Following flaws in the student-loan industry that have kept many borrowers in repayment longer than intended, many borrowers were counting on Biden for broad relief — and he attempted to deliver on that promise in August 2022, when he <a target="_blank" href="https://www.businessinsider.com/biden-cancels-student-loan-debt-100000-people-making-125k-income-2022-5?esd">announced up to $20,000 in debt cancellation for borrowers making under $125,000 a year</a>.However, that relief did not go according to plan. Shortly after Biden's announcement, a number of conservative-backed lawsuits arose seeking to block the implementation of the relief, and the Supreme Court ruled in June 2023 that Biden <a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-blocked-supreme-court-strikes-down-debt-cancellation-2023-5">could not move forward with his first try at broad student-loan forgiveness</a>.The Education Department is undergoing a process to get relief to borrowers using a different law, but it will take time to reach borrowers. First established in 2014, the rule cut off federal student aid for schools that offered degrees that left students with too much debt compared to their likely post-graduation earnings.While former President Donald Trump repealed the rule in 2019, Biden's administration reinstated it to protect students from taking on spiraling debt loads.The department also announced a financial transparency framework to give students upfront information on the costs of their degrees and how much debt they should expect to acquire.<h2>A new repayment plan</h2>Biden <a target="_blank" href="https://www.businessinsider.com/does-debt-ceiling-deal-ban-student-debt-relief-payment-pause-2023-5">codified the end of the over three-year student-loan payment pause</a> in his bill to raise the debt ceiling in June, leading payments to once again resume in October. In an attempt to make the transition easier for borrowers, the Education Department announced a new income-driven repayment plan, known as the SAVE plan, <a target="_blank" href="https://www.businessinsider.com/student-loan-debt-borrowers-apply-income-driven-repayment-save-plan-2023-7">intended to lower monthly payments for many borrowers</a>.The plan includes a range of provisions intended to make relief more accessible for borrowers. In January, the department announced it would be implementing one of those provisions ahead of schedule: loan forgiveness for borrowers who originally borrowed $12,000 or less and made as few as 10 years of qualifying payments.In February, the department announced <a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-debt-cancellation-save-income-driven-payment-plan-2024-2">$1.2 billion in debt relief for 153,000 borrowers</a>, the first group to benefit from that provision.Other plan elements to be implemented later this year include cutting payments for undergraduate borrowers in half and counting periods spent in deferment or forbearance toward relief.<h2>A second attempt at broader debt relief</h2>A process that has likely gotten the most attention from borrowers is the Education Department's second attempt at a broader version of student-debt cancellation.On the same day the Supreme Court struck down Biden's first relief attempt, the department <a target="_blank" href="https://www.businessinsider.com/how-long-will-take-cancel-student-debt-higher-education-act-2023-7">announced a new route using the Higher Education Act of 1965</a>. That law requires the administration to participate in a process known as negotiated rulemaking, which involves a series of negotiation sessions with stakeholders and periods of public comment before the relief can reach borrowers.The department <a target="_blank" href="https://www.businessinsider.com/student-loans-where-does-biden-debt-cancellation-stand-negotiations-relief-2024-2">concluded its fourth and final negotiation session</a> in February, and it's now drafting its proposal to present to the public for comment. Based on the text proposed at the negotiations, the department is considering <a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-who-will-qualify-second-attempt-biden-education-2023-12">five groups of borrowers for relief</a>, including those with balances greater than what they originally owed, along with a category to determine what hardship factors would qualify a borrower for relief.However, McCann said that "we don't have much sense of the department's timeline" for the relief at this point, and "borrowers should expect that this regulation will likely be entangled in litigation pretty quickly.""So I think it's very unlikely that borrowers will have seen actually dollars discharged before the election," McCann said, when it comes to implementation of this new regulation.

The adjustments are intended to bring borrowers' payment counts on those programs up to date, allowing many of them to reach the forgiveness threshold.According to the department, the adjustments will be completed by September 1 and will be automatically applied to borrowers with student loans managed by the Education Department.Another key program the department hopes to implement this fall is its <a target="_blank" class="" href="https://www.businessinsider.com/student-loan-forgiveness-borrowers-action-opt-out-debt-relief-2024-7">broader plan for student loan forgiveness</a> using the Higher Education Act of 1965. Although thousands of borrowers have <a target="_blank" class="" href="https://www.businessinsider.com/how-to-get-student-loan-forgiveness-early-income-driven-repayment-2024-1">already gotten relief through SAVE</a> due to its shorter timeline for forgiveness, the 8th Circuit Court of Appeals recently blocked the plan from being implemented.Biden's Justice Department <a target="_blank" class="" href="https://www.businessinsider.com/save-plan-blocked-justice-department-asks-supreme-court-cheaper-payments-2024-8">asked the Supreme Court to allow the plan to progress</a>, but in the meantime, 8 million enrolled borrowers are on forbearance and cannot receive progress toward loan forgiveness as long as the injunction stays in place.

When it comes to higher education, the ruling will impose more barriers on regulations that are particularly controversial, like efforts to forgive student debt.Jon Fansmith, senior vice president of government relations and national engagement at the American Council on Education, told Business Insider that Chevron's overruling places students, institutions, and the government in a "Wild West situation.""It's not a guarantee that every regulation gets thrown out, but what it does is it says the field of what's open to challenge just got a whole lot bigger," Fansmith said."There are almost no existing regulations that are simply direct implementations of what's written down in the statute. All of them, to a varying degree, but in some cases, very large degree, rely on the agency's interpretation," he said. "So they're all subject to challenge, and you can't look at the compliance environment you're in right now and say with any certainty what that's going to look like in six months or a year or three years from now."While federal agencies typically craft regulations to ensure they're in accordance with Congress's language and can withstand legal challenges, the Supreme Court has now made that process a lot more difficult by handing over interpretation power to the courts. Experts told BI that lawmakers could help solve the issue by making the language in laws like the Higher Education Act more clear, but that's unlikely to happen given the partisanship and slow-moving nature of Congress."Having some level of basic certainty for a number of years is far more preferable to trying to constantly stay on top of a shifting environment and not knowing whether you are in compliance or not," Fansmith said. "It is a difficult situation to be in, and I think for most people, the significant new chaos that's introduced is going to be really, really hard to work with and operate under."<h2 id="694b64a3-8a0d-4b29-b9a5-32dd6c2106a2">'Huge implications for American life'</h2>Since President Joe Biden announced his <a target="_blank" href="https://www.businessinsider.com/biden-cancels-student-loan-debt-100000-people-making-125k-income-2022-5?esd">first plan to cancel student debt</a> broadly in 2022, conservative groups haven't stopped trying to block the relief — and some of them succeeded. The Supreme Court <a target="_blank" href="https://www.businessinsider.com/student-loan-forgiveness-blocked-supreme-court-strikes-down-debt-cancellation-2023-5">struck down Biden's plan</a> to cancel up to $20,000 in student debt for borrowers last June, and district courts <a target="_blank" href="https://www.businessinsider.com/save-plan-student-loan-forgiveness-blocked-borrowers-forbearance-payments-paused-2024-6">placed preliminary injunctions</a> on the new SAVE income-driven repayment plan just weeks ago.The Education Department is working on finalizing <a target="_blank" href="https://www.businessinsider.com/biden-announces-new-student-loan-forgiveness-plan-who-qualifies-relief-2024-4">its second attempt at a broader debt relief plan</a>, which it hopes to implement this fall. It's highly likely to face legal challenges. But striking down Chevron could pose even more barriers to debt relief and many higher education regulations borrowers rely on.Those include reforms to the borrower defense to repayment process, which allows debt relief for borrowers who prove they were defrauded by the school they attended, and the gainful employment rule, which ensures borrowers do not graduate from a school with too much debt compared to post-graduation earnings.All of those rules could be at risk. Neal Hutchens, a professor in the Department of Educational Policy Studies and Evaluation at the University of Kentucky, told BI that the Chevron ruling is "really going to empower individual judges to weigh in and interpret the law in a way that we haven't seen in 50 years.""This means that it's even harder for an administration to come up with a rule or regulation around student debt relief because now it can be challenged in a way that it couldn't just a couple of weeks ago," he said.That's good news for some Republican lawmakers. After the Supreme Court's Chevron ruling, Sen. Bill Cassidy — top Republican on the Senate education committee — sent a <a target="_blank" href="https://subscriber.politicopro.com/f/?id=00000190-6bca-d3d9-a9da-efda40f10000">letter</a> to Education Sec. Miguel Cardona asking how the Education Department would comply with the ruling."For too long, Chevron deference has let agencies make broad decisions governing a diverse country of over 330 million people," Cassidy wrote.Fansmith said that Congress could help matters by writing laws with clear, specific language on intent so there's no room for ambiguity — but typically, big bills have a lot of gray areas, and it's difficult to get both parties to agree on particulars.Ultimately, the ruling has opened the door for significant uncertainty, and removing agency authority to make decisions could have "huge implications for American life moving forward," Hutchens said."I think it makes it harder for the average person, the average consumer, to hope that agencies will be able to do things on their behalf," Hutchens said. "They're not necessarily going to be winners in this system."

United Nations, India is "deeply troubled" by the conflict in Gaza that has raged on for nearly five months now, the country's envoy to the UN has said, asserting that the loss of civilian lives and the resulting humanitarian crisis is "clearly unacceptable". India's Permanent Representative to the UN Ambassador, <keyword id="19898338" type="General" weightage="20" keywordseo="ruchira-kamboj" source="keywords">Ruchira Kamboj</keyword>, said this while addressing a UN General Assembly meeting on the 'Use of Veto' on Monday. "The ongoing conflict between Israel and Hamas has led to large scale loss of civilian lives, especially women and children....this has also resulted in an alarming humanitarian crisis. This is clearly unacceptable," Kamboj told the UNGA. She said that India has been "deeply troubled by the conflict in Gaza that has been raging for nearly five months now." "The humanitarian crisis has deepened, and the region and beyond have seen rising instability," India's top diplomat to the UN said. The General Assembly held the plenary debate on the 'Use of the veto' after the US cast a veto in the UN Security Council last month, leading to the failure of the Council to adopt a resolution calling for a humanitarian ceasefire in the Gaza war. Kamboj told the UNGA that India's position on the conflict has been clear, and New Delhi has strongly condemned the deaths of civilians in the conflict. "It is critical to prevent further escalation of violence and hostilities. It is imperative to avoid the loss of civilian lives in any conflict situation," she said. Kamboj underlined that humanitarian aid to the people of Gaza must be scaled up immediately to avert a further deterioration in the situation. She urged all parties to come together in this endeavour and welcomed the efforts of the UN and the international community. "India has provided humanitarian aid to the people of Palestine and will continue to do so," she said. Kamboj said India is cognizant of the fact that the immediate trigger of the conflict was the terror attacks in Israel on October 7, which were "shocking and deserve our unequivocal condemnation. "India has a longstanding and uncompromising position against terrorism in all its forms and manifestations. There can be no justifications for terrorism and hostage-taking. We demand the immediate and unconditional release of all hostages," she said. India has repeatedly emphasised that only a two-state solution, achieved through direct and meaningful negotiations between both sides on final status issues, will deliver an enduring peace. "India is committed to supporting a two-state solution where the Palestinian people are able to live freely in an independent country within secure borders, with due regard to the security needs of Israel," Kamboj said. To arrive at a lasting solution, India urged for immediate de-escalation, eschewing violence, the release of all hostages, avoiding provocative and escalatory actions, and working towards creating conditions for an early resumption of direct peace negotiations. "We have noted that the Secretary-General has announced a time-bound investigation into all such allegations," Kamboj said. UN Secretary-General <keyword id="19962050" type="General" weightage="20" keywordseo="antonio-guterres" source="keywords">Antonio Guterres</keyword> was "horrified" by the "extremely serious allegations" which implicate several UNRWA staff members in the terror attacks of October 7 in Israel. In consultation with UNRWA Commissioner-General <keyword id="20355646" type="General" weightage="20" keywordseo="philippe-lazzarini" source="keywords">Philippe Lazzarini</keyword>, the Secretary-General appointed an independent Review Group to assess whether the agency was doing everything within its power to ensure neutrality and to respond to allegations of serious breaches when they are made. The UN has said it is taking swift action following the allegations, and an investigation by the UN's Office of Internal Oversight Services (OIOS) was immediately activated. Kamboj said that the ongoing conflict between Israel and Hamas has led to large-scale loss of civilian lives, especially women and children, and has resulted in an alarming humanitarian crisis. She said that India has provided humanitarian aid to the people of Palestine and will continue to do so. "We are also positively considering specific requests from the UNRWA for assistance in kind. We urge utmost diligence in the utilisation of this assistance," she said. As a mark of solidarity with the Palestinian refugees, Kamboj said India enhanced its annual contribution to the agency from USD 1.25 million to USD 5 million in 2018. Since then, India has been making this contribution to the agency annually, supporting the agency's core programmes and services, including education, healthcare, relief, and social services provided to Palestinian refugees.
