"But TikTok knew that Nylah would watch because the company's customized algorithm placed the videos on her 'For You Page.'"The challenge encouraged viewers to choke themselves until they passed out. In a 2022 suit filed against TikTok, attorneys for her parents said Nylah tragically died when she attempted to replicate what she saw. The case was initially dismissed by a district judge due to Section 230. The Third Circuit, however, found that TikTok's algorithm, which tailors content recommendations to specific users based on the posts they interact with, is a form of speech — one that isn't protected by Section 230.The company had argued in court that it was immune from prosecution due to Section 230 of the Communications Decency Act. "Arguably, the algorithmic suggestion is even more powerful than an in-person suggestion."French and other supporters of the Third Circuit ruling argue that TikTok's liability protections should end where its algorithmic suggestions begin.Neutrally hosting a wide array of content on an online platform is fine, French and other proponents say, but promoting specific content — especially content the site administrators know could be harmful — is where a new line needs to be drawn, and the platforms themselves need to be held legally accountable, as the Third Circuit ruled.<h2 id="108dc6d1-8678-4113-ad8d-8ff0ed1ea524">Section 230 defenders argue the ruling is a blow to free speech</h2>Opponents of the ruling argue that critics of Section 230 are using Anderson's tragic death and the reasonable desire to protect children online as a way to erode speech rights."It's a myth — these laws that claim to protect children," Betsy Rosenblatt, the associate director of Case Western University's Spangenberg Center for Law, Technology &amp; the Arts, told Business Insider. "They all wear the costume of child protection, but they are not child protection underneath that — they are attempts to silence speech."Rosenblatt said the Third Circuit's decision doesn't make logical or legal sense. It's morally reprehensible to suggest in a video a child choke themselves for engagement online — but it isn't illegal, and it shouldn't be illegal for the host of the video to show it on your "For You Page.""The more you require platforms to filter speech, the more platforms will have to delete first and ask questions later," Rosenblatt told BI. "And that means that things that are controversial, the moment they face any challenge, will get taken down, even if they should stay up."<h2 id="b73b0075-18f8-4e9c-97a8-c7768718b5be">What's next?</h2>The Third Circuit's decision can be appealed by <a target="_blank" class="" href="https://www.businessinsider.com/the-ban-tiktok-movement-is-losing-momentum-among-americans-2024-9">TikTok</a>. If the company appeals, the case will then end up on the Supreme Court's desk, where the high court justices could choose to take up the case or let the Third Circuit ruling stand — which would force platforms like TikTok to reconsider <a target="_blank" class="" href="https://www.businessinsider.com/how-tiktok-is-changing-music-industry">how their algorithms function</a> to avoid liability in cases like Anderson's.Though the high court has so far shied away from defining the scope of Section 230, its conservative justices have previously signaled they're open to reconsidering the statute. If they do, their ruling could have even broader consequences than the Third Circuit ruling.Justices Clarence Thomas and Neil Gorsuch dissented in July from the court's refusal to hear a case that would have revisited Section 230. The case stemmed from allegations that the Snapchat app has a design flaw that aids sexual predators, but lower courts found that the app's parent company was shielded by 230.And in a decision last term, SCOTUS also left a loophole open to holding platforms liable based on which country their headquarters are in. In Moody v. NetChoice, which determined a platform's algorithmic activity is a form of "expressive activity" and should be regulated like speech is, Justice Amy Coney Barrett wrote that a foreign-owned social-media platform — like TikTok — may not have the same First Amendment protections that a US corporation does.Rosenblatt said that if SCOTUS agrees to hear the case, the high court could agree with the Third Circuit that TikTok's algorithmic recommendations are a version of the site's speech. If they do, the question would then become whether the recommendation itself was negligent, which could carry legal consequences."That would still be terrible for business on the internet, but it wouldn't kill all websites," Rosenblatt said of upholding a more narrow reading of the Third Circuit ruling. But the potential for a broader reading, which could determine that any form of content moderation equals a conversion of user speech into a platform's speech, would "have devastating effects on the internet ecosystem and tech more generally."

Neither did <keyword id="19897184" type="General" weightage="20" keywordseo="taylor-swift" source="keywords">Taylor Swift</keyword> after her recent deepfake "endorsement" of Donald Trump. When dueling deepfakes of <keyword id="19928904" type="General" weightage="20" keywordseo="tom-hanks" source="keywords">Tom Hanks</keyword> shilled for a dental plan last October and a miracle cure in August, the real Tom Hanks sued no one. Likewise, Jennifer Aniston, whose AI double recently told Facebook users that she owes her timeless bikini body to collagen supplements, did not run to the courthouse. Amid this litigation restraint, former Arkansas Gov. Mike Huckabee stands apart. He, too, has been targeted. In May, Huckabee, a Baptist minister and staunch conservative, discovered his manipulated image had been used for months in Facebook ads for CBD gummies. "CBD cured me and can save American lives," the ads quote the two-time GOP presidential candidate as saying. "It was quite the shock," Huckabee told Business Insider Wednesday. "I was just outraged." Huckabee may now be the only deepfaked American public figure who is taking his outrage to court. His lawsuit against <keyword id="19911549" type="General" weightage="20" keywordseo="meta" source="keywords">Meta</keyword>, the parent company of Facebook and Instagram, demands unspecified damages "for its malicious conduct." "Meta profited from these unlawful advertisements, and because of Meta's approval, these advertisements reached millions of Facebook users," the lawsuit alleges. An attorney and spokesperson for Meta did not return requests for comment for this story. The company is fighting to dismiss the lawsuit, an effort centered on Section 230 of the federal Communications Decency Act. Since 1996, Section 230 has generally immunized publishers of third-party content from lawsuits. Experts in digital law told Business Insider that Section 230 protections make it virtually impossible to successfully sue a social media platform over deepfake scam ads. So while public figures get deepfaked all the time, Huckabee v Meta, filed in federal court in Delaware, is unsurprisingly a rare effort, they said. "He's going straight into the teeth of an impressive record of courtroom futility," said Eric Goldman, a professor of digital law at Santa Clara University. Huckabee said he remains determined. "There are so many people who have been defrauded in this way, and either they don't have the energy to pursue it, or they think it's an effort in futility, which I disagree with," he said. "Quite frankly, it's kind of a Wild, Wild West approach that they've taken, that they can do whatever they want to do, and no one can touch them," he added, referring to Meta. The billionaire alleged that Meta was negligent in posting deepfake cryptocurrency scam ads using his image. The ads remained up on Facebook and Instagram despite Forrest's repeated demands they be taken down, and defrauded victims out of millions of dollars, his suit alleges. In June, US District Court Judge P. Casey Pitts rejected Meta's argument that the case should be dismissed pretrial on Section 230 grounds. The decision means Forrest may proceed to trial on this claim: that Meta was more than just a neutral conveyor of content and, therefore, has no immunity from a negligence claim. That's Huckabee's argument in a nutshell, Poynter said. "Facebook is an advertising company," he told BI. "Almost 98% of Meta's $134 billion in revenue last year came from the sale of advertisements. Its algorithm decides how many of these ads will be sent out, and who will see them." "We argue that Meta is no longer a third-party content provider protected by 230 immunity when it manipulates and pushes an ad, through its algorithm, to the people who are most likely to buy." Goldman, the digital law professor, thinks the Forrest decision may be "an anomaly." "If I were Facebook, I would appeal," he said. Still, there are warning signs that 230 immunity is in legal jeopardy, he said. He pointed to <a target="_blank" class="" href="https://www.businessinsider.com/blackout-challenge-tiktok-death-could-end-section-230-liability-protections-2024-9">Anderson v. TikTok</a>, a lawsuit on behalf of a 10-year-old girl, Nylah Anderson, who died trying the "Blackout Challenge" promoted on her TikTok feed. In August, a federal appeals court in Pennsylvania found that because its algorithm fed these videos to the girl, TikTok served as more than just a neutral repository of third-party content. The court rejected TikTok's 230 challenge, allowing the case to go forward. "They found that algorithms are content, protected by the First Amendment, so they're not covered by 230 immunity," Goldman said. "It's obviously wrong, and it will be appealed, maybe to the US Supreme Court," he added. He just remembers he was "livid." "I was getting a number of friends who were sending it to me," he remembered. "And they were saying 'What the heck is going on?'" The ads used photos of the former governor, including from his nationally syndicated talk and variety show, "Huckabee," which runs weekly on Trinity Broadcasting Network. Other photos were clearly AI-manipulated, his lawsuit says. "There is no real photo of me like it. It looks like I'm crying," Huckabee told BI. "I'm in a bright red paisley shirt, and it looks like I'm at the end of my rope." At least one of the ads took the form of a Fox News story, the lawsuit alleges. All of the ads falsely said Huckabee was leaving Trinity Broadcasting because he had nearly died after a four-year battle against an auto-immune disease — but that the "miracle" of Fortin-brand CBD gummies had saved his life. The ads also falsely claimed that because he'd switched to gummies, he no longer needed to take opioid painkillers. Fortin is still selling CBD gummies online without the help of a bogus Huckabee endorsement. The company is not named as a defendant in Huckabee's lawsuit, and a representative did not respond to requests for comment for this story. Huckabee said he was soon inundated with calls from friends, fans, people from the network, and sponsors from the show, all wondering if he was really sick, really quitting, and really popping CBD gummies. "Governor Huckabee does not endorse CBD gummies or any marijuana derivative," Poynter told BI. "For decades, Governor Huckabee has been against marijuana and its derivatives." The former governor said he has more than 2 million followers on Facebook and has had beef with Meta before, including when it temporarily froze his account after he criticized the government's COVID response. "Everybody I know has been Facebook jail," he said. "If they're monitoring the content of people who don't have that much content, why can't they see these ads?" Huckabee said he is no fan of Section 230 immunity. The law was enacted to encourage the growth of the internet and protect free speech, but "I don't think we have to worry about that now," he said. "We have to worry about how the internet has become a monster and it's gobbling up people's lives," he added. As for his lawsuit, "We're going to take it as far as we can take it," Huckabee said. Meta is due to file additional papers supporting its motion to dismiss the Huckabee lawsuit on Monday. In the Forrest case, the company continues to argue that it has meaningful safeguards in place to combat scam advertisements. "She was a butterfly," Anderson reportedly told the outlet. "She was everything. <ul class="summary-list"><li><keyword id="11894125" type="UNKNOWN" weightage="60" keywordseo="tiktok" source="Orion">TikTok</keyword> is being sued for <keyword id="14356109" type="UNKNOWN" weightage="60" keywordseo="wrongful-death" source="Orion">wrongful death</keyword> after two girls died trying to recreate a <keyword id="13637773" type="UNKNOWN" weightage="60" keywordseo="choking" source="Orion">choking</keyword> challenge.</li><li>The <keyword id="11921506" type="UNKNOWN" weightage="60" keywordseo="lawsuit" source="Orion">lawsuit</keyword> alleges the girls aged 8 and 9 were fed videos of the challenge by the app's algorithm.</li></ul>TikTok is being sued after two young girls died while trying to recreate a viral trend on the app called the "<keyword id="12801980" type="UNKNOWN" weightage="60" keywordseo="blackout-challenge" source="Orion">blackout challenge</keyword>."The lawsuits allege that Lalani Erika Walton, 8, and Arriani Jaileen Arroyo, 9, died after copying the trend in which participants try to choke themselves into unconsciousness, <a href="https://www.latimes.com/business/technology/story/2022-07-01/tiktok-sued-over-death-of-two-young-girls-in-viral-blackout-challenge">the Los Angeles Times</a> reported.The wrongful death lawsuits were filed on Friday in Los Angeles County Superior Court.The suit alleges that the app's algorithm recommended videos of the strangulation challenge to the young girls.Walton, from Texas, was found "hanging from her bed with a rope around her neck" in her bedroom.The police took Walton's phone and tablet, and later told her stepmother that she had been watching blackout challenge videos "on repeat," the suit says, according to the newspaper.Arroyo, from Milwaukee, was found "hanging from the family dog's leash" in her basement, according to the suit.She was taken to hospital and put on a ventilator, but had lost all brain function and was eventually taken off life support, according to the lawsuit, the LA Times reported.They are not the first children to die while allegedly trying to participate in the challenge. The notorious 2017 "Tide Pod" challenge involved young people eating laundry detergent capsules.
