New Delhi, The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Thursday stayed the Centre's notification on setting up a fact-checking unit under the <keyword id="19910339" type="General" weightage="20" keywordseo="press-information-bureau" source="keywords">Press Information Bureau</keyword> (PIB) to identify fake news about the Union government. The <keyword id="20497070" type="General" weightage="20" keywordseo="fact-check-unit" source="keywords">Fact Check Unit</keyword> was notified on March 20 under Information Technology Rules, 2021, by the Ministry of Electronics and IT. A bench headed by Chief Justice D Y Chandrachud set aside the March 11 order of the Bombay High Court which had refused to grant interim stay on setting up the FCU under the amended IT Rules to identify fake and false content on social media about the Union government. "We are of the considered view that questions before the HC deal with core questions on Article 19(1)(a) of the constitution," the bench said. "We are of the view that notification dated March 20, 2024, after rejection of application of interim relief, needs to be stayed. The challenge to the validity of 3(1)(b)(5) involves serious constitutional question and the impact of the rule on free speech and expression would need to be analysed by the high court," the bench, also comprising Justices J B Pardiwala and Manoj Misra, said. Rule 3(1)(b)(v) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 The FCU will be the nodal agency to tackle or alert about all fake news or misinformation related to the <keyword id="19910020" type="General" weightage="20" keywordseo="central-government" source="keywords">central government</keyword>. The notification came days after the Bombay High Court declined to restrain the Centre from notifying the unit. The petition was filed by stand-up comedian Kunal Kamra and the Editors Guild of India. In April last year, the <keyword id="19959928" type="General" weightage="20" keywordseo="ministry-of-electronics-and-information-technology" source="keywords">Ministry of Electronics and Information Technology</keyword> (Meity) promulgated the 2023 Rules, which further amended the Information Technology Rules, 2021. Under the new rules, if the fact check unit comes across or is informed about any posts that are "fake", "false" or contain "misleading" facts pertaining to the business of the government, it would flag it to the social media intermediaries. The online intermediaries would then have to take down such content if they wanted to retain their "safe harbour" (legal immunity against third-party content).

Supreme Court stays centre's notification setting up PIB's Fact Check Unit

The <keyword id="107241" type="COMPANY" weightage="20" keywordseo="Press-Information-Bureau">Press Information Bureau</keyword> on Wednesday set up a portal for fact-checking issues related with the novel <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">coronavirus</keyword> pandemic, and it will receive messages by email and send its response in quick time. The PIB will also release a daily bulletin at 8 pm everyday to inform regarding Centre's decisions and developments and progress on the deadly <keyword id="8764262" type="UNKNOWN" weightage="20" keywordseo="covid">COVID</keyword> 19. The first bulletin was released today at 6.30 pm, the PIB said in statement. The PIB's bulletin is in line with the Supreme Court directive on Tuesday that to check fake news, a daily bulletin system with regard to the COVID-19 pandemic be made active within 24 hours by the government through all media avenues, including social media and forums, to clear people''s doubts. Press Information Bureau has set up a portal - COVID 19 Fact Check Unit -- which will receive messages by email and send its response in quick time, the statement said. "The Ministry of Health and Family Welfare has set up a technical group consisting of professionals from AIIMS, et al, to clarify any doubts in the minds of the general public on any technical aspect of COVID 19," it said The ministry has also issued detailed guidelines to deal with psychological issues among migrants, it said. The cabinet secretary on Wednesday wrote to all the state governments, informing them of the constitution of 11 empowered groups under the Disaster Management Act with clear-cut mandate to decide on various aspects in the management of COVID-19, the statement said. A request has been made for development of similar mechanism at the state-level too. State governments have also been requested to engage volunteers to supervise the welfare activities of the migrants, the PIB said.

Govt warns about fake SMS asking users to update their PAN – what it is and how to stay safe

The government on Thursday said it has blocked more than 60 social media accounts, including <keyword id="10879" type="General" weightage="20" keywordseo="youtube" source="Orion">YouTube</keyword> channels and <a href="https://www.businessinsider.in/tech/enterprise/news/meta-chime-file-joint-complaint-against-phishing-attacks-on-facebook-and-instagram/articleshow/89445529.cms" data-type="tilCustomLink">Facebook and Instagram</a> pages, in the last two months for spreading anti-India fake news. Replying to supplementary questions in the Upper House, Minister for State for Information and Broadcasting L Murugan said the government is very much concerned about the freedom of speech and freedom of expression. Asked about action taken against those spreading fake news, and publishers of anti-national material, he said more than 60 accounts have been blocked including those on YouTube, Twitter, <keyword id="6354576" type="General" weightage="20" keywordseo="facebook" source="Orion">Facebook</keyword> and <keyword id="819905" type="General" weightage="20" keywordseo="instagram" source="Orion">Instagram</keyword>. "These YouTube channels are sponsored from Pakistan," he said. On fake news through newspapers, the minister said the Press Council of India is an autonomous statutory body and takes care of the journalists ethics code. "Journalists have to follow ethics code. Wherever they have not followed the ethics code under the Press Council Act Section 14, action has to be initiated. In more than 150 cases, we took action against them," he said. Asked about Techfog app roles in spreading fake news, Murugan said the government has established a fact check unit, which has responded to more than 30,000 queries. This unit is also verifying viral fake news, he added. According to an official statement, the ministry on January 21 had ordered blocking of 35 YouTube based news channels and two websites which were involved in spreading anti-India fake news in a coordinated manner over digital media. Additionally, two Twitter accounts, two Instagram accounts, and one Facebook account were blocked. In December also, 20 YouTube channels and two websites were blocked, the official statement had said. In a written reply to the starred question, Information and Broadcasting Minister Anurag Singh Thakur said the government has statutory and institutional mechanisms in place to combat fake news. A "Fact Check Unit" has been setup under the Press Information Bureau of this Ministry in November, 2019 which takes cognisance of fake news both suo motu and by way of queries sent by citizens on its portal or through e-mail and WhatsApp. "The unit responds to relevant queries with correct information when the same pertains to Central Government or forwards them to States/UTs in other cases. The Unit also maintains a Twitter account @PIBFactcheck and posts cases of fake news, being busted, on the same on regular basis. PIB Fact Check Unit has so far responded to 30,533 actionable queries," he said. For print media, the Press Council of India (PCI), a statutory autonomous body set up under the Press Council Act, 1978, has framed "Norms of Journalistic Conduct" for adherence by the media. These norms emphasise the principles of accuracy and fairness as well as pre-publication verification. The PCI has formulated specific norms to refrain print media from publication/ dissemination of fake or false news. For electronic media (Television), all TV channels are required to adhere to the Programme Code under the Cable Television Networks (Regulation) Act, 1995. As per the code, programmes should not contain anything obscene defamatory, deliberate, false and suggestive innuendos and half-truths. For digital news, the government has notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 on February 25 2021, under the Information Technology Act, 2000 which inter alia provides for a Code of Ethics for adherence by digital news publishers. "Appropriate action is taken in cases where violation of norms, codes etc., are found. The government also issues advisory from time to time to the media to adhere to the laid down codes," Thakur said.
