<ul><li>Karnataka legislative assembly is set to undergo a floor test after the Supreme Court final verdict came out yesterday. </li><li>Ramalinga Reddy, one of the 13 Congress rebel MLAs’ has decided to take his resignation back and vote in favour of the party. </li><li>The 14 rebel MLAs’ in Mumbai are not showing signs of any melt down and have clearly said that there is no question of stepping back. </li></ul> Karnataka CM H D Kumaraswamy led Congress-JD(S) government got some relief as one of its 15 rebel MLAs has decided to take a U-turn and withdraw his resignation, <a href="https://www.news18.com/news/politics/breather-for-karnataka-govt-as-rebel-congress-mla-agrees-to-withdraw-resignation-vote-for-alliance-2235481.html">according to reports</a>. Congress MLA Ramalinga Reddy, has decided to vote in favour of the HDK government. “I will take part in the assembly session tomorrow and vote in favour of the party. I will continue to remain in the party and serve as MLA,” Reddy told PTI. The move has come hours before the Karnataka assembly is set for a trust vote. In the meanwhile, a Section 144 is imposed around Vidhan Soudha area, where assembly of more than four people is banned, ahead of the vote. Supreme Court in its ruling yesterday in the Karnataka political crisis case had said that the MLAs cannot be forced to take part in the trust vote. While all the rebel MLAs were residing in Mumbai, Reddy was the only one who stayed back in Bengaluru and there were speculations that he may have been approached by the Congress for taking his resignation back. Congress also did not include Reddy’s name in the list of MLAs for disqualification saying he was an ‘exception’. Reddy while giving his resignation on July 6 had said that he is only resigning from the assembly and will continue to be in the party. Now the faith of the Congress-JD(S) alliance government in Karnataka is completely dependent on the trust vote, as the rebel MLAs in Mumbai are showing no sign of melt down. If this continues the HDK government will be reduced to a minority with 102 members after Reddy’s return. The ruling government went into a crisis mode after 16 of its MLAs from both the parties of the coalition government resigned early this months. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, yesterday. Karnataka floor test promises to be interesting after a last minute U-turn by a rebel MLA

The Congress coalition government in Karnataka is facing the risk of losing its majority in the state assembly since as many as 13 Congress MLAs and 3 JD MLAs submit their resignations to the Speaker. The total strength of the JD(S)-Congress coalition in Karnataka including those who have submitted their resignations is 118 (Congress-78, JD(S)-37, BSP-1 and Independents-2), in addition to the Speaker. On the other hand, the BJP has a strength of 105 MLAs in the State Assembly. The list of Congress MLAs who were spotted at the Speaker’s office for submitting their resignations are Ramesh Jarkiholi (elected from Gokak), Pratap Gowda Patil (won from Maski), Shivram Hebbar (won from Yellapur), Mahesh Kumathalli (voted from Athani), B C Patil (won from Hirekerur), Byratibasavaraj (elected from K R Puram), S T Soma Shekar (from Yashwanthpur constituency) and Ramalinga Reddy (BTM Layout constituency). The JD(S) MLAs who have resigned are: A H Vishwanath (won from Hunsur), who recently quit his position as the party’s state chief, Narayana Gowda (elected from K R Pet), and Gopalaiah (won from Mahalakshmi Layout). Commenting on the repercussions of the situation, Assembly Speaker Ramesh Kumar said, “Whether the government will fall or survive would be decided in the Assembly“. He also added, “11 of them have submitted resignation letters. I told officials to take the letters and issue acknowledgement...on Tuesday I will go to office and take further action in accordance with rules.” Later, Congress MLA Munirathna who was elected from Rajarajeshwari Nagar also submitted his papers as per the sources of the Assembly Secretariat.

Baig had kickstarted the crisis by tendering his resignation on June 10. After that, 15 MLAs across both the coalition parties followed suit, shaking up the state government. In a major development amid the ongoing <keyword id="6355554" type="LOCATION" weightage="20" keywordseo="Madhya-Pradesh">Madhya Pradesh</keyword> political crisis, the Supreme Court on Thursday ordered a floor test in the state Legislative Assembly be held on Friday and the <keyword id="6394153" type="UNKNOWN" weightage="20" keywordseo="Proceedings">proceedings</keyword> be completed before 5 p.m. The floor test will be done by show of hands, it said. A bench headed by Justice D.Y. <keyword id="364737" type="LOCATION" weightage="20" keywordseo="Chandrachud">Chandrachud</keyword> and comprising Justice <keyword id="180213" type="PERSON" weightage="20" keywordseo="Hemant-Gupta">Hemant Gupta</keyword> said the test is essential to the political uncertainty in the state. The bench also directed the Karnataka DGP to provide security to 16 rebel Congress <keyword id="41448" type="ORGANIZATION" weightage="20" keywordseo="MLAs">MLAs</keyword> who may want to attend the floor test. "The session of the Madhya Pradesh Legislative Assembly which has been deferred to 26 March 2020 shall be reconvened on 20 March 2020. The meeting to be convened shall be confined to a single agenda, namely, whether the government of the incumbent Chief Minister continues to enjoy the confidence of the House," it said. The court said that the voting on the agenda shall take place by show of hands, as the Governor having clarified by his letter dated March 15 that there is no provision for recording the division by 'press of button', and the proceedings shall be videographed and, if a provision exists for live telecast of the proceedings. "All authorities, including the Legislative Secretary, shall ensure that there is no breach of law and order in the course of the proceedings and that the floor test is conducted in a peaceful manner," it ruled. The court added that the Director General of Police, Karnataka as well as the Director General of Police, Madhya Pradesh shall ensure that there shall be no restraint or hindrance whatsoever "on any of the sixteen MLAs taking recourse to their rights and liberties as citizens. In the event that they or any of them opt to attend the session of the Legislative Assembly, arrangements for their security shall be provided by all the concerned authorities". The top court will publish a detailed judgement on the matter latter, observing that the judgement will take some time on submissions made by parties in the case. "The state of uncertainty in the state of Madhya Pradesh must be effectively resolved by issuing a direction for convening a floor test, bearing in mind the principles which have been enunciated in the decision of the nine-Judge Bench of this Court in S.R. Bommai v Union of India," said the court.

SC orders floor test in Madhya Pradesh Assembly by Friday

Karnataka government has submitted to the High Court that it has issued order to attach the movable and immovable assets of former state minister, R. Roshan Baig, who is an accused in the multi-crore <keyword id="667927" type="PERSON" weightage="20" keywordseo="Ponzi-scam">Ponzi scam</keyword> of I-Monetary Advisory (IMA) group of companies. The state government submitted its report on Wednesday. On June 12, the High Court had slammed the state government over the delay in taking a decision on attaching the properties of eight-time <keyword id="381991" type="POSITION" weightage="20" keywordseo="Congress-legislator">Congress legislator</keyword>, Baig, under the provisions of the Karnataka Protection of Interest of Depositors in Financial Establishments (KPIDE) Act, even two months after the court passed the order to do so. A division bench of <keyword id="42759" type="POSITION" weightage="20" keywordseo="Chief-Justice">Chief Justice</keyword> Abhay Shreeniwas Oka and Justice Suraj Govindaraj on June 12 had granted the government two weeks' time. After this rap, the state government submitted to the High Court that it has issued a notification on July 6 attaching around 20 immovable and movable assets of the former Minister located in various parts of the city. The state government also submitted another notification under the Karnataka Protection of Interest of Depositors in Financial Establishment Act, 2004, attaching a sum of Rs 62.26 crore paid in excess to the 100 top depositors of the IMA group who had received the amount in excess of their principal deposit amounts from out of the deposits of the IMA group. The copies of the notifications were submitted before a Division Bench comprising Chief Justice Abhay Shreeniwas Oka and Justice Suraj Govindaraj during the hearing of a batch of <keyword id="6355791" type="UNKNOWN" weightage="20" keywordseo="PIL">PIL</keyword> petitions related to the scam. The attached assets were those declared by Baig in his nomination papers when contesting elections to the <keyword id="144407" type="ORGANIZATION" weightage="20" keywordseo="state-Assembly">state Assembly</keyword> in 2018 and the present market value of these properties are yet to be declared after being assessed by the jurisdictional sub-registrars, it was stated in the notification. The notification has also indicated the values of these properties, around Rs 15-Rs 16 crore, as declared by Baig in his affidavit filed before the Election Commission of India. The notification issued by the government also lists properties including a commercial building developed in joint development (<keyword id="48584" type="COMPANY" weightage="20" keywordseo="JDA">JDA</keyword>) on the Hosur Road (with 33 per cent share), a commercial building on the Residency Road, houses on Sanders Road, Cleveland Road and sites each in HBR Layout, Fraser Town and Cleaveland Road. The notification submitted to the court also stated that the government had found that Baig had played a key role in the promotion of the IMA Group obtaining financial gains. Baig, an eight-time legislator, was minister in the Congress-led governments in the state from 1985 onwards. He emerged as one of the influential leaders in the Congress till 2019 when his name cropped in this ponzi scam. He chose to cross over to the BJP along with 17 rebel MLAs from the Congress and JD(S). In November 2020, the CBI had arrested Baig from his residence in Bengaluru as part of the investigation. He was then sent to judicial custody for 14 days. To date, the CBI has registered four cases, and filed three charge sheets and three supplementary charge sheets against 33 people in the case. IMA group of companies were founded in 2013 onwards and I-Monetary Advisory Private Limited was presented as an Islamic banking company to investors. It is alleged that the company defrauded more than a lakh investors to the tune of Rs 4,000 crore over a period of time. This is not the first time that Baig family's name has cropped up in such multi-crore scam, his younger brother Rehan Baig was one of the accused in the infamous multi-crore fake stamp paper scam which is also known as Telagi scam in the state. Rehan was arrested when Baig was serving as minister in then Chief Minister, S.M. Krishna's cabinet. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was disrupted throughout the day on the issue of trust vote and when it was finally adjourned till today, BJP announced a night long strike in the assembly itself till the voting was not done. “We are demanding voting on the motion but the chief minister is reluctant to take it up as he has confirmed himself that he has lost confidence of the House and the people. Congress delayed the vote as it alleged that BJP kidnapped the Congress MLA Shreemath Patil, who had decided to take his resignation back and vote in favour of the ruling party. BJP state president B S Yeddyurappa said that they are willing to wait till midnight till the voting starts. Speaker’s Dilemma The Speaker had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was adjourned for half an hour till 4:30 pm, after ruckus raged at the Vidhan Soudha in Bengaluru. Previously in the day, a delegation of senior BJP leaders Jagadish Shettar, Arvind Limbavalli and Baravraj Bommai met the Governor of Karnataka, Vajubhai Vala and submitted a complaint on the proceedings of the house and requested him to intervene and ask the Speaker to conduct the confidence motion today itself. The Karnataka state government went into a crisis mode after 16 of its MLAs from both the parties of the coalition government resigned early this month. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, yesterday.

This was highly expected as 17 of the ruling coalition government's legislators were absent from the assembly today. The motion for confidence was moved by Kumaraswamy on July 18, after as many as 15 MLAs resigned from the government early this month. Of the 17 missing legislators, 12 of the Congress and 3 of the JD-S are rebels who resigned from the Assembly and are holed-up at a star hotel in Mumbai while other two Congress members are in private hospitals in Bengaluru and Mumbai for treatment. "The rebels have rejected even the last-minute appeal of the party leaders to be present in the Assembly for voting in favour of the motion, as they have already resigned and the Supreme Court ruled on July 17 that they cannot be compelled to attend the session for the floor test," a leader of the ruling combine told IANS. Though two Independents, who resigned as ministers on July 8 and pledged support to the BJP were not seen in the Assembly since the 10-day monsoon session began on July 12, the opposition party is hoping they would be present at the time of voting against the motion. "Even if they are not present, their absence will not make a difference as all our 105 legislators are present in the House to vote against the motion," party spokesman G. Madhusudana told IANS. With 17 members absent, the effective strength of the 225-member Assembly at the time of voting will be 208, with 105 the new halfway mark. The Congress strength has been reduced from 79 to 65, but this includes the Speaker, who can vote only in the event of a tie. Similarly, the JD-S strength has come down from 37 to 34. With the support of the lone BSP member and the nominated member, the ruling combine has 101 votes, which is four short of the half-way mark, while the BJP's 105 increases to 107, with the two Independents. The BJP leader said that they hoped that good sense will prevail in Kumaraswamy, who knows that his fate is sealed, and he will resign than face a humiliating defeat in the floor of the house. As many as 10 MLAs from the Congress resigned from the government on July 1 which weakened the Congress and Janata Dal (S) coalition government. The MLAs had stayed holed up in <keyword id="6358070" type="LOCATION" weightage="20" keywordseo="mumbai">Mumbai</keyword> for days since the mass resignations as the crisis to Mumbai. A few silver lines of resolution came on Thursday after the Supreme Court directed the dissenting MLAs to appear before the Assembly on Thursday evening. The Apex court had also asked the Karnataka Police to provide protection to the MLAs — Pratap Gouda Patil, Ramesh Jarkhiholi, Byrati Basavaraj, BC Patil, ST Somashekar, Arbail Sivaram Hebbar, Mahesh Kumathalli, K Gopalaiah, HD Vishwanath and Narayan Gowda. The All India Congress Committee (AICC) had also registered a complaint against the rebel MLAs for not abiding by the party rules and staying illegally at a hotel in Mumbai. The situation also heated up when Congress party leaders like Milind Deora and Shikumar were stopped from entering the hotel premises. Later, a Section 144 which bans the assembly of more than four people, was also imposed on Wednesday in Powai area where the rebel MPs were staying. The MLAs had accused that the Speaker Ramesh Kumar was not accepting their resignations, even when they were in accordance with the Indian constitution. Governor Vala had earlier directed the Speaker to hold the trust vote by 1:30 pm today. Also, the Congress state President was seen heading to the Supreme Court, possibly delaying it further. Kumaraswamy said, “It (trust vote) is crucial and cannot be completed by 1:30 pm. This needs to be discussed.” The opposition, BJP, has been alleging that the ruling party is delaying it, as it does not have the requisite majority. They had also staged an overnight protest by ‘sleeping’ in the Assembly. Governor is interfering: Cong JD(S) spokesman Ramesh Babu said that the CM’s counsel will move the Supreme Court today for a stay on the Governor's Thursday’s order asking him to prove majority by the deadline. “The Governor is interfering in the workings of the Legislative Assembly, which is the domain of the Speaker under the provisions of the Constitution,” Babu said. Congress-JD(S) alliance is to petition on the basis that CM Kumaraswamy had moved the confidence motion in the house on Thursday and the debate had started and so setting a deadline should be stayed by the court. In the meanwhile, one of the Congress MLAs Shreemant Patil is admitted in a hospital in Mumbai, after he complained of chest pains. Yesterday, Congress alleged that BJP has kidnapped them. Delayed Trust The trust vote which was supposed to happen yesterday, was relentlessly delayed by the ruling Congress-JD(S) coalition which might be facing an end of its run. Kumaraswamy will have to prove that his government has majority to carry on, as MLAs have been leaving his fold. BJP party members had staged an overnight dharna or protest over the delay of trust vote. Accusations, speeches and allegations between both Congress and BJP managed to delay the vote, yesterday. Finally, the state’s Governor wrote a letter to CM Kumaraswamy regarding the trust vote after senior BJP MLAs met him at the Raj Bhawan. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back.
