The Central Bureau of Investigation (CBI) remained tight-lipped on the development. The Red Notice is highest form of alert issued by the 195-member country-strong Interpol to law enforcement agencies worldwide to locate and provisionally arrest a person pending extradition, surrender, or similar legal action. Requests seeking comments of the CBI and the legal team of Choksi remained unanswered. The Interpol had issued the Red Notice against Choksi in 2018, nearly 10 months after he fled from India in January that year to take refuge in Antigua and Barbuda, where he had taken citizenship. Choksi had challenged the CBI application seeking issuance of Red Notice against him, calling the case a result of political conspiracy, sources said. He had also raised questions on issues such as jail conditions in India, his personal safety and health, they added. The matter had gone to a five-member Interpol committee's court, called Commission for Control of Files, which had cleared the RCN (Red Notice) rejecting his contentions, sources said. The CBI has charge sheeted both Choksi and his nephew <keyword id="571991" type="General" weightage="20" keywordseo="nirav-modi" source="Orion">Nirav Modi</keyword> separately in the scam. The agency, in its charge sheets, had alleged that Choksi swindled Rs 7,080.86 crore, making it one of the biggest banking scam in the country at over Rs 13,000 crore. Nirav Modi allegedly siphoned Rs 6,000 crore. An additional loan default of over Rs 5,000 crore to Choksi's companies is also a matter of probe under the CBI. Choksi had disappeared from his sanctuary in Antigua and Barbuda in May 2021 to mysteriously appear in neighbouring Dominica where he was detained for illegal entry. After news of Choksi being held in Dominica surfaced, India rushed a team of officials led by CBI DIG Sharda Raut to make every effort to bring him back on the basis of a Interpol Red Notice against him. His lawyer in London Michael Polak, who filed a complaint with the Scotland Yard, said Choksi was removed from Antigua and Barbuda, where as a citizen he enjoys rights to approach the British Queen's Privy Council as a last resort in cases on his citizenship and extradition to Dominica where these rights are not available to him. India's effort to bring Choksi back was unsuccessful as his lawyers moved with unprecedented agility to file a habeas corpus petition before the Dominica High Court which was admitted for hearing. Their swift legal manoeuvres coupled with investigation into circumstances of his disappearance from Antigua blunted attempts of India to get Choksi deported from Dominica. After 51 days in prison, Choksi, 62, was given bail by Dominica High Court July 2021 to travel back to Antigua to seek medical help from a neurologist based there with a provision that he will return to face trial when gets fitness clearance by his doctors. Later, all the proceedings against Choksi of illegal entry into Dominica were dropped. But there are cracks in said system, and ever so often, a fraudulent mastermind uses them to slip some cash out for their advantage. From <keyword id="19964851" type="General" weightage="20" keywordseo="ponzi" source="keywords">Ponzi</keyword> schemes to bank frauds, the Indian government and investors have fallen victim to many financial scandals — some of which were so sordid that they can be recounted like they happened yesterday. Here’s a rundown of the most infamous scams in Indian financial history: <h2><keyword id="20713434" type="General" weightage="20" keywordseo="harshad-mehta" source="keywords">Harshad Mehta</keyword> Scam (1992) – ₹4,000 Crore </h2>Perhaps the most iconic of all Indian financial scams, Harshad Mehta was known as the "Big Bull" of the stock market. He manipulated stock prices using illegal loopholes in the banking system. By obtaining unsecured loans from banks and investing them in the stock market, Mehta artificially inflated stock prices. His bubble burst when banks demanded their money back, revealing the massive fraud. This scandal led to a major reform in India's financial markets. Mehta died in jail before full legal accountability was reached, but the scam caused a significant loss to investors and led to tighter regulation in the Indian stock market. <h2><keyword id="23122396" type="General" weightage="20" keywordseo="satyam-scam" source="keywords">Satyam Scam</keyword> (2009) – ₹14,000 Crore </h2>Dubbed as India’s Enron, the Satyam scandal involved its founder, <keyword id="23122397" type="General" weightage="20" keywordseo="ramalinga-raju" source="keywords">Ramalinga Raju</keyword>, admitting to falsifying the company's accounts to the tune of ₹14,000 crore. Satyam Computer Services, once considered a blue-chip company, was found guilty of inflating profits and revenues. Raju admitted to the scam after a failed attempt to buy two Maytas firms owned by his family. This case brought corporate governance issues in India to the forefront. Raju was convicted, but the legal processes have allowed him temporary freedom through bail. But this incident called for improved transparency and stricter corporate governance norms. <h2>Punjab National Bank Scam (2018) – ₹13,700 Crore </h2>Diamond merchant Nirav Modi and his uncle Mehul Choksi orchestrated one of the largest frauds in Indian banking history by obtaining fraudulent Letters of Undertaking (LoUs) from Punjab National Bank (PNB). These LoUs allowed them to obtain loans from foreign branches of Indian banks without providing any collateral. The scam involved over ₹13,700 crore, and Modi fled the country, causing significant reputational damage to India’s banking sector. Nirav Modi’s extradition is still pending, and Mehul Choksi remains out of India’s legal jurisdiction. The scam, however, resulted in strengthened banking regulations regarding LoUs and SWIFT transactions. <h2><keyword id="23122399" type="General" weightage="20" keywordseo="vijay-mallya-scam" source="keywords">Vijay Mallya Scam</keyword> (2016) – ₹9,000 Crore</h2>The "King of Good Times" was living large while his airline, Kingfisher, was drowning in debt. Vijay Mallya allegedly defaulted on loans amounting to ₹9,000 crore from various banks. He fled to the UK in 2016, leaving creditors, employees, and stakeholders in financial distress. His lavish lifestyle amidst the collapse of his airline made this scandal a high-profile case. Mallya’s extradition process is ongoing, but he remains out of reach of Indian authorities. The main impact was enhanced scrutiny of loan defaults and triggered legal reforms on extradition. <h2>Saradha Chit Fund Scam (2013) – ₹2,500 Crore </h2>The Saradha Group, operating a ponzi scheme disguised as a chit fund, promised unrealistically high returns to its investors, mostly in West Bengal and Odisha. The scam collapsed, leaving over 1.7 million people, many of whom were low-income investors, without their life savings. Politicians and celebrities were also implicated in the case. While Sudipta Sen is behind bars, not all the accomplices have been held accountable. Telecom minister A. Raja was at the centre of this controversy, which allegedly caused a loss of ₹1.76 lakh crore to the exchequer. The case was seen as a massive blow to public trust in India’s telecom sector and led to significant political fallout. Sadly, all key figures involved were acquitted despite the Supreme Court’s intervention and cancellation of 122 telecom licences. <h2><keyword id="455134" type="General" weightage="20" keywordseo="coal-allocation-scam" source="Orion">Coal Allocation Scam</keyword> (Coalgate) (2012) – ₹1,86,000 Crore </h2>The coal allocation scam, or "Coalgate," involved the illegal allocation of coal blocks to private companies between 2004 and 2009. The CAG of India estimated a loss of ₹1.86 lakh crore to the exchequer due to non-competitive bidding. Many high-profile politicians and industrialists were implicated, making this one of the largest political scandals in India. While some officials faced legal consequences, many key players were not prosecuted. But it did trigger policy reforms in the allocation of natural resources. <h2>DHFL Scam (2019) – ₹34,615 Crore </h2>Dewan Housing Finance Corporation Limited (DHFL) was accused of syphoning off over ₹34,000 crore through a series of shell companies and fraudulent loans. Investigations revealed that the promoters used these funds for personal enrichment and illegal political donations. The case came to light after an investigation by investigative journalists and was later confirmed by a report from KPMG. The case is ongoing, and the main accused are in custody. For now, regulations governing non-banking financial companies (NBFCs) have been strengthened. <h2>Yes Bank Crisis (2020) – ₹3,788 Crore </h2>Yes Bank, under its founder <keyword id="19899935" type="General" weightage="20" keywordseo="rana-kapoor" source="keywords">Rana Kapoor</keyword>, was involved in questionable lending practices. The bank made high-risk loans to companies already in financial trouble, which eventually turned into non-performing assets (NPAs). As of now, Rana Kapoor is facing trial, and legal proceedings are active. Kalmadi was arrested but the case has not resulted in major convictions or recoveries, except for stricter oversight on large public projects and international event planning. These scams not only caused financial damage but also eroded public trust in India’s institutions. One of India's most wanted fugitive businessman <keyword id="2763" type="General" weightage="50" keywordseo="mehul-choksi" source="Orion">Mehul Choksi</keyword> has been buying protection in Antigua by bribing a string of officials according to investigations conducted by <keyword id="16049056" type="General" weightage="50" keywordseo="kenneth-rijock" source="Orion">Kenneth Rijock</keyword>, a renowned financial crimes investigator. Rijock made shocking revelations in a news article on Blogger against Mehul <keyword id="31842" type="General" weightage="100" keywordseo="choksi" source="Orion">Choksi</keyword>'s bribery and conspiracy in Antigua, where officials are interfering with Interpol's efforts to detain him for extradition to India. He said that Choksi has been scheming to illegally extend the court process in Antigua, by paying bribes to government officials, including senior Antigua police official, <keyword id="16049058" type="General" weightage="50" keywordseo="adonis-henry" source="Orion">Adonis Henry</keyword>. Multiple witnesses report that Choksi and Inspector Henry have been meeting at least three times a day at Al Porto, a Jolly Harbor restaurant reportedly owned by Choksi, wrote Rijock in his financial crime blog. Choksi not only reached out to Henry but also tried to influence Antigua magistrate <keyword id="16049057" type="General" weightage="50" keywordseo="conliffe-clarke" source="Orion">Conliffe Clarke</keyword> through illegal payments. Choksi has corruptly influenced Clarke, through illegal payments, made purely for dilatory purposes, to indefinitely delay his pending extradition, wrote Rijock in his blog post. Rijock said that his sources confirmed that Clarke and Henry conspired together to interfere with Interpol's efforts to detain him for extradition to face the music in India. Rijock's article, supported by various facts, describes how the diamond merchant failed to flee from Antigua to Cuba and then fabricated a kidnapping scenario. Choksi intended to flee from Antigua to Cuba to avoid extradition since Cuba and India do not have an extradition treaty. The Indian fugitive was dumped off on the coast of Dominica in May 2021, after he refused to pay the agreed-upon payment to the smugglers' crew of the ship transporting him to Cuba, according to the investigator. Although an Antiguan court ordered Choksi extradited to his native India, where he allegedly stole the equivalent of millions of dollars, corrupt government officials, judges and law enforcement agents in Antigua have successfully delayed the proceeding, but only after the illicit receipt of substantial bribes. Choksi, a billionaire due to fraudulent consumer business practices, and major bank fraud, has avoided Indian justice for several years, after he obtained a Citizenship by Investment (CIP/CBI) passport in Antigua, notwithstanding an outstanding Interpol Red Notice seeking his arrest. Interpol has issued a Red notice against the fugitive who had been involved in the Punjab National Bank Scam in India before fleeing the country in 2018. A Red Notice is a request to locate and provisionally arrest an individual pending extradition. It is issued by the General Secretariat at the request of a member country or an international tribunal based on a valid national arrest warrant and it is not an international arrest warrant. PNB has alleged that two of its employees had "fraudulently" issued LoUs and transmitted SWIFT instructions to the overseas branches of Indian Banks. This was done to raise the buyer's credit for the firm of a diamond merchant without making entries in the bank system. The bank has alleged that one such fraudulent letter of undertaking (LoU) issuance took place on January 2018, the trail of which revealed the entire design. SBI’s box of troubles The annual inspection of banks’ accounts by RBI has opened a Pandora’s Box where many evils came out—where the country’s largest bank has suppressed employee fraud, covered bad loans, flouted anti-money laundering rules, covered up bad loans by a mechanism referred to as ‘window dressing’, according to the report. An e-mail sent to SBI seeking answers on the revelations, did not elicit any response. Most Indian banks were found guilty of trying to hide the rising problem of bad loans. They would either give fresh loans to pay old ones or book the losses in a different year to soften the blow on the company’s financials. In SBI’s case, the RTI response reportedly revealed that these factors were seen in the loans given out to diamond trading and power sector. Loans to diamond traders have brought down banks, especially Punjab National Bank scam where diamantaire Nirav Modi made away with unpaid loans of ₹2 billion and is now in the UK. Yet, SBI is not in as much trouble, not from RBI who is aware of the situation, not from its 435 million customers --- that’s over 30% of India’s population! Like Goldman Sachs, it is everywhere and, probably, too big to fail. Flouting Norms The report says that the bank also flouted norms laid down by the Reserve Bank of India (RBI) itself with regards to Know Your Customer (KYC), lending limits set on sectors and individuals. The bank, as per the report, was also lax with its loans. In many cases, the bank has not enforced securities provided on a loan, wherein assets of defaulters are taken over. In some cases loans were disbursed even before a charge was created on the collateral. And, the suppression of data has happened at every level since most of the credit problems were never taken to the board as well. Scrubbing it clean In all, the bank performed a clean-up exercise every time a new chairman took over. The first year a new chairman comes in, huge amounts are written off the books, and has become a common practice with the bank. This leaves the chairman of the bank concentrating on ‘managing profits’. The owner of the bank however is the government. And it seems to be doing its part too. As non-performing assets as a result of bad loans increased and credit growth slowed down, the government is looking to recharge public sector banks (PSBs) with fresh funds. In the latest Budget 2019, the Finance Minister Nirmala Sitharaman said that they would be giving out as much as ₹75,000 crore to re-capitalise government banks, so that they can kickoff growth in the country, with renewed interest. The solution named India Trade Connect aims to increase the security and efficiency of the banking sector and now has seven Indian private banks – ICICI Bank, Axis Bank, Yes Bank, IndusInd Bank, Kotak Mahindra Bank, RBL Bank and South Indian Bank – on board. At the heart of the Rs 1,400 crore (approximate) <a href="https://www.businessinsider.in/how-one-fraudster-drove-punjab-national-bank-to-the-highest-quarterly-loss-in-the-history-of-indian-banking/articleshow/64187005.cms" data-type="tilCustomLink">Nirav Modi-Mehul Choksi scam</a>, where three jewellery firms defrauded India’s second biggest state-run lender <keyword id="62034" type="ORGANIZATION" weightage="20" keywordseo="Punjab-National-Bank">Punjab National Bank</keyword> scam, is lack of transparency and accountability. The blockchain-based trade finance network will make the transactions more transparent for all stakeholders in any undertaking. The solution, earlier called <a href="https://www.prnewswire.com/news-releases/infosys-finacle-pioneers-blockchain-based-trade-network-in-india-in-consortium-with-seven-leading-banks-682801371.html" data-type="tilCustomLink">Finacle Trade Connect</a>, and now rechristened as India Trade Connect, will allow the document-heavy, process-heavy trade financing to happen digitally. How does a <keyword id="6355684" type="PERSON" weightage="20" keywordseo="Blockchain">blockchain</keyword> network function? India Trade Connect will help digitise the various processes in trade financing, including validation of ownership, certifying documents, making payments, collection of bills, and producing letters of credit and even invoice financing. <keyword id="6357624" type="UNKNOWN" weightage="20" keywordseo="blockchain-technology">Blockchain technology</keyword> stores details of every transaction securely shared between all the parties involved, say for instance, a buyer, the buyer’s bank, a seller and the seller’s bank. This is more efficient than each bank working on its own. In an interview with the <a href="https://economictimes.indiatimes.com/tech/ites/infosys-creates-blockchain-solutions-for-trade-finance/articleshow/64199469.cms" data-type="tilCustomLink">Economic Times</a>, Sanat Rao, chief business officer at <keyword id="1658904" type="ORGANIZATION" weightage="20" keywordseo="Infosys-Finacle">Infosys Finacle</keyword>, said, “Because of the network effect, where a buyer, the buyer’s bank, the seller and the seller’s bank are all on the platform, it creates a single source of truth. Banking and blockchain Earlier this week, on May 14, HSBC Holdings <a href="https://www.reuters.com/article/us-hsbc-blockchain/hsbc-says-performs-first-trade-finance-transaction-using-blockchain-idUSKCN1IF01X" data-type="tilCustomLink">claimed</a> it had performed the world’s first trade finance transaction on a shared blockchain platform. Prior to this, no trades used a single, shared digital application. This is not the first time that Indian banks have attempted to integrate blockchain into their systems. In June last year, ICICI Bank, DCB Bank, and Deutsche Bank, to name a few stakeholders, <a href="https://www.ethnews.com/indian-banks-partner-with-microsoft-for-blockchain-banking-platform" data-type="tilCustomLink">partnered</a> with <keyword id="10387" type="ORGANIZATION" weightage="20" keywordseo="Microsoft">Microsoft</keyword> to develop blockchain platforms for the Indian banking sector. It was called BankChain. Blockchain <a href="https://www2.deloitte.com/in/en/pages/strategy/articles/blockchain-in-banking.html" data-type="tilCustomLink">started off</a> being a giant, decentralised ledger for bitcoin (digital currency) that records every transaction and stores information about it on a global network. This data is highly secure and cannot be tampered with. Banks and other financial institutions back and invest in blockchain technology because it cuts their costs and makes operations faster, transparent and automated. “The framework of India Connect is said to be ledger agnostic and capable of working with other blockchain platforms like Bitcoin, Hyperledger, Ethereum and Corda,” Rao said.
