MPs and MLAs taking bribes to vote or make a speech in the <keyword id="19910021" type="General" weightage="20" keywordseo="house" source="keywords">House</keyword> are not immune from prosecution, the Supreme Court said on Monday in a landmark, unanimous verdict that overrules its 1998 judgment protecting such lawmakers. Observing that bribery is not protected by parliamentary privileges, a seven-judge constitution bench headed by Chief Justice D Y <keyword id="19985698" type="General" weightage="20" keywordseo="chandrachud" source="keywords">Chandrachud</keyword> held that a five-judge bench's interpretation in the 1998 verdict in the JMM bribery case was contrary to Articles 105 and 194 of the Constitution. Describing the judgment as "great", Prime Minister <keyword id="19895781" type="General" weightage="20" keywordseo="narendra-modi" source="keywords">Narendra Modi</keyword> said in a post on X that it would "ensure clean politics and deepen people's faith in the system". Articles 105 and 194 deal with the powers and privileges of MPs and MLAs in the Parliament and the legislative assemblies. "Corruption and bribery by members of the legislatures erode probity in public life," the CJI, who read the operative part of the verdict, said while pronouncing the verdict today. The bench also comprised Justices A S Bopanna, M M Sundresh, P S Narasimha, J B Pardiwala, <keyword id="19931190" type="General" weightage="20" keywordseo="sanjay-kumar" source="keywords">Sanjay Kumar</keyword> and Manoj Misra. In 1998, the five-judge constitution bench held in its majority verdict on the Narasimha Rao versus CBI case that parliamentarians have immunity against criminal prosecution for any speech made and vote cast inside the House under Articles 105(2) and 194(2). The seven-judge bench was reconsidering the 1998 judgement. While pronouncing the verdict, the CJI said Article 105 of the Constitution seeks to sustain an environment to have deliberations by the lawmakers in the House and this atmosphere is vitiated when a member is bribed to deliver a speech. Justice Chandrachud said the privileges claimed must have a nexus to the collective functioning of the House and must have a relationship with the essential functions of a legislator which he or she has to discharge. The seven-judge bench had reserved its judgement in the matter on October 5 last year. During the arguments, the Centre had submitted that bribery can never be a subject matter of immunity and a parliamentary privilege is not meant to place a lawmaker above law. The top court, in the course of the hearing, had said it will examine whether the immunity granted to lawmakers from prosecution for taking bribes to make a speech or vote in Parliament and state legislatures extends to them even if criminality is attached to their actions. On September 20, 2023, the <keyword id="19936355" type="General" weightage="20" keywordseo="apex-court" source="keywords">apex court</keyword> had agreed to reconsider its 1998 judgement, saying it was an important issue having a significant bearing on "morality of polity". The issue came under the apex court's lens in 2019, when a bench headed by then Chief Justice Ranjan Gogoi was hearing an appeal filed by <keyword id="20405400" type="General" weightage="20" keywordseo="sita-soren" source="keywords">Sita Soren</keyword>, JMM MLA from Jama and daughter-in-law of party chief Shibu <keyword id="19968807" type="General" weightage="20" keywordseo="soren" source="keywords">Soren</keyword>. She was an accused in the JMM bribery scandal. The Gogoi-led bench had referred to a five-judge bench the matter, noting it had "wide ramification" and was of "substantial public importance". Sita Soren was accused of taking bribes to vote for a particular candidate in the Rajya Sabha election in 2012. She contended that the constitutional provision granting lawmakers immunity from prosecution, which saw her father-in-law being let off the hook in the JMM bribery scandal, be applied to her. She moved the apex court against the Jharkhand High Court order of February 17, 2014 refusing to quash the criminal case lodged against her. The three-judge bench had then said it will revisit the apex court verdict in the JMM bribery case involving Shibu Soren, a former Jharkhand chief minister and ex-union minister, and four other party MPs who had accepted bribes to vote against the no-confidence motion threatening the survival of the P V Narasimha Rao government in 1993. The Narasimha Rao government, which was in a minority, survived the no-confidence vote with their support. The CBI registered a case against Soren and four other JMM Lok Sabha MPs but the Supreme Court quashed it citing immunity from prosecution they enjoyed under Article 105(2) of the Constitution. No immunity for MPs, MLAs taking bribe to vote, make speech in House: SC

Patna (Bihar) [India], March 22 (ANI): Rashtriya Janata Dal (RJD) leader Tej Pratap Yadav on Friday condemned the recent arrest of Delhi's Chief Minister Arvind <keyword id="19895701" type="General" weightage="20" keywordseo="kejriwal" source="keywords">Kejriwal</keyword> and stated the INDIA alliance is not the one who gets scared, adding that the INDIA alliance are the ones who fight and win. He also accused the BJP of using government investigation agencies and other constitutional institutions to their advantage in the upcoming elections. He added that the people of INDIA Alliance, stand firmly with the Delhi government. "The way Delhi's Chief Minister Arvind Kejriwal was arrested today clearly shows that the BJP is completely scared and wants to fight elections with the help of government investigation agencies and other constitutional institutions. Ranchi, Mar 3 () The Jharkhand government on Tuesday proposed to set up a state farmers relief fund this kharif season, state finance minister Rameshwar Oraon said while presenting budget for 2020-21 in the assembly.He said a sum of Rs 100 crore has been earmarked for the proposed relief fund.Oraon presented an estimated Rs 86,370 crore budget for the financial year 2020-21 in the house, the first one of the new JMM-Congress-RJD ministry headed by Hemant Soren."There is a proposal to set up Jharkhand Rajya Kisan Rahat Kosh (farmers relief fund) from this Kharif season, changing the form of Pradhan Mantri Fasal Bima Yojana (PMFBY)," Oraon said.The minister, however, did not elaborate about the proposal.The Soren-led government came to power in Jharkhand after elections in November-December last year.PMFBY was introduced on January 14, 2016 with an aim to reduce agricultural distress and farmers welfare without having to affect hefty hikes in the minimum support price (MSP) for agricultural products due to monsoonfluctuation induced risks.Oraon said in his budget speech that out of the total budget, Rs 73,315.94 crore is under the head of revenue expenditure, while Rs 13,054.06 crore on the capital expenditure.He also said that the state government has decided to introduce "Short Term Agriculture Loan Relief Yojana", underlining Rs 2,000 crore for 2020-21 fiscal for the scheme.Another Rs 200 crore has been allocated under the "Paddy Production &amp; Market Accessibility," the finance minister said.Announcing a new scheme Modern Diagnostic &amp; Other Testing Lab along with ambulance facilities for animals, Oraon said women from the above poverty line would be connected with the ongoing scheme of distribution of cows along with the BPL families.There is also a proposal to give an additional Rs 50,000 to the beneficiaries under "Pradhan Mantri Awas Yojana" and allowing them to construct houses as per their choice.The minister also said that Rs 4,199 crore has been earmarked for constructing five thousand housing units under "Baba Saheb Ambedkar Yojana" in the new financial year.The government has set a target to connect one lakh families under "Livelihood Promotion" scheme in paddy cultivation, poultry, vegetables and medicinal herbs, he said.Under the "Mukhya Mantri Visesh Chhatra Vriti Yojana" (Chief Ministers Special Students Scholarship), he said that the government has earmarked Rs 30 crore with a proposal to give scholarship to all the students, from Class I to Class XII of the government schools.The minister said that there is also a proposal of Rs 1,660.77 crore to ensure regular honorarium to para teachers.The honorarium of Cook-cum-Sahaika engaged in preparations of midday meals will be increased by Rs 500, taking their monthly payment to Rs 2,000.The government has also taken several measures in the sectors of health, industry, tourism, skill development and among others. At first, it sounds like something from a horror film."I figured out what all that noise coming from the basement is," Nico's message begins. "It's a family of raccoons. A mom and babies.""They're super friendly and so cute, but they kinda stink. After I feed them I'm going to give them a bath in your bathtub," he says.The bizarre message is made more amusing as Federighi continues presenting like there's nothing weird going on behind him.But it definitely suits the advertised tone of an urgent phone call, and one imaginative copywriter has brought more eyes to this feature that might've otherwise gone under the radar.<a href="https://www.businessinsider.com/soren-iverson-behind-viral-fake-app-features-twitter-2023-5">Soren Iverson</a>, a product designer whose viral tweets imagine absurd features like a LinkedIn nepotism disclosure, <a href="https://twitter.com/soren_iverson/status/1665838659763879936" target="_blank" rel="noopener">tweeted</a>: "Whatever copywriter at Apple came up with Nico finding and BATHING an entire family of raccoons is far more unhinged than I could ever dream of being."Apple did not immediately respond to Insider's request for comment.
