<ul class="summary-list"><li>Judy Huth alleges that <keyword id="12047791" type="UNKNOWN" weightage="60" keywordseo="bill-cosby" source="Orion">Bill Cosby</keyword> molested her as a minor at the Playboy Mansion and filed a civil suit against him.</li><li>Cosby's legal team claims that it never occurred.</li></ul><p>One of Bill Cosby's accusers may have relied on more passive "sexual refusal messages" to "save face," an expert forensic psychologist testified in court on Thursday.</p><p>Thursday was the second day of trial in Cosby's first civil suit since he was released from jail on June 30, 2021, after a judge vacated his conviction.</p><p>"One of the most common sexual assault myths is that women say no verbally or fight back physically," Dr. Barbara Ellen Ziv, a forensic psychiatrist, told a 12-person jury at the Bill Cosby v Judy Huth trial in Santa Monica, California.</p><p>Huth's legal team claims that Cosby molested her in 1975 at the Playboy Mansion, even after she lied and said she was menstruating. Cosby denies all sexual assault allegations.</p><p>As part of the suit, Huth's team called Ziv as an expert on sexual assault. Ziv was a blind expert asked to offer opinions on hypothetical situations but has not met or evaluated either party.</p><p>Ziv testified that "women who are sexually assaulted by someone who is known to them" typically try to use "sexual refusal messages" — such as saying they're on their period, that they have to leave, or that they have an STD — hoping it "allows a man to save face" or to "preserve social niceties."</p><p><strong style="background-color: #ccffff;"></strong></p><div type="image" title="Plaintiff Judy Huth (L) arrives outside the courthouse for the start of her civil trial against actor Bill Cosby, on June 1, 2022 at Los Angeles Superior Court in Santa Monica, California." height="512" width="1024" msid="91973987" hostid="261"></div><p>Huth, 64, filed her lawsuit against Cosby in 2014 claiming that he molested her in 1974 when she was 15. On May 5, 2022, her team pushed forward a new court filing amending the date of the allegation from 1974 to 1975 — a move that Cosby's team called a "trial by ambush."</p><p>She claims to have met him with a friend at Lacy Park in San Marino, California, while Cosby was filming the movie, "Let's Do It Again," <a href="https://www.scribd.com/doc/249060466/Judy-Huth-v-Bill-Cosby-Complaint?irclickid=UydXePWfoznWUyVWmKRMLzzIUkDx7O1WNQj9zQ0&amp;irpid=10078&amp;utm_source=impact&amp;utm_medium=cpc&amp;utm_campaign=affiliate_pdm_acquisition_Skimbit%20Ltd.&amp;sharedid=businessinsider.com&amp;irgwc=1">according to the 2014 complaint</a>.</p><p>The complaint adds that Cosby, now 84, invited them that same day to meet him at a tennis club the upcoming weekend. At the tennis club, she claims he invited them to a house after their arrival and presented them with alcoholic beverages.</p><p>They then went to another house where Cosby said he had a "surprise" for the two girls, the court document claims. The house turned out to be the Playboy Mansion, per the complaint, and Huth alleges that Cosby told her and her friend to tell the greeters that they were 19 years old.</p><p>In a bed near a game room, Cosby "proceeded to sexually molest her by attempting to put his hand down her pants, and then taking her hand in his hand and performing a sex act on himself without her consent," the complaint alleges, calling the act "childhood sexual abuse."</p><p>Claims, Cosby denies.</p><p>Huth is seeking punitive, exemplary, and compensatory damages from Cosby for alleged sexual battery, intentional infliction of emotional distress, and negligent infliction of emotional distress.</p><p>On Wednesday, <a href="https://www.insider.com/sexual-assault-trial-against-bill-cosby-since-jail-release-begins-2022-6">Huth's friend, Donna Samuelson, 64, who says she was with Huth on that day was the first witness</a> to take the stand in the trial. Samuelson claimed that Huth was upset at the Playboy Mansion.</p><p>"She said 'I want to go, I wanna leave,' she was crying," Samuelson said, according to <a href="https://apnews.com/article/bill-cosby-judy-huth-sex-abuse-trial-1ce19893ab1336f2ea1195299263070a">The Associated Press</a>.</p><p>Samuelson testified that she convinced Huth to stay in an effort to help her feel better.</p><p>"I thought it would calm her down to go swimming and stuff," Samuelson testified, according to the AP. "I said, 'We'll leave as soon as he gets back.'"</p><p>Ziv stated Thursday that the decision to remain at the location after the assault is "consistent" with other cases "especially when the perpetrator is known to the victim."</p><p>Ziv added that "traumatic memories are less likely to erode over time," claiming that sexual assault victims face a "different level of scrutiny than other crimes" with victims.</p><p>Cosby will not be present throughout the trial — invoking his fifth amendment right not to testify.</p><p>Cosby's lawyer Jennifer Bonjean called Huth's allegations "a complete and utter fabrication." </p><p>"Boy did Judy and Donna enjoy themselves," Bonjean told the courtroom on Wednesday. "They stayed for 12 hours. There's no typical response to a traumatic event but partying at the Playboy Mansion does not seem consistent."</p><p>Bonjean, who has represented R. Kelly, also represented Cosby in his criminal trial. </p><p>He was <a href="https://www.insider.com/bill-cosby-released-from-prison-sex-assault-conviction-overturned-2021-6">released from jail</a> last year when the Pennsylvania Supreme Court vacated his conviction claiming a previous district attorney in Montgomery County, Pennsylvania, made a 2005 agreement not to prosecute Cosby.</p><p>Even if the court rules in favor of Huth, Cosby cannot be sent to jail in this civil case, because of the deal with the former district attorney. </p><p><a href="https://www.thewrap.com/60-bill-cosby-accusers-complete-list-breakdown-guilty/">Sixty women have accused</a> "<a href="https://www.nbcnews.com/news/us-news/bill-cosby-says-he-still-america-s-dad-father-day-n1018151">America's Dad</a>" of rape, other sexual harassment, or other sexual violence allegations, but the statute of limitations for sexual assault allegations has prevented most from filing lawsuits against Cosby.</p><p>"If all 60 women who accused Mr. Cosby of assault were able to bring their cases criminally, he would have probably done a life sentence," Camille Cooper, the vice president of public policy at Rape, Abuse &amp; Incest National Network, known as "the nation's largest anti-sexual violence organization," <a href="https://www.insider.com/cosby-got-more-time-than-most-accused-of-sexual-assault-2021-7">previously told Insider</a>.</p><p>While he was incarcerated, 11 civil cases against him had been settled — 10 of which his former insurance company was responsible for settling, according to <a href="https://www.nytimes.com/2022/05/22/arts/television/bill-cosby-civil-lawsuit-sexual-assault.html">The New York Times.</a> </p>

<ul class="summary-list"><li>550 <keyword id="11892913" type="UNKNOWN" weightage="60" keywordseo="women" source="Orion">women</keyword> who say they were assaulted by <keyword id="1042120" type="UNKNOWN" weightage="60" keywordseo="uber" source="Orion">Uber</keyword> drivers have filed a <keyword id="11921506" type="UNKNOWN" weightage="60" keywordseo="lawsuit" source="Orion">lawsuit</keyword> against the company.</li><li>Lawyers for the women say they were kidnapped, falsely imprisoned, and stalked by their drivers.</li></ul><p>A new civil action has been brought against <a href="https://www.businessinsider.com/uber-whistleblower-comes-forward-former-lobbyist-mark-macgann-2022-7">Uber</a> by approximately 550 women who say they were assaulted by drivers, lawyers for the plaintiffs said in a <a href="https://www.prnewswire.com/news-releases/uber-facing-lawsuit-from-sexual-assault-survivors-for-endangering-them-on-rides-and-failing-to-put-adequate-protections-in-place-301586028.html">press statement</a> Wednesday.</p><p>The plaintiffs are being represented by the law firm Slater Slater Schulman LLP. The law firm said the plaintiffs who have signed on to the case include women who were kidnapped, falsely imprisoned, and stalked by Uber drivers.</p><p>The lawsuit has been filed two weeks after Uber published its second-ever <a href="https://uber.app.box.com/s/vkx4zgwy6sxx2t2618520xt35rix022h?uclick_id=b7441693-09e7-46cd-93eb-6e089d330591">US safety report</a>, and contends that Uber has not taken adequate steps to protect riders from sexual assault.</p><p>The report said there had been a <a href="https://www.businessinsider.com/uber-sexual-assault-43-percent-by-passengers-report-2022-7">38% drop in reports of sexual assault</a> from 2019-2020 compared to 2017-2018, although this could in part be due to an overall downturn in journeys caused by the pandemic.</p><p>"There is so much more that Uber can be doing to protect riders, adding cameras to deter assaults, performing more robust background checks on drivers, creating a warning system when drivers don't stay on a path to a destination," Adam Slater, founding partner at Slater Slater Schulman LLP, said in the press statement.</p><p>"Acknowledging the problem through <keyword id="11943424" type="UNKNOWN" weightage="60" keywordseo="safety" source="Orion">safety</keyword> reports is not enough. It is well past time for Uber to take concrete actions to protect its customers," Slater added.</p><p>"Sexual assault is a horrific crime and we take every single report seriously," a spokesperson for Uber told Insider.</p><p>"There is nothing more important than safety, which is why Uber has built new safety features, established survivor-centric policies, and been more transparent about serious incidents. While we can't comment on pending litigation, we will continue to keep safety at the heart of our work," they added.</p><p>This isn't the first time Uber has faced scrutiny over how it handles sexual assault.</p><p><a href="https://www.businessinsider.com/uber-fined-59-million-california-sexual-assault-data-refusal-2020-12">California regulators fined the company $59 million</a> in 2020 accusing it of repeatedly refusing to cooperate when asked for data from its 2019 sexual assault report.</p><p>In 2018, the company abandoned a policy which previously <a href="https://www.nytimes.com/2018/05/15/technology/uber-sex-misconduct.html">forced anyone bringing a sexual assault or harassment claim into arbitration</a>, meaning they couldn't go to court.</p>

<ul class="summary-list"><li><keyword id="12087449" type="UNKNOWN" weightage="60" keywordseo="aly-raisman" source="Orion">Aly Raisman</keyword> held an ice cube, a technique to shock the body when it's experiencing trauma symptoms. </li><li>Surviving sexual assualt can manifest in physical ways long after the abuse. </li><li>The strategy, shown in her special "Darkness to Light," is a dialectical behavioral therapy tool. </li></ul><p>In her new <a href="https://www.mylifetime.com/specials/aly-raisman-from-darkness-to-light">Lifetime documentary "Darkness to Light,"</a> retired gymnast Aly Raisman often describes how <a href="https://www.insider.com/aly-raisman-said-abuse-made-so-tired-couldnt-stand-shower-2021-9">surviving trauma takes a physical toll</a>. The two-time Olympian was abused by former USA gymnastics team doctor Larry Nassar, and has been a <keyword id="11897683" type="UNKNOWN" weightage="60" keywordseo="sexual-assault" source="Orion">sexual assault</keyword> awareness advocate since opening up about it in 2017. </p><p>In the special, Raisman said she often feels like she's going to throw up after media interviews about sexual assault. "It literally feels like I just finished a training session," the former USA Gymnastics team captain said. </p><p>Even when there's not an obvious trigger, Raisman said she can experience physical symptoms of trauma. "I'd be at a dinner and I felt like my throat was closing up," she said in the show. </p><p>But during a meeting with another sexual assault survivor and advocate, <a href="https://transgenderlawcenter.org/programs/disability-project/disability-project-advisory-board">Ericka Dixon,</a> Raisman learned a trick for regaining control when the body misperceives threat: put an ice cube in your hand. </p><p>"If you're really activated or in crisis, it shocks your body," Dixon, also a disabilities advocate, said. "The goal is really to return to your body, to calm down enough so that then you can be in a better head space to figure out what to do next." </p><div type="image" title="Ericka Dixon puts an ice cube on the back of her neck." height="983" width="1310" msid="86571167" hostid="261"></div><p>Dixon said some people put the ice cube on the back of their neck, their wrists, or even put their whole face in a bowl of ice. Raisman tried holding one cube in her hand. "It actually feels better than I thought it would," she said. </p><h2>The ice trick is one of several distress tolerance strategies in dialectical behavior therapy</h2><p>Dixon said she learned the technique in dialectical behavior therapy, a type of <a href="https://www.insider.com/surprising-forms-of-therapy-2019-2">cognitive behavior therapy</a> that aims to help people stay in the moment, develop healthy coping mechanisms, regulate emotions, and improve relationships, according to <a href="https://www.verywellmind.com/dialectical-behavior-therapy-1067402">Verywell Mind</a>. </p><p>It was developed in the 1980s for patients for whom <keyword id="12189698" type="UNKNOWN" weightage="60" keywordseo="cbt" source="Orion">CBT</keyword> fell short, and focuses on self-acceptance and positive change. In addition to holding an ice cube, other "distress tolerance" exercises include running up and down stairs or moving from indoors to outdoors in order to distract yourself and let your body, not mind, lead in moments of perceived crisis. </p><p>"We are finding more therapeutic approaches, we're understanding more and more how trauma is affecting the mind and body, and how we can teach our patients how to take control over these symptoms," <a href="https://www.the-nhsn.org/Members/m_martinez-d.aspx">neuroscientist Dr. Diana Martinez</a> said in the special. </p>

<ul class="summary-list"><li><keyword id="11928261" type="UNKNOWN" weightage="60" keywordseo="prince-andrew" source="Orion">Prince Andrew</keyword> has had the Freedom of the City of <keyword id="12973722" type="UNKNOWN" weightage="60" keywordseo="york" source="Orion">York</keyword> stripped from him by its council.</li><li>In an extraordinary general meeting, councillors voted unanimously to remove the honour.</li></ul><p>Prince Andrew has been stripped of the Freedom of the City of York.</p><p>Councillors voted unanimously with two abstentions to remove the honour, which was bestowed upon Andrew in 1987.</p><p>The motion was supported by the Liberal Democrats and Greens, who control the council, as well as the Labour and Conservative groupings.</p><p>The motion was introduced after <a href="https://www.insider.com/prince-andrew-virginia-giuffre-reach-settlement-in-sexual-assault-lawsuit-2022-2">Andrew reached a settlement with Virginia Giuffre</a>. Giuffre had brought a sexual-assualt lawsuit against him. In the joint settlement, Andrew did not admit to sexually abusing Giuffre and did not disclose the amount of money paid in a nonprofit run by Giuffre advocating for victims of trafficking.</p><p>Insider spoke with Rachael Maskell, Labour MP for York Central, ahead of the meeting.</p><p>"We're a human rights city. We espouse and promote those rights and values. Andrew by his associations with people who clearly do not uphold those values is concerning in itself."</p><p>Passing the motion "would be an appropriate sign", she said.</p><p>Liberal Democrat Councillor Darryl Smalley, the council's executive member for culture, proposed the motion.</p><p>He said: "The removal of this honorary title sends the right message that we as a city stand with victims of abuse. The next logical step is now for Prince Andrew to do the right thing and relinquish his Duke of York title.</p><p>"If he fails to do so, the Government and Buckingham Palace must step in to remove his title to finally end Prince Andrew's connection to York."</p><p>Smalley told Insider that any resident of York would do so. Councillor Dave Taylor suggested Andrew's daughter, Beatrice, could be made Duchess of York.</p><p>Maskell is also campaigning to strip the prince of his Duke of York title. Andrew was made the Duke of York in 1986.</p><p>"Nobody has the power to remove a title, that can only be achieved if there is legislation," Maskell said.</p><p>"That challenge falls to the next Parliamentary session, first of all to see if the government brings anything forward, but if not, I've been looking at this with the clerks."</p><p>In January, <a href="https://www.insider.com/residents-say-they-could-be-next-duke-of-york-2022-1">Insider spoke to residents of York on their views of Andrew's title</a>. Several said it should be removed from him, with a few offering to take up the title themselves.</p><p>The vote took place at an extraordinary general meeting of the City of York Council at York Racecourse.</p><p>In January, the racecourse announced it would seek to rebrand the horse race called the Duke of York Stakes to the 1895 Duke of York Stakes. It was originally named after Prince George, later George V, who was in 1895 the Duke of York.</p><p>At the meeting, a member of the public called on the council to never again refer to Andrew as the Duke of York, only as Andrew Windsor.</p><p>"He needs to be declared persona non grata", Gwen Swinburn said. She told councillors they should write to the racecourse to say they should never invite Andrew again.</p>

<ul class="summary-list"><li>The woman who accused <keyword id="3664204" type="PERSON" weightage="60" keywordseo="Trevor-Bauer">Trevor Bauer</keyword> of sexual assault continued her testimony in court on Tuesday.</li><li>Her legal team played a voicemail Bauer left as she was checked into the hospital for injuries from the alleged assualt.</li><li>Bauer has denied all allegations of sexual assault and domestic violence.</li></ul><p>The woman who accused Los Angeles Dodgers pitcher Trevor Bauer of sexual assault testified Tuesday about the injuries she says she sustained at the baseball star's hands.</p><p>Lawyers for the woman, who Insider has chosen not to name, played a voicemail they say Bauer left as she was checked into the Palomar Medical Center in Escondido, California.</p><p>"Hey dude, just wanted to check in and see how you're doing, I'm worried about you," Bauer said in the voicemail.</p><p>Lawyers for the woman also shared text messages Bauer sent in response to photos of her face after one alleged assault in May, asking, "Damn girl are you ok?" </p><p>In a statement provided to Insider in August, Bauer's agent, Jon Fetterolf, denied allegations of sexual abuse and said the encounters between Bauer and the woman were consensual. Bauer is currently on leave from the Dodgers.</p><p>In court Tuesday, the woman <a href="https://www.insider.com/trevor-bauer-accuser-testifies-about-very-forceful-sexual-encounter-2021-8">continued her emotional testimony</a>, saying that after the second time she alleges Bauer assaulted her, "I just wanted to get out of his house."</p><p>She described being nauseous and vomiting several times in a Starbucks parking lot on her way home to San Diego. </p><p>"I texted Trevor a picture of my face because I wanted him to see what he did. And I wanted to know what happened when I was unconscious," she said, adding that her injuries appeared worse the following day.</p><p>She said that she first went to an urgent care facility in San Diego for treatment because she didn't want to be seen by more people, but that facility told her to go to the ER because they couldn't treat her injuries.</p><p>"I felt lifeless," she said about arriving at the hospital. "I was so tired of telling the story."</p><p>"I did not want to talk to the police, but a social worker told me that because of the injuries it was the hospital's policy to call law enforcement," she added. "At first I refused to say his name, just that he was a baseball player."</p><p>The woman also described a deep fear and anxiety that set in several days after the second alleged assault. She said she told a cousin and a friend about the incident, and showed them her injuries.</p><p>The woman further testified that during a cold call she conducted with the Pasadena Police Department, Bauer "was asking how we could move forward." She added Bauer apologized on that call and admitted to punching her in the buttocks.</p><p>"I lost my job, I lost my residence. The sadness I live with every day, and the living in fear of Trevor Bauer, is brutal," she told the court. "I am terrified of him and what he can do to me."</p>

A new Bill Cosby museum exhibit ignores sex-assault allegations, and people are furious

<p><div class="KonaFilter image-container float_right"><div class="image on-image"></div><p></p></div>Ex-frat member and whistle-blower James Vivenzio filed a lawsuit Monday against Penn State, the national fraternity of Kappa Delta Rho (KDR), Penn State's chapter of the fraternity, the Interfraternity Council, and Panhellenic Association.</p><p>The suit - <a href="http://www.buzzfeed.com/maryanngeorgantopoulos/whistleblowers-lawsuit-says-penn-state-knew-about-fraternity#.jdnYzmApe">posted online by Buzzfeed</a> - alleges the university did nothing to intervene when Vivenzio alerted it to "reckless, barbaric, and life-threatening" hazing and alleged sexual assault of women by the <a href="https://www.kdr.com/">Kappa Delta Rho (KDR)</a> fraternity on campus.</p><p>Here's one of the more disturbing parts of the complaint:</p><p style="padding-left: 30px;"><em>The KDR fraternity operated much like a gang, obtaining some of its funding by converting the pre-paid food plans of its pledges and confiscating and selling their prescription drugs. These funds were then used to pay for countless socials, pre-socials and parties at the fraternity house at which underage students were plied with alcohol and, in some cases, drugs to facilitate sexual assault and abuse. Crucial to the fraternity's routine schedule of parties, alcohol and dru use, and sexual misconduct, was the regular and violent hazing of fresh recruits.</em></p><p style="padding-left: 30px;"><em>Plaintiff James Vivenzio is the whistleblower who, in January 2015, brought evidence to police in the adjoining Borough of State College, Pennsylvania, where KDR's fraternity house is located, about an invitation-only Facebook site that was used by KDR members to post photos of, among other subjects, female students naked, unconscious and, in some cases, in the act of being sexually assaulted. The Facebook site was also used to facilitate hazing by enabling instant communication with pledges and also to humiliate, harass and beckon pledges on a 24/7 basis.</em></p><p><div class="KonaFilter image-container display-table float_left"><div><div class="image on-image"></div><p></p></div></div>Vivenzio says he met with an investigator from Penn State in April 2014 to share the evidence and prompt action from the university. However, he says, that action never came until a full year later in May 2015 when Penn State issued a three year suspension for KDR.</p><p>Vivenzio alleges that Penn State acted only after he went to the police.</p><p>The lawsuit claims the alleged hazing caused Vivenzio to fail out after his freshman year.
