The Supreme Court has dismissed the customs department appeal against <keyword id="76451" type="General" weightage="100" keywordseo="adani" source="Orion">Adani</keyword> Power Maharashtra Ltd. (<keyword id="334816" type="General" weightage="80" keywordseo="apml" source="Orion">APML</keyword>), Adani Power Rajasthan Ltd. (<keyword id="14511074" type="General" weightage="80" keywordseo="aprl" source="Orion">APRL</keyword>) and others in alleged over-valuation of imported goods matter. A bench comprising Justices Krishna Murari and <keyword id="1726232" type="General" weightage="50" keywordseo="sanjay-karol" source="Orion">Sanjay Karol</keyword>, after hearing detailed arguments in the matter from both sides, dismissed the appeal filed by the customs department against APML, APRL and others. According to the counsel familiar with the development, the apex court found that the project cost of APML and APRL was either similar or lower than the price of peers/competitors. The counsel added that the price was lesser than the benchmark per megawatt cost fixed by Central Electricity Regulatory Commission (CERC) and the contract was an EPC contract awarded to the lowest bidder following worldwide bidding called International Competitive Bidding (<keyword id="318416" type="General" weightage="80" keywordseo="icb" source="Orion">ICB</keyword>). According to the counsel, the apex court upheld the findings of both the lower authorities, i.e., adjudicating authority as well as appellate tribunal and confirmed that there was no overvaluation in import of capital goods. The top court dismissed the custom's appeal on Monday. APML &amp; APRL following ICB, imported goods required for setting up of thermal power projects in Maharashtra and Rajasthan. Likewise, consortium led by PMC Projects (India) pvt. ltd., which was awarded the contract following ICB, imported goods for setting up of transmission line and substation package for Maharashtra Eastern Grid Power Transmission Co. Ltd. (MEGPTCL). The Directorate of Revenue Intelligence (DRI), in May 2014, issued show cause notices (SCNs) to APML, APRL, MEGPTCL and others alleging over-valuation in import of capital goods. The adjudicating authority of DRI in 2017, the same authority which issued the SCNs after dealing with it in detail, held that all the imports were genuine and concluded that the value declared is correct and is not required to be re-determined. Later, SCNs were dropped. In 2022, the appellate tribunal dismissed the plea filed by the customs department and confirmed that there was no overvaluation while importing the equipment by Adani. SC dismisses custom's plea claiming overvaluation in import of capital goods by Adani

Chief Justice of India DY Chandrachud on Monday administered the oath of office to the five new judges as the <keyword id="6354977" type="General" weightage="100" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> judges. President Droupadi Murmu had on Saturday signed the warrants to appoint five new judges to the Supreme Court. The new judges were inducted after a swearing-in ceremony today in the Supreme Court. Rajasthan High Court (HC) Chief Justice Pankaj Mithal, Patna HC Chief Justice <keyword id="1726232" type="General" weightage="50" keywordseo="sanjay-karol" source="Orion">Sanjay Karol</keyword>, Manipur HC Chief Justice PV <keyword id="14272" type="General" weightage="50" keywordseo="sanjay-kumar" source="Orion">Sanjay Kumar</keyword>, Patna HC judge, Justice Ahsanuddin Amanullah and Allahabad HC judge, Justice Manoj Misra took oath as judges of the top court. The Supreme Court Collegium on December 13 last year had recommended these names for the elevation. On February 3, an apex court bench led by Justice <keyword id="6383088" type="General" weightage="50" keywordseo="sanjay-kishan-kaul" source="Orion">Sanjay Kishan Kaul</keyword> gave a word of caution to the Centre saying that things would get "uncomfortable" if the government continues to delay judicial appointments and transfers. Justice Kaul had told Centre, "If you keep them pending... you will make us take some very, very difficult decisions." With the swearing-in of five new judges, the strength of the top court went up to 32 from 27 and only two vacancies remain. The Supreme Court has a sanctioned strength of 34 judges. The Supreme Court Collegium on January 31 recommended two more names for elevation to the apex court. These two names are Allahabad High Court's Justice <keyword id="1399371" type="General" weightage="50" keywordseo="rajesh-bindal" source="Orion">Rajesh Bindal</keyword> and Gujarat High Court Chief Justice Aravind Kumar. After August 26, 2021, when nine Supreme Court judges were appointed together, this is the second time when so many judges have been appointed in one single batch. Supreme Court gets five new judges, Chief Justice of India administers oath of office

The Supreme Court on Tuesday held as illegal the third extension granted to the <keyword id="6992715" type="General" weightage="20" keywordseo="enforcement-directorate-chief" source="Orion">Enforcement Directorate chief</keyword> <keyword id="634984" type="General" weightage="20" keywordseo="sanjay-kumar-mishra" source="Orion">Sanjay Kumar Mishra</keyword> and curtailed his extended tenure to July 31. A bench of Justices BR Gavai, Vikram Nath and Sanjay Karol said in view of the peer review being conducted by the Financial Action Task Force (FATF) this year and to enable smooth transition, Mishra's tenure will be till July 31. The 1984-batch IRS officer was otherwise to remain in office till November 18, 2023, according to the notification issued by the government. The bench, however, affirmed the amendments of the Central Vigilance Commission Act, and the Delhi Special Police Establishment Act to extend the tenure of ED director for a maximum of five years. On May 8, the top court had reserved its verdict on a batch of pleas challenging the third extension of service granted to the Enforcement Directorate chief, which was defended by the Centre on grounds of the peer review being conducted by the FATF. The top court had on December 12 last sought the response from the Centre and others to a plea challenging the third extension granted to Mishra. It had issued notices to the Union of India, the Central Vigilance Commission and the ED director on a plea filed by Jaya Thakur which accused the central government of destroying the basic structure of democracy by misusing the enforcement agencies against its political opponents. The bench gave the verdict on a batch of petitions, including those filed by Congress leaders Randeep Singh Surjewala and Thakur, and <keyword id="17969032" type="General" weightage="20" keywordseo="tmcs-mahua-moitra" source="Orion">TMC's Mahua Moitra</keyword> and Saket Gokhale. Mishra, 62, was first appointed the director of the ED for two years on November 19, 2018. Later, by an order dated November 13, 2020, the central government modified the appointment letter retrospectively and his two-year term was changed to three years. The government promulgated an ordinance last year under which the tenure of the ED and CBI chiefs could be extended by up to three years after the mandated term of two years.

SC holds third extension of ED director SK Mishra as illegal, curtails tenure to July 31

The <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> has recently acquitted a man who was convicted of murdering his wife almost 22 years ago, saying his conviction was "travesty of justice", and it is the court's duty "to rectify miscarriage of justice". A bench comprising justices B.R. Gavai and Sanjay Karol said: "The courts below presumptively, proceeded with the acquired assumption of the guilt of the accused for the reason that he was lastly seen with the deceased, and lodged a false report, forgetting that as per the version of the father of the deceased, father of the accused had himself apprised him of his missing daughter, at least two days prior to the incident." Justice Karol, who authored the judgment on behalf of the bench, said doubt and suspicion cannot form the basis of guilt of the accused and the circumstances linking the accused to the crime are not proven at all, much less beyond reasonable doubt. The bench said: "We may reiterate that, suspicion howsoever grave it may be, remains only a doubtful pigment in the story canvassed by the prosecution for establishing its case beyond any reasonable doubt." It noted that there is no evidence: ocular, circumstantial or otherwise, which could establish the guilt of the accused. There is no discovery of any fact linking the accused to the crime sought to be proved, much less, established by the prosecution beyond reasonable doubt, said justice Karol. He said: "In normal course of proceedings, this court does not interfere with the concurrent finding of facts reached by both the courts below. It is only in exceptional cases where we find the concurrent findings to be absurd, leading to travesty of justice, it is our duty to rectify miscarriage of justice." The bench added that the courts below have seriously erred in passing the order of conviction based on incorrect and incomplete appreciation of evidence, causing serious prejudice to the accused, also resulting in travesty of justice. "It is our bounden duty to ensure that miscarriage of justice is avoided at all costs and the benefit of doubt, if any, given to the accused," it added. The top court's judgment came on an appeal filed by one Guna Mahto challenging a 2004 Jharkhand High Court judgment, which upheld his conviction and life sentence awarded by the trial court in 2001. The petitioner's wife was found murdered in August 1988. Her body was found in the well of the village. The father of the deceased had not stated anything against the accused in relation to the crime. "He states that two days prior to the recovery of the dead body, the father of the accused had informed him that the deceased had eloped with someone. But with whom? He does not mention," noted the bench. Acquitting Mahto, the bench said: "We set aside the orders passed by both the courts below. Since the appellant is already on bail, his bail bond shall stand discharged. Appeal stands allowed."

Chief Justice of India D Y Chandrachud on Monday administered the oath of office to two new judges of the <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword>, taking the number of judges in the apex court to its full sanctioned strength of 34. <keyword id="16475577" type="General" weightage="20" keywordseo="justices-rajesh-bindal" source="Orion">Justices Rajesh Bindal</keyword> and Aravind Kumar were administered oath during a swearing-in ceremony held in the Supreme Court premises. With the appointment of two judges, the total number of judges in the apex court has risen to 34. Before being elevated as judges of the apex court, Justice Bindal was the Chief Justice of the Allahabad High Court while Justice Kumar was the Chief Justice of the Gujarat High Court. Their names were recommended for elevation as apex court judges by the Supreme Court Collegium on January 31. On February 6, the CJI had administered the oath of office to Justices Pankaj Mithal, Sanjay Karol, P V Sanjay Kumar, Ahsanuddin Amanullah and Manoj Misra as apex court judges. Justice Bindal was serving as the Chief Justice of the Allahabad High Court since October 11, 2021. Born on April 16, 1961, Justice Bindal did LL.B. from the Kurukshetra University in 1985 and joined the profession in the Punjab and Haryana High Court in September 1985. He was elevated as a <keyword id="18182" type="General" weightage="20" keywordseo="judge" source="Orion">judge</keyword> of the Punjab and Haryana High Court on March 22, 2006. According to information available on the website of the Allahabad High Court, Justice Bindal disposed of around 80,000 cases during his tenure in the Punjab and Haryana High Court. On his transfer to the Jammu and Kashmir High Court, he took oath of office on November 19, 2018 and later, he was appointed as the acting Chief Justice of the common high court for the Union Territory of Jammu and Kashmir and Union Territory of Ladakh. Justice Bindal was sworn in as a judge of the Calcutta High Court on January 5, 2021 and was appointed to perform the duties of the office of the Chief Justice of that high court with effect from April 29, 2021. Prior to his elevation as an apex court judge, Justice Kumar was serving as the Chief Justice of the Gujarat High Court since October 13, 2021. Born on July 14, 1962, he was enrolled as an advocate in 1987. In 1999, he was appointed as an additional central government standing counsel at the Karnataka High Court. He was appointed as member of the Regional Direct Taxes Advisory Committee in 2002 and later, he was appointed as an Assistant Solicitor General of India in 2005. Justice Kumar was elevated as an additional judge of the Karnataka High Court on June 26, 2009. He was elevated as a permanent judge on December 7, 2012. In a <a href="https://www.businessinsider.com/elon-musk-says-tesla-has-chance-to-break-delivery-recordl-2019-9">leaked email just days before the period's end</a>, CEO Elon Musk said the company had stood a fair chance of setting a new record and delivering more than 100,000 cars for the first time.In addition to the leaked email, Tesla also rolled out a new software update to its vehicles. Version 10.0 includes streaming video services like Netflix and Youtube, a karaoke game, and Spotify music.Perhaps its most attention-getting feature, however, is "smart summon," which allows Tesla vehicles with the most robust version of the Autopilot driver-assistance system to drive in parking lots without anyone in the car. That could make it harder for Tesla to return to profitability even despite drastic <a href="https://www.businessinsider.com/elon-musk-tesla-cost-cutting-is-only-way-for-financial-sustainability-2019-5">cost-cutting measures earlier this summer. </a>"Even if it meets consensus on deliveries, the question into third quarter earnings will be around margins, plus how the stock reacts with likely the first negative year-over-year revenue growth quarter since 2012," Dan Levy, an analyst at Credit Suisse, said in a note to clients last week.Analysts will also be looking for an update on the new factory in China, where Tesla expects to produce vehicles to be sold in the country and avoid further headaches from the US-China trade war.
