New Delhi, The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> Thursday held the Maharashtra governor was not justified in calling upon then chief minister <keyword id="53973" type="General" weightage="20" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword> to prove majority in the Assembly on June 30 last year but refused to order status quo ante, saying he did not face the floor test and resigned. It, however, said since Thackeray had resigned without facing the floor test, the governor was justified in inviting Shinde to form government at the behest of the BJP which was the largest political party in the House. In a unanimous verdict on a batch of pleas related to the political crisis that led to the fall of the Maha Vikas Aghadi (MVA) government led by Thackeray following a revolt by the <keyword id="193503" type="General" weightage="20" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword> faction, a five-judge Constitution bench headed by Chief Justice of India D Y Chandrachud held that House speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal". "The governor was not justified in calling upon Thackeray to prove his majority on the floor of the House because he did not have reasons based on objective material before him to reach the conclusion that Thackeray had lost the confidence of the House," said the bench which also comprised Justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha. "However, the status quo ante can't be restored because Thackeray did not face the floor test and tendered his resignation. The governor was, therefore, justified in inviting Shinde to form the government at the behest of the BJP which was the largest political party in the house," it said. The top court also referred the 2016 Nabam Rebia verdict by a five-judge constitution bench, which relates to the power of speaker on disqualification of MLAs, to a larger bench of seven judges.

Sena scion Aaditya Thackeray makes a stellar debut with a 26,000-vote margin

Uddhav Thackeray on Saturday alleged that the Union budget
gives "step-motherly" treatment to the state and does not do
justice to Mumbai.
 The budget presented by finance minister Nirmala
Sitharaman was far removed from reality, said Thackeray, a
former ally of the BJP.
 "It is deeply disappointing for Maharashtra. This
budget is unjust for Maharashtra and Mumbai which is the
country's growth engine," Thackeray said in a statement.
 It does not support development of basic amenities in
Mumbai and on-going metro projects in the megapolis, he said.
 "There is no mention of the suburban railway network
(in Mumbai) and development of proposed lines (on the Central
and Western Railway routes).
 "The budget gives no momentum to the development of
railway network in the state except for the mention of
projects announced earlier, such as the Mumbai-Ahmedabad
Bullet Train," Thackeray said.
 He also raised a question over the Centre not
considering any site from "culturally rich" Maharashtra for
development as "iconic site".
 Sitharaman announced in the budget that Rakhigarhi
(Haryana), Hastinapur (Uttar Pradesh), Shivsagar (Assam),
Dholavira (Gujarat) and Adichanallur (Tamil Nadu) will be
developed as "iconic sites".
 "The step-motherly treatment given to Maharashtra has
become evident in the budget. The International Finance Centre
in Gujarat has been strengthened, while Mumbai, which makes
the highest contribution to the country's growth, has been
deliberately ignored," Thackeray said.
 The decision to divest a stake in LIC and possible
privatisation of the railways show the precarious state of the
economy, the chief minister said.
 The growth rate for the current fiscal is 5 per cent,
while in the economic survey for 2020-21 it is estimated at 6
to 6.5 per cent, he said.
 "This growth doesn't not have the potential to achieve
Prime Minister Narendra Modi's dream of making India a USD 5
trillion economy nation," Thackeray said.
 He also dismissed the finance minister's claim that
the Goods and Services Tax gave a relief to the Small and
Medium Enterprises (SMEs).
 "The Small and Medium Enterprises have been bedevilled
by GST. People's purchasing power has decreased, impacting
small scale industries, which in turn has landed workers in
trouble.
 "There was a need to encourage employment-generating
industries. But no such steps were announced in the budget,"
Thackeray said.
 It made no substantial provisions for farmers, women
and children and disabled persons, he added.

Budget does injustice to Maharashtra, Mumbai: Uddhav Thackeray

An ace photographer, he is the third Sena Chief Minister, after Manohar Joshi and Narayan Rane (both in 1990s), and the first member of the Thackeray family to hold the top post in the country's richest state. Thackeray, 59, otherwise considered an affable, mild- mannered politician, displayed combative traits of his father, Sena founder Bal Thackeray, in dealing with one-time senior ally BJP on the demand for rotational chief ministership just after assembly poll results were announced on October 24. He stood his ground and refused to budge on the issue of splitting the chief ministership, a stand that eventually led to the collapse of the three-decade old saffron alliance. After outmaneuvering the BJP, Thackeray will now have to prove his credentials as a leader who can navigate a new political path with ideologically different parties like the Congress and the NCP, partners in the Sena-led ruling coalition, the Maharashtra Vikas Aghadi (MVA). Though in politics for long, Thackeray has never contested an election or held a public post and it will be interesting to watch how he learns the ropes of governance in a state which is an economic powerhouse and home to the financial capital of the country. The Sena, a party identified with Hindutva politics and "anti-Congressism" since its inception, has entered a new phase where it will have to chart out a new course under Thackeray in the changed political scenario. Born on July 27, 1960 in Mumbai, Thackeray studied at Balmohan Vidyamandir and later graduated from the JJ School of Arts, where photography was his main subject. Besides being a published author, he is also a professional photographer whose work has appeared in various magazines and has been showcased at numerous exhibitions. Thackeray largely lived in the shadows of his legendary father before coming on his own after being appointed the Sena working president in January 2003. Thackeray formally took over as the chief of the Sena, founded in 1966 to fight for the rights of Marathi people, after his father died in 2012. Known for his passion for photography, he started out in the advertising field by setting up an agency called 'Chaurang'. Thackeray specialises in aerial and wildlife photography. He has two photo books to his credit, 'Maharashtra Desh' (2010) on the forts of the state, and 'Pahava Vitthal' (2011) on the Pandharpur wari (on pilgrimage to the temple town of Pandharpur). 'Maharashtra Desh' is full of breathtaking aerial shots, providing a glimpse into the cultural fabric, physical beauty and historical perspective of this wondrous state. A few years ago, he organised an exhibition of his photographs and Rs 10 lakh collected from their sale was donated for farmer causes. Like former prime minister Rajiv Gandhi, who started out in politics by helping his mother Indira Gandhi, Thackeray began assisting his father at a time when the firebrand Sena patriarch was aging and the party's sphere was expanding. He focused on strengthening the organisation and encouraged cadres to take up issues of farmers in the suicide- prone districts of rural Maharashtra. Thackeray sought to make the Sena, known for street politics and aggressive stand on issues of public interest, more acceptable to people outside its core voter base. After completing his journey from 'Matoshree', the Thackeray home in suburban Bandra, to 'Varsha', the CM residence in south Mumbai, the Sena leader will have to reinvent himself, according to political observers. He will now have to display flexibility and political acumen to deal with new-found allies and keep the coalition government going for five years, they said. "Despite being in government, the three parties are independent entities and would want to expand their respective political base," the observers said. "A political affairs committee would be needed to identify constituencies where the Sena and the Congress-NCP are in direct contest with each other and prevail upon the local leadership to work out an arrangement where political base of the three parties remains unaffected," a senior Congress leader said. While Thackeray has shown political sagacity and maturity till now, he will also have to deal with an aggressive BJP in the opposition knowing very well the former ally will try to make functioning for his government difficult, the observers said. "Uddhav will have to keep his flock of MLAs together," they said. Over 20 years ago, Thackeray was seen as a 'reluctant' politician, living a cosy life with his wife Rashmi and sons Aaditya (now an MLA) and Tejas at 'Matoshree'. But now that he has taken plunge into governance and managing a disparate coalition, a slew of challenges await Thackeray, who will be one of the most closely watched politicians in the country in these media-driven times. Since the Sena leader is currently not a legislator, he will have to get elected either to the legislative assembly or the council within six months of taking oath.

Shiv Sena president Uddhav Thackarey sworn-in as Maharashtra's 18th chief minister

On Wednesday evening, Thackeray addressed the state via social media and expressed his readiness to step down from both crucial posts provided the rebels led by Minister Eknath Shinde come to meet him and say they don't want him to continue. However, Shinde promptly spurned the CM's offer, reiterating his pre-condition that the Shiv Sena must first walk out of its Maha Vikas Aghadi (MVA) alliance government with the NCP and Congress. Hours after that, late on Wednesday, Thackeray and family packed up their bags and left the CM's official residence 'Varsha' at Malabar Hill and returned to the family home, 'Matoshri' in Bandra. Prior to that, he also held meetings with NCP President Sharad Pawar and NCP state chief Patil, Congress leaders including state President Nana Patole and central leader Kamal Nath, besides other senior Sena leadership. Thackeray is scheduled to address an online meeting of all top Mantralaya bureaucrats this day ostensibly to express his gratitude for their cooperation and contributions during the 30-month tenure of the MVA regime. The political suspense continued with Sena MP Sanjay Raut claiming in Mumbai that "around 20 MLAs" from the rebel group were in contact with the party leaders, besides the 15-odd currently in Mumbai. "About 20 MLAs are in touch with us... When they come to Mumbai, you will get to know. We will reveal soon under what circumstances and pressures these (rebel) MLAs left us," declared Raut. NCP's Patil expressed hope that the rebels would return to the Sena fold and ensure the continuation of the MVA government for which Thackeray is making all efforts and the other allies are fully helping out. Uddhav Thackeray starts making farewell calls ahead of possible resignation

The move came hours after his emotional appeal to the rebel group of Shiv Sena MLAs, led by Minister Eknath Shinde, that he (Thackeray) was ready to quit both as as CM and as party President, provided the rebels met him and made the demand. Thackeray - who tested Covid-19 positive this morning - also said that he had kept his resignation letter ready and any of the rebels could go and hand it over to the Governor. On his part, Shinde responded by saying that steps would have to be taken for Hindutva and reiterated his demand to break off with the Nationalist Congress Party and Congress to form the government with the Bharatiya Janata Party. The crisis shows no sign of defusing despite effects by the MVA allies, the offer to quit by the CM, and even his decision to vacate his official residence.

Interacting with reporters at the Goa Airport, he said Maharashtra could see this day because of his 50 MLAs. "My colleagues and entire Maharashtra is happy that Balasaheb Thackeray's Shiv Sainik has become the chief minister of the state," Shinde commented. The chief minister said his government will do the works that are expected from them by the people of Maharashtra. Shinde said his government will work to deliver justice to every section of society. The <keyword id="53973" type="General" weightage="80" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword> camp, led by Sunil Prabhu, has moved the Supreme Court seeking suspension of 16 MLAs, including <keyword id="193503" type="General" weightage="100" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword>, from the Maharashtra <keyword id="6354702" type="General" weightage="80" keywordseo="assembly" source="Orion">Assembly</keyword> till the disqualification proceedings initiated against them are decided and also urged the court to restrain 'delinquent' MLAs from entering the Assembly. Prabhu has filed the plea through advocate Javedur Rahman, which will be mentioned on Friday before a vacation bench. The plea said till date there is no dispute regarding the leadership position of Uddhav <keyword id="41515" type="General" weightage="80" keywordseo="thackeray" source="Orion">Thackeray</keyword> as the president of the <keyword id="6358821" type="General" weightage="80" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> political party. It cited the resolution passed in national executive meeting of the Shiv Sena political party held on June 25, this year, where Thackeray's leadership was re-affirmed and the conduct of the delinquent MLAs led by Eknath Shinde has been criticised. The plea said it has further been resolved to take necessary steps to disqualify the rebels from the membership of the <keyword id="130426" type="General" weightage="80" keywordseo="legislative-assembly" source="Orion">Legislative Assembly</keyword>. The plea said despite the rebellion carried out by the Eknath Shinde faction, the original Shiv Sena political party remains under the leadership of Uddhav Thackeray, who was elected as the president on January 23, 2018, when the organisational elections of the Shiv Sena were conducted and the same was duly communicated to the Election Commission on February 27, 2018. The plea said, "Pass an interim order suspending the delinquent MLAs, against whom disqualification petitions have been filed by the <keyword id="892378" type="General" weightage="80" keywordseo="applicant" source="Orion">Applicant</keyword> herein, from the membership of the 14th Maharashtra Legislative Assembly, till the final adjudication of the Tenth Schedule proceedings initiated against them."
