<ul><li>WhatsApp and Facebook filed a plea in the <keyword id="6355014" type="COMPANY" weightage="20" keywordseo="delhi-high-court">Delhi High Court</keyword> for a stay on the <keyword id="97393" type="COMPANY" weightage="20" keywordseo="Competition-Commission-of-India">Competition Commission of India</keyword>’s (<keyword id="47183" type="COMPANY" weightage="20" keywordseo="CCI">CCI</keyword>) plans to conduct an antitrust investigation.</li><li>The tech giants argue that the issue of data sharing is one of privacy, and does not fall under the purview of India’s competition watchdog.</li><li>However, India's solicitor general undercut their argument saying the issue is not whether or not data is being collected — the issue is how it is being used.</li><li>He argued that changes to WhatsApp's privacy policy could give the companies an unfair advantage and ammunition to push competitors out of the market.</li></ul>India’s competition watchdog doesn’t want WhatsApp sharing user data with its parent company, Facebook. But, the tech giants don’t believe that is the CCI’s place to have an opinion on the matter. While the Delhi High Court has reserved its order on WhatsApp and Facebook’s challenge to the probe by the Competition Commission of India (CCI), the two sides had some scathing exchanges during the arguments. <div type="Article" hostid="261" msid="81673084" title="WhatsApp faces a fresh antitrust investigation in India over its new privacy policy that shares users’ data with Facebook" mstype="2" mssubtype="0"></div> The plea filed by WhatsApp and its parent company asserted that since there is already an ongoing case in the <keyword id="6354977" type="COMPANY" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> over the policy update, the CCI does not need to conduct its own investigation. The messaging platform’s 2021 update states that WhatsApp will be sharing user data with Facebook in order to optimise recommendations for their users. The CCI contends that WhatsApp is using its dominant position in the market to force users to share information with its parent company. India’s competition watchdog believes that ‘excessive’ data collection is getting in the way of creating a healthy competitive environment. Harish Salve, who argued on behalf of the tech giants, asserted that the issue of whether excessive data collection has any anti-competitive implications is something for the Indian government to decide, not the CCI. <cmsannotation type="cmsannotation" annotationid="Is the WhatsApp-Facebook connection a matter of privacy or data use?" comment="subhead" text="Is the WhatsApp-Facebook connection a matter of privacy or data use?">Is the WhatsApp-Facebook connection a matter of privacy or data use?</cmsannotation> According to Salve, the CCI’s probe into Facebook and WhatsApp is not a matter of competition but of protection and privacy — which would fall under the government’s purview since they are constitutional issues. He also argued that since the privacy policy under question is with respect to WhatsApp, there is no point in dragging Facebook into the picture. However, assistant solicitor general (ASG) Aman Lekhi, hit back saying that the analysis of the data collected by WhatsApp will give even more information about an individual than actual physical stalking. The company can then use this data to either buy out the competition or make it irrelevant over time. “Facebook comes into the picture because of the privacy policy through which data collection is happening,” Lekhi explained. According to him, the purpose of data sharing is targeted advertising and customer profiling. So, when it comes to the issue of privacy versus access to data, the issue is that the data will have exclusionary effects. “The problem is that <a href="https://twitter.com/LiveLawIndia/status/1381887150371696645">nomenclature</a> is ‘privacy policy’ but the issues arising are to do with the competition aspect,” Lekhi told the High Court. Simply put, India's argument is that these changes to WhatsApp's privacy policy could give both the messaging app, as well as Facebook and Instagram, an unfair advantage over its competitors and may drive them out of business. The Delhi High Court has not issued a verdict on the matter and reserved its judgement. The date for the next hearing has not been announced yet. What WhatsApp and Facebook want to do is worse than stalking, India's solicitor general tells court

<ul class="summary-list"><li>Former <keyword id="18877" type="PERSON" weightage="60" keywordseo="Michigan">Michigan</keyword> governor <keyword id="896321" type="PERSON" weightage="60" keywordseo="Rick-Snyder">Rick Snyder</keyword> was charged last week in connection with the <keyword id="3222434" type="PERSON" weightage="60" keywordseo="flint-water-crisis">Flint water crisis</keyword> during his tenure.</li><li>Current Michigan Solicitor General <keyword id="10622181" type="UNKNOWN" weightage="60" keywordseo="fadwa-hammoud">Fadwa Hammoud</keyword> told Insider that the investigation is ongoing, and the state may bring more indictments against him.</li><li>She also said she hoped that the case shows how everyone should be treated equally under the law, and that "your position of power, or your title alone, does not shield you from that."</li></ul>On Wednesday, the Michigan Attorney General's office charged 11 people who made ruinous decisions that led to the water crisis in Flint.The accused include Rick Snyder, the state's former Republican governor, who oversaw the decisions that injected improperly treated water into the city's homes.The charges are the culmination of more than six years of tangled investigations, which have been set back with false starts and mishandled evidence. And they are severe: Snyder's top health official, Nick Lyon, faces nine counts of involuntary manslaughter.But to some, the charges against Snyder - <a href="https://www.michigan.gov/documents/ag/GJ_Indictment_-_Snyder_R_712955_7.pdf">two misdemeanors for willful neglect of duty</a> - are remarkably soft.Michigan Solicitor General Fadwa Hammoud told Insider that they're not done with Snyder yet."Nothing is out of the possibility when you're talking about a criminal investigation," Hammoud said.In an interview on Friday, Hammoud said the investigation into the people responsible for the city of Flint's crisis was still ongoing, and that superseding indictments may be filed as new evidence comes to light."Like any criminal case, as this case goes on, new evidence comes up, new evidence comes forward," she said. "We're not going to turn a blind eye to that."Snyder and Lyon have both pleaded not guilty.<h2>'Everybody should be treated equally under the law'</h2>Snyder is the first governor in the state's history to be charged based on his activities in office. Prosecutors say he failed to declare a state of emergency over Flint's water troubles and failed to properly supervise his appointees - two charges of willful neglect of duty that each carry a sentence of up to a year in prison and $1,000 in fines.Snyder's administration, in 2014, exposed Flint's 100,000 residents to water with high lead levels. It <a href="https://www.nrdc.org/stories/flint-water-crisis-everything-you-need-know#sec-summary">coincided with an outbreak of Legionnaires' disease</a> that killed 12 people and sickened at least 87 more.Bill Schuette, the state attorney general who served in Snyder's administration, investigated the issue and filed several charges. While several members of Snyder's administration were charged - <a href="https://www.nytimes.com/2019/06/13/us/flint-water-crisis-charges-dropped.html">some of whom pleaded guilty</a> - Snyder himself had not been.<div type="image" title="rick snyder zoom hearing" height="1875" width="2500" msid="80355906" hostid="261"></div>But Hammoud rebooted the investigation after she and Dana Nessel, the current attorney general, took over in 2019. At the time, they said the underlying evidence wasn't properly analyzed the first time around.Hammoud declined to comment directly on how the case was handled before she came to office in 2019. But she said that she understood that the public's trust into a public office, like her own, wasn't something she could take for granted. She said she wanted to do her due diligence and make sure the state of Michigan pursued the criminal cases it was supposed to pursue."I understand that we can't please everybody," she said. "And I understand that we're not entitled to the people's trust blindly. But people are entitled to vigorous action."And while the charges against Snyder are only two misdemeanors, the overall scope of the charges is more significant than what her predecessor pursued. Lyon, for example, had previously been charged with two manslaughter counts instead of nine.Hammoud said her office simply looked at the evidence, presented it in front of a grand jury, and went with the indictments the grand jury agreed to."When we conducted this investigation, we couldn't go in there with preconceived notions or say, 'Alright, this is what we want,'" Hammoud said. <div class="KonaFilter image-container display-table float_right"><div><div class="image on-image">Joe Raedle/Getty ImagesDonald Trump.</div></div></div>A former US solicitor general said this week that what will be key to whether President Donald Trump is victorious defending his immigration moratorium in the court system is whether the executive order is interpreted solely based on the text of the document.Charles Fried, who served as solicitor general under President Ronald Reagan and is now a Harvard <keyword id="6355470" type="CITY" weightage="60" keywordseo="Law">law</keyword> professor, told Business Insider that things may not bode well for Trump if the court decides to consider statements he made along the campaign trail about banning Muslims from entering the country."What shadows any such effort is the question whether these executive orders have to be interpreted within the four corners (purely on the text of the documents) ... or whether various statements - including statements by candidates, including statements by advisers, including 3 a.m. tweets - whether those bare on the constitutionality in the sense that they are considered competent evidence of the intent of the order," Fried said.If the executive order is viewed "within the four corners," Fried said he believes it "is really pretty secure.""If you let in all this other stuff, who knows," he said.In late December of 2015, Trump announced that he would seek an indefinite ban on Muslims entering the US if he won the election. From then on, Trump made a number of statements related to the barring of Muslims from entering the country, at times backing away from the severity of his initial remark.Following the implementation of his travel ban last month, Trump said Christians would be given preferential treatment. Additionally, one of his top surrogates and advisers, former New York mayor Rudy Giuliani, told Fox News that Trump was looking for a way to do such a Muslim ban "legally," and enlisted Giuliani to help figure out exactly how to do so. Giuliani later walked back the comment.At the heart of the matter is the fact that presidents have the authority to suspend entry to groups of individuals deemed to be detrimental to the United States, while, as the 9th Circuit Court wrote in its Thursday decision, the First Amendment prohibits any "law respecting an establishment of religion" and the Equal Protection Clause "prohibits the government from impermissibly discriminating among persons based on religion."The states arguing against Trump's executive order, Washington and Minnesota, used Trump's past statements to make the case that it was discriminatory based upon religion. But the 9th Circuit Court, in its ruling, did not make a determination on whether the executive order was discriminatory.Fried said "there are great dangers" about bringing Trump's and his advisers' past statements into consideration."Because candidates say all kinds of things, and this president says all kinds of things," the Harvard law professor explained. "Some of which, he contradicts himself with within the next 10 minutes. So a court might be tempted in that context to say, 'we're not going to look at any of this stuff, it's just the text of the order [that will be reviewed].'"Although he said he "wouldn't go that far" and say the order was constitutional based alone on the text of the order, Fried did say the the "four corners" interpretation would boost the Trump administration's chances of success."I would say that it has a very much better chance," he said.Reince Priebus, White House chief of staff, said Friday that the administration would be "fighting out this case on the merits." Andy Beshear.The court won't consider the substance of the law, which passed in 2018 under then-Republican Gov. Matt Bevin, and has since been blocked by lower federal courts. The law, known as HB 454, bans a standard abortion procedure called dilation and evacuation that is most commonly used to end a pregnancy after 15 weeks.A Louisville clinic, EMW Women's Surgical Center, immediately challenged the statute, arguing that it poses an undue burden on the right to an abortion. A federal district judge in 2019 agreed and struck the law down, <a href="https://s3.documentcloud.org/documents/21083248/govuscourtskywd1064701260.pdf">saying it presented</a> a "substantial obstacle" to abortion rights and violated Supreme Court precedent.The Bevin administration appealed, but the 6th U.S. Circuit Court of Appeals upheld the lower court ruling, affirming that the law was unconstitutional. In the meantime, an election took place and Bevin was replaced by Democratic Gov. Andy Beshear, who decided to drop the case without further appeal.Yet newly elected Attorney General Cameron, a Republican, wanted to continue to defend the law. The 6th Circuit declined his request to intervene, saying it was too late. So Cameron turned to the Supreme Court, asking the justices to review whether he should be allowed to take over and defend the law. On Tuesday, Kentucky's principal deputy solicitor general, Matthew Kuhn, argued that position. "What we as Kentuckians want is a fail-safe," Kuhn told the court. "If a state official who enforces state law says, 'I'm not going to appeal any further,' Kentucky's attorney general can come in for the commonwealth and say: 'No, the commonwealth wants to go farther.'"The justices seemed open to that argument.Chief Justice John Roberts said once the Democratic administration pulled out of the <keyword id="11975980" type="UNKNOWN" weightage="60" keywordseo="legal" source="Orion">legal</keyword> battle, Kentucky "maybe ought to be there in some form, and the attorney general is the one that wants to intervene."Justice Stephen Breyer raised a similar suggestion in his questioning. "There have been a lot of party changes. First the Republicans are in, then the Democrats are in, and they have different views on an abortion statute," he said. "We have an attorney general who think it's a pretty good statute. He wants to defend it.""Why can't he just come in and defend the law?" Breyer asked the lawyer defending EMW Women's Surgical Center, Alexa Kolbi-Molinas of the American Civil Liberties Union.Kolbi-Molinas argued that the attorney general is bound by the lower courts' judgment."The attorney general, it is well-settled in this court, stands in the shoes of his predecessors," she said. <ul class="summary-list"><li><keyword id="11918128" type="UNKNOWN" weightage="60" keywordseo="virginia" source="Orion">Virginia</keyword>'s new Republican attorney general has reversed the state's position in a <keyword id="11893011" type="UNKNOWN" weightage="60" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> case challenging abortion rights.</li><li>The state's new position is that abortion laws should be up to states to decide. </li></ul>Virginia's new Republican attorney general Jason Miyares told the Supreme Court that the state will no longer oppose <keyword id="11898268" type="UNKNOWN" weightage="60" keywordseo="mississippi" source="Orion">Mississippi</keyword>'s restrictive abortion law, according to a <a href="https://files.constantcontact.com/d3e83e11901/0daf6061-15b8-483e-b1f6-4dda872d35c0.pdf">letter</a> sent to the nation's top court on Friday. Former Attorney General Mark Herring, a Democrat, had signed onto a <a href="https://www.oag.state.va.us/media-center/news-releases/2154-september-20-2021-herring-pushes-back-against-mississippi-s-efforts-to-overturn-aspects-of-roe-v-wade">legal brief</a> in September with 24 state attorneys general urging the Supreme Court to protect the constitutional right to an abortion and strike down Mississippi's law, which seeks to ban the procedure after 15 weeks of pregnancy. Citing a "change in Administration," Miyares has "reconsidered" Virginia's previous position on the law, the state's Solicitor General Andrew Ferguson wrote in a letter to Supreme Court. "Virginia is now of the view that the Constitution is silent on the question of abortion, and that it is therefore up to the people in the several States to determine the legal status and regulatory treatment of abortion," Ferguson wrote. In December, the Supreme Court heard <a href="https://www.businessinsider.com/supreme-court-hears-biggest-abortion-challenge-to-roe-v-wade-in-decades-2021-12">arguments</a> on the Mississippi case, which threatens to overturn Roe v. Wade, the 1973 landmark ruling that legalized abortion nationwide up until pre-viability, or around 24 weeks of pregnancy. The case represents the most significant challenge to abortion rights in nearly three decades."It is Virginia's position that the Court's decisions in Roe and Casey were wrongly decided," Ferguson wrote, referencing a subsequent 1992 Supreme Court decision that upheld abortion rights.Under Democratic leadership, Virginia has thrown its support behind abortion rights, and campaigned on the issue last year in a fight to protect them. Republicans, including Miyares and then-gubernatorial candidate Glenn Youngkin, said they were "pro-life" but largely steered clear of offering policy proposals. Miyares and Youngkin were sworn into office on January 15, and now have already taken steps to push back on abortion rights.The Supreme Court is expected to hand down a ruling on the case by June.

Virginia's new Republican attorney general tells the Supreme Court the state will no longer oppose Mississippi's restrictive abortion law

The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> asked Reliance ADAG's power distribution company, BSES Yamuna to pay up its dues to electricity generating utilities totaling Rs 257 crore by July 15. Currently, the company has 13.5 lakh customers in central and east Delhi.
 As per the records till June 30, the power distribution company owes Rs 60 crore to central generating and transmission utilities, including <keyword id="75753" type="COMPANY" weightage="40" keywordseo="Damodar-Valley-Corporation">Damodar Valley Corporation</keyword>, <keyword id="105181" type="COMPANY" weightage="40" keywordseo="Power-Grid-Corporation">Power Grid Corporation</keyword> and <keyword id="2402471" type="UNKNOWN" weightage="40" keywordseo="Aravali-Power-Company-Ltd-">Aravali Power Company Ltd.</keyword> <keyword id="75796" type="COMPANY" weightage="80" keywordseo="BSES-Yamuna">BSES Yamuna</keyword> also owes Rs 195 crore to Delhi-based power generating units Indraprastha, Delhi Transco and <keyword id="301258" type="COMPANY" weightage="40" keywordseo="Pragati-Power-Corporation">Pragati Power Corporation</keyword>. 

	BSES Yamuna also clarified that the government subsidy, which was promised but not factored in, was to the tune of Rs 96 crore and hence its total liability would be Rs 161 crore.
 Appearing for Delhi Transco and Indraprastha, <keyword id="132134" type="POSITION" weightage="40" keywordseo="Additional-Solicitor-General">additional solicitor general</keyword> <keyword id="243257" type="PERSON" weightage="40" keywordseo="Tushar-Mehta">Tushar Mehta</keyword> said the total dues as per their calculation was Rs 370 crore. However, <keyword id="45179" type="CITY" weightage="40" keywordseo="NTPC">NTPC</keyword>, which was the first to approach the court with a threat to disconnect power supply to the national capital because of mounting arrears from BSES Yamuna, informed the court that it had been fully paid by the discom. BSES’s <keyword id="2117" type="POSITION" weightage="40" keywordseo="senior-advocate">senior advocate</keyword> K V Vishwanathan attempted to put forth the discom's grievance. He said the state had not kept its promise of giving proper return on the Rs 15,000 crore investment made by the company. However, a bench headed by Chief Justice R M Lodha and Justice <keyword id="135052" type="PERSON" weightage="40" keywordseo="Madan-B-Lokur">Madan B Lokur</keyword> and Justice <keyword id="108280" type="PERSON" weightage="40" keywordseo="Kurian-Joseph">Kurian Joseph</keyword> said the apex court would decide about BSES Yamuna's grievances against the <keyword id="6354952" type="ORGANIZATION" weightage="40" keywordseo="Delhi-Government">Delhi government</keyword> later. 

	“We are directing you only to pay current dues. Power generation and transmission companies are no baniya shops. You must clear all dues since January 2014 if you want electricity. You can’t continue like this. You are in arrears, arrears, arrears... This isn’t our headache,” observed the court.
