This move is seen as a relief for the company, which has been under scrutiny following the RBI’s intervention in January. The NPCI, which had previously allowed Paytm to operate as a Third-Party Application Provider (TPAP) for UPI transactions, has now reinstated its ability to bring new users onto the platform, albeit with strict conditions. Paytm can continue UPI operations through its partnerships with major banking institutions, including SBI, HDFC Bank, Axis Bank, and YES Bank. The NPCI’s approval comes after a thorough review of Paytm’s compliance with procedural guidelines, including those pertaining to risk management, app branding, multi-bank participation, and data privacy. The fintech firm has been instructed to adhere to key regulatory frameworks, such as the Payments and Settlement Act of 2007 and the Digital Personal Data Protection Act of 2023. The company posted a net profit of ₹928.3 crore, a marked improvement from the ₹290.5 crore loss it recorded during the same period last year. <h2>What had happened? </h2> For the unversed, in January 2024, the Reserve Bank of India (RBI) told Paytm Payments Bank Limited (PPBL) to stop accepting deposits and processing UPI top-ups. This decision stemmed from ongoing concerns about the bank’s compliance and serious issues that needed addressing. As a result, Paytm found itself unable to onboard new UPI users, significantly disrupting its growing customer base and raising doubts about its future in the crowded <keyword id="19989657" type="General" weightage="20" keywordseo="digital-payments" source="keywords">digital payments</keyword> market. However, things took a turn for the better in March 2024 when the National Payments Corporation of India (NPCI) gave Paytm the green light to resume UPI transactions. The catch? "But it's curious as to why the FBI won't do the same thing in this case, won't allow these women who have bravely come forward to get that accountability, responsibility, and justice."Merson filed <a target="_blank" href="https://www.documentcloud.org/documents/24613196-jeffrey-epstein-victims-jane-doe-lawsuit-vs-fbi">the lawsuit</a>, initially on behalf of 12 Epstein accusers, against the FBI in February. "The FBI sat back while Epstein and his co-conspirators sexually abused Jane Does 1-12."<h2>The DOJ concluded it botched an earlier Epstein investigation</h2>In 2019, Epstein killed himself in jail while awaiting trial on sex-trafficking charges in New York.Years earlier, in 2007, he reached a plea deal with federal prosecutors in Florida that allowed him to serve an insubstantial sentence on a prostitution charge, even though law enforcement officials believed at the time that he had sexually abused dozens of girls. Fintech companies like Paytm and PB Fintech have not only reported better than expected earnings but also narrowed their losses significantly. Another new age company among talks is hyperlocal delivery startup Dunzo with elevated losses and massive valuation. The growth was driven by pick up in merchant subscription revenues and loan distribution. “Biggest surprise is distribution business, control of cashbacks, opex,” said Macquarie in a report. Shares of the company rose nearly 22% from February 3 when it reported its quarterly earnings. Macquarie has upgraded rating on the company’s stock to ‘Outperform’ from ‘Underperform’ with a target price of ₹800. “PayTM has positively surprised on the distribution of financial services revenue by a wide margin and has also managed to control overall expenses and charges. At the time of listing, profit and free cash flow were not even a part of management’s discussion. However, we see a very visible change in approach of management to deliver profit, evidenced, we believe, by the core EBIDTA profitability that was reported recently,” said Macquarie in a report. Zomato: A promising road to profitability Zomato reported better than expected Q3 FY23 revenues, and analysts believe it may reach profitability by the end of the current financial year. “Depending on execution-related wins, the company (ex of quick commerce) may clock profitability in Q4FY23 itself, two quarters ahead of their guidance,” said analysts at Nuvama Institutional Equities. “Zomato’s road to profitability has grown even more promising. Zomato (ex-quick commerce) clocked adj. EBITDA level profitability in the month of Jan-23. Depending on execution-related wins, the company (ex of quick commerce) may clock profitability in Q4FY23 itself, two quarters ahead of their guidance,” added the report. Analysts say Zomato’s relaunch of its Gold membership plan should bring growth back. Most brokerage houses have <a href="https://www.businessinsider.in/business/news/no-long-tail-effect-zomato-banks-on-demand-recovery-in-future-even-as-it-shuts-operations-in-225-cities-on-poor-performance/articleshow/97907071.cms">maintained a ‘Buy’ rating </a>on the company’s stock. “The fact that most of these companies have put forth their strategy to cut down losses and become profitable in the near future builds hope for investors. Nykaa: Premium valuation reflects solid outlook, say analysts Nykaa, reported a 70% on year decline in net profit in Q3 <a href="https://www.businessinsider.in/business/corporates/news/nykaas-stock-plunges-4-2-after-its-q3-net-profit-slips-70/articleshow/97901748.cms">missing analysts expectations</a>. Despite this, brokerages believe the best is yet to come for the company. During a post-earnings conference call Falguni Nayar, executive chairperson, MD and CEO of Nykaa said that although inflationary pressures were present, it wasn’t that big of an issue for many of Nykaa’s customers. Q3 is considered to be a seasonal quarter for the company because of the festive season and despite macro challenges Nykaa’s growth was applauded by analysts. “In a quarter rampaged by a tougher macroeconomic environment, Nykaa reported substantial growth in Q3FY23 numbers,” said a report by JM Financial. The brokerage firm has assigned a ‘Buy’ rating on the stock. “We continue to see increased strength of the dominant positioning in beauty and personal care (BPC) vertical while the newcomer, fashion vertical, has gained market share at the cost of a sharp dip in contribution margin,” added the report. Nykaa’s EBITDA margins came under pressure and fell to 5.3% in Q3, as against 6.3% in the same period last year. “While we expect Nykaa’s GMV growth, at 35% in FY23E-25E, to be the highest within our global ecommerce coverage, we believe Nykaa’s valuation premium (FY24 EV/GMV of 3.1x vs 0.5x median for peers) already reflects this solid growth outlook and Nykaa’s stronger margin profile,” said a report by Goldman Sachs. The investment banker has assigned a ‘Neutral’ rating on the stock. PB Fintech on course to profitability soon The December quarter performance of PB Fintech, the parent company of Policybazaar and Paisabazaar, was another surprise for investors as the company narrowed its losses significantly. Its insurance premiums jumped 70.3% on year to ₹30.3 billion driven by a strong showing across segments. “Given its market share of 90%-plus in online insurance sales and a growing offline presence, PB is poised to post strong sales,” said analysts at Nuvama Institutional Equities. Further, the management expects revenue and margins to improve further as agent productivity rises and benefits of appointments channel are realised. They hinted at a sharp profitability uptick in Q4, say analysts. “This growth becomes even more impressive considering the seasonally weak Q3 for insurance, where new business premiums for life and general insurance declined QoQ by 19% and 12%, respectively,” said a report by JM Financial. New-age internet based businesses, like their unlisted peers, have been chalking out strategies that lead them towards profitability and are already on a growth path aided by their unique business propositions — allaying investor and analyst concerns. Not everyone is sold. Cotton. Sen. Lindsey Graham, a noted Trump ally, cautioned that while someone could "make a good argument" in favor of impeachment, that was not his goal."I didn't come here to impeach the president," Graham, a South Carolina Republican, told reporters at the same news conference. "I came to here to let everyone know we don't agree with this decision."It's worth remembering what specifically got Trump in trouble. There are numerous differences between then and now.<h2 id="ff0a71d5-1fba-4af4-a236-ae03e48e6ec4">A government watchdog found Trump broke the law.</h2>The Government Accountability Office, a nonpartisan watchdog, formally concluded that <a target="_blank" href="https://www.businessinsider.com/top-government-watchdog-says-trump-illegally-withheld-aid-to-ukraine-2020-1">the Trump administration broke the law</a> in withholding congressionally approved aid to Ukraine. The watchdog concluded that Trump violated a Nixon-era law by withholding about $214 million in defense aid. The Trump White House disputed the report, but the office was unmoved by its defense."Faithful execution of the law does not permit the President to substitute his own policy priorities for those that Congress has enacted into law," the watchdog concluded.It's unlikely that Biden would be found to have violated the law if the White House spent the congressionally approved aid on Israel by the end of the fiscal year in September, according to a defense policy expert."The fact that Congress has enacted money to support Israel means the president has to spend it," Mark Cancian, a senior advisor at the Washington DC-based think tank the Center for Strategic and International Studies, told Business Insider. "So basically, he's going to have to spend that money on Israel as Congress appropriated, but he doesn't have to do that today."Cancian did caution that the current bomb shipment Biden has paused likely has a different deadline, but it's not immediately clear which tranche of money that falls under. According to the Council on Foreign Relations, the US sends roughly $3.3 billion to Israel a year, mostly through grants that Israel must, in turn, use to purchase US military goods and services.And it wasn't just about the letter of the law. One of House Democrats' impeachment articles cited a "scheme or course of conduct for corrupt purposes in pursuit of personal political benefit." Trump's withholding of aid wasn't the offense alone.The issue was whether Trump took official action, delaying aid to benefit a private scheme to get the Ukraine government to help dig up dirt on Hunter Biden. Trump's EU ambassador, Gordon Sondland, later confirmed a quid-pro-quo did take place.Republicans have accused Biden of withholding weapons due to concerns about his reelection. Multiple Republicans cited the <a target="_blank" href="https://www.businessinsider.com/arab-americans-uncommitted-michigan-dearborn-biden-israel-gaza-2024-4">president's standing in Michigan</a>, a key swing state, where over 100,000 people voted "uncommitted" in the state's Democratic presidential primary in an organized campaign to protest Biden's support of Israel."Why is it on hold? To appease his liberal base in places like Dearborn, Michigan, because Joe Biden is in trouble in Michigan," Sen. Steve Daines of Montana, the leader of the Senate GOP's campaign arm, told reporters.Biden has repeatedly expressed concern about civilians dying during the war. According to Gaza health officials, about 34,000 people, many of them women and children, have been killed there. US allies — the United Kingdom, France, and Germany — have all expressed concern about an invasion of Rafah.<h2 id="aa36f5ec-f426-4624-a00e-709a1dc4086f">Other presidents have paused weapons shipments.</h2>President <a target="_blank" href="https://www.nytimes.com/1983/04/01/world/reagan-to-block-f-16-s-till-israel-leaves-lebanon-transcript-of-speech-page-a8.htm">Ronald Reagan</a> blocked the transfer of F-16s to Israel in 1983 when its forces were in Lebanon. He cited a belief that doing so could violate the law, according to The New York Times. President <a target="_blank" href="https://www.huffpost.com/entry/george-h-w-bush-last-president-to-get-tough-with-israel_n_5c06ac48e4b07aec5753418a">George H.W. Bush</a> also threatened loan guarantees in 1991 when then-Israeli Prime Minister Yitzhak Shamir wouldn't abide by his desired limitation on funding for settlements on occupied territory.Trump himself was involved in another dispute. His administration withheld a $105 million package to support the Lebanese Armed Forces. Trump's delay occurred around when Congress was already probing his actions related to Ukraine.<h2 id="b11e1ee5-fcfc-47ee-bacd-5af62c86a6e6">This doesn't mean there won't be costs for Biden.</h2>Biden relied on a bipartisan coalition to pass a $95 billion foreign aid package for Ukraine, Israel, and Taiwan. House Speaker Mike Johnson took a political risk in backing the package with little changes after House conservatives had threatened his future if he tried to pass additional Ukraine aid. <ul class="summary-list"><li>Fox News kept its position atop right-wing media and fought off rivals while settling with Dominion.</li><li>It can afford the hefty price tag, and top executives and hosts won't have to testify under oath.</li></ul>WILMINGTON, Delaware — Just a couple of hours after a judge seated a jury for what was supposed to be the defamation trial of the century, <a href="https://www.businessinsider.com/fox-news-settles-dominion-defamation-lawsuit-trial-2023-4">Dominion and Fox agreed to settle their case</a>.Fox News said it would shell out $787.5 million to Dominion, an election technology company that was the target of right-wing conspiracy theories falsely claiming it rigged the 2020 presidential election against Donald Trump. By a large margin, it's the biggest publicly known settlement for a defamation case in US history.In the moments after I watched the judge announce the settlement in court, 16 things went through my mind:<h2>1. Fox gets to keep its audience.</h2>Dominion's CEO, lawyers, and corporate owners <a href="https://www.businessinsider.com/fox-news-settles-dominion-defamation-lawsuit-trial-2023-4">blasted Fox News in a press conference</a> outside Delaware Superior Court following news of the settlement.On Fox's end, it's hard to imagine a more tepid statement."We acknowledge the Court's rulings finding certain claims about Dominion to be false," the company said in an email as its lawyers dodged journalists. "This settlement reflects FOX's continued commitment to the highest journalistic standards. We are hopeful that our decision to resolve this dispute with Dominion amicably, instead of the acrimony of a divisive trial, allows the country to move forward from these issues."Pay attention to the first bit. The company acknowledged <a href="https://www.businessinsider.com/fox-news-loses-part-of-dominions-defamation-lawsuit-2023-3">Judge Eric M. Davis' ruling, made last month, that it broadcasted false claims from Sidney Powell and Rudy Giuliani</a>.Not "we lied," or "sorry," or "we'll do better next time."A person familiar with the settlement terms told Insider that Fox News' hosts — including Sean Hannity, Tucker Carlson, Jeanine Pirro, and Maria Bartiromo — would not be required to issue retractions or make any statements about Dominion whatsoever. <a href="https://www.businessinsider.com/fox-news-loses-part-of-dominions-defamation-lawsuit-2023-3">Davis ruled that all of those hosts broadcast falsehoods about Dominion</a>.In other words: Fox doesn't admit to anything, except that the judge is right. Aside from forking over money, they get to do things on their own terms. The network's hosts don't have to tell their audience what they don't want to hear.That audience may not want to hear, for instance, that Trump really lost the 2020 election. <a href="https://www.nbcnews.com/meet-the-press/meetthepressblog/poll-61-republicans-still-believe-biden-didnt-win-fair-square-2020-rcna49630">Recent polls show</a> a majority of Republicans don't believe Biden legitimately won the presidency. As <a href="https://www.businessinsider.com/rupert-murdoch-make-trump-non-person-after-january-6-2023-2">Fox Corp. Chairman Rupert Murdoch himself said in a deposition for the Dominion case</a>, Trump's fans and Fox News' audience have a lot of overlap, and he didn't want to antagonize the then-president in the election's aftermath."He had a very large following, and they were probably mostly viewers of Fox, so it would have been stupid," Murdoch said.<h2>2. $787.5 million was the price to keep it.</h2>Dominion asked for $1.6 billion in damages and got about half of that, not counting legal fees. It's still a massive settlement.You can also say that number was the price Fox paid to keep itself at the top of the right-wing media universe.Fox clearly wanted to make a tepid statement about the case and avoid issuing retractions or denunciations of its own employees. Did that requirement drive up the price Dominion wanted it to pay?One of the main arguments in Dominion's lawsuit, filed back in March 2021, was that Fox was driven to push lies about the 2020 election because it was threatened by the rise of Newsmax and One America News, two further-right media organizations that Dominion says more explicitly embraced election conspiracy theories.Evidence obtained by Dominion in the lawsuit and filed to court ahead of the settlement <a href="https://www.businessinsider.com/fox-news-hosts-knew-election-conspiracy-theories-false-messages-dominion-2023-2">appeared to support that theory</a>. Hannity and Carlson privately fretted that Newsmax's ratings could threaten Fox's dominance."Serious $$ with serious distribution could be a real problem. Imho they need to address but wtf do I know," Hannity wrote in a text message obtained by Dominion, referring to Newsmax."Do the executives understand how much credibility and trust we've lost with our audience? We're playing with fire, for real....an alternative like newsmax could be devastating to us," Carlson told his producer in another message included in filings.Newsmax and OAN are already in dire straits after DirecTV dropped them from its programming listings. Dominion and Smartmatic — a rival election technology company caught up in false 2020 election conspiracy theories — have <a href="https://www.businessinsider.com/everyone-dominion-smartmatic-suing-defamation-election-conspiracy-theories-2021-2" rel="">separate pending defamation lawsuits against them as well</a>.<h2>3. Fox avoided a likely reckoning in court.</h2>It's extremely hard to win a defamation case against a media company in the US, given the country's strong First Amendment protections.Unfortunately for Fox, <a href="https://www.businessinsider.com/fox-news-dominion-defamation-lawsuit-trial-first-amendment-free-speech-2023-4">First Amendment experts widely agreed Dominion had an extremely strong case</a>. James Goodale, a leading media lawyer and former top attorney for the New York Times, told Insider that Fox put itself in a terrible position by repeatedly hosting Powell and Giuliani on its shows. Most libel cases, he said, are over only a single disputed issue."In an ordinary libel case, that probably would happen once, and you fight over that one instance," Goodale told Insider. "In here — I don't know, what's the number, a hundred? — it happens over and over and over again."<h2>4. Rupert Murdoch and other Fox brass won't have to testify.</h2>A settlement means that 92-year-old Fox Corp. Chairman Rupert Murdoch gets to stay home and avoid the glare of the courtroom. His son, Fox Corp. CEO Lachlan Murdoch, can kick back on <a href="https://www.dailymail.co.uk/news/article-11903347/Lachlan-Murdoch-superyacht-150million-ship-ready-News-Corp-media-mogul-five-years.html">his $150 million yacht</a> instead of making the trek to Wilmington, Delaware.It also means that executives like Fox News President Jay Wallace and CEO Suzanne Scott, and hosts like Hannity, Carlson, and the litany of others Dominion said they intended to call as witnesses, avoid the drama of a trial as well.While <a href="https://www.businessinsider.com/dominion-fox-news-trial-american-democracy-private-equity-settle-2023-4">Fox News' detractors might love to see them grilled on the witness stand</a>, Dominion got to use the prospect of testifying under oath as leverage to extract the largest settlement possible.<h2>5. Dominion won't have to deal with appeals.</h2>Even if Dominion won at trial, it would still face the prospect of years of appeals. Both Fox and Dominion hired prominent appellate attorneys for the case. In court Tuesday, each side had about two dozen lawyers filling the rows. And Fox Corp.'s top lawyer, Viet Dinh, <a href="https://www.nytimes.com/2023/04/16/business/media/fox-news-dominion-trial.html">reportedly believed Fox had good odds</a> of winning their case if it appealed to the Supreme Court. First Amendment experts Insider spoke to strongly disagreed with Dinh on that point.Now, Dominion doesn't have to deal with any of that. So that's nice for them.<h2>6. Fox, though, has to deal with shareholder lawsuits.</h2>A historically large settlement like this might mean Fox Corp., the parent company of Fox News, will have the headache of shareholders who will claim it overpaid.One shareholder <a href="https://www.reuters.com/legal/fox-investors-seek-records-possible-step-toward-suing-directors-2023-04-17/" target="_blank" rel="noopener">filed a suit earlier this year in Delaware Chancery Court</a> alleging the company breached its fiduciary duties by allowing the network to broadcast election lies in the first place, exposing it to litigation from Smartmatic and Dominion.<h2>7. Fox can afford it.</h2><a href="https://www.businessinsider.com/fox-news-payout-big-for-company-but-insurance-may-help-2023-4">Fox Corp. has nearly $4.1 billion of cash on hand</a>, Lachlan Murdoch said in February. The company, which also includes Fox Sports and the streaming service Tubi, is valued at more than $17.6 billion.It's not clear if any of the $787.5 million settlement figure will be borne by libel insurance. Representatives and attorneys for Fox Corporation declined to answer Insider's questions about insurance arrangements.<h2>8. Still — wow!</h2>Did I mention that $787.5 million is the biggest known defamation settlement in US history? Feels like that needs its own item on this list.The runner-up is <a href="https://www.businessinsider.com/pink-slime-case-177-million-settlement-2017-8">the $177 million Disney paid to settle the infamous "pink slime" lawsuit</a> against its subsidiary ABC News in 2017.The lawyer who represented the plaintiff suing ABC News in that case is J. Erik Connolly.He's now representing Smartmatic in its lawsuit against Fox News.<h2>9. Smartmatic is still suing.</h2>Speaking of which, Smartmatic's separate lawsuit against Fox News is <a href="https://www.businessinsider.com/smartmatic-remains-committed-to-fox-news-defamation-case-2023-4">still moving forward</a>."Dominion's litigation exposed some of the misconduct and damage caused by Fox's disinformation campaign. Smartmatic will expose the rest," Connolly said in a statement on Tuesday. "Smartmatic remains committed to clearing its name, recouping the significant damage done to the company, and holding Fox accountable for undermining democracy."Smartmatic's lawsuit, in New York state court, may be an even greater risk for Fox.It's asking for $2.7 billion in damages. The suit also counts Giuliani as a defendant; it has <a href="https://www.businessinsider.com/smartmatic-restarts-defamation-lawsuit-against-sidney-powell-dc-court-2022-3">a separate lawsuit against Powell for jurisdictional reasons</a>.And as outlandish as Giuliani's and Powell's claims about Dominion were, Smartmatic's were even more fantastical. The company's technology was used in elections for only two counties in the US 2020 election. Dominion's was used in multiple states. Smartmatic has also been able to bolster its own case by drawing on evidence filed in Dominion's lawsuit.For the same <a href="https://www.businessinsider.com/dominion-fox-news-trial-american-democracy-private-equity-settle-2023-4">reasons Fox settled Dominion's suit</a>, it likely wants to settle Smartmatic's suit as well — and before Smartmatic makes public more embarrassing revelations from its discovery process.<h2>10. The settlement is a victory for Delaware courts.</h2>The settlement helps bolster the Delaware court system's reputation as a place to resolve business disputes with minimal fuss, <a href="https://thechancerydaily.substack.com/p/delaware-scores-another-massive-litigation" target="_blank" rel="noopener">as The Chancery Daily noted</a>.Tuesday's events, in some ways, echo last fall, where <a href="https://www.businessinsider.com/elon-musk-offers-buy-twitter-at-original-deal-price-report-2022-10">Elon Musk reached a settlement</a> with Twitter where he agreed to purchase the company for $44 million shortly before a case was supposed to go to trial. Twitter had sued him for trying to back out of a deal where he agreed to buy the company for that sum. (<a href="https://www.businessinsider.com/elon-musk-twitter-tesla-crisis-mood-intensity-2023-2">Things haven't been going too well for Musk since</a>.)Smartmatic's lawsuit against Fox, it should be noted, is in New York, where <a href="https://www.businessinsider.com/judge-denies-fox-news-motion-to-dismiss-smartmatic-defamation-lawsuit-2022-3">a judge has had little patience with Fox's legal positions</a>.<h2>11. I wouldn't want to be Sidney Powell, Rudy Giuliani, or Mike Lindell right now.</h2>For a lot of reasons. Legally speaking, the three are most directly responsible for the proliferation of false conspiracy theories about Dominion and Smartmatic that, according to a legal process, have caused at least $787.5 million in damages.Fox News broadcast them and at times endorsed the claims, Dominion argued. Google released a statement it doesn’t allow online casinos or support any unregulated gambling apps that facilitate sports betting. “This includes if an app leads consumers to an external website that allows them to participate in paid tournaments to win real money or cash prizes, it is a violation of our policies,” said the company’s statement. However, Paytm had a different story to tell. Paytm said that its recently launched mode of gamification where after every transaction you get a scratch card with a cricket sticker (a player's image and name), was the reason for the ban. “If a user collects five stickers then you would get a cashback, it’s as simple as that. Out of the blue and for reasons best known to Google, they considered it gambling. Whereas, their own payment app runs a similar promotion where you get scratch cards and then get money from that. We are a bit surprised because of that,” a Paytm spokesperson told Business Insider. While Google in its statement said that when an app violates the policies, they notify the developer of the violation and remove the app from Google Play until the developer brings the app into compliance. “And in the case where there are repeated policy violations, we may take more serious action which may include terminating Google Play Developer accounts,” it said. However, Paytm said that it was only today that it was notified regarding the scratch card ‘violation’. Earlier in the beginning of September, there was a different violation regarding Paytm First Games. “Today you can go and advertise about a fantasy gaming app on any other app but Google says that you can’t promote your own sister app. This meant that Paytm can promote any other app but not our own fantasy gaming app. This is drawing on the lines of anti-competitiveness. Today’s violation was absolutely Google’s single-minded understanding of what the game is. They clubbed it both under the same ‘policies’ violation whereas they are two different things,” said the spokesperson. ‘Google’s policies have to adhere to the law of the land’ Interestingly, Paytm First Games continues to exist in the Apple App Store, where it was launched a month ago. Google and Apple have different approaches towards fantasy gaming.
