Tuesday, April 2: Exaggerated claims of unbelievable results with the use of consumer products are not new in the Indian advertisement industry. But, the law of the land does explicitly prohibit and punish misleading advertisements from time to time. One such case is grabbing headlines of late. <keyword id="20083249" type="General" weightage="20" keywordseo="baba-ramdev" source="keywords">Baba Ramdev</keyword> and <keyword id="20752072" type="General" weightage="20" keywordseo="acharya-balkrishna" source="keywords">Acharya Balkrishna</keyword>, co-founder and managing director of <keyword id="19980518" type="General" weightage="100" keywordseo="patanjali" source="keywords">Patanjali</keyword>, respectively, appeared before the <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> today for a hearing regarding a case involving misleading advertisements. So, what exactly happened? <cmsannotation type="cmsannotation" annotationid="A case of false and misleading advertisements" comment="subhead" text="A case of false and misleading advertisements">A case of false and misleading advertisements</cmsannotation> The case began in November last year when the Supreme Court, responding to a petition by the Indian Medical Association (IMA), cautioned <keyword id="6406649" type="General" weightage="20" keywordseo="patanjali-ayurved" source="Orion">Patanjali Ayurved</keyword> against airing "false" and "misleading" claims in its advertisements about medicinal products. The IMA cited several ads that allegedly portrayed allopathic medicine and doctors negatively, claiming that companies producing ayurvedic medicines made disparaging remarks to deceive the public. Despite the Supreme Court's cautionary stance and prohibition on advertising products claiming to treat specific ailments under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, Ramdev and Balkrishna reportedly conducted a press conference, once again making misleading claims about Patanjali's ability to cure various conditions permanently. Subsequently, on February 27, the Supreme Court expressed dissatisfaction with Patanjali's continuous dissemination of false advertisements regarding medicinal cures and issued notices to the company, questioning why contempt proceedings should not be initiated. It also chastised the government for not taking action and “sitting with their eyes shut”. On March 21, the Court summoned Baba Ramdev and Balkrishna to personally appear before it on April 2 to address their failure to respond to the contempt notice regarding misleading advertisements about medicinal cures. <cmsannotation type="cmsannotation" annotationid="What’s the latest update?" comment="subhead" text="What’s the latest update?">What’s the latest update?</cmsannotation> In today's hearing, the Supreme Court criticised Ramdev and Balkrishna for their "absolute defiance" in failing to submit proper affidavits of compliance and for disregarding legal directives. The Court also rebuked Patanjali's MD for describing the Drugs and Cosmetics (Magic Remedies) Act as "archaic". Noting that Patanjali's advertisements are in the "teeth of law" of the land, the Court warned Ramdev to prepare for potential consequences. Justices Hima Kohli and Ahsanuddin Amanullah, presiding over the bench, declined to acknowledge the apology extended by Patanjali last month. Subsequently, Ramdev's attorney, reportedly with folded hands, reiterated that both Ramdev and Balakrishna were extending a personal and unconditional apology before the court. Finally, the Court has granted Ramdev and Balkrishna a final opportunity to file affidavits in one week and mandated their presence at the next hearing on April 10.

However, it is yet to see if the <keyword id="6363690" type="PERSON" weightage="20" keywordseo="strategy">strategy</keyword> will work as the yoga guru is not paying anything extra to shopkeepers to give prominence to <keyword id="6356684" type="UNKNOWN" weightage="20" keywordseo="patanjali">Patanjali</keyword> products. 
 
Generally, companies pay shopkeepers to place their products prominently.

"No one can deny them (Patanjali) the Swadeshi plank. But we are Swadeshi too, and we also make in India. Besides, the shopkeepers are looking for returns on investment from their real estate space and pushing products for prominence on shops won't cut ice," Parle products marketing head Mayank Shah told ET. 
 
Meanwhile, Reliance Retail has created 'Patanjali Destinations' and the Future Group has a tie-up with <a href="http://www.businessinsider.in/FMCG-companies-are-sweating-it-out-as-Baba-Ramdevs-Patanjali-is-entering-kitchens-and-even-bathrooms/articleshow/50351200.cms">Patanjali</a> already. 
 
Experts say the ‘swadeshi’ angle might work for end users but the strategy may fail with traders, who only mean good business. 
 
It is worth mentioning that IIFL Institutional Equities has projected the Patanjali brand's sales to reach Rs 20,000 crore by fiscal 2020. 
 
"We believe Patanjali will gather some initial market share in juices as it has done in honey and Chyawanprash on the back of lower priced products," Edelweiss Securities stated in its report.

We would have to hike prices or decrease quality to get in. That is not a part of our policy. We may try with some categories, but not all.”

New Delhi, Dec 18 () Yoga guru <keyword id="6355107" type="UNKNOWN" weightage="20" keywordseo="Baba-Ramdev">Baba Ramdev</keyword>'s <keyword id="6406649" type="UNKNOWN" weightage="20" keywordseo="Patanjali-Ayurved">Patanjali Ayurved</keyword> on Wednesday made its first big acquisition when it paid Rs 4,350 crore to take over soya food brand Nutrela-maker Ruchi Soya through an insolvency process. The acquisition will help Patanjali acquire edible oil plants as also soyabean oil brands such as Mahakosh and Ruchi Gold. Sources said Patanjali settled Rs 4,350 crore of dues Ruchi Soya had towards financial creditors by infusing Rs 1,100 crore equity and arranging another Rs 3,250 crore via debt.
 The acquisition of Ruchi Soya by Patanjali Ayurveda has been completed, sources said, adding that the amount has been transferred to an escrow account and disbursals to financial creditors are in process.
 When contacted, Patanjali Ayurveda spokesperson S K Tijarewala said: "We have completed all the formalities and the entire amount of debt and equity has been deposited. Now, officially Ruchi Soya has become Patanjali group firm."
 In December 2017, the National Company Law Tribunal (NCLT) ordered start of insolvency proceedings against Ruchi Soya on application of Standard Chartered Bank and DBS Bank. Shailendra Ajmera, part of consultancy firm EY, was appointed as resolution professional (RP).
 Ruchi Soya is the second big insolvency case to be completed this week. World's largest steel maker ArcelorMittal together with Japan's Nippon Steel on Monday completed the acquisition of Essar Steel for Rs 42,000 crore.
 Both the companies were taken to insolvency court over unpaid dues of lenders. Their bankruptcy proceedings had been pending for two years. Their resolution will help lenders such as State Bank of India clear a good part of bad loans, sources said.
 Japyee Infratech, which built the country's first road expressway that is wide enough to land fighter jets during emergency, is also headed towards resolution with lenders on Tuesday accepting the offer of state-owned NBCC Ltd. The deal is slated to close in coming months.
 In April 2019, Patanjali Ayurved had received approval of financial creditors to acquire Ruchi Soya. The NCLT gave its nod to the resolution plan in early September.
 But later, the Singapore-based DBS Bank became a dissenting creditor and approached the NCLAT challenging the distribution of proceeds from the bid submitted by Patanjali Ayurveda.
 Earlier, Ruchi Soya had informed in a regulatory filing that resolution applicant Patanjali group will infuse Rs 204.75 crore as equity and Rs 3,233.36 crore as debt.
 The amount will be infused in a special purpose vehicle 'Patanjali Consortium Adhigrahan Pvt Ltd', which will be later amalgamated with Ruchi Soya.
 Another Rs 900 crore would be infused by the Patanjali group through subscription of non-convertible debentures and preference shares in the SPV. It will also provide credit guarantee of nearly Rs 12 crore.
 Out of the Rs 4,350 crore offered by Patanjali group, Rs 4,235 crore would be utilised to pay creditors while Rs 115 crore would be used for capital expenditure and working capital requirements of Ruchi Soya.
 As per the filing, Rs 4,053.19 crore would be paid to secured financial creditors, Rs 40 crore to unsecured financial creditors, Rs 90 crore to operational creditors, Rs 25 crore to clear statutory dues, Rs 14.92 crore to workmen/employees and Rs 11.89 crore to provide counter bank guarantee.
 Patanjali won the bid to acquire Ruchi Soya after Adani Wilmar, which sells edible oil under the Fortune brand, withdrew from the race citing significant delays in resolution process that led to deterioration of assets.

Patanjali Ayurved completes acquisition of bankrupt Ruchi Soya for ₹4,350 crore

Haridwar/New Delhi, Jun 23 () Yoga guru <keyword id="6369109" type="PERSON" weightage="20" keywordseo="ramdev">Ramdev</keyword>'s Patanjali on Tuesday launched what he claimed was the first ayurvedic medicine to cure coronavirus disease even as the scientific community the world over struggles to develop an effective cure for the highly contagious disease. Patanjali claimed 'Coronil' and 'Swasari' had shown 100 per cent favourable results during clinical trials on affected patients, at Patanjali Yogpeeth in Haridwar. Launching the medicines at a press conference in Haridwar, Ramdev claimed "100 per cent recovery rate in 7 days". The Corona kit will be made available at Rs 545, said Acharya Balkrishna, the MD of Patanjali Ayurved. The corona kit will have medicines for 30 days. Patanjali claims that its corona medicine kit can also be taken as prevention for coronavirus. This is not an immunity booster but a coronavirus cure, Ramdev said. Manufactured by Haridwar-based Divya Pharmacy and Patanjali Ayurved Ltd, the medicine is the result of a research partnership between Patanjali Research Institute and the Jaipur based National Institute of Medical Sciences. The drug was clinically tried on 280 COVID-19 positive persons out of which 69 per cent were cured within three days, Ramdev said at the launch of the medicine held at Patanjali Yogpeeth in the presence of NIMS Director Dr Balbir Singh Tomar and allopathic and ayurvedic experts involved in the research behind making the drug. "100 per cent recovery from COVID-19 within seven days of consuming the medicine is guaranteed," Ramdev said. Coronil is made of the extracts of pure Giloy, Tulsi and Ashwagandha. A corona kit consisting of the three medicines - Coronil, Shwasari and Anu Tel. The other two medicines to be taken along with Coronil are 'Shwasari' which works on strengthening the respiratory system and cures the obvious symptoms of corona including cough, cold and fever and a nasal drop named 'Anu Tel' which helps build immunity, the firm said. Ramdev said the medicines can be ordered online through a mobile app from next Monday.

For the new unit, Patanjali Ayurved is in talks with the Yamuna Expressway Industrial Development Authority (YEIDA) to buy a 200-acre plot for around Rs 320 crore. 
 
"They are in talks with us to take industrial land to set up a factory and institutional land to set up a university. Once they decide, they will apply for allotment of land," YEIDA Chief Executive Arun Vir Singh told ET. 
 
Presently, Patanjali has only one manufacturing facility, which is near Haridwar in northern Uttarakhand state, and is spread over around 150 acres. 
 
Patanjali Ayurved’s sales rose by 64% to Rs 731 crore within six months that ended December 31, 2015. 
 
Patanjali Ayurved's provisional turnover in the first 10 months of FY16 was Rs 3,266.97 crore, compared with Rs 1,587.51 crore in the same period in the previous year, as per credit ratings firm Brickwork Ratings.

"There is a natural feeling that these products are good and the price points are lower compared with the premium products available in the market. There is a great product out there and their distribution and packaging are pretty good," he said. 
 
One might be forced to think that the success of this 10-year old FMCG firm is just because of Baba's charm. Raamdeo Agrawal, Co-Founder &amp; Joint MD of MOFSL, says, "It will definitely <a href="http://www.businessinsider.in/BabaRamdevs-Patanjali-is-already-spelling-doom-for-this-global-brand-in-India/articleshow/51303845.cms">take away market shares</a> in some segments. They have a segment where they will thrive. So it is a marketing challenge for the rest of the pack, be it <keyword id="6365619" type="CITY" weightage="100" keywordseo="Hindustan-UniLever">Hindustan Unilever</keyword> or Colgate or <keyword id="40233" type="COMPANY" weightage="100" keywordseo="emami">Emami</keyword>, whosoever is hurt by Patanjali products." However, he also added that, "Patanjali will have some challenges coming in later on product superiority, because one needs to see whether product superiority or just the blind faith in Baba Ramdev's brand equity is driving them" 
 
Some, however, are of the view that the market is big enough for the competitors to survive. "Clearly, Patanjali is making inroads, but that does not mean the Unilevers of the world will fade away. They are astute. They have excellent marketing. They will come out with different products. They will come out with different prices," Pradip P Shah of IndAsia Fund Advisors told ET.

Is Patanjali actually going to displace traditional biggies from the market, or is it just Baba Ramdev’s charm?

Roared by the success of his FMCG company <keyword id="6356684" type="UNKNOWN" weightage="100" keywordseo="patanjali">Patanjali</keyword>, yoga guru <keyword id="6355107" type="PERSON" weightage="100" keywordseo="Baba-Ramdev">Baba Ramdev</keyword> has started to openly target his FMCG rivals, like Colgate, Unilever and Nestle, adding that they will be uprooted in just a few years. 
 "Colgate will be below Patanjali by this year, and in three years, we will overtake Unilever," <keyword id="6369109" type="PERSON" weightage="100" keywordseo="Ramdev">Ramdev</keyword> told reporters while he was announcing Patanjali Ayurved's Rs 1,000-crore investment plan this year. The plan includes setting up five or six new processing units in Assam, Maharashtra, Madhya Pradesh, Rajasthan, Haryana and Uttar Pradesh. 
 
"Patanjali would shut the 'gate' in Colgate. The birds in Nestle's nest (logo) will also fly away," Ramdev said, openly mocking his arch rivals. 
 
 
"Pantene ka to pant gila hone wala hai, aur do saal me Unilever ka lever kharab ho jayega," the yoga guru added. 
 
He was also asked whether his firm was eating into the market share of MNCs, to which he (jokingly?) replied, "We are totally vegetarian." 
 
Patanjali also has plans to venture into exports and e-commerce this year, while wanting to venture into dairy products and yoga clothing. 
 "We will be exporting honey and cosmetics to 10-12 countries, including US, Britain, Canada, African and Arab countries," said Patanjali managing director <keyword id="669583" type="UNKNOWN" weightage="100" keywordseo="Acharya-Balkrishna">Acharya Balkrishna</keyword>. 
 
The FY that ended saw Patanjali reaching its revenue target of Rs 5,000 crore. "We have made profits of 8-12%," he said. "And we are just getting started. Wherever we see MNCs taking advantage of Indian consumers, we will enter that segment with better quality natural products and affordable pricing. At the same time, we need to get more competitive in modern trade. These mega stores will help us get there," he said.

Weirdest comment of the day - Ramdev Baba says Patanjali will shut the gate in Colgate, make Nestle's bird disappear

Yoga guru Ramdev, whose company <keyword id="6356684" type="UNKNOWN" weightage="100" keywordseo="patanjali">Patanjali</keyword> has been asked to send several of its consumer products for quality tests, has claimed that global consumer goods conspired against Patanjali by getting fake and adulterated products tested in laboratories for irregular results. 
 
Ramdev said that these companies are afraid of Patanjali winning over the customers and taking a major part of the market share. 
 
"Multinational firms like Hindustan Unilever, Colgate and Nestle are bribing people to get fake and adulterated Patanjali products tested in labs," said Ramdev at a press briefing. "Sometimes they even produce reports from fake laboratories to malign us." 
 
While Nestle, the transnational food and beverage company headquartered in Switzerland and having operations in India, has denied the accusation, Colgate-Palmolive has refused to comment on the charges. 
 
"Patanjali has become the point of discussion in the boardrooms of MNCs," Ramdev further stated. 
 
Patanjali, which paid all its pending debts last year, will be posting sales of Rs 5,000 crore next year, because of growth in the food, cosmetic and ayurvedic product categories. 
 
The brand is rapidly becoming a contender in the consumer goods space, and will soon be increasing its infrastructure by four times. 
 
The aggressive marketing strategy adopted by the company is also responsible for the growth. As per the data of the Broadcast Audience Research Council (BARC), it became one of the top three most-advertised brands on television in November, while hiring yesteryear actress Hema Malini as the brand ambassador for some of its products.

<a href="http://www.businessinsider.in/searchresult.cms?query=baba+ramdev">Baba </a><a href="http://www.businessinsider.in/searchresult.cms?query=baba+ramdev">Ramdev</a>’s <a href="http://www.businessinsider.in/searchresult.cms?query=patanjali">Patanjali’s</a> phenomenal rise is posing some serious troubles for <keyword id="34523" type="CITY" weightage="20" keywordseo="fmcg">FMCG</keyword> giants like <a href="http://www.businessinsider.in/searchresult.cms?query=dabur">Dabur</a>, <a href="http://www.businessinsider.in/searchresult.cms?query=nestle">Nestle</a>, Emami, etc. 
 
The shares of these FMCG giants, which have dominated the industry, had expensive valuations and this can lead of downgrade of earnings. 
 <keyword id="75190" type="CITY" weightage="20" keywordseo="Nestle">Nestle</keyword> is trading at 88 times to its 12-month earnings; whereas <a href="http://www.businessinsider.in/searchresult.cms?query=emami">Emami</a> is around 44-times. 
 Meanwhile, Dabur is trading at about 40 times and <keyword id="80626" type="CITY" weightage="20" keywordseo="Colgate-Palmolive">Colgate-Palmolive</keyword>'s valuations are at 39.5 times to its one-year earnings. 
 <keyword id="6356684" type="UNKNOWN" weightage="20" keywordseo="patanjali">Patanjali</keyword> products, which range from soap to medicines, have become an instant hit among consumers. 
 
Patanjali clocked revenues of about Rs 450 crore in fiscal year 2012 and shares of Colgate-Palmolive declined 21.7% in last one year. 
 
Aditya Mathur, research analyst at Citi, told ET, “There are competitive pressures for the incumbents due to Patanjali. The pricing of products might be an issue in categories such as health supplements, including honey, chyawanprash, and also certain premium segments like hand and face wash, and others, where the price value equation could work in Patanjali's favour."
