Mumbai, The <keyword id="19899808" type="General" weightage="20" keywordseo="rbi" source="keywords">RBI</keyword> on Monday released a 'draft framework for recognising <keyword id="20198317" type="General" weightage="20" keywordseo="self-regulatory-organisations" source="keywords">Self-Regulatory Organisations</keyword> (SRO) for <keyword id="19942953" type="General" weightage="20" keywordseo="fintech-sector" source="keywords">FinTech Sector</keyword>', laying down the characteristics of a <keyword id="19945816" type="General" weightage="20" keywordseo="fintech" source="keywords">FinTech</keyword> SRO, and includes the required functions and governance standards. FinTechs are significantly reshaping the landscape of financial services by streamlining processes, improving accessibility, and reducing costs. Achieving a healthy balance between facilitating innovation by the industry on the one hand, and meeting regulatory priorities in a manner that protects consumers and contains risk, on the other, is crucial to optimising the contribution of the FinTech sector, the RBI said. "Self-regulation within the FinTech sector is a preferred approach for achieving the desired balance," the central bank stated. According to the RBI draft framework, the SRO-FT would derive its strength from its membership, ensuring that it is truly representative of the FinTech sector. Through comprehensive membership agreements that encompass a broad spectrum of industry players, the SRO-FT should gain the legitimacy and credibility to not only frame baseline standards and rules of conduct codes, but also to effectively monitor and enforce them. The SRO-FT must be looked up to and accepted by the industry as the key body for setting market standards, defining rules of conduct and ensuring voluntary adoption of the common framework by its members, the RBI said. The framework also states that the SRO-FT should be development-oriented, actively contributing to the growth and evolution of the industry. This involves providing specialised knowledge and expertise, offering guidance, and contributing to capacity building through training programs, and prescribing minimum eligibility criteria for its members. Also, members should perceive the SRO-FT as a legitimate arbiter of disputes. This would require a transparent and fair resolution mechanism for disputes arising among members that instils confidence in the FinTech industry. By efficiently handling conflicts and grievances, the SRO-FT would contribute to a more stable and harmonious FinTech environment. A proactive <keyword id="20198316" type="General" weightage="20" keywordseo="sroft" source="keywords">SROFT</keyword> should be capable of motivating its members to align with regulatory priorities. This would involve facilitating communication between industry players and regulatory bodies, advocating for necessary changes, and promoting a culture of compliance. The SROFT, as its duty towards ensuring compliance, should be empowered to investigate and take disciplinary action against its members for non-adherence to codes/standards/rules. The RBI said comments from stakeholders and members of the public on the draft framework may be sent by end February 2024, through e-mail. The final framework will be issued taking into account stakeholder and public responses.

RBI releases draft framework for Fintech sector self-regulatory organisations

Markets regulator <keyword id="19901201" type="General" weightage="20" keywordseo="Sebi" source="keywords">SEBI</keyword> has proposed expanding the <keyword id="22367248" type="General" weightage="20" keywordseo="sustainable-finance-framework" source="keywords">sustainable finance framework</keyword> in the <keyword id="20922662" type="General" weightage="20" keywordseo="securities-market" source="keywords">securities market</keyword> by introducing a new category of financial instruments. This category will include <keyword id="20518791" type="General" weightage="20" keywordseo="Social-Bonds" source="keywords">social bonds</keyword>, <keyword id="22623575" type="General" weightage="20" keywordseo="Sustainable-Bonds" source="keywords">sustainable bonds</keyword>, and <keyword id="22623576" type="General" weightage="20" keywordseo="Sustainability-linked-Bonds" source="keywords">sustainability-linked bonds</keyword>, in addition to the current <keyword id="22819966" type="General" weightage="20" keywordseo="green-debt-securities" source="keywords">green debt securities</keyword>. It aims to provide issuers with flexibility in raising funds for projects that align with environmental, social, and governance (ESG) objectives. In a consultation paper released on Friday, SEBI proposed that issuers, in addition to existing green debt securities, should be allowed to raise funds through issuance of social bonds, sustainable bonds, and sustainability-linked bonds. These bonds will collectively be known as ESG Debt Securities. This will enable issuers to raise money for more sustainable projects, assisting in closing the funding gap for the Sustainable Development Goals. SEBI said it received representations from market participants including the Confederation of Indian Industry to expand the scope of the regulatory framework pertaining to sustainable finance to include social bonds, in addition to existing green debt securities as a mode of raising sustainable finance, in line with global practices. As per the consultation paper, SEBI said, it "proposed to introduce the concept of sustainable securitised debt instruments for the purpose of providing originators of the underlying credit facilities which are within such international or domestic frameworks for sustainable finance, and thereby provide investors as well an opportunity to participate in the sustainable securitised debt instruments". The consultation paper also addressed the initial and continuous disclosures for sustainable securitised debt instruments that would be based on international frameworks. Initial disclosures could be made in the offer document for the securities, while continuous disclosures might be included in annual reports or other mandated formats. The markets watchdog also suggested that issuers of ESG debt securities and sustainable securitised debt instruments appoint an independent external reviewer or certifier, to facilitate transparency and credibility. The review could take various forms including, second-party opinions, verification, certification, or scoring/ rating. SEBI proposes expansion of sustainable financial framework in securities market

In her Budget speech in the Lok Sabha, she said the Budget provides special attention to micro, small &amp; medium enterprises (MSMEs) and manufacturing, particularly labour-intensive units. "We have formulated a package, covering financing, <keyword id="20961204" type="General" weightage="20" keywordseo="regulatory-changes" source="keywords">regulatory changes</keyword> and technology support for MSMEs to help them grow and also compete globally, as mentioned in the interim budget," she said. The credit guarantee scheme for MSMEs in manufacturing will operate on the pooling of credit risks of such entities. "A separately constituted self-financing guarantee fund will provide, to each applicant, guarantee cover up to Rs 100 crore, while the loan amount may be larger," the minister announced in the Budget. The borrower will have to provide an upfront guarantee fee and an annual guarantee fee on the reduced loan balance. She also announced a new mechanism for facilitating the continuation of bank credit to MSMEs during their stress period. Sitharaman said that while being in the 'special mention account' (SMA) stage for reasons beyond their control, MSMEs need credit to continue their business and avoid getting into the NPA stage. "Credit availability will be supported through a guarantee from a government-promoted fund," she added. In another move to help MSMEs, the minister announced a new assessment model for credit to the sector. She said public sector banks will build their in-house capability to assess MSMEs for credit, instead of relying on external assessment. "They will also take a lead in developing or getting developed a new credit assessment model, based on the scoring of digital footprints of MSMEs in the economy," she added. The new assessment model, she said, is expected to be a significant improvement over the traditional assessment of credit eligibility based only on asset or turnover criteria. It will also cover MSMEs without a formal accounting system. Mohammad Athar (Saif), partner and leader capital projects and infrastructure development, PwC India, said the credit guarantee scheme and <keyword id="22514802" type="General" weightage="20" keywordseo="e-commerce-export-hubs" source="keywords">e-commerce export hubs</keyword> for MSMEs will enable demand creation and boost India's aspiration of achieving USD 1 trillion in exports by 2030, driven by MSMEs. Sitharaman also announced that to enable MSMEs and traditional artisans to sell their products in international markets, e-commerce export hubs will be set up in public-private-partnership (PPP) mode. These hubs, under a seamless regulatory and logistic framework, will facilitate trade and export-related services under one roof. Vivek Jalan, Partner, Tax Connect, a multi-disciplinary firm, said, as requested by the trade and industry bodies and laid down by the Economic Survey, for MSME businesses, the compliance burden is also sought to be relaxed. Litigations will be reduced in the new <keyword id="22517694" type="General" weightage="20" keywordseo="Vivaad-Se-Vishwas-Scheme" source="keywords">Vivaad Se Vishwas Scheme</keyword>, he added. Rumki Majumdar, Economist, Deloitte India, said the credit guarantee schemes for MSMEs in the <keyword id="19955573" type="General" weightage="20" keywordseo="manufacturing-sector" source="keywords">manufacturing sector</keyword>, facilitating term loans for the purchase of machinery, and formulating packages to finance technology support to them will go a long way to providing access to finance and increasing investments, which have been key challenges in the sector.

FM announces credit guarantee scheme, other measures for MSMEs

The <keyword id="30356" type="General" weightage="50" keywordseo="telecom-regulatory-authority-of-india" source="Orion">Telecom Regulatory Authority of India</keyword> (Trai) on Tuesday released recommendations on the '<keyword id="15650412" type="General" weightage="100" keywordseo="licensing-framework" source="Orion">licensing framework</keyword> for establishing and operating satellite earth station gateway (<keyword id="15650413" type="General" weightage="80" keywordseo="sesg" source="Orion">SESG</keyword>)'. Among the recommendations, Trai suggested there shall be a separate satellite earth station gateway (SESG) license under the <keyword id="116276" type="General" weightage="50" keywordseo="indian-telegraph-act" source="Orion">Indian Telegraph Act</keyword>, the SESG license will not form part of the Unified License (UL) and the service area for the license shall be at a national level. A unified License implies that a customer can get all types of telecom services from a unified licence operator. Trai also recommended that the SESG licensee may establish, maintain, and work SESGs anywhere within the territory of India for all types of satellite systems for which the government has given permission and it may provide satellite-based resources to any entity, which holds license/permission granted by the department of telecommunication (DoT) or ministry of information and broadcasting (MIB) and is permitted to use satellite media for the provision of services under its license/ permission. A satellite gateway also referred to as a teleport or hub, is a ground station that transmits data to/from the satellite to the local area network. According to the recommendations, the SESG licensee may establish SESGs in respect of one or more government-approved satellite systems and it shall not be permitted to provide any kind of telecommunication service or broadcasting service directly to the consumers, for the provision of which, a separate license/authorisation/permission is required from the government. About the licence's validity, Trai recommends the SESG licence shall be valid for 20 years from the effective date of the licence with a provision of renewal for 10 years. Trai recommended that the licensee shall adhere to the instructions/guidelines issued by the government in respect of connecting trusted products in its network and that the licensee shall meet the instructions/ directions of DoT issued from time to time in the interest of national security. Recommendations also indicated that only the companies registered under the Companies Act shall be eligible to apply for the grant of their licence. For an entry fee, it recommended a non-refundable one-time entry fee of Rs 10 lakh shall be levied for the grant of an SESG License. And lastly, only a token license fee of Re 1 per annum shall be levied on the SESG licence SESG licensees will not provide any service directly to end-consumers. The <keyword id="116246" type="General" weightage="50" keywordseo="department-of-telecommunications" source="Orion">Department of Telecommunications</keyword> (DoT), through a letter dated September 10, 2021, had earlier sought the Trai's recommendations on licensing framework for the establishment of a satellite gateway. In this regard, a consultation paper on 'Licensing Framework for Establishing Satellite Earth Station Gateway' was issued on November 15, 2021. Comments from 23 stakeholders and counter-comments from seven stakeholders were received. An open house discussion (OHD) with stakeholders was held on February 25, 2022. Based on these comments and inputs from stakeholders and on its own analysis, Trai had finalised its recommendations on the 'Licensing Framework for Establishing and Operating Satellite Earth Station Gateway (SESG)' to the government. Munjal positive on Indian regulatory framework

New Delhi, Feb 25 () Amid rising instances of defaults, markets regulator Sebi on Tuesday proposed stronger framework for governing corporate bonds and debenture trustees, including enhanced disclosure requirements. Among other measures, the watchdog has suggested that NBFCs (Non-Banking Financial Companies) create charge on the identified assets for every bond issue. Sebi has issued a consultation paper on 'Review of the Regulatory Framework for Corporate bonds and Debenture Trustees'. "The increased events of default by a few financial institutions and the lapses/ complications on the part of debenture trustees in the expeditious enforcement of the security has brought to the fore the need for a review of the present regulatory framework for debenture trustees," Sebi said. In order to enhance transparency, the regulator has also proposed to mandate minimum disclosures. For standardisation of Debenture Trust Deed (DTD), Sebi has proposed that the same should be bifurcated into two parts. One part should have standard clauses common to all DTDs. The second part should contain specific and customised clauses and covenants relevant to the particular issue for which the DTD is executed. "An SOP (Standard Operating Procedure) shall be prepared that shall list out the penalties for specific violations by the issuer company for the listed debt," the watchdog said. Sebi proposes stricter regulatory framework for corporate bonds, debenture trustees

New Delhi, Jan 21 () Private non-life insurer Bharti AXA General Insurance on Tuesday said it has received nod from the Insurance Regulatory and Development Authority of India (Irdai) for its two products under the regulatory sandbox framework.
 The two proposed products, usage-based motor insurance in the non-life insurance category and short-term health insurance in the health segment, have been shortlisted by the regulator for its sandbox framework, the company said in a statement.
 Irdai has selected only 33 out of 173 applications under health, non-life and distribution segments for the regulatory sandbox, which allows insurers and technology companies to collaboratively experiment with new products along with unique customer proposition on a live audience under the supervision of the regulator, it said.
 "As customers' needs are ever-evolving, there has always been a demand for flexible and 'Do It Yourself' coverages from partners and customers alike.
 "We are cognisant of this and always put their needs at the forefront of our innovations. Our proposed products for the sandbox project cater to this requirement, and they are recent examples of our commitment towards customer centricity," said Sanjeev Srinivasan, chief executive officer, Bharti AXA General Insurance.
 The proposed 'usage-based motor insurance' product charges premium based on pre-declared or promised vehicle usage distance along with the standard parameters, thus benefiting those who drive less, it said.
 The company said the proposed 'short-term health insurance' product will provide short-term health insurance cover to customers, covering customisable waiting periods, and includes both indemnity and benefit.
 While traditional health insurance is generally offered for the longer duration starting from a year, this product offers coverage for sachet (shorter) periods, and includes both indemnity and benefit, it added.
 The insurance sandbox project has been launched mainly to help the regulator gauge and measure real-life acceptance of new customer propositions before giving them the regulatory nod for commercial launch. It also has immense potential to facilitate innovation and securely experiment with ideas to solve unmet customer expectations and raise efficiency levels in processes or manage risk better.
