The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday issued a slew of directions for speedy disposal of criminal cases against Members of Parliament and Members of Legislative Assembly (MPs/MLAs) and asked High Courts to register a Suo Motu case for effective monitoring and speedy disposal of such cases. A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra said it was difficult for it to form a uniform guideline for trial courts across the country relating to speedy disposal of <keyword id="16453350" type="General" weightage="40" keywordseo="cases-against-mps" source="Orion">cases against MPs</keyword> and MLAs. The top court left it to the high courts to evolve such measures for effective monitoring of such cases. The bench directed that High Court Chief Justices shall register a suo motu case titled "In Re Designated Courts for MPs and MLAs" to monitor the early disposal of pending criminal cases against lawmakers. It directed that the suo motu case be heard by a special bench headed by the Chief Justice or a bench assigned by him or her. It was further directed that the Special Bench of the High Court may list the matter at regular intervals as felt necessary. The top court said the High Court may issue such orders and directions as necessary for expeditious and effective disposal of the cases. The bench further ordered that the Special Bench of the High Court may consider taking the assistance of the Advocate General or prosecutor to assist it. The apex court also directed that cases against MPs and MLAs that are punishable by death should be prioritised over other cases. Then cases punishable with imprisonment for five years or more will be given priority. It further said that the cases would not be adjourned by the trial court except for rare and compelling reasons. The top court said that the High Court may require a Principal District and Sessions judge to bear the responsibility of allocating the subject cases to such courts. The High Court may call upon the Principal District and Sessions judge to send reports on such intervals, it added. The concerned principal and session judge should ensure sufficient infrastructural facilities are available for the trial of such cases, as directed by the top court. The directions of the top court came on a PIL filed by advocate Ashwini Upadhyay seeking speedy disposal of criminal cases pending against MPs and MLAs. Earlier, the Enforcement Directorate (ED) filed a status report stating that there are 51 MPs and 71 MLAs, sitting and former, who stand accused by the agency of offence under the Prevention of Money Laundering Act (PMLA). The report did not specify exactly how many of those are sitting MPs or MLAs and how many are former MPs or MLAs. The Central Bureau of Investigation (CBI) had also submitted a similar report stating that a total of 121 cases are pending trial against sitting and former MPs and MLAs. The number of MPs involved in those cases is 51, out of which 14 are sitting, 37 are former and 5 are deceased. The report further stated that 112 MLAs are involved in CBI cases, out of which 34 are sitting, 78 are former and 9 are deceased. The number of cases pending investigation against MPs and MLAs by the CBI is 37, according to the report the CBI submitted. Senior advocate Vijay Hansari, who was assisting the apex court in the case as amicus curiae, had highlighted a "glaring case of inordinate delay" in the trial of cases against lawmakers, submitting that many cases were pending for over five years. The apex court had sought a status report from Hansaria relating to the pendency and grant of sanctions for prosecution, the expected time for completion of the investigation and reasons for delay in the same. Hansaria had sought directions to ensure that courts dealing with cases against lawmakers should exclusively try such issues. The plea sought speedy disposal of cases against them and pointed out that while judges and babus were suspended for such activities, politicians were condoned by the law. As of now, convicted politicians have been banned from the polls for six years.

SC issues directions to HCs for speedy disposal of criminal cases against MPs, MLAs

In a significant judgement, the Supreme Court on Thursday directed political <keyword id="15047" type="PERSON" weightage="20" keywordseo="Parties">parties</keyword> to upload on their respective websites the details of all pending criminal cases against candidates contesting polls, citing the alarming increase in criminalisation of politics in past four general elections. A bench headed by Justice R.F. Nariman said the parties would have to clarify on reasons for selecting candidates with pending criminal cases and upload this information on their websites. The top court also observed that political parties will have to submit a compliance report within 72 hours, to the Election Commission, after selecting candidates having pending criminal cases. The order from the top court came on a contempt plea filed by Advocate Ashwini Upadhyay, raising critical issues due to increase in criminalisation of politics. The plea claimed the directions given by the apex court in its September 2018 verdict, which specified guidelines to disclosure of criminal antecedents by candidates, is not being followed in letter and spirit. The top court also directed that political parties would have to publish this information on their social media platforms like <keyword id="6354576" type="COMPANY" weightage="20" keywordseo="facebook">Facebook</keyword> and <keyword id="6354616" type="COMPANY" weightage="20" keywordseo="Twitter">Twitter</keyword> besides publishing this information in one local vernacular and one national newspaper. Parties must publish candidates criminal cases on sites: SC

New Delhi, More than 10 years after a Supreme Court judgement paved way for introduction of the <keyword id="20335981" type="General" weightage="20" keywordseo="nota" source="keywords">NOTA</keyword> button on EVM for polls, the number of voters choosing it still remains low, with the experts dubbing it as a "toothless tiger" with no implications on the results. NOTA (None of the Above) was introduced in India through the Supreme Court's judgement in September 2013. The need to introduce NOTA was felt to discourage the parties from fielding tainted candidates. The Supreme Court directed the Election Commission to make necessary provision in the ballot papers/EVMs so that the voters can decide not to vote for any of the candidates in the fray. Introduced in 2013, the NOTA option on electronic voting machines has its own symbol - a ballot paper with a black cross across it. After the Supreme Court order in September 2013, the Election Commission added the NOTA button on the EVMs as the last option on the voting panel. One ballot unit has 16 buttons. Before the apex court order, those not inclined to vote for any candidate had the option of filling what is popularly called form 49-O. But filling out the form at the polling station under Rule 49-O of the Conduct of Elections Rules, 1961, compromised the secrecy of the voter. However, even as NOTA has secured over 1.29 crore votes in the state assembly elections and the <keyword id="19895394" type="General" weightage="20" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> elections combined in the last five years, the number of candidates with criminal records has increased in both the general and the assembly elections. According to a report by Association for Democratic Reforms (ADR), the share of MPs with declared criminal cases against them has been increasing in the last decade. While 30 per cent elected MPs had criminal cases against them in 2009, which went up. Of the 543 winners analysed by the ADR in the 2009 Lok Sabha elections, 162 (30 per cent) had declared criminal cases against them, with 76 (14 per cent) had serious criminal cases against them. In 2019, the share of MPs with criminal and serious criminal cases increased to 43 per cent and 29 per cent. "NOTA has made no difference as far as criminality is concerned, in fact the number of candidates with criminal cases has increased," Major General (Retd) Anil Verma, Head of ADR, told PTI. "The concept of NOTA was that some pressure would be on the parties not to field tainted candidates. It has not happened," he said. Overall in different state and general elections, votes polled on NOTA have been between .5 per cent to 1.5per cent, according to data compiled by the ADR. It secured around 1.06 per cent votes in the 2019 Lok Sabha polls, and among states, highest was when it got 1.98 percent of the total votes in the 2018 Chhattisgarh Assembly polls. The lowest number of votes NOTA in the Lok Sabha was 100 votes in Lakshadweep, and among the state polls, it secured the lowest percentage of vote share - 0.46 percent in both the Delhi State Assembly Elections, 2020, and the Mizoram State Assembly Elections, 2018. "Unfortunately, it turned out to be a toothless tiger. It merely provided a platform to express dissent or one's anger for political parties to take note and nothing more," <keyword id="20887282" type="General" weightage="20" keywordseo="maj-gen-verma" source="keywords">Maj Gen Verma</keyword> (Retd) said. He, however, pointed out that overall, the percentage of NOTA votes in seats reserved for the Scheduled Castes and the Scheduled Tribe has been slightly higher, which may indicate there are more grievances among these groups. "In the reserved constituencies, we have seen the percentage of NOTA votes are higher. Perhaps the tribals and SCs have more grievances so they go in larger numbers for NOTA," he said. Constituency wise, NOTA has secured as high as 27,500 votes in Maharashtra's Latur Rural constituency, a seat reserved for the SC community, over 13 per cent of the total votes. NOTA got the second spot, with Congress' Dhiraj Deshmukh winning with over 67 per cent of the total votes. In 'Red Alert Constituencies', the seats with three or more candidates with criminal cases contesting the elections, NOTA secured 26, 77,616 votes (26.77 lakhs) in the state assembly elections since 2018. It ranges from 1.63 per cent in Bihar in 217 red alert constituencies to 0.43 per cent in Delhi. In the 2019 Lok Sabha polls, the highest number of NOTA votes (51,660) were polled in Bihar's Gopalganj, another reserved SC constituency, where it secured the third spot getting 5.03 per cent of the total votes. Axis India chairman <keyword id="20816878" type="General" weightage="20" keywordseo="pradeep-gupta" source="keywords">Pradeep Gupta</keyword> said there is a requirement to give more teeth to the NOTA option. "I believe that candidates, who have lost against NOTA should not get a chance to contest again. That is what the logic is all about. Since there is no such rule, many voters think what is the point of choosing NOTA," Gupta told PTI. "In 2014, 1.08 pc voters chose NOTA, the percentage was 1.06 pc in 2019. It is a sizeable number but I believe it is more due to error and less due to intention," Gupta said. "But if a rule is brought in barring the rejected candidates from contesting again, I believe the number will go up like anything. The political parties understand the sensitivity of this and that is why I believe no one will favour such a law and hence NOTA is a toothless option," he added. Calls have also been made for scrapping NOTA. Former Chhattisgarh chief minister Bhupesh Baghel had last year sought scrapping NOTA, stating that in certain cases it polled more votes than winning margin. In 2018, the Supreme Court had ruled that NOTA option should not be given in the <keyword id="19895369" type="General" weightage="20" keywordseo="rajya-sabha" source="keywords">Rajya Sabha</keyword> elections.

None of the Above or NOTA toothless without right to reject, say experts

New Delhi, Jan 5 () The CBI has registered a fresh case in coal scam in connection with alleged irregularities in the allotment of Kilhoni block in Maharashtra to Nippon Denro Ispat Limited in 1998, officials said on Sunday.
 In its FIR, the agency has said the case of allocation of Kilhoni coal block to NDIL was discussed in the 13th meeting of Screening Committee on August 24, 1998 where clearance was given, the CBI FIR said.
 The committee also directed Coal Indian Limited to include Kilhoni block in the list of blocks to be offered for captive mining, it said.
 Kilhoni was not in the list of identified coal blocks for captive mining and the apex committee of CIL did not agree for allocation of this block to NDIL, it alleged.
 "The 12th Screening Committee had not agreed for allocation of Kilhoni Block, Maharashtra to NDIL even then 13th SC allocated it to NDIL even though the block was included in the list of blocks for captive mining," it alleged.
 After conducting a seven-year long preliminary enquiry into alleged irregularities in the allocation of coal blocks during the period 1993-2005 on the complaint of then Congress MP Sandeep Dikshit, the agency has registered the FIR against NDIL.
 "The...information discloses that Nippon Denro Ispat Ltd along with unidentified public servants in a criminal conspiracy cheated the Government of India and committed offences punishable under 120-B (criminal conspiracy) read with 420 (cheating) and...Prevention of Corruption Act," the FIR alleged. CBI registers fresh case in coal scam pertaining to 1998 allotment of Kilhoni block

The <a href="http://www.businessinsider.in/searchresult.cms?query=Special+Investigation+Team">Special Investigation Team (SIT)</a> is leaving no stone unturned to unearth <a href="http://www.businessinsider.in/searchresult.cms?query=black+money">black money</a> and the tax authorities are in a haste to file cases against people having illicit money stashed abroad. Following this, the foreign bank account holders are now under pressure and crowding tax tribunals to either stop persecution or to disclose their names. 
 
However, as per lawyers and chartered accountants, the tax authorities are showing inappropriate haste in filing criminal cases for concealment of income, even when appeals are pending before adjudicatory forums. 
 The name of KK Modi, chairman of Modi group, allegedly appeared in the <keyword id="6358584" type="CITY" weightage="20" keywordseo="HSBC">HSBC</keyword> list after which he moved the <a href="http://www.businessinsider.in/searchresult.cms?query=ITAT">Income Tax Appellate Tribunal (ITAT)</a> seeking a stay on prosecution proceedings initiated against him. Modi denied any comment and said that he was not aware of any such account in any foreign bank which has around Rs 3 crore deposited. 
 As per an <keyword id="6354751" type="COMPANY" weightage="20" keywordseo="Income-Tax">income tax</keyword> officials aware of the matter, Modi has paid taxes under protest but refused to sign the consent form. The matter was presented in front of the <keyword id="6402350" type="ORGANIZATION" weightage="20" keywordseo="ITAT">ITAT</keyword> last week and another date has been fixed for the hearing. 
 
Meanwhile, in June this year, the tax authorities issued a show-cause notice, under Sections 276 (c) and 276 (d) of IT Act, for initiation of prosecution proceedings for alleged concealment of income. A questionnaire was sent to Modi's office, requesting a formal response, but his spokesman Harmanjit Singh refused to comment. 
 Modi’s advocate in ITAT, senior advocate Ajay Vohra also refused to comment on the matter. The <keyword id="65338" type="ORGANIZATION" weightage="20" keywordseo="Income-Tax-Department">Income Tax Department</keyword>'s representative questioned the jurisdiction of ITAT to hear the petition by Modi seeking a stay, since the matter had to do with a criminal case. 
 
The representative informed the tribunal that "on the Swiss account, Mr Modi's address is there, mobile number is there, we conducted a search, he conceded and paid taxes but they are refusing to own up the transaction, and also refusing to sign the consent form." However, Modi's lawyer denied owning the account. "When the Swiss account doesn't belong to me, I have no locus to sign the consent form." He also informed the tribunal that his appeal has been dismissed by CIT (Appeals). 
 
However, according to official sources, the ITD had initiated prosecution proceedings against Modi, even before the appeal could be disposed of by CIT (Appeals). 
 
Similarly, in cases of Sanjiv Gupta, Pradip Burman, Rear Admiral PN Aggarwal, all foreign account holders, appeals were pending before CIT (appeals), but criminal proceedings were initiated against them. This issue also figured in Bishwanath Garodia's case, another HSBC account holder, who has got relief from Calcutta high court. 
 
The court order, reviewed by Economic Times says, no steps can be taken against Garodia, "till the appeal pending before the Commissioner (appeals) is disposed of." 
 
On May 7, this year CJM Alipore had issued summons against Bagrodia, on a complaint filed under section 276 (c), by tax authorities. Garodia had claimed that the "issue regarding the alleged concealment of income by the writ petitioner by maintaining an account with HSBC, Geneva, Switzerland is sub judice before the Commissioner (Appeals) Central -21, Kolkata." 
 The high court order also mentioned about an SC observation in Commissioner of Income Tax vs Bhupen Champak Lal Dalal case, wherein the apex court affirmed the order of the <keyword id="48485" type="ORGANIZATION" weightage="20" keywordseo="Bombay-high-court">Bombay High Court</keyword>, staying criminal proceedings. It said, "when ultimately the result to come out of the proceedings before the appellate authorities would have a definite bearing on the cases alleged against the respondents, we find that the high court order is justified in granting the interim order it did."

Black Money: Foreign bank account holders accuse tax authorities of haste in filing complaints

New Delhi, Jan 20 () Adani Enterprises on Monday said that it has not done anything wrong in supply of the dry-fuel amid reports that the CBI registered a case against the company for alleged coal supply contract irregularities.
 The firm was replying to the BSE in response to the clarification sought by the bourse on a media report which said that the Central Bureau of Investigation (CBI) had booked "Adani Enterprises, officers for alleged irregularities in coal supply contract".
 "In this context, please note that the subject matter is an old one. The company has complied with the process, all formalities and relevant laws for the subject supply of coal. The company has not done anything wrong in supply of coal."
 The company further said that it is a preliminary investigation report only and added that it shall respond to the same and shall also put forth the factual position to the authority.
 The shares of Adani Enterprises were trading at Rs 225.35 a piece on BSE, down 1.31 per cent from the previous close.
In its FIR filed on Wednesday after a detailed preliminary enquiry in the matter, the CBI booked Adani Enterprises Ltd, the then NCCF chairman Virender Singh, the then managing director G P Gupta and senior advisor SC Singhal under IPC sections related to alleged criminal conspiracy, cheating under Indian Penal Code and Provisions of Prevention of Corruption Act, officials said last week. All of a sudden, the same party that had opposed the idea of <keyword id="155319" type="COMPANY" weightage="20" keywordseo="Aadhar">Aadhar</keyword>, calling it a fraud scheme and assured of <keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword> enquiry if voted to power, has taken a U-turn from its own move only three years after ruling the country. While CBI is being engaged elsewhere, the finance minister <keyword id="42575" type="PERSON" weightage="20" keywordseo="Arun-Jaitley">Arun Jaitley</keyword> has mandated the linking of Aadhar to <keyword id="61610" type="ORGANIZATION" weightage="20" keywordseo="pan">PAN</keyword>, driving licenses and several other documents. 
 
Why do we take U-turn? Before we jump in to analyze Aadhar and its allied insecurity, let’s get straight into philosophy of contradictions. What characterizes a critical thinker? American feminist historian <keyword id="4353413" type="UNKNOWN" weightage="20" keywordseo="joan-wallach-scott">Joan Wallach Scott</keyword> would say “pointing a finger to contradictions.” French philosopher François Noudelmann in his book <keyword id="310615" type="PERSON" weightage="20" keywordseo="Le">Le</keyword> Génie du Mensonge (The Genius of Lies) portrays <keyword id="352788" type="PERSON" weightage="20" keywordseo="Michel-Foucault">Michel Foucault</keyword> as a man who has the courage of truth. 
 Perhaps U-turns are a necessary ingredient for triggering intellectual blunders. And nobody better than <keyword id="41281" type="ORGANIZATION" weightage="20" keywordseo="NDA">NDA</keyword> government knows that most of us struggle to maintain stability in psychological unity. And at such a juncture, contradictions produce destabilizing breaches in the self. 
 
How the government wants to go with Aadhar? 
The 12-digit number will be required for all citizens of India to file tax returns, driving licenses, filing EPF, getting railway tickets and a variety of other services. 
 
 
 
Why is it alarming? 
Firstly, we need to do understand how Aadhar cards were made. Terming the procedure as causal wouldn’t be an exaggeration. A card that started as a mere identity card was gradually made into a mechanism to gain benefits from the government and now even to get basic things done in life. 
 
The process of registering people on Aadhar was executed through private enterprises known as enrollers who operated freely without any government supervision at the field level. The qualifications needed to become an enrolment agency were quite low and nobody was from a recognized name. 
 Also with the case of whether Aadhar would be mandatory for all these services still pending in the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword>, taking such a move would be no less than violations of <keyword id="42836" type="ORGANIZATION" weightage="20" keywordseo="SC">SC</keyword> guidelines. 
 Besides, there is zero privacy of an individual. Aadhar doesn’t guarantee any privacy and allows for mass surveillance of the countrymen under the vague term of ‘national security’. Only law that is valid in the case is Section 47 that only <keyword id="86474" type="ORGANIZATION" weightage="20" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (UIDAI) can file criminal complaint for theft of data. 
 
Government is the new <keyword id="4646" type="PERSON" weightage="20" keywordseo="Big-Boss">Big Boss</keyword> 
No you aren’t criminal that you would need to hide. But let’s admit it nobody wants to be tracked by a big brother. Imagine the scene when somebody knows how much you earn and spend, where you holiday and which flight did you take on your last office trip, which hotel did you put up and what broadband do you use. And for many people in the country who work on contracts and you will track every penny you earn even if you don’t work throughout the year.

In his plea, Naidu contended that the Andhra Pradesh High Court had rejected his petition by ignoring his pleading that under Section 17A of the PC Act, which came into force on July 26, 2018, no FIR against a public servant could be registered without prior sanction of the appropriate authority.
