These are unique codes assigned to iPhones which track users' behavior and allow advertisers to target them accordingly."Apple's operating system creates the IDFA without user's knowledge or consent. After its creation, Apple and third parties (e.g. applications providers and advertisers) can access the IDFA to track users' behaviour, elaborate consumption preferences and provide personalized advertising," Schrems' privacy campaign group Noyb — short for "none of your business" — said in a <a href="https://noyb.eu/en/noyb-files-complaints-against-apples-tracking-code-idfa">statement</a>.Noyb argued this was in violation of a part of the EU's e-Privacy Directive focused on cookies. "EU law protects our devices from external tracking. Tracking is only allowed if users explicitly consent to it. This very simple rule applies regardless of the tracking technology used," Stefano Rossetti, a privacy lawyer at Noyb, said in a statement."While Apple introduced functions in their browser to block cookies, it places similar codes in its phones, without any consent by the user. This is a clear breach of EU privacy laws," he added.Apple was not immediately available for comment when contacted by Business Insider.Noyb also signalled it is looking into a similar system operated by Google.Apple <a href="https://www.businessinsider.com/apple-ios-14-privacy-apps-tracking-you-2020-6">announced in June</a> it was going to roll out a new feature with its iOS 14 update that would show users the data their apps are collecting — such as location data, financial information, and browsing history — and ask them to opt into having that data collected, rather than have it collected by default.In September, Apple announced it was delaying the rollout of the feature to give developers time to adapt to the change. With our complaints, we want to enforce a simple principle: trackers are illegal, unless a user freely consents. The IDFA should not only be restricted, but permanently deleted. Smartphones are the most intimate device for most people and they must be tracker-free by default," Rosetti said.Schrems has a proven track record of launching privacy cases against Big Tech companies. In July, the EU's top court <a href="https://www.reuters.com/article/us-facebook-privacy-eu-schrems-idUSKCN24H1BF">ruled in his favor over a case he brought against Facebook in 2011</a>, arguing the way US companies ship European user data back to America was unlawful because of concerns over US government surveillance.In its case against Apple, Noyb deliberately filed its complaints with specific countries' authorities, rather than go via the EU, because the law it believes Apple is breaching pre-dates Europe's overarching GDPR laws.Rosetti said the intent was to achieve faster results."These cases are based on the 'old' cookie law and do not trigger the cooperation mechanism of the GDPR. In other words, we are trying to avoid endless procedures like the ones we are facing in Ireland," he said.Ireland is the data regulator for Facebook in Europe. The company was hit with two fines on Wednesday – one for <a href="https://www.businessinsider.com/meta-doesnt-know-where-all-your-data-is-engineers-say-2022-9">Facebook</a> and one for <a href="https://www.businessinsider.com/instagram-data-download-feature-gdpr-privacy-photos-searches-2018-4">Instagram</a> – by Ireland's Data Protection Commission for violating the Europe's <a href="https://www.businessinsider.com/what-is-gdpr-regulation-explained-2018-4">General Data Protection Regulation (GDPR) laws.</a><a href="https://www.businessinsider.com/meta-fined-400-million-for-breaching-kids-privacy-on-instagram-2022-9">Meta was previously fined $403 million</a> by Irish authorities last September for failing to protect children's privacy. The company previously relied on "Contractual Necessity," which meant users could only use the platform if they accepted they would be tracked. Meta said: "The suggestion that personalized ads can no longer be offered by Meta across Europe unless each user's agreement has first been sought is incorrect."But Max Schrems, a privacy activist and honorary chairman of Noyb — the organization that made the complaint against Meta – told Insider this was misleading. It is understood that Meta is considering numerous options besides consent as the basis for its appeal, although Schrems said it was the only one that could work. He said Meta could have used "legitimate interest"– but the company would need to have announced it beforehand. "Facebook tries to say 'oh they haven't said we have to use consent,' but if you basically do the math and look at the other five options, you realize that consent is the only one that's left," Schrems told Insider. "The law simply doesn't have a seventh or eighth or ninth option. It simply doesn't exist."The European Commission and Irish Data Protection Commission did not immediately respond to requests for comment from Insider.

It also states he previously worked at FirstEnergy's Davis-Besse Nuclear Power Station in Ohio.Catherine Turcer, executive director of Common Cause Ohio, a nonpartisan government watchdog organization, said all congressional candidates should follow the law about personal financial disclosures — especially in a race as close as the one for Ohio's 9th Congressional District."It allows voters to consider the statements the candidates make, it allows voters to consider any conflicts of interest," Turcer said. The pro-privacy activist's expected legal action is just one of a deluge of cases observers are expecting to be brought against Facebook (and other tech firms) in the months ahead.But there may be a bigger threat of the horizon: Direct government action.In a research note published on Tuesday, Deutsche Bank analysts discussed how the impending legislation may affect Facebook, and predicted a "flood of lawsuits."Their verdict: "While we do not opine on the likelihood of these lawsuits being successful we believe the sheer volume of lawsuits could be cause for concern, and if nothing else, a distraction for FB and other tech companies alike (e.g. Google)."The analysts' larger concern is that national governments and regulators might attempt to take action against Facebook. "We would be far more alarmed by regulators directly litigating," they wrote - citing a report on how UK regulator the ICO is growing its staff by 40% over three years to enforce the new legislation.<h2>A track record of taking on American tech giants</h2><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image">Thomson ReutersEU Competition Commissioner Vestager</div></div></div>GDPR lays down strict new rules about how Europeans' data can be used by corporations, and has some serious teeth to aid enforcement. Non-compliant companies can be fined 4% of their global annual revenue (i.e. not just revenues generated in Europe) or €20 million ($24 million), whichever is higher.For Facebook, which generated more than $40 million in revenue in 2017, that would amount to around $1.6 billion. The EU doesn't shy away from going after the American tech giants, either: The European Commission, under the leadership of competition commissioner Margrethe Vestager, has previously forced Apple to pay €13 billion in back taxes after its arrangements in Ireland ran afoul of EU rules.Schrems has had some success battling Facebook, but his resources are limited - <a href="https://noyb.eu/support">his new legal initiative Noyb is crowdfunded by members of the public</a>.
