<ul><li>The Indian government is reportedly all set to increase <keyword id="6354679" type="General" weightage="80" keywordseo="gst" source="Orion">GST</keyword> on online gaming to 28%, a proposal that could spell trouble for the industry and players alike. </li><li>The online gaming industry is expected to cross $5 billion valuation by 2025, but the taxman’s greed could kill the golden-egg laying hen. </li><li>Experts are worried about the impact this could have on the industry – both the players and the businesses, which are still in their early days. </li></ul>The Indian government is reportedly all set to tax casinos, online gaming and horse racing at the highest slab of GST – 28%. Looks like the taxman is intent on treating these recreational activities and skills on par with tobacco, cigarettes, <a href="https://www.businessinsider.in/cryptocurrency/news/28-gst-on-crypto-transactions-india-is-reportedly-mulling-another-tax-levy-next-week/articleshow/92407767.cms">cryptocurrencies</a> and luxury cars. Online betting, gambling, casinos and horse racing have long been treated ‘unfairly’ by the Indian taxman – while GST has been considerably moderate at 18% until now. Winnings and other income earned from these activities have been taxed at the highest rate of 30% without any deductions whatsoever. Now, a new <a href="https://economictimes.indiatimes.com/news/economy/policy/28-gst-likely-on-casinos-online-gaming-horse-races-on-gross-revenue/articleshow/92474293.cms?from=mdr">report</a> suggests that the government is mulling increasing the GST rate to 28% – the highest in effect currently. "Taxing online gaming, horse racing, and casinos at gross revenue instead of net value addition would be a departure from the global tax ethics," Rajat Mohan, senior partner, AMRG &amp; Associates told PTI. This could have an adverse impact on the entire industry. For instance, the online gaming sector which includes the likes of MPL, Zupee, Winzo and other startups, is expected to cross $5 billion in valuation by 2025, according to a <a href="https://www.ibef.org/blogs/india-s-nascent-gaming-industry-on-the-rise">IBEF report</a>. The government earned nearly ₹1,500 crore from fantasy sports in the form of taxes in FY21. A Deloitte report says that the combined industry contribution could cross a whopping ₹16,000 crore cumulatively over the next two years. The taxman has often been said to be confused about the nature of online games – whether those involve skills or are just gambling. It might be justified to tax gambling at the highest rate of tax, but experts believe that punishing games of skill in the same manner is unfair. In fact, RIL believes that gaming in India will be bigger than music, movies and television shows put together,” said a report by Bank of America Securities. This could also impact <keyword id="201442" type="General" weightage="50" keywordseo="delta-corp" source="Orion">Delta Corp</keyword>, the only listed casino operator in the country which has seen its fortunes fade away, with even Rakesh Jhunjhunwala paring down his holdings in the company considerably. <div type="javascript" title="Custom" contenttype=""><cdata><![CDATA[]]></cdata></div> “This would be a distress the business model to a great extent as the touted super tax will have to be funded either by the platform, who do not make that kind of money in this business or would go on to reduce the prize pool size – effectively bringing down the interest in customer engagement,” Adarsh Somani, senior partner at ELP Law, told Business Insider India. This would wreak havoc on the gaming industry, and even if the government wants to reduce difficulties by offering a single – but higher – rate of tax, the valuation methodology will have to be made clear, Somani added. As things stand today, there is plenty of ambiguity that will have to be worked out by the government – even a small misstep could spell a lot of trouble for the gaming industry and its participants. He further added that the partnership is expected to be “formalised in an expeditious manner during this year.” "We operationalised the JV [joint venture] with BP [of UK] in fuel retailing, using technology and innovation to deliver new customer value. The demand and margin environment for petrochemicals had recovered to pre-COVID levels by March. I am confident that our O2C [oil-to-chemicals] business will benefit from the strong global growth environment,” Ambani. Saudi Aramco’s chairperson Yasir al-Rumayyan’s appointment to the Reliance’s board is seen as another positive sign for this deal initially announced in 2019. “He is one of the most renowned names in energy finance and technology globally. I am sure that we will immensely benefit from his rich experience with one of the world's largest companies, and also one of the largest sovereign wealth funds in the world,” Ambani said. Reliance Industries’ AGM — Mukesh Ambani officially announces Saudi Aramco as strategic partner

<keyword id="6355199" type="ORGANIZATION" weightage="20" keywordseo="reliance-industries">Reliance Industries</keyword> Ltd (RIL), India's largest company, on Thursday said its board has approved hiving off its USD 75 billion worth oil-to-chemicals business into a separate division to enable the sale of 20 per cent stake in the unit to Saudi national oil company Aramco. The hiving off will be subject to the approval of the National Company Law Tribunal. After the approval, the oil-to-chemical (O2C) business will become a separate vertical with independent balance sheet just like the conglomerate's digital arm, Jio Platforms. RIL had organised all its digital businesses including Reliance Jio that has 388 million telecom subscribers, into Jio Platforms. It last week agreed to sell a 9.99 per cent stake in Jio Platforms to <keyword id="319320" type="COMPANY" weightage="20" keywordseo="Facebook-Inc">Facebook Inc</keyword> for USD 5.7 billion. RIL Board "approved a Scheme of Arrangement for transfer of O2C Undertaking of the company to <keyword id="9147221" type="COMPANY" weightage="20" keywordseo="reliance-o2c-ltd">Reliance O2C Ltd</keyword> as a going concern on slump sale basis for a lump sum consideration equal to the income tax net worth of the O2C Undertaking as on the appointed date of the Scheme," it said in its fourth-quarter earnings statement. O2C undertaking of the company comprises entire oil-to-chemicals business of the company consisting of refining, petrochemicals, fuel retail and aviation fuel (majority interest only) and bulk wholesale marketing businesses together with its assets and liabilities. "The scheme is subject to necessary statutory/regulatory approvals under applicable laws including approval of National Company Law Tribunal," it added. In August last year, RIL head <keyword id="3820" type="PERSON" weightage="20" keywordseo="Mukesh-Ambani">Mukesh Ambani</keyword> had announced initial agreements to sell a 20 per cent stake in the oil-to-chemical business to <keyword id="152170" type="COMPANY" weightage="20" keywordseo="Saudi-Aramco">Saudi Aramco</keyword> for an asking of USD 15 billion. The deal covers all of Reliance's refining and petrochemicals assets as well as the remainder of stake the firm has in fuel retailing business after selling 49 per cent to BP Plc of UK for Rs 7,000 crore. The deal, which valued the oil-to-chemical business at USD 75 billion, was to close by March 2020 but it is now expected to close within the current calendar year. Reliance has pivoted away from energy to the new economy. But refining and petrochemicals are cash cows for Reliance and still account for the bulk of its EBITDA. As part of the August deal, Saudi Aramco will supply 500,000 barrels per day (25 million tonnes a year) of crude on a long-term basis to RIL's Jamnagar refinery complex (more than a third of the 1.36 million bpd refining capacity). The deals give Aramco and BP access to the fastest-growing refined fuels market in the world. Market analyst firm Bernstein in a recent report had stated that it expects RIL to grow their petrochemical and refining business given the secular growth opportunities. "While bears will argue that Reliance is stepping away from energy to digital, we see this deal as an opportunity to expand the downstream business in India with a solid partnership. For Aramco, the deal provides direct access to what is widely expected to be the fastest-growing refined oil product market over the next 20 years," it said. "For Reliance, it provides cash to fund the expansion of their digital business and further expansion of downstream capacity with an experienced partner." While talks with Aramco continue, the BP deal has been finalised. Reliance's existing 1,400-odd petrol pumps, as well as 31 aviation fuel stations, will be transferred to the new joint venture where BP will hold 49 per cent equity stake. Reliance will hold the balance 51 per cent in the entity, which aims to expand the retail network to 5,500 petrol pumps in the next five years. This is the third joint venture between Reliance and BP since 2011. BP had in 2011 bought 30 per cent stake in 21 oil and gas exploration and production blocks of Reliance for USD 7.2 billion. At that time, another 50:50 joint venture, <keyword id="838593" type="COMPANY" weightage="20" keywordseo="India-Gas-Solutions">India Gas Solutions</keyword>, was set up for sourcing and marketing gas in India. The country currently has 69,109 petrol pumps, with public sector retailers owning 61,811. PSU retailers have plans to double this network and have already started appointing dealers. Russia's Rosneft-backed Nayara Energy, formerly Essar Oil, has 5,702 petrol pumps and has plans to scale them up to more than 7,000 in two-three years. Royal Dutch Shell has 189 outlets and is slated to add 150-200 more petrol pumps. BP had in 2016 received a licence from the government to set up 3,500 petrol pumps in India. French energy giant Total SA too is keen on entering the Indian retail market and has tied up with Adani Group for the same. The Saudi national oil company, along with its partner UAE's Abu Dabhi National Oil Co (ADNOC) has taken a 50 per cent stake in a planned USD 60-billion mega refinery-cum-petrochemical complex in Maharashtra by state-owned oil companies, and has a bullish outlook on India's energy demand and is keen on investing here. Reliance operates two refineries in Jamnagar, Gujarat, with a total capacity of 68.2 million tonnes per annum. It plans to expand its only-for-exports special economic zone (SEZ) refining capacity to just over 41 million tonnes from the current 35.2 million tonnes. Saudi Arabia, on the other hand, is keen to get a foothold in the world's fastest-growing fuel market to get a captive customer for the crude oil it produces. Crude oil is the basic raw material for the manufacturing of petrochemicals. Saudi Aramco is also keen on retailing fuel in India. A refinery in India can also be a base for it to export fuel to deficit countries in Europe and the Americas. India has a refining capacity of 249.9 million tonnes, which exceeded the demand of 213.7 million tonnes. Eicher Motors gains 8% on the stock split date Eicher Motors gained over 8% as its stock split comes into effect from today. ICICI Lombard up over 1% ICICI Lombard General Insurance gained nearly a percent during early trade hours on Monday after the company said it would acquire Bharti AXA General Insurance operations in a share swap deal. The shareholders of Bharti AXA will receive two shares of ICICI Lombard for every 115 shares of Bharti AXA, as per the share exchange ratio recommended by independent valuers. Minda Industries down nearly 3% Minda Industries shares slid nearly 3% after the company said it incurred a loss of ₹118.3 crore in the first quarter ended June 3. The revenue was down sharply from ₹1,439.7 crore to ₹417.1 crore in Q1. Balaji Telefilms opens 4% higher Balaji Telefilms shares gained nearly 4% after the government announced standard operating procedures (SOPs) for resuming shooting of films and TV programmes. Future Retail down nearly 4% The shares of Kishore Biyani-led Future Retail were down nearly 4% as the company faces a debt repayment deadline after missing an interest payment of $14 million in July. The 30-day grace period also ended on August 22. Reliance Industries up over 1% RIL gained nearly a percent after the company concluded amalgamation and merger amongst its wholly-owned subsidiaries Reliance Holdings USA into Reliance Energy Generation and Distribution. Merger entity Reliance Energy and Distribution has further merged into RIL. New Delhi, The government's decision on mandatory payment of at least 1% of <keyword id="10497869" type="UNKNOWN" weightage="20" keywordseo="gst-tax-liability">GST tax liability</keyword> in cash will impact only around 40,000 to 45,000 taxpayers but help the entire system curb the menace of fake ITC availment and <keyword id="38388" type="ORGANIZATION" weightage="20" keywordseo="operation">operation</keyword> of fly-by-night operators, sources in <keyword id="1549446" type="COMPANY" weightage="20" keywordseo="The-Finance-Ministry">the finance ministry</keyword> said on Saturday. Based on the recommendations of <keyword id="10283255" type="COMPANY" weightage="20" keywordseo="the-gst-law-committee">the GST Law Committee</keyword>, the government has notified <keyword id="10497871" type="UNKNOWN" weightage="20" keywordseo="new-indirect-tax-rules">new indirect tax rules</keyword> that makes cash payment of 1% of GST tax liability mandatory for businesses whose <keyword id="10497870" type="UNKNOWN" weightage="20" keywordseo="taxable-supply-value">taxable supply value</keyword> exceeds ₹50 lakh. This change will come into effect from January 1, 2021. Sources in department of revenue said data indicated out of the total GST tax base of 1.2 crore taxpayers only around 4 lakh taxpayers have supply value greater than ₹50 lakh, and only around 1.5 lakh out of these 4 lakh taxpayers pay less than 1% tax in cash. So, the changes would include only a <keyword id="4473154" type="PERSON" weightage="20" keywordseo="small-section">small section</keyword> of taxpayers. Moreover, the DoR sources said with exclusions around 1.05 lakh taxpayers get further excluded from these 4 lakh. Thus, the rule would apply only to about 40,000 to 45,000 taxpayers. This would be around 0.37% of the total GST tax base of 1.2 crore taxpayers. "The data clearly indicates that a small fraction of taxpayers would need to pay 1% of GST liability in cash. Moreover, the rule is clearly for businesses whose taxable value of supply exceeds ₹50 lakh, so the measure would not affect small businesses or increase their working capital requirement," sources said. Under the new rule cash payment of 1% is to be calculated on the tax liability in a month and not turnover of the month. For example, if the turnover of taxable supplies of a taxpayer is ₹100 in a month and he is required to pay GST of 12% on his output taxable supplies, then he will be required to pay 1% of ₹12, i.e., ₹0.12 (12 paisa) only in the month through cash under this rule. Therefore, the net requirement of cash payment will be only 0.12% of the turnover in such a case, finmin sources said citing another example, if a dealer has made sale of ₹1 crore of the goods whose tax rate is 12 per cent and if he is discharging his tax liability more than 99% through input tax credit (ITC) then he has to pay only ₹12,000 under this rule. The rule clearly identifies where the risk to revenue is high and imposes very reasonable cost to deter the fraudsters in a multi-layered fraud of ITC, said the sources. The government had notified the cash rule to curb fake ITC availment and passing on of such credit by unscrupulous persons who generally pay no tax in cash, particularly in those risky cases where GST turnover does not match with the income tax returns. Such registered person will not be able to use the amount of ITC available in electronic credit ledger to discharge his liability towards output tax in excess of 99% of such tax liability. At least 1% liability would need to be discharged in cash. Payment of 1% GST in cash only for 45,000 taxpayers: DoR sources

State-run Indian Oil Corporation has maintained its numero uno position followed by <keyword id="6355199" type="CITY" weightage="20" keywordseo="Reliance-Industries">Reliance Industries</keyword> in terms of revenue for the sixth consecutive year in the list of Fortune 500 Indian companies 2015. 
 
IOC tops the chart with an annual revenue of Rs 4,51,911 crore, while Mukesh Ambani-led RIL's full-year revenue is Rs 3,82,565 crore. <keyword id="42747" type="CITY" weightage="20" keywordseo="Tata-Motors">Tata Motors</keyword> with a revenue of Rs 2,67,025 crore jumped to third slot from last year's fifth place by replacing Bharat Petroleum (BPCL). State Bank of India (SBI) moved to fourth position with an annual revenue of Rs 2,57,289 crore, from sixth rank in 2014. 
 
Bharat Petroleum (BPCL) is ranked fifth with an annual revenue of Rs 2,40,367 crore. It had grabbed the third spot in last year's ranking. 
 
The list, which has been compiled by global business magazine Fortune's Indian edition since 2010, said the total revenue of firms has grown a merely 2.7 per cent and profits fell 5.9 per cent compared with 2014. 
 
"While the total revenue of Fortune India 500 companies has nearly doubled from Rs 38,16,000 crore in 2010 to Rs 71,27,000 crore in 2015, the same cannot be said of profits, which went up by a meagre 3.6 per cent over the period," the magazine noted. 
 Others in the top 10 are <keyword id="6374014" type="CITY" weightage="20" keywordseo="Hindustan-Petroleum">Hindustan Petroleum</keyword> (sixth in the ranking, with a revenue of Rs 2,13,380 crore, followed by ONGC Rs 1,65,161 crore, <keyword id="6357147" type="CITY" weightage="20" keywordseo="Tata-Steel">Tata Steel</keyword> Rs 1,41,669 crore, Hindalco Industries Rs 1,06,897 crore and TCS Rs 98,368 crore. 
 
According to Fortune India, "While the overall scene does not seem too promising, individual companies are swimming against the tide to deliver value to customers and shareholders." 
 Among others in the list are <keyword id="6354924" type="PERSON" weightage="20" keywordseo="Idea-Cellular">Idea Cellular</keyword> (47th rank), Asian Paints (85), TVS Motor Company (125), <keyword id="6369697" type="COMPANY" weightage="20" keywordseo="Godrej">Godrej</keyword> Consumer Products (157), Kwality (195), Aegis Logistics (271), Srei Infrastructure Finance (303), Transport Corporation of India (397) and Persistent Systems (447). 
 
The ranking is based on total revenues of the organisation. Other individual parameters include year-on-year change in total revenues, net operating income, profits, assets, networth, dividend, among others. 
 
Fortune ranks top players across different sectors ranging from banking, telecommunications, automobiles, consumer durables, pharma, FMCG, infrastructure, media, oil and gas, power, real estate, retail and among others.

6th straight year

<ul><li>Telecom industry lobby Cellular Operators Association of India (COAI) has come up with a wishlist for the upcoming Budget 2023-24.</li><li>These demands include a temporary suspension of regulatory levies like Universal Service Obligation (<keyword id="221628" type="General" weightage="80" keywordseo="uso" source="Orion">USO</keyword>), in addition to tax relief.</li><li>COAI has also urged the government to exempt customs duty on import of telecom equipment to ensure a smooth rollout of 5G services in the country.</li></ul>With the Budget 2023-24 fast approaching, several sectors of the Indian economy have come up with a list of expectations from the government for their respective industries. The Cellular Operators Association of India (COAI) has come up with its wishlist for the telecom sector. Key among its demands are a reduction in regulatory payments of license fee and spectrum usage charges, besides a temporary suspension of regulatory levies like Universal Service Obligation (USO). “Telecom is one of the highly-regulated sectors in the country. Given the huge burden of taxes and regulatory levies on telecom operators, and the critical nature of the service to drive Digital India, a special benefit may be provided to telecom operators by way of exemption of GST on regulatory payments of license fee, spectrum usage charges and spectrum assigned under auction,” said <keyword id="3200319" type="General" weightage="50" keywordseo="sp-kochhar" source="Orion">SP Kochhar</keyword>, director general, COAI. COAI is the apex telecom lobby and counts Reliance <keyword id="2003276" type="General" weightage="80" keywordseo="jio" source="Orion">Jio</keyword>, Bharti Airtel and Vodafone Idea amongst its core members. COAI wants this levy to be suspended till the existing USO fund is exhausted. It also wants the license fee to be reduced from 3% to 1%. The funds collected under USO are used to deliver affordable connectivity to remote areas like the Northeast India, the Andaman &amp; Nicobar Islands, and other rural areas of the country. For instance, the BharatNet project to provide affordable broadband services is run using the funds from the USO levy. <cmsannotation type="cmsannotation" annotationid="Clarification of services included in telecom activities" comment="subhead" text="Clarification of services included in telecom activities">Clarification of services included in telecom activities</cmsannotation> COAI has also asked the government to clarify the definition of telecom activities for the purpose of calculation of gross revenue. At present, the term “telecom activities” is not defined, and may include activities which are incidental or ancillary to the primary telecom services. The group wants the government to define telecom activities such that revenue from activities that do not require any license should not be included for the computation of gross revenue. <cmsannotation type="cmsannotation" annotationid="Special tax regime for telecom companies" comment="subhead" text="Special tax regime for telecom companies">Special tax regime for telecom companies</cmsannotation> COAI has also asked the government to extend the period for carry forward of business losses for the telecom sector from the existing 8 years to 16 years. Under the existing regime, any business losses that have been carried forward but not completely set off will lapse after eight assessment years. Further, under section 72A of the Income Tax Act, an amalgamated company can carry forward the losses of the amalgamating company provided it holds 75% of the book value of fixed assets of the amalgamating company for a period of 5 years. COAI wants these requirements to be relaxed to 50% of the book value of fixed assets, and the holding period reduced to 2-3 years. Further, the industry body wants the rate of tax deducted at source (TDS) under section 194H of the Income Tax Act to be reduced to 1% from the existing 5% for telecom distributors. <cmsannotation type="cmsannotation" annotationid="Exemption of customs duty on telecom equipment imports" comment="subhead" text="Exemption of customs duty on telecom equipment imports">Exemption of customs duty on telecom equipment imports</cmsannotation> The industry body also wants the government to exempt telecom equipment imports from basic customs duty of 20% to ensure smooth rollout of 5G services in the country. A basic customs duty of 20% is charged on import of IP radios, LTE products, optical transport equipment and other telecom equipment. Apart from this, COAI has also urged the Central Board of Indirect Taxes and Customs (CBIC) to direct its field officers to not charge customs duty on cable- laying vessels outside India’s territorial waters. CBIC had earlier issued a clarification that customs duties on such activities are not applicable, but COAI says that the board’s field units are still insisting on payment of duties on these activities.
