New Delhi, Dec 29 () After sending out notices to firms such as gas utility GAIL for crores of rupees in past dues, the Department of Telecommunications has said that any relief to non-telecom companies from payment of enhanced levies can come only from the Supreme Court.
 The Telecom Department is current "examining" the replies given by the state-owned non-telecom corporations on the Adjusted Gross Revenue (AGR) dues, a senior official said.
 "They have sent their replies, which we are examining. We believe that they will have to go to Supreme Court to seek notification or clarification on whether they are included or not included in this (Supreme Court order). That is for them to seek," the Telecom Department official told .
 There are certain cases where players were parties in the court and in those cases the companies are bound by the court order. Some parties have also filed review petition, the official noted.
 "Then there were others who were not parties, they will have to take a call because our assessment is that it will be applicable...we are examining the issue but in our assessment they will probably have to go to SC to seek a clarification," the official added.
 As it is, Bharti Airtel, Vodafone Idea and other telecom companies owe the government nearly Rs 1.47 lakh crore in past statutory dues. These AGR liabilities arose after the Supreme Court in October this year upheld the government's position on including revenue from non-telecommunication businesses for calculating the annual AGR of telecom companies, a share of which is paid as licence and spectrum fees to the exchequer.
 The apex court allowed three months to the affected companies to cough up the amounts due to the government.
 The Department of Telecommunications (DoT) has meanwhile made it clear that the AGR order will apply to all licencees, including companies such as GAIL, RailTel, and Power Grid.
 As things stand today, such players, despite a smaller telecom exposure, may have to pay liabilities computed on their entire revenue.
 Non-telcos, such as internet service providers (ISPs), had argued that DoT has unnecessarily imposed the order on internet service providers, many of which are run by entrepreneurs in smaller cities and towns. It had also sought intervention of the Prime Minister's Office (PMO) to resolve this issue.
 The DoT has sought Rs 1.72 lakh crore in past statutory dues from state-owned gas utility GAIL India Ltd following the Supreme Court's AGR ruling.
 DoT sent a letter to GAIL last month seeking Rs 1,72,655 crore in dues on IP-1 and IP-2 licences as well as Internet Service Provider (ISP) licence. In response, GAIL has told DoT that it owes nothing more than what it has already paid to the government.
 Besides GAIL, DoT is also seeking Rs 1.25 lakh crore from PowerGrid which had both a national long-distance as well as an internet licence. PowerGrid says it has an AGR of Rs 3,566 crore since 2006-07 and after adding penalty it comes to Rs 22,168 crore. MBI ABM

New Delhi, Jan 19 () The telecom department is examining the legal applicability of January 23 deadline for payment of over Rs 2.4 lakh crore statutory dues in the case of non-telecom PSUs which were not originally party to AGR matter in the Supreme Court, according to sources.
Sources in the Department of Telecom (DoT) told that while the PSUs too have been asked to make payments related to statutory liabilities (after the SC in October upheld government's position on calculation of non-core revenue for AGR dues), the larger question is whether the January 23 deadline is legally enforceable on state-owned companies that were not direct party to the dispute.
The current view that is emerging in the DoT appears to be that the court-imposed timeline may not apply to PSUs, but the matter is being legally examined for clarity.
"Of course, the court has decided the issue of principle of what is AGR, so they (PSUs) have to pay but if they do not pay by January 23 it will not be contempt as it will be in case of the parties to the case. So PSUs have to pay and we have raised demands, but if they do not pay by January 23 it will not amount to contempt of court on their part because they were not party to the case, but they have to pay," a source added.
Another official also said that the issue of deadline for PSUs is being examined legally. Telecom companies Bharti Airtel and Vodafone Idea, on the other hand, are legally bound to comply with the payment timelines stipulated by the apex court.
Following the Supreme Court order of October last year, the DoT estimated that the total liability of 15 telecom companies, including penalties and interest, would be Rs 1.47 lakh crore. 
These AGR liabilities arose after the Supreme Court in October last year upheld the government's position on including revenue from non-telecommunication businesses for calculating the annual AGR of telecom companies, a share of which is paid as licence and spectrum fees to the exchequer.
It has estimated another over Rs 2.4 lakh crore in liability for non-telecom companies, including state-owned gas utility GAIL India Ltd and power transmission firm PowerGrid, which had taken licences to trade broadband on optic fibre running along their pipelines and transmission lines.
The DoT has sought Rs 1.72 lakh crore in past statutory dues from state-owned gas utility GAIL India Ltd following the Supreme Court's AGR ruling. The DoT sent a letter to GAIL last month seeking these dues on IP-1 and IP-2 licences as well as Internet Service Provider (ISP) licence, in response to which, GAIL has told DoT that it owes nothing more than what it has already paid to the government.
The assessment puts PowerGrid liability at Rs 21,000 crore, and another Rs 40,000 crore liability was assessed of Oil India Ltd. However, a demand notice was served in case of Gujarat Narmada Valley Fertilizers &amp; Chemicals Ltd for Rs 15,019 crore. MBI ANZ MKJ

A day after Bharti Airtel approached the <keyword id="6354977" type="COMPANY" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> over the assessment of adjusted gross revenue (AGR) calculations, <keyword id="1553175" type="PERSON" weightage="20" keywordseo="Vodafone-Idea">Vodafone Idea</keyword> also moved the top court seeking "correction" in the AGR assessment. The petition filed by the telco on Thursday said that payments made by the company have not been accounted for in the AGR demands issued by the department. Further, it also said that double counting has been done on some revenue items in the AGR demands. It also said that deduction has not been given for PSTN related call charges and for roaming charges actually paid to other operators. "The excess demand upon the applicant which is attributable to these error amounts to Rs 5,932 crores of principal amount, which would have an overall impact of over four times on the total principal amount aforementioned due to the imposition of interest, penalty and interest on penalty," the petition said. In September, the <keyword id="6356229" type="COMPANY" weightage="20" keywordseo="apex-court">apex court</keyword> allowed telecom operators 10 years to pay up <keyword id="8275485" type="UNKNOWN" weightage="20" keywordseo="agr-dues">AGR dues</keyword>. Vodafone Idea's total AGR dues as per DoT stood at Rs 58,254 crore, while the dues according to the company stood at Rs 21,533 crore. The company has paid AGR dues worth of Rs 7,854 crore so far. Vodafone Idea approaches Supreme Court over AGR dues

New Delhi, After being rapped by the Supreme Court for failing to deposit <keyword id="8275485" type="UNKNOWN" weightage="20" keywordseo="agr-dues">AGR dues</keyword>, <keyword id="15492" type="COMPANY" weightage="20" keywordseo="Vodafone">Vodafone</keyword> Idea on Monday moved the apex court stating it can as of now pay only Rs 2,500 crore of the arears to the government and will follow it up with another Rs 1,000 crore by February 21. The telecom firm also appealed to the top court that the <keyword id="62528" type="COMPANY" weightage="20" keywordseo="Department-of-Telecom">Department of Telecom</keyword> should not take any coercive action and invoke bank guarantees, as an action of this nature would have consequences and it would eventually hamper their operations. The Supreme Court declined to entertain the telco's plea seeking "no coercive action". According to counsels, Vodafone contended before the court that Rs 3,500 crore is 50 per cent of its estimated principle AGR dues of Rs 7,000 crore. Vodafone is estimated to pay Rs 53,000 crore to the government as part of its AGR dues. According to reports, it has informed the government that it is examining all avenues as to how much of AGR dues it could pay off.

The apex court on Wednesday lashed out at the telcos for trying to reopen the dues they owed to the government through the self-assessment exercise. The <keyword id="116246" type="COMPANY" weightage="20" keywordseo="Department-of-Telecommunications">Department of Telecommunications</keyword> (<keyword id="16054" type="ORGANIZATION" weightage="20" keywordseo="DoT">DoT</keyword>), according to its own submission to the apex court seeking relief in payment tenure, has put dues of the three companies at Rs 1.19 lakh crore. The dues estimated by DoT for Bharti Airtel and <keyword id="173082" type="COMPANY" weightage="20" keywordseo="Telnor">Telnor</keyword> was pegged at Rs 43,980 crore, while that of Vodafone Idea was Rs 58,254 crore, and Tata Group of companies at Rs 16,798 crore outlined under 'total demand of DoT incorporating CAG and special audit as on October 2019'. Against this, Bharti Group has calculated its dues at Rs 13,004 crore, Vodafone Idea at Rs 21,533 crore and Tata Group of companies at Rs 2,197 crore. In all, AGR dues calculated by the government for 16 entities add up to Rs 1.69 lakh crore, while telcos' self-assessment place their dues at a mere Rs 37,176 crore. These dues arose after the Supreme Court, in October last year, upheld the government's position on including revenue from non-core businesses in calculating the annual AGR of telecom companies, a share of which is paid as licence and spectrum fee to the exchequer. The Supreme Court on Wednesday pulled up the Centre and telecom companies for doing self-assessment or reassessment of the Adjusted Gross Revenue (AGR) dues fixed by the apex court in its verdict given on October 24 last year. A bench of Justice Arun Mishra, Justice S A Nazeer and Justice M R Shah refused to take up the Centre's plea for allowing telecom companies to pay AGR dues in 20 years, saying the application will be taken up after two weeks. "The time frame of 20 years is unreasonable. The telecom companies have to clear all dues mentioned in the judgement," the bench said, adding it had settled all AGR dues after hearing telecom companies and the government then had fought tooth and nail for interests and penalties. The bench said it will summon the secretary and desk officer of DoT who permitted telecom companies to do self-assessment of AGR dues. "Exercise of self-assessment of AGR dues by telecom companies cannot be permitted even in wildest dreams," it said. The court said serious fraud was being committed by telecom companies by asserting to do self-assessment of AGR dues and that its judgment was final and to be followed in letter and spirit. Beleaguered Vodafone Idea has pegged its total dues to the government following a Supreme Court order at Rs 21,533 crore. Earlier this week, Vodafone Idea paid another tranche of Rs 3,354 crore to the government, thereby taking its total payments to Rs 6,854 crore. The company said this was equivalent to full principal amount as per its self-assessment. Bharti Airtel has paid Rs 13,004 crore to the government in two installments. It had also deposited an additional Rs 5,000 crore "as an ad-hoc payment (subject to subsequent refund/adjustment) to cover differences, if any, arising from the reconciliation exercise with the DoT. Tata Teleservices has paid Rs 2,197 crore in AGR dues, and thereafter an additional Rs 2,000 crore to cover reconciliation differences.

An 82,300 crore rupees gap in telco's and DoT assesment of spectrum dues

New Delhi, Mar 19 () The Department of Telecom's plea seeking 20 years time for operators to pay adjusted gross revenue dues was approved by the Cabinet, Union minister Sanjay Dhotre informed Parliament on Thursday. The Supreme Court will hear the government's rescue plan of giving telcos a 20-year repayment period for AGR dues during the next hearing scheduled after two weeks."Consequent to the approval by the Cabinet, an application has been moved before the Hon'ble Supreme Court on March 16, 2020, seeking, inter-alia, permission of the Hon'ble Court for the licensees impacted by the AGR judgement to pay the unpaid or remaining to be paid amount of past DoT assessed/calculated dues in annual instalments over 20 years duly protecting the net present value of the said dues using a discount rate of 8 per cent," the Minister of State for Communications told the Rajya Sabha in a written reply. DoT plea to seek 20 year time for payment of AGR bears cabinet stamp

New Delhi, Jan 17 () Shares of Vodafone Idea on Friday plunged over 39 per cent after the Supreme Court dismissed review petitions of top telecom firms seeking review of its earlier order asking them to pay Rs 1.47 lakh crore in past statutory dues by January 23.
 The company's scrip tanked 39.30 per cent to Rs 3.66 on the BSE.
 On the NSE, it plummeted 39.16 per cent to Rs 3.65.
 Bharti Airtel, however, was trading in the green after initial losses of 0.83 per cent on the BSE.
 The Supreme Court Thursday dismissed review petitions of top telecom firms including Bharti Airtel and Vodafone Idea seeking review of its earlier order asking them to pay Rs 1.47 lakh crore in past statutory dues by January 23 saying it did not find any "justifiable reason" to entertain them.
 In a big blow to telecom sector, India's apex court has dismissed the review petition filed by telecom companies to grant a relief on AGR liabilities, said a report by Motilal Oswal Institutional Equities.
 "The verdict may put a severe burden on telcos and have unconceivable repercussions, particularly against the backdrop of VIL facing a risk of shutdown (it may result in INR1.2t debt default, large-scale job losses and subscriber churn)," the report said.
 The apex court had on October 24 ruled that the statutory dues need to be calculated by including non-telecom revenues in what is known as adjusted gross revenues (AGR) of telcos.
 Bharti Airtel, in its plea, had sought review of the directions on aspects of levy of interest, penalty and interest on penalty relating to AGR.
 With the Supreme Court dismissing its review petition on AGR dues, Bharti Airtel on Thursday said it is disappointed, and evaluating options to file a curative petition in the matter.
 "While respecting the Supreme Court's decision, we would like to express our disappointment as we believe the long standing disputes raised regarding the AGR definition were bonafide and genuine," Airtel said in a statement. SUM ANS

Vodafone Idea shares nosedive over 39 pc

New Delhi, Mar 18 () Telecom shares came crashing on Wednesday, led by Vodafone Idea which plunged 35 per cent after the Supreme Court pulled up the Centre and telcos for doing self-assessment or reassessment of the AGR dues fixed by the apex court. Vodafone Idea plunged 34.85 per cent to close at Rs 3.16 on the BSE. During the day, it dived 40 per cent to Rs 2.91. Bharti Airtel also declined 6.14 per cent to close at Rs 426.20 after falling 9.86 per cent to Rs 409.30 during the day. Both the companies erased their early gains. The Supreme Court on Wednesday pulled up the Centre and telecom companies for doing self-assessment or reassessment of the Adjusted Gross Revenue (AGR) dues fixed by the apex court in its verdict given on October 24 last year. The apex court, which was also anguished by frequently published newspaper articles on the AGR issue said all managing directors of telecom companies will be personally responsible and will be held for contempt of court for any such future newspaper articles. The BSE telecom index plunged most by 9.48 per cent as all its components cracked including Bharti Infratel which tanked 22.62 per cent. "The global mayhem combined rising coronavirus cases in India triggered the initial fall, which further worsened with the Supreme Court's stance on AGR dues," Ajit Mishra, VP - Research, Religare Broking Ltd said.
