The new laws, enacted late last year, are set to replace the <keyword id="22189969" type="General" weightage="20" keywordseo="British-era-Indian-Penal-Code" source="keywords">British-era Indian Penal Code</keyword>, <keyword id="19898813" type="General" weightage="20" keywordseo="Code-of-Criminal-Procedure" source="keywords">Code of Criminal Procedure</keyword> and the Indian Evidence Act respectively. Under the new laws, a person can now report incidents by electronic communication, without the need to physically visit a police station. This allows for easier and quicker reporting, facilitating prompt action by the police, the sources said. With the introduction of zero FIR, a person can file a First Information Report (FIR) at any police station, regardless of jurisdiction. This eliminates delays in initiating legal proceedings and ensures immediate reporting of the offence. Under the new laws, victims will receive a free copy of the FIR, ensuring their participation in the legal process. An interesting addition of the law is that in the event of an arrest, the individual has the right to inform a person of his choice about his or her situation. This will ensure immediate support and assistance to the arrested individual. Besides, arrest details will now be prominently displayed within police stations and district headquarters, allowing families and friends of the arrested person easy access to important information. To strengthen the case and investigations, it has become mandatory for forensic experts to visit crime scenes for serious offences and collect evidence. Additionally, the process of evidence collection at the crime scene will be mandatorily videographed to prevent tampering of evidence. This dual approach significantly enhances the quality and reliability of investigations and contributes to a fair administration of justice, the sources said. The new laws prioritised the investigations for offences against women and children, ensuring timely completion within two months of recording information. Under the new law, victims are entitled to regular updates on the progress of their case within 90 days. This provision keeps the victims informed and involved in the legal process, enhancing transparency and trust. The new laws guarantee free first-aid or medical treatment to victims of crimes against women and children at all hospitals. This provision ensures immediate access to essential medical care, prioritising the well-being and recovery of victims during challenging times. Summons can now be served electronically, expediting the legal processes, reducing paperwork and ensuring efficient communication between all parties involved. For certain offences against women, statements of the victim are to be recorded, as far as practicable, by a woman magistrate and in her absence, by a male magistrate in the presence of a woman to ensure sensitivity and fairness, creating a supportive environment for victims. Both the accused and the victim are entitled to receive copies of the FIR, police report, chargesheet, statements, confessions and other documents within 14 days. Courts grant a maximum of two adjournments to avoid unnecessary delays in case hearings, ensuring timely justice delivery. The new laws mandate all state governments to implement witness protection scheme to ensure the safety and cooperation of witnesses and enhancing the credibility and effectiveness of legal proceedings. The definition of "gender" now includes transgender individuals, promoting inclusivity and equality. By conducting all legal proceedings electronically, the new laws offer convenience to victims, witnesses and accused, thereby streamlining and expediting the entire legal process. In order to provide more protection to the victim and enforce transparency in investigation related to an offence of rape, the statement of the victim shall be recorded through audio video means by the police. Women, persons below 15 years, persons above 60 years and those with disabilities or acute illness are exempt from attending police stations and can receive police assistance at their place of residence. A new chapter has been added in BNS specifically to address offences against women and children, ensuring focused protection and justice. Various offences against women and children have been made gender-neutral in BNS, covering all victims and perpetrators regardless of gender. The new laws introduce community service for minor offences in order to promote personal growth and social responsibility of an individual. Under community service, the offenders get the chance to positively contribute to society, learn from their mistakes and build stronger community bonds. Under the new laws, the fines imposed for certain crimes have been aligned with the severity of the offences, ensuring fair and proportional punishment, deterring future offences and maintaining public trust in the legal system. The legal processes have been simplified to make them easier to understand and follow, ensuring fair and accessible justice. The new laws promise a faster and fair resolution of cases, instilling confidence in the legal system. The legislations were considered and passed by Parliament in its winter session in 2023. Total 37 members of Parliament from Lok Sabha and 40 from Rajya Sabha participated in the debate.

New criminals laws will allow citizens to lodge police complaints online, file FIR from any jurisdiction

In Maharashtra’s Thane district, police have registered a case of alleged fraud involving two construction company owners accused of deceiving a family of ₹1.2 crore. The incident came to light after a 28-year-old woman from Thane’s Rabodi area lodged a complaint against the two accused, who are brothers. The accused allegedly persuaded the woman, her mother, and her sister to invest the substantial sum in their construction company based in Mumbai’s Bandra area. Promises were made of a significant payout within five years or, alternatively, the option of acquiring two or three apartments in the city’s prime real estate zone. According to the complaint, the woman’s family entered the deal on December 31, 2022, convinced by assurances of either a return of ₹3 crore over five years or property options in Bandra. To meet the required investment amount, the family borrowed funds from various sources, entrusting their money with the accused based on the lucrative promises. The police official handling the case noted that the family, enticed by the seemingly profitable terms, had not foreseen the outcome that would follow. In May 2023, however, when the family attempted to reclaim their funds and the anticipated profit, the accused allegedly declined the request. The complainant stated that the brothers not only refused to pay but also reportedly threatened the family, citing powerful connections that would shield them from legal repercussions. This behaviour alarmed the family, leading them to seek legal recourse. The Rabodi police have filed a case against the accused under various sections of the Indian Penal Code, including Section 420 for cheating, Section 406 for criminal breach of trust, and Section 506 for criminal intimidation. Additionally, charges were filed under Section 34, indicating common intention, along with relevant provisions of the Maharashtra Protection of Interest of Depositors Act. The case highlights the dangers that investors may face when lured by high-return promises in unregulated sectors. Fraudulent schemes in real estate and construction have been known to target individuals and families looking for profitable investments, often leaving them with financial losses and emotional distress. Authorities are continuing investigations, with the Rabodi police closely monitoring the case to gather further evidence. Shortly after this, there were reports of tickets being bought and sold in black, for much higher prices. Social media was then rife with discussions about scalpers, and how they are hoarding tickets to sell them at higher prices. Now, BookMyShow has filed an FIR for black marketing of Coldplay's tickets. According to an ANI report, the company has taken legal action against unknown scalpers involved in the reselling of tickets for Coldplay's "<keyword id="23232180" type="General" weightage="20" keywordseo="Music-Of-The-Spheres-World-Tour" source="keywords">Music Of The Spheres World Tour</keyword> " in India. The online ticket platform filed an FIR with the <keyword id="19906039" type="General" weightage="20" keywordseo="Mumbai-Police" source="keywords" meta.keywordsubtype="org" meta.entityname="Mumbai Police" meta.hostid="261" meta.entityid="Mumbai Police">Mumbai Police</keyword> on October 2, accusing scalpers of black market activity surrounding tickets for the band's highly anticipated shows in January 2025 at DY Patil Stadium in Navi Mumbai. BookMyShow's spokesperson said the company remains committed to combating ticket reselling and is cooperating with the authorities to investigate all instances of illegal sales, including those on social media platforms such as Instagram and WhatsApp, as well as digital reselling platforms like Viagogo and Stubhub. "In its ongoing fight against <keyword id="23311384" type="General" weightage="20" keywordseo="ticket-scalping" source="keywords">ticket scalping</keyword> and black marketing of tickets for Coldplay's Music Of The Spheres World Tour 2025 in India, BookMyShow has lodged a formal FIR (First Information Report) on October 2, 2024. This action follows our initial complaint filed proactively with the Mumbai Police on September 23, 2024, addressing these concerns much before any formal complaint was raised against us. BookMyShow's FIR filed with the Mumbai police also urges authorities to investigate the unauthorised resale of tickets by individuals and platforms. "We have provided details of all resellers that have come to our attention, including independent individuals reselling tickets for this tour across social media platforms such as Instagram, WhatsApp and beyond, as also digital platforms such as Viagogo, Stubhub Holdings and more, to aid authorities in a thorough investigation," a statement from the company read. The platform is also reportedly considering cancelling tickets that have been sold through unauthorised channels and reiterated its strong opposition to illegal ticket resale. "Our stance remains clear and unchanged - BookMyShow vehemently condemns and opposes ticket reselling which is deemed illegal and is punishable by law in India. BookMyShow has no association with any such unauthorised ticket selling/reselling platforms and/or any third party individuals/platforms for the purpose of reselling Coldplay's Music Of The Spheres World Tour 2025 in India," a company spokesperson said as per ANI. BookMyShow had also posted a statement on Instagram last month, saying that scalping of tickets is punishable by law in India and that people should stay safe from scammers. "Scalping is strictly condemned and punishable by law in India. We have filed a complaint with the police authorities and will provide complete support to them in investigation of this matter. We urge you not to fall victim to these scams. Any tickets bought from unauthorised sources will be at risk of consumer and can turn out to be fake tickets. Beware of such scammers," the statement had read. Coldplay is set to perform three shows in Navi Mumbai on January 18, 19, and 20, 2025, as part of their world tour.

The case is still ongoing.In June, the case was dismissed without prejudice because the court ruled that Hill had not adequately pleaded that California law should apply extraterritorially. Workday is based in California, while Hill is based in Maryland. Hill has filed an amended complaint, which Workday has moved to dismiss. Court-mediated settlement negotiations last month were unsuccessful.Hill alleges that he was on medical leave from October 12, 2022, to November 22, 2022.Leading up to his leave, Hill said he started drinking more as he faced more stress. On October 12, 2022, he went to the hospital due to "stress, exhaustion, and trauma associated with this and other disparate, discriminatory, retaliatory, harassing and hostile treatment of him" by other Workday employees, the lawsuit said.That day, Hill emailed his manager to inform her that he was having a medical emergency and going to the hospital. He also sent a completed leave request form and said he would file the required <a target="_blank" class="" href="https://www.businessinsider.com/why-pregnant-workers-parental-maternity-leave-can-be-laid-off-2023-3">Family and Medical Leave Act</a> paperwork soon.The following day, his manager replied with information about FMLA and said, "Please don't worry about work and focus on feeling better."On October 20, 2022, while he was still at the hospital, Workday sent police to his house for a "wellness check."According to a police report about the incident, a safety and security manager at Workday called the police for a welfare check on Hill because the company was unable to contact Hill or his wife, his emergency contact. The police spoke with Hill's wife, who confirmed that Hill was in medical treatment, the report said.Hill told Business Insider that he did not receive any records, calls or emails from Workday after the last email from his manager on October 13 and before the incident.At the hospital, Hill couldn't use his cellphone, so a member of the rehabilitation center staff informed Hill about this and allowed him to call his wife. Hill said when he heard about this, he felt like he "was going to have a heart attack," and his wife, who was home at the time, was "rattled" about the incident.The police department of Montgomery County, where the wellness check took place, declined to comment as it is not involved in the lawsuit."There's nothing they would've thought cops with guns could solve on October 20 that doctors with stethoscopes could not have solved," Hill told BI.Workday declined to comment on this report.FMLA guarantees eligible employees of covered employers to take up to 12 weeks of unpaid medical or family leave in a year. The employee must make it clear they need to take leave for FMLA reasons, while the employer should let the employee know they qualify for medical leave and provide the paperwork for the employee to complete.The Department of Labor requires that employers give employees 15 calendar days to provide their complete medical certification under FMLA.Hill said he was initially worried about complying with the FMLA when he was admitted to the hospital because he had not finished the paperwork at the time, but the staff told him of this legal protection, and he said the hospital provided the FMLA paperwork within 15 days.Hill filed an EEOC charge against Workday in April 2023. In August 2023, he first filed a lawsuit against the company in the Superior Court for the District of Columbia, which was voluntarily dismissed without prejudice.<h2 id="4f3f4d72-e4f6-4265-82fc-03ca97b5fe9d">Returning from medical leave</h2>A few months after returning from leave, Hill asked Workday's HR department in March 2023 for more information on the wellness check. The staff declined to provide him with information or documentation about it."They won't tell me anything. Did they think it was an emergency? Did they think I was in danger?" Hill said."Did they think I was going to hurt someone? Why did they send police to my house and endanger my wife and kids?"While Workday may have been trying to contact Hill to finish his FMLA paperwork, it's uncommon to send police to an employee's house for a wellness check, said Cassie Lenning, partner at Outten and Golden, a law firm that represents tech employees and is not involved in the lawsuit.If an employee had mental health issues that the employer was aware of, that could be a situation where an employer may send someone for a wellness check, Lenning said."Even in that circumstance, why wouldn't they send someone from the office as opposed to the police? There's still a level of escalation in calling the police, well-intentioned or not," Lenning said. "I question the judgment of someone who would send police to the home of a Black man. There are racial implications that are being ignored."Hill said after he went back to work, he received "awful treatment," such as receiving more pushback at work and getting left out of meeting invites. He said he had a modified schedule where he worked half-time.In January 2023, he reported to HR about his racial and disability discrimination claims at the company and asked to be transferred to a different group at work. The company's HR staff investigated the case and then closed it in March, concluding that his claims "lacked merit," the lawsuit said.<h2 id="c07eb502-03de-4d81-968b-8ee1f7197d20">Other claims of work discrimination</h2>Hill has worked at Workday since January 2021. Leading up to his leave, he said he had been seeking a promotion but had been denied one. When he asked his manager for one, he was told he had to put together and submit a document on his accomplishments."That's a hurdle my non-Black colleagues didn't have to overcome," Hill said.Later, he said he started getting more pushback in his work, such as when he enforced policies around limiting gift-giving to federal officials that the company wanted him to sign off on. According to the lawsuit, Hill also said a colleague told him during a meeting, "Everybody knows you don't want to work, Anthony," and doubled down on his work ethic and professional reputation. Hill told his manager that the incident "appeared racist.""It was quite clear to me they were setting me up to fail," Hill said.In March 2023, Hill was put on paid administrative suspension for five weeks. Encouraged by these (false) success stories, the victim began by investing a small amount of money. To his surprise, he quickly received returns on his initial investment, which further convinced him of the scheme’s legitimacy. This early success was part of the scammers' strategy to build trust and encourage the victim to invest larger amounts. As the victim's confidence grew, he decided to invest more money, even going as far as taking bank loans and borrowing from friends to increase his trading capital. The scammers, posing as experienced traders, provided him with tips and advice, which seemed to be leading to profitable trades. However, as time passed, the victim started noticing irregularities. Despite his trades showing profits, the system would automatically close them, resulting in losses. When he questioned this, the scammers blamed the system’s automated processes and reassured him that his losses could be recovered by investing more. The situation reached a tipping point when the victim was unable to withdraw any funds from the trading app. Growing increasingly concerned, he approached a friend for a loan, explaining his predicament. It was this friend who first alerted him to the possibility that he was being scammed. Moreover, the frausters were operating from the UK and carried out the scam with the help of mule accounts that were rented from people in North India. The victims were also shown a fake website, which claimed to provide them with real-time updates of their investments. Now, wherever there are websites involved, people tend to believe that a business is legitimate. However, it is to be noted that almost anyone can create a website and just because something appears to be legitimate, doesn't always mean that it is. After a few months, when the couple wanted to withdraw a portion of their invested money, they saw that the website could not be accessed anymore. They realised that they had been scammed when they were blocked from the platform. The couple went to the local police after this and a complaint was registered. Investigation began and the police was successful in tracking down the money trail with the help of banks. The case is linked to the duping of gullible investors who were promised astronomical returns on investing money (claimed to be used for mining bitcoins and other crypto Currencies) for which an app-based token by the name of "<keyword id="19984854" type="General" weightage="20" keywordseo="hpz-token" source="keywords">HPZ Token</keyword>" was used. The prosecution complaint filed before a Special Prevention of Money Laundering Act (PMLA) court in Nagaland's Dimapur named 299 accused persons and 78 entities. Out of the total entities named in the prosecution complaint, 76 are Chinese-controlled entities (in which 10 directors are of Chinese origin) and two other entities are controlled by other foreign nationals. The court took cognizance of the offence of money laundering in the prosecution complaint on Tuesday after finding that a prima-facie case has been made under PMLA, 2002, against the said 299 accused persons. ED initiated an investigation based on an FIR registered by Cyber Crime Police Station, <keyword id="20214444" type="General" weightage="20" keywordseo="kohima" source="keywords">Kohima</keyword> (Nagaland) under various sections of the Indian Penal Code, 1860 and the <keyword id="20003647" type="General" weightage="20" keywordseo="information-technology-act" source="keywords">Information Technology Act</keyword>, concerning the duping of gullible investors who were promised astronomical returns on investing money [claimed to be used for mining of bitcoins and other cryptocurrencies], for which an app-based token by the name of "HPZ Token" was used. The ED investigation revealed that various bank accounts and merchant IDs were opened by various shell entities having dummy directors and proprietors only for the rotation and layering of proceeds of crime representing funds fraudulently received for illegal online gaming betting and investment in <keyword id="19899404" type="General" weightage="20" keywordseo="bitcoin" source="keywords">Bitcoin</keyword> mining. For an investment of Rs 57,000, returns of Rs 4,000 per day for three months were promised but money was paid only once and thereafter, fresh funds were sought. Earlier, ED conducted search operations at 44 locations throughout the country and an amount of Rs 176.67 crore, maintained by shell entities in various banks and virtual accounts, was frozen. Further movable and immovable properties to the extent of Rs 278.70 crore held in the name of dummy entities were attached. Total seizure and attachment stand at Rs 455.37 crore in the case so far.
