<ul><li>On Monday, during the <keyword id="120956" type="PERSON" weightage="20" keywordseo="Monsoon-Session">Monsoon Session</keyword> of <keyword id="6354721" type="ORGANIZATION" weightage="20" keywordseo="parliament">Parliament</keyword>, the Criminal Law (Amendment) Bill was passed.</li><li>Its implementation increases the maximum sentence for raping a girl under 12 years of age to a death penalty; for raping for a girl under 16 years of age to 20 years; and for raping a woman to 20 years. </li><li>While some people believe the situation is so extreme that the <keyword id="6384243" type="UNKNOWN" weightage="20" keywordseo="death-penalty">death penalty</keyword> is the only option, critics believe the law may do more harm than good. </li></ul>On Monday, the Parliament passed the Criminal Law (Amendment) Bill, replacing the Criminal Law (Amendment) Ordinance, <a href="http://www.prsindia.org/billtrack/the-criminal-law-amendment-bill-2018-5286/">increasing the minimum sentence</a> for raping a girl under 12 years to age to at least 20 years. Following which, the sentence can be increased the life imprisonment to a maximum of serving out the death penalty. People in favour of the law claim that the situation in India has become so extreme that such a measure is unavoidable. On the other hand, the critics assert that increasing the punishment alone isn’t enough. They believe that provided the current laws are properly imposed and the system is made more efficient, there isn’t necessarily a requirement for the death penalty. In the larger picture, certain critics are worried that India is swimming against the trend where most countries are abolishing the death penalty. Jail time The increase in the severity of punishment when it comes to rape isn’t limited to the death penalty in the case of a minor. The minimum sentence for raping a girl under the age of 16 years has also been increased from 10 years to 20 years, which is extendable to include life imprisonment. Life imprisonment, in this case, implies that the convict will serve his or her jail term for the rest of their ‘natural life’. Also, in the case of raping or gang raping a girl under 16 years of age, there is no provision for anticipatory bail.  Faster trials Justice isn’t justice until it is served. More than the increase in the sentences for rape, the bill also puts in place a measure to increase the speed with which rape cases are handled. First of all, the initial probe has to be completed within two months of the complaint being filed. After which there’s another deadline of two months in which the trial has to be concluded. There are another six months on the table for the disposal of appeals, after which matter should be settled. Whether or not such an amendment will have the desired effect on the level of rapes in the country is something that only time will determine. There are worries that the implementation of this law has been a ‘knee-jerk’ reaction from the government to satiate public outcry rather than bring about societal change. That being said, just this law, without programs to spread awareness and inform people of the consequences of rape, won’t do much good.

With or without the subject’s consent, when the subject is under sixteen years of age. Penetration alone is sufficient to constitute the act of sexual intercourse that can be considered as an offense of rape. Definition of consent under Section 375 Consent can be defined as a clear and voluntary communication given by a woman for a given sexual act. As long as the woman is above the age of 18, <keyword id="150124" type="PERSON" weightage="20" keywordseo="marital-rape">marital rape</keyword> is a clear exception to giving consent since marital rape is not a crime under the <keyword id="75223" type="ORGANIZATION" weightage="20" keywordseo="Indian-Penal-Code">Indian Penal Code</keyword>. Exceptions to Section 375 The act will not be considered as a sexual assault if a man has sexual intercourse with his own wife who is aged above 18. Amendment made to Section 375 The Parliament of India passed the Criminal Law (Amendment) Act, 2013 also called as the Nirbhaya Act, in order to make a significant amendment to Section 375. This measure was meant to rule out the ambiguity that existed in the earlier law and created room for strict punishment during the occurrences of the rarest cases of sexual violence. As part of this amendment, the ambiguity that existed in the earlier law was addressed and room was created for giving strict punishment in case of the rarest cases of sexual violence. The legislation was altered to define acts such as penetration of penis into vagina, urethra, anus or mouth, or any other object or any other body part to any extent into a woman’s body parts (or facilitating any other person do it), to constitute the offence of sexual assault. The amendment also classified acts such as applying mouth or touching the private parts as offences of sexual assault.

Timeline of the Nirbhaya case — the seven year march to justice

Can it be more shameful for us to learn that India has seen a 288 per cent increase in the arrest of juveniles for committing rapes in 10 years - from 2003 to 2013. Even more disturbing is the fact that arrests of juveniles in the age group 16-18 has increased to almost 60% in this period, which is the highest among all three juvenile age groups. 
 Despite such alarming facts staring at us, we still required a brutal and horrifying Delhi gangrape-murder of a female paramedical student on Delhi streets to realize the threat from rising <keyword id="6793720" type="UNKNOWN" weightage="20" keywordseo="Juvenile-crimes">juvenile crimes</keyword> in the country. It wasn’t until the spine-chilling details of the crime emerged and we learnt that the youngest rapist in the case (17 years’ old) was infact the most brutal one, that we stood up against unfair constitutional concession to dangerous minors like him in India which says those under 18 to be sentenced only to a maximum of three years in a reform facility. That meant no strict trial for him and others like him. 
 
You will be surprised to know that even before the Delhi gangrape incident took place, the statistics on juvenile crimes were startling. 
 
-In 2011, 33,887 juveniles were arrested for crime. Of these, 21,657 fell in the 16-18 years age group. In Delhi itself, of the 925 boys arrested for juvenile crimes in 2011, 567 were in the 16-18 years age group. -The next year 2012 which saw the <keyword id="1499530" type="UNKNOWN" weightage="20" keywordseo="Nirbhaya-gangrape">Nirbhaya gangrape</keyword> had the number of juvenile offenders steadily increasing. There were 39,822 juvenile arrests and the highest increase in the incidents of crimes committed by them was reported under assault on woman to outrage her modesty (132.3%) followed by insult to the modesty of women (70.5%) and <keyword id="39493" type="ORGANIZATION" weightage="20" keywordseo="Rape">rape</keyword> (60.3%). Notably, the debate about the trial age of juveniles between 16 and 18 years first began after the 2012 Delhi gang-rape case, in which one of the main accused was a juvenile. While the others accused in the case were given death (one committed suicide), the minor accused was sent to a remand home for three years. 
-In 2013, the number of juvenile arrests increased to 43,506 which further up to 48,230 in 2014 when a total of 48,230 juvenile boys and girls were arrested. 
 Despite such a situation, <keyword id="42851" type="PERSON" weightage="20" keywordseo="Maneka-Gandhi">Maneka Gandhi</keyword> introduced the Juvenile Justice (Care and Protection of Children) Amendment Bill in Parliament only in August last year. Yes, we did finally wake up to the need of a stricter juvenile law, one that would consider those above 16 who commit “heinous crimes” as adults. Finally, a gruesome rape case had led to massive debates in the political corridors, which were echoing in the Parliament. It was a welcome change for sure, but the crucial Bill passed in Rajya Sabha merely two days after the now 20-year-old ‘juvenile’ rapist of Nirbhaya walked out of jail amid vociferous protests, still awaits President’s assent to become a law. 
 
Had it not been for the narrow scope of the prevailing law, and the new Bill being stuck in the Rajya Sabha due to the Parliament logjam, the consequent new law could have prevented the juvenile rapist, from getting out of jail. The new law would have set an unprecedented example to begin with. Justice was however not only delayed, but denied in one of the most gruesome case the country has ever witnessed. We wish no more Nirbhayas being raped and in the face of increasing crimes by juveniles, all India direly needs now is the Juvenile Justice Act.

Why India direly needs Juvenile Justice law

Protests continue to surge across India against the rape of 19-year old Dalit girl from the <keyword id="6390895" type="LOCATION" weightage="20" keywordseo="hathras">Hathras</keyword> district in Uttar Pradesh. Congress workers are holding a candlelight march near India Gate against the alleged gang-rape. Protests also errupted in other parts of the country, like Pune, Chennai and Kolkata. after the brief detainment of <keyword id="5268" type="PERSON" weightage="20" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> and <keyword id="12587" type="PERSON" weightage="20" keywordseo="Priyanka-Gandhi">Priyanka Gandhi</keyword> Vadra by the Uttar Pradesh (UP) Police. Meanwhile, Seema Kushwaha — who fought on the behalf of the rape victim in the landmark Nirbhaya case — may also be roped into defend the Hathras victim. "The family of the alleged gang-rape victim called me to Hathras as they want me to stand as their legal counsel. I'm not being allowed to meet them as administration says it will affect law and order situation," she told ANI. UP Police claims Hathras victim was not raped A senior Uttar Pradesh police officer said on Thursday said the forensic report has revealed that the 19-year-old Hathras woman who succumbed to her injuries at a Delhi hospital was not raped. Citing a forensic science laboratory (FSL) report, ADG (Law and Order) Prashant Kumar said the cause of her death is an injury on the neck and trauma resulting due to it. "The report of the FSL has also come. It says clearly that samples did not have sperm. It makes clear that there was no rape or gang rape," Kumar said. "Even the woman in her statement to police did not mention about rape but talked about 'marpeet' (beating) only," he said. "For disturbing social harmony and create caste violence, some persons wrongly presented facts," the UP police officer said. "Police took immediate action in the case and now we will identify those who tried to disturb social harmony and create caste violence," the ADG added, stressing that people "distorted facts" in the media. As the two Gandhi's were being taken away, Congress workers were seen blocking the road to keep the police van from leaving, which ensued in the UP police using force to clear the way. They have been taken to the Buddh International Circuit guest house. NCW seeks explanation from UP Police on urgency to cremate body of Hathras gangrape victim <ul class="inte_common"></ul>The National Commission for Women (NCW), in a statement, said it is shocked at the brutal gangrape of a 20-year-old woman in Hathras, Uttar Pradesh who died in Delhi after fighting for life for two weeks. The incident underlines the grim state of women in the society, it said. The commission said it also came across a disturbing report on police officials cremating her body in the middle of the night without the permission and presence of her family members. It has been reported that the victim's body was cremated at 2:30 am by the police without the presence of any family member. "The victim's family had reportedly appealed to the District Magistrate for taking her body home for performing the last rites, however the police went ahead with the cremation while most of her family members were away," it said. "The commission has now written to Director General of Police, Uttar Pradesh seeking an explanation on the urgency to cremate the body of the victim in the middle of the night that too in the absence of her family. NCW has asked the administration to send a reply on the same at the earliest," it said. After Hathras, another gangrape victim dies in UP's Balrampur A 22-year-old Dalit woman died after allegedly being raped by two men in Uttar Pradesh's Balrampur district, succumbing to critical injuries on the same day as the teen from Hathras in the state who breathed her last in a Delhi hospital two weeks after she was gangraped. Both the women died on Tuesday and were cremated on Wednesday. The two men accused of assaulting the woman from Balrampur have been arrested, police said amid outrage over the death of the 19-year-old Dalit woman from Hathras. The Balrampur victim's mother told reporters on Wednesday night that the rapists broke her daughter's legs and back, a charge denied by the police. "My daughter had gone to take admission in a college on Tuesday. On her way back, three-four persons abducted her, took her to their room, gave her an injection and raped her. They later sent her back on an e-rickshaw, which dumped her outside our house. They broke her legs and back. She could not stand or talk," the woman said. Quoting the victim's family members, Balrampur Superintendent of Police (SP) Dev Ranjan Verma said the woman worked in a private firm and returned home on Tuesday in a serious condition. She looked dazed and had a cannula, medically known as Vigo and used for administering an injection or other fluids in the body, inserted in her hands. She was rushed to a nearby hospital but died on the way, the SP said. When the matter was reported to the police by the hospital, her parents alleged she was gangraped, he added. Acting on the family's complaint, police identified the accused as Shahid and Sahil and arrested them. About the mother's allegation that the woman's legs and back were broken, Verma said, "It was not confirmed in the post-mortem. We contradict this news." She was cremated on Wednesday after the post-mortem in the presence of her family members, the police said. The district magistrate and the SP, along with the mahant of the Devipatan temple, Mithilesh Nath Yogi, visited her home on Thursday morning, met the family members and condoled her death. "The family members were assured that the accused will be given a strict punishment in accordance with law. A letter sanctioning a financial assistance of Rs 6,18,450 was handed over to them by the mahant. The amount will be sent to the victim's mother's bank account by the afternoon," a statement issued here said. The mother has demanded a compensation of Rs 25 lakh and a government job for her son. "My daughter wanted to become a lawyer but she was killed. The same fate should await the culprits. We want justice. My son should be given a government job and we should get at least Rs 25 lakh as compensation," she said. Safdarjung Hospital releases autopsy The autopsy of the 19-year old victim of the Hathras gang rape reveals that she was tortured, strangled and suffered from a cervical spine injury. However, the final diagnoses does not mention rape. It reads, "Alleged post-strangulation with cervical spine injury with sepsis with cardiopulmonary arrest." Instead, ‘rape and strangulation’ have been noted under the ‘<a href="https://www.ndtv.com/india-news/hathras-gang-rape-autopsy-report-shows-victim-was-strangled-suffered-cervical-spine-injury-2303696">medical history</a>’ section. The report adds that the victim was given CPR and ‘despite all resuscitative efforts’ was declared dead at 8:55 am on Tuesday, September 27. Section 144 in Hathras, borders sealed The district administration in Hathras has imposed Section 144 in the area and has banned the entry of all 'outsiders' including media persons in Boolgarhi Village where a 19-year-old Dalit girl was gang-raped and later passed away. District Magistrate Praveen Lakshkar said that the Special Investigation Team (SIT), set up to probe the incident, has reached the village and is interacting with the family and other people to record their statements. "They do not want any disturbance and hence, all entry of outsiders has been stopped," he said. The District Magistrate further said that he had no information of Congress leaders Rahul Gandhi and Priyanka Vadra reaching Hathras to meet the bereaved family. NHRC issues notice to Yogi government on Hathras incident The National Human Rights Commission (NHRC) has taken suo motu cognizance of the Hathras incident of the rape and murder of a 19-year-old Dalit girl and has issued a notice to the Yogi Adityanath government. The Commission has directed the state government to provide adequate protection to the family of the deceased, keeping in view the gravity of the matter and also the aspect of the witness protection as there is apparent rift between two communities. Yogi announces ₹ 25 lakh aid for victim’s family Amid an uproar over the cremation of the body of a Dalit gang-rape victim early on Wednesday, Uttar Pradesh Chief Minister Yogi Adityanath spoke to the 19-year-old woman's father in Hathras district and offered his condolences. He also announced a compensation of ₹ 25 lakh to the bereaved family, apart from a job to one of its members. The family would also be given a house. The victim's father sought the harshest punishment for the four accused arrested for the crime reported on September 14. Additional Chief Secretary (Home) Avanish Awasthi said that the Chief Minister assured the woman's father of the most stringent action against the culprits and all possible help to the family. Yogi sets up SIT to probe Hathras incident The Yogi Adityanath government on Wednesday set up a Special investigation Team (SIT) to probe the Hathras incident. The SIT, according to official sources, will comprise home secretary Bhagwan Swaroop, DIG Chandra Prakash and IPS officer Poonam. The SIT will submit its report at the earliest. The Chief Minister, sources said, has decided to send the case to a fast track court in order to ensure justice to the victim. All four accused have already been arrested. PIL filed in Supreme Court seeking CBI probe in Hathras gang-rape and murder A PIL was filed in the Supreme Court on Wednesday seeking a CBI probe or SIT investigation under a sitting or former Supreme Court or High Court judge in the gruesome gang-rape and murder of a 19-year-old Dalit woman in Uttar Pradesh's Hathras district. The PIL has been filed by social activist Satyama Dubey and advocates Vishal Thakre and Rudra Pratap Yadav. The petitioners urged the apex court to pass appropriate order for a fair investigation - either by the CBI or the SIT under a sitting or retired judge of Supreme Court or High Court - and transfer the case to Delhi, as Uttar Pradesh authorities had failed to take certain actions against the accused. The plea said the victim was first raped and then brutally assaulted, and according to a medical report, her tongue was chopped and her neck and back bones broken by the accused, who belonged to an upper caste. The victim succumbed to her injuries at Safdarjung hospital in Delhi. The petitioner said on September 14, the accused persons raped and brutally assaulted the victim when she was in the fields to collect fodder for her cattle. It also said that the police have said the victim's cremation was being carried out as per the wishes of the family, which was not true, and the police personnel set fire to the body of the deceased, even as media persons were banned, as per the information received, said the plea. The Delhi Commission for Women (DCW) on Wednesday also wrote to Chief Justice of India (CJI) SA Bobde to urge the Supreme Court to take suo motu cognisance of the gruesome gang rape and murder of a Dalit woman in Uttar Pradesh's Hathras district. Hathras victim cremated, police denies coercion The 19-year-old Dalit woman from Hathra was cremated early Wednesday in her village amid tight security. "The police have forcibly taken the dead body, and my father along with them for cremation. When my father reached Hathras, he was immediately taken (to the crematorium) by the police," the victim's brother told the media. However, Hathras police have denied the charges and has issued a notice saying the coercion being talked about on social media is canard. It said: "The family cremated the body with due rituals under the supervision of police and administration." The victim, who was paralyzed after being allegedly dragged on the field by her attackers on September 14, died at the Safdarjung Hospital on Tuesday after battling for life for a fortnight. Her mortal remains reached the Boolgarhi village around midnight and the cremation was done at 3 a.m. There was tension as the victim's mortal remains reached the village and people tried to block the ambulance from moving ahead. Superintendent of Police (SP) Vikrant Veer denied any 'urgency' by the police in holding the cremation at night even though cremations do not normally take place after sunset. He added that the cremation was done by the family as usual after the body reached Boolgarhi village. The SP claimed that the situation is calm in the village, but heavy police force has been deployed. The woman was allegedly raped in a Hathras village by four men, who were later taken into custody. Initially she was rushed to the Jawaharlal Nehru Medical College and Hospital in Aligarh, but on Monday night had to be shifted to the Safdarjung Hospital in Delhi after her condition deteriorated. Outrage over Hathras gang rape case intensifies with protests across the country

The Union <keyword id="6355513" type="COMPANY" weightage="20" keywordseo="Cabinet">Cabinet</keyword> on Wednesday approved extending the upper limit for permitting abortions from the present 20 weeks to 24 weeks. The Cabinet approved the Medical Termination of Pregnancy (Amendment) Bill, 2020 to amend the Medical Termination of Pregnancy Act, 1971. The Bill will be introduced in the ensuing session of Parliament. While addressing the media after the Cabinet meeting, Union Minister <keyword id="119642" type="PERSON" weightage="20" keywordseo="Prakash-Javadekar">Prakash Javadekar</keyword> said the upper limit for permitting abortions has been extended from the present 20 weeks to 24 weeks. He also said that this will ensure safe termination of pregnancies and also give women reproductive rights over their bodies. The extension to 24 weeks will also help victims of rape, girls with disabilities as well as minors, who may not realise they are pregnant until later, he said.

The attack comes three months after the fatal gang-rape of a woman aboard a New Delhi bus outraged Indians.
Authorities detained and questioned 13 men in connection with the latest attack, which occurred Friday night as the couple camped out in a forest in Madhya Pradesh state after bicycling from the temple town of Orchha, local police officer R.K. Gurjar said.
The men beat the couple and gang-raped the woman, he said. They also stole the couple's mobile phone, a laptop computer and 10,000 rupees ($185).
The woman was treated at a hospital in the nearby city of Gwalior, Gurjar said, adding that she and her husband apparently suffered no major injuries.
A photo showed the woman — her identity concealed with a hood — walking while being escorted by police to the hospital.
Police detained 13 men and questioned them, Gurjar said. Six of the men were released after questioning. No other details were immediately available.
Indian television stations showed scores of police searching the forest where the attack occurred.
Swiss Foreign Ministry spokesman Tilman Renz described the case as "deeply disturbing" and said Swiss diplomats were assisting the couple.
The diplomats called on Indian authorities "to do everything to quickly find the perpetrators so that they can be held accountable," Renz said in a statement.
Last month, the Swiss government issued a travel notice for India that included a warning about "increasing numbers of rapes and other sexual offenses" in the South Asian nation.
India has seen outrage and widespread protests against attacks on women since December's fatal gang-rape of a young woman on a moving bus in New Delhi, the capital. The <keyword id="39494" type="ORGANIZATION" weightage="60" keywordseo="Crime">crime</keyword> horrified Indians and set off nationwide protests about India's treatment of women and spurred the government to hurry through a new package of laws to protect them.
One of six suspects in the December attack was found dead in a New Delhi jail this past week. Authorities said he hanged himself, but his family and lawyer insisted foul play was involved. A magistrate is investigating. Four other men and a juvenile remain on trial for the attack.

The court will announce the quantam of sentence in the case against the six convicted at 2 pm today. The rest six accused in the Kathua rape case are convicted under three sections including <keyword id="7741461" type="UNKNOWN" weightage="20" keywordseo="Ranbir-Penal-Codes-Sections-201">Ranbir Penal Codes' Sections 201</keyword> (pertaining to the disappearance of evidence) and 120-B (pertaining to criminal conspiracy). Reports of two police officers accepting bribes for covering up the crime also surfaced. One of the arrested suspects is juvenile. India toughned its juvenile law for serious crime including rape after the horrific December 2016 Delhi gangrape. The bill allows juveniles between 16 and 18 years of age to be treated as adults for serious crimes like rape or murder. The police officials said that they have DNA tests and physical evidence of the defendants connected with Asifa’s case. The officials also said that they interviewed over 130 witnesses who “unequivocally corroborated the facts that emerged’’.

Kathua rape case: The J&K Court convicted six of seven who were held guilty for 8-year-old's rape-murder last year

During the trial, the driver was alleged to have <a href="http://www.firstpost.com/india/uber-driver-gets-life-term-for-rape-survivor-has-moved-on-says-father-2493640.html">had a history of sexual assault</a>. After she was raped, she sued Uber and <a href="http://www.hindustantimes.com/delhi-news/delhi-uber-rape-victim-ends-lawsuit-against-company-in-us-court/story-AVqUDwVanOwfffTlxcWSFJ.html">that case was settled.</a> The rapist was convicted of the crime and sent to prison for life. Alexander reportedly helped with that conviction, <a href="https://www.recode.net/2017/6/15/15810556/uber-india-rape-victim-lawsuit-medical-files">even testifying at his trial.</a>This lawsuit is the second one the woman filed against Uber. It came after a story that circulated earlier this year, <a href="https://www.recode.net/2017/10/16/16486418/former-uber-exec-has-filed-to-dismiss-case-related-to-india-rape-controversy">first reported by Recode's Kara Swisher</a>, that alleged that Uber executives had obtained and mishandled the woman's medical records when dealing with that first lawsuit. The suit alleges that various Uber executives violted her medical privacy by looking at her health records.Michael is one of three Uber executives personally named in the suit. The company is also being sued. The other executives named are former CEO Travis Kalanick, and former president of Asia, Eric Alexander.In the motion to dismiss, Michael's lawyers argue that the whole case against their client is nonsense. The lawyers don't go so far as to deny that someone at Uber (perhaps even Michael) may have seen the woman's medical records, obtained by another employee from the police in Dehli, India, when she sued Uber and was working to put the rapist behind bars. Rather, Michael denies that he had anything to do with obtaining them.The woman - who is not named - also alleges that Uber executives defamed her by suggesting to others that she was working with a rival company to harm Uber's business. On that allegation, the lawyers use an interesting tactic: they invoke the name of LeBron James and the crazy 2010 lawsuit from a man named Leicester Bryce Stovell Stovell is an attorney who claimed that he was the biological father of James by way of that lawsuit. He was demanding $4 million dollars from his allegedly long-lost-son and his son's mother.Among the things Stovell claimed was defamation. This was, apparently, based on a remark from James who at one point said, "I want to be a better father than mine was." The lawsuit was dismissed in 2011 with the judge basically decreeing that the people hearing a negative remark have to know exactly who is being dissed, and no one would have thought of Stovell. Michael's attorneys invoke LeBron James to argue that since the woman's identity was never revealed publicly by Michael, he couldn't have defamed her. This second lawsuit is filed under "Jane Doe."The hearing for the lawsuit is scheduled for December 1. Even if the judge decides to drop Michael from the suit, that doesn't mean that the whole suit will be kicked out and the other executives won't be on the hook for allegations involving her medical records. But should a judge drop Michael from the case, it would be a step in that direction.
