLM had the @misshayleypaige account and other related social-media pages created for business purposes, and maintains that they belong to the company. (In her video, Gutman claimed she created the @misshayleypaige account years ago.)<h2>JLM's lawsuit says the wedding-dress designer was using company social-media accounts like an influencer</h2>The complaint said issues started when Gutman created a TikTok account with the account name "misshayleypaige" in November 2019 and "and subsequently posted videos that did not properly represent the HP [Hayley Paige] brands."The complaint alleges that when JLM's CEO "Joe Murphy advised Gutman that she should post JLM approved content on the Tik Tok account, rather than posting personal images, Gutman responded shortly thereafter by changing the password to the Main IG Account [@misshayleypaige] so that JLM no longer had access."Gutman also changed the Instagram account bio to say it was a "Personal &amp; Creative account" and "removed reference to JLM" sometime in late 2019 or early 2020, according to the lawsuit.In July, the complaint says Gutman started sharing personal posts as well as posts touting "the goods of third parties, such as olive oil, beer and nutritional supplements, none of which were approved by JLM." According to the complaint, Gutman had "been paid for these endorsements, and therefore has profited off the substantial investment made by JLM at JLM's expense." (The complaint says JLM spent millions of dollars on advertising that has helped its social-media accounts grow their follower count and engagement.)Although the complaint says Gutman later restored links to JLM on the Instagram account following a meeting with Murphy in October, she later "removed these links and many hundreds of bridal related posts in a further act of exercising dominion and control over JLM's property" after a November 2 call with Murphy; during this call, the complaint says Murphy told Gutman the account belonged to JLM.Later that month, Gutman refused "JLM's request to add JLM content" to the account, and "insisted that the Main IG Account is her personal account," the complaint says. "Gutman still refuses to return the Main IG Account to JLM, continues to delete JLM related posts on the account, continues to post off-brand content [...] and refuses to post the bridal related content as required by JLM," it reads.<div type="image" title="Hayley Paige Gutman Getty" height="3000" width="2400" msid="79945939" hostid="261"></div>Gutman has also refused to give JLM access to the Pinterest and TikTok accounts under the misshayleypaige name, according to the complaint.JLM Couture previously told <a href="https://pagesix.com/2020/12/21/wedding-gown-designer-hayley-paige-weeps-over-bitter-dispute-with-bosses/">Page Six</a> it had been the sole financial backer of Hayley Paige for nearly a decade and had helped "grow it into a successful wedding gown line."The statement continued: "While negotiating a new employment contract, the two sides disagreed over how much freedom Hayley would have to promote her non-related side businesses on the company site. After Hayley stopped posting JLM content and deprived the company access to the account, we brought the matter before the court. After carefully listening to both sides, a judge granted us the Temporary Restraining Order (TRO). We respect the judge's decision that JLM should have temporary control over the company site and feel the process was fair and equitable."<h2>Gutman told Insider she's undecided on her next steps</h2>"It's unfortunate that JLM continues to make statements that are inaccurate and hurtful," Gutman told <a href="https://people.com/style/jlm-couture-responds-hayley-paige-resignation-video/">People</a> in an exclusive statement. "JLM's statement that they 'encourage' me to post on the @misshayleypaige Instagram account is contradicted by the restraining order that JLM wrote and the Court ordered.""That restraining order - which is public record - prohibits me from using my own personal Instagram account, including prohibiting me from making any posts, without the JLM CEO's written permission," Gutman continued. "I have made my position clear that my personal social media accounts should not be taken away and exploited by a corporate entity. I am grateful to my friends, fans, and followers for sticking with me through this ordeal, and I remain hopeful that JLM will do the right thing and return my social media accounts to me," she said. Speaking to Insider for <a href="https://www.insider.com/video-wedding-dress-designer-hayley-paige-banned-from-instagram-account-2020-12">a previous article</a>, Gutman said she's unsure of her next move, but feels "overwhelmed with gratitude" following the response to her video."I'm going to build a better castle," Gutman told us. "I know I want to continue to serve brides, and I will find a way to do that."She later added: "I was just horrified that JLM was using my account to post their commercial content in my name, and not tell anyone what they were doing. Now, though, I feel surrounded by support.
