The cases, Brnovich vs. Democratic National Committee and Arizona Republican Party vs. DNC, were consolidated for one hour of oral arguments in early March and centered on Arizona laws that throw out provisional ballots filed at the wrong precinct and bar third-party groups from returning mail ballots. The petitioners argued the laws are discriminatory in their disproportionate impact on voters of color.They not only concerned the legality of the two laws in question, but tested the limits of Section 2 itself, which bans voting laws or redistricting plans that result "in the denial or abridgment of the right of any citizen to vote on account of race, color, or membership in a language minority group." Justice Samuel Alito authored the majority opinion, joined by Chief Justice John Roberts, Justice Neil Gorsuch, Justice Clarence Thomas, Justice Amy Coney Barrett, and Justice Brett Kavanaugh. "We think it prudent to make clear at the beginning that we decline in these cases to announce a test to govern all VRA §2 claims involving rules, like those at issue here, that specify the time, place, or manner for casting ballots," Alito's opinion said, adding that "as this is our first foray into the area, we think it sufficient for present purposes to identify certain guideposts that lead us to our decision in these cases." While a US District Court sided with Arizona and upheld the laws, <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2020/01/27/18-15845.pdf">the full 9th Circuit overturned that ruling</a>.The appellate court found that both laws violated Section 2 and had discriminatory impacts against Black, Latino, and Native American voters in Arizona. Applying a two-part results part, the Court found that the plaintiffs proved that the laws "imposed a significant disparate burden" on minority voters, and resulted from "social and historical conditions" that fostered hostile conditions for minorities' voting rights. Under Arizona's out-of-precinct policy, even votes for statewide races at the top of the ticket like president, US senate, and governor, cast in the wrong precinct are not counted.Alito's opinion, however, argued that "the racial disparity in burdens allegedly caused by the out-of precinct policy is small in absolute terms," accusing the appeals court of misleadingly portraying statistics to make the disparity seem larger than it is, and that the state of Arizona has a compelling interest in holding precinct-based voting. The <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2020/01/27/18-15845.pdf">9th Circuit further ruled</a> that the ban on third-party ballot collection was enacted with discriminatory intent, citing the state's "long history of race-based voting discrimination," the legislature's prior attempts to restrict ballot collection, the increase in Latino and Native American voter turnout, unfounded claims of fraud used as a basis to pass the law, and racially polarized voting patterns in the state. The Supreme Court found too that given the availability of early and mail voting in Arizona, the bans on third-party ballot collection do not go beyond "the usual burdens" on voting, and that the plaintiffs challenging the rule "were unable to provide statistical evidence showing that HB 2023 had a disparate impact on minority voters."The Court further reversed the appellate court's finding that the Arizona legislature enacted the ballot collection ban with racially discriminatory intent, writing, "the spark for the debate over mail-in voting may well have been provided by one Senator's enflamed partisanship, but partisan motives are not the same as racial motives."The Court also ruled that the Appeals Court erred in applying<a href="https://www.scotusblog.com/2021/02/justices-to-consider-whether-arizonas-voting-rules-discriminate-against-minorities/"> "the cat's paw" doctrine</a> to the legislature's adoption of the bill, finding the doctrine, <a href="https://www.parsonsbehle.com/images/pdfs/catspaw.pdf">which has roots in employment law</a>, does not apply to legislative bodies. In her dissent, Kagan charged that the majority opinion had effectively re-written the law to blunt its ability to counter discriminatory voting rules. "Today, the Court undermines Section 2 and the right it provides," the dissent said. "The majority fears that the statute Congress wrote is too 'radical'-that it will invalidate too many state voting laws. So the majority writes its own set of rules, limiting Section 2 from multiple directions. Wherever it can, the majority gives a cramped reading to broad language."

While a US District Court sided with Arizona, <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2020/01/27/18-15845.pdf">the 9th Circuit overturned that ruling</a>.The appellate court found that both laws violated Section 2 and discriminatory impacts against Black, Latino, and Native American voters in Arizona. Applying a two-part results part, the Court found that the plaintiffs proved that the laws "imposed a significant disparate burden" on minority voters, and resulted from "social and historical conditions" that fostered hostile conditions for minorities' voting rights. The <a href="https://cdn.ca9.uscourts.gov/datastore/opinions/2020/01/27/18-15845.pdf">9th Circuit further ruled</a> that the ban on third-party ballot collection was enacted with discriminatory intent, citing the state's "long history of race-based voting discrimination," the legislature's prior attempts to restrict ballot collection, the increase in Latino and Native American voter turnout, false claims of fraud used as a basis to pass the law, and racially polarized voting patterns in the state. The partisan implications of the case were clearly delineated in Tuesday's arguments. In response to a question from Justice Amy Coney Barrett questioning the Arizona GOP's standing in the case, Carvin said that the 9th Circuit's decision "puts us a competitive disadvantage relative to Democrats," adding: "<keyword id="6358883" type="UNKNOWN" weightage="100" keywordseo="politics">Politics</keyword> is a zero-sum game. Every extra vote they get through unlawful interpretations of Section 2 hurts us." Similarly, Spiva told Justice Clarence Thomas that the DNC's standing "rests on organizational standing principles, because they have to expend resources in order to overcome the discriminatory effects of these laws." Jacqueline De Léon, staff attorney at the Native American Rights Foundation, <a href="https://www.businessinsider.com/native-american-voters-still-face-widespread-challenges-to-voting-2020-12">previously told Insider in November</a> that while Native voters showed record turnout in Arizona in 2020, they still faced significant barriers to voting. Reservations are divided into chapter houses, or distinct communities within the reservation led by a chapter president. Chapter house boundaries, however, do not always align with the precinct boundaries set by the state, leading some voters to wrongly believe they could vote at their chapter house, a mistake that may force them to cast a provisional ballot.Under Arizona's out-of-precinct policy, even votes for statewide races at the top of the ticket like president, US senate, and governor, cast in the wrong precinct are not counted. <div type="image" title="Arizona election" height="1000" width="2000" msid="81279648" hostid="261"></div>Voters of color, <a href="https://www.businessinsider.com/native-american-voters-still-face-widespread-challenges-to-voting-2020-12">and especially those who live on Native American reservations</a>, also often lack traditional mailing addresses, experience unreliable mail delivery, and live further distances from ballot dropboxes and election offices than white voters. Those factors make third-party ballot collection drives critical get-out-the-vote tools for hard-to-reach voters <a href="https://www.azcentral.com/story/news/politics/arizona/2020/09/14/voting-by-mail-arizona-tradition-unlike-much-of-us-story-how-happened/5707050002/">in a state where the majority of voters cast ballots by mail</a>, advocates argue. The Supreme Court hasn't been the friendliest arena for voting rights advocates in recent years, and is poised to be even less so now with a 6-3 conservative majority. In addition to reversing the 9th Circuit, the Arizona attorney general, the Arizona GOP, and its allies have filed amicus briefs in the case seeking changes to how Section 2 is applied in the future.Some of the respondents and their amici have asked the Court to further narrow Section 2's reach, including by limiting Section 2 lawsuits to cases of intentional racial discrimination, and restricting the provision to challenge only racial gerrymandering and vote dilution, not to voting policies. "This case doesn't have to approach anywhere close to the impact of the Shelby County decision if the Court does the right thing, and that's what we're hoping for here," Morales-Doyle said.

It should also be said that the writing of Black authors isn't merely instructive — it's also artistry. Like many of us were forced to read the works of F. Scott Fitzgerald or Harper Lee to understand both craft and experience, the works of these Black authors contain multitudes and should be read with the depth of their skills in mind, not just for what they can "teach" white Americans.It should be said that people much smarter than I have written about <a href="https://www.vulture.com/2020/06/anti-racist-reading-lists-what-are-they-for.html">the questionable value of these reading lists</a>. I believe in the transformative power of books. I believe if you do the reading and use it as a catalyst for antiracist action there is much power in the pages of these books. If you read a book and then call officials in Kentucky to demand the arrest of the cops who murdered Breonna Taylor, America has a fighting chance to make lasting change. This collection is biting and emotional, and carries the voice that Laymon is known for. His own self-doubt and love of Black people can be felt throughout each essay, no matter the subject.Laymon never settles for less than incredible in his writing — there's a driving rhythm behind the words and that propels the reader deeper into the narratives.<h2>2. <a href="https://www.amazon.com/Breathe-Letter-Sons-Imani-Perry/dp/0807076554/ref=sr_1_1?crid=1EFU34SRJW064&amp;dchild=1&amp;keywords=breathe+imani+perry&amp;qid=1594908333&amp;s=books&amp;sprefix=breath+imani+per%2Cstripbooks%2C144&amp;sr=1-1ipbooks%2C144&amp;sr=1-1">"Breathe: A Letter to My Sons"</a> by Imani Perry </h2>This book is a mother's letter to her young sons about what it means to be alive and Black in America. It's deeply personal and still touches on grander ideas of race and humanity. Perry seamlessly weaves personal stories and American history together in this epistolary work.It should be noted that Perry's writing is out of this world, both poetic and no nonsense. This book looks at the choices and relationships young women face and the ways in which the bonds we create are at once destructive and fortifying. This book helps to make sense of one part of systematic racism and the deliberate nature of white supremacy. She deftly calls out and outlines the tactics and repercussions of these types of practices, like voter ID and the closing of polling locations. It's a coming of age story, a mother and son story, a story of finding one's true self at the intersection of sexuality and race.What Jones is able to do in this book is beyond compare. He explores his own life with a compassionate and critical eye. His humanity is on full display in the pages of this book. Thompson-Spires uses her stories to introduce us to a cast of characters that could be called, among other things, creative, wacky, obsessive, paranoid, perky, obtuse, particular, and on and on.More than anything, we see that Black people can and are anything and everything. We do in fact contain multitudes. He sees us and feels us and then he interprets us. He gives his stories so much audacity and fullness.I only wish I was able to read his words as a young person so that I could understand the depth of suffering and joy that the other kids around me were experiencing. I am glad to read his words now as an adult. To appreciate what empathy really is is to read a book by Jason Reynolds. She examines the many facets of white culture that are obsessed with the creations of Black people — things like food, memes, beauty standards, and so much more."White Negroes" exposes the many ways in which Blackness is stripped from Black people and repurposed into something palatable and profitable for white people. This book is searing and thought provoking in the ways only the best nonfiction can (and should) be. The citations resulted in fines that total $29,365.According to Cal-OSHA, Tesla failed to do the following:<ul><li>Obtain a permit prior to building GA4</li><li>Inspect GA4 for potential safety hazards</li><li>Cover or guard an opening in the floor of GA4 that was 22 inches wide, 14 inches long, and 8-inches deep</li><li>Train enough employees to help evacuate workers from the facility in the event of an emergency</li><li>Properly train employees to prevent and respond to heat illness</li><li>Protect workers from exposed metal rods and rebar that posed a "hazard of impalement"</li></ul>Tesla appealed the citations, saying for each that it did not violate the specified regulation and that the corresponding penalty was unreasonable."Nothing is more important to me or to Tesla than the health and well-being of our employees," Laurie Shelby, Tesla's vice president of environmental, health, and safety, said in a statement to Business Insider. "My EHS team and operational leaders have been intently focused on GA4 over the past six months, implementing safety protocols throughout the new line that not only keep Tesla in compliance with existing standards but also reduce risks to associates. Tesla will challenge OSHA's findings regarding the safety conditions that were present at the time of GA4 construction," Read more: <a href="https://www.businessinsider.com/ex-tesla-employees-describe-layoffs-2019-1">Ex-Tesla employees describe the abrupt way they were laid off and say questions linger</a>Thomas Armstrong, a professor at the University of Michigan who has worked with auto companies to make their manufacturing processes more ergonomically friendly, told Business Insider that the violations are not surprising due to the speed with which Tesla built GA4, but he said the violations do not necessarily indicate that the facility is unsafe, since they largely refer to failures to take preventive measures, rather than worker injuries."It certainly is not an endorsement for their safety culture, but, again, it doesn't mean that they aren't operating safely," he said.The kinds of violations Tesla was cited for are common in the auto industry, and the fine Tesla received amounts to "a slap on the wrist," Armstrong said.<h2>Questions about worker safety</h2>Injury statistics and reports from media outlets have raised questions about worker safety at Tesla's factories, though concerns about workplace safety <a href="https://www.bloomberg.com/news/features/2017-03-23/inside-alabama-s-auto-jobs-boom-cheap-wages-little-training-crushed-limbs">are not unique to Tesla</a> in the auto industry.A <a href="https://worksafe.org/file_download/inline/83a169a1-2af7-4c2e-81a5-21b6965ff996">2017 report</a> from the worker advocacy group Worksafe said the injury rate at Tesla's Fremont factory was 31% higher than the industry average in 2015 and 2016, but Tesla said in 2018 that it had made safety improvements that led its recordable injury rate to <a href="https://www.tesla.com/en_CA/blog/becoming-safest-car-factory-world?redirect=no">fall by nearly 25%</a> in 2017. The automaker said its 2017 recordable injury rate was "equivalent" to the industry average.Worksafe has not released an analysis of Tesla's 2017 or 2018 injury rates, but Tesla received more citations from OSHA related to vehicle manufacturing than Ford, General Motors, or Fiat Chrysler from 2017 through the end of 2018. Tesla received 21 citations during that period, while Ford received 15, General Motors received three, and Fiat Chrysler received one. Ford was fined the most during that period, $102,554, while Tesla was fined $63,870, General Motors was fined $14,122, and Fiat Chrysler was fined $7,967.While OSHA's online database does not disclose the nature of each violation, <a href="https://www.revealnews.org/article/tesla-says-its-factory-is-safer-but-it-left-injuries-off-the-books/">reports</a> from <a href="https://www.revealnews.org/article/inside-teslas-factory-a-medical-clinic-designed-to-ignore-injured-workers/">Reveal</a> published in 2018 claimed that Tesla misreported workplace injuries, avoided using safety markings for aesthetic reasons, and failed to give injured employees proper medical care. The first report was published before Tesla built GA4, and the second made no specific mention of the facility.Tesla has <a href="https://www.businessinsider.com/tesla-responds-to-report-claims-about-misreported-injuries-factory-2018-4">denied</a> that it has misreported workplace injuries and failed to use safety markings for aesthetic reasons. The automaker <a href="https://www.businessinsider.com/tesla-new-medical-provider-may-have-affected-number-injuries-report-2018-11">did not respond</a> to requests for comment on the allegation that it failed to give injured employees proper medical treatment.<h2>An unconventional decision</h2>The decision to build an open-air structure to supplement vehicle production in less than a month was unconventional. It was motivated by a desire to hit production goals for the Model 3 sedan, which had been subject to significant production delays in the prior year.Michael Ramsey, an automotive analyst at Gartner, <a href="https://www.businessinsider.com/teslas-new-open-air-assembly-line-is-unprecedented-in-the-auto-industry-2018-6">told Business Insider</a> at the time that the move had no precedent in the auto industry."It's extremely unusual, at a minimum," he said. "I've never heard of anyone ever doing this before on a grand scale."But Tesla CEO Elon Musk praised GA4 on multiple occasions, saying he preferred it to the main factory and highlighting how it increased the automaker's production output by 50%."It's actually way better than the factory building.
