The Debt Recovery Tribunal-I here has put up a <keyword id="70990" type="General" weightage="20" keywordseo="solar-power" source="Orion">solar power</keyword> plant belonging to a group entity of the absconder diamantaire Nirav D. Modi to try and recover a tiny portion of the whopping <keyword id="59005" type="General" weightage="20" keywordseo="dues" source="Orion">dues</keyword> of over Rs 2,348-crore. The solar power plant, with a capacity of 5.247MW is situated at Khandale village in Karjat Taluka of Maharashtra's Ahmednagar district, and along with the plant and machinery, the solar plant is valued at Rs 12.40-crore. The <keyword id="1639" type="General" weightage="20" keywordseo="auction" source="Orion">auction</keyword> ordered by the DRT-I Recovery Officer Ajeet Tripathi on September 21 makes no mention of the revenues assessed on the property, whether it has any encumbrances or faces any claims, or any other details. Besides, also going under the hammer for at least the third time is Nirav D. Modi's posh flat in the fashionable Pedder Road area of south Mumbai. The flat is on the second floor of Grosvenor Building, and proposed to be auctioned off as a fully furnished residence along with two parking lots, all collectively valued at Rs 11.70-crore. In addition, the DRT-I plans to auction off two large land-parcels belonging to Nirav D. Modi and his group company, Firestone Trading Pvt. Ltd. The plots are situated at different locations in Khandale Village, Karjat Taluka of Ahmednagar district, and one of the properties also houses the (aforementioned) solar power plant on it, which is being auctioned off separately. As far as encumbrances are concerned, both these land parcels are currently mortgaged with the Union Bank of India, presumably in lieu of the loans it had extended to the diamantaire and his group companies. The online auction shall be held on October 25 between 2-4 p.m. only, for all the listed assets, as per the DRT-I's notification, andthese properties shall be auctioned off on 'as is where is' and 'as is what is' basis. The Certificate Debtors named are: Nirav D. Modi of Grosvenor House; Bentley Properties Pvt. Ltd, MAK Business Enterprises Pvt. Ltd, ANM Enterprises Pvt. Ltd, NDM Enterprises Pvt Ltd, Neeshal Trading Pvt Ltd -- all having a common registered address as: 15 Nagindas Mansion, 57/61 Jagannath Shankarsheth Road, Opera House, Mumbai - 400004. The other entities figuring in the list are: Firestone Trading Pvt. Ltd, Paundra Enterprises Pvt Ltd, and Radashir Jewelery Co. Ltd - all with a single registered address as: AE-4050, A Tower, East Wing, G Block, Bharat Diamond Bourse, BKC, Bandra East, Mumbai - 400051. Billed as the biggest <keyword id="511750" type="General" weightage="20" keywordseo="banking-fraud" source="Orion">banking fraud</keyword> in recent Indian history, the PNB first admitted to the Rs 14,400-crore plus scam in January 2018, after which probe agencies, including the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) launched their investigations. The prime accused were the 'mama-bhanja' duo -- Mehul C. Choksi and his nephew Nirav D. Modi -- plus their family members, business associates and entities, bank officials and others. The banks, individually and as consortiums, have been desperately attempting to recover their dues, by auctioning off vehicles, expensive artefacts, paintings, Nirav C. Modi's huge seaside bungalow 'Roopanya' in Alibaug (Raigad) was demolished in March 2019, and efforts on to auction off various properties-assets seized from the 'mama-bhanja' tricksters. However, long before the scam exploded on the Indian banking industry and sparked a nationwide furore, many of the accused had sneaked out of the country and Nirav D. Modi is currently in London and Mehul C. Choksi is in the tiny nation of Antigua &amp; Barbuda Isles in the Caribbean region, and efforts are on to get them extradited to India.

Nirav Modi's solar power plant up for auction to salvage PNB dues

The February 3 auction of two prime properties in <keyword id="2094" type="General" weightage="50" keywordseo="pune" source="Orion">Pune</keyword> worth around Rs 18 crore - belonging to absconding diamantaire <keyword id="740578" type="General" weightage="80" keywordseo="nirav" source="Orion">Nirav</keyword> <keyword id="6354642" type="General" weightage="100" keywordseo="modi" source="Orion">Modi</keyword> - apparently proved a dud as it failed to attract buyers. Accordingly, the Debt Recovery Tribunal-I (DRT-I), Mumbai, Recovery Officer Ashu Kumar last Thursday ordered the re-auction of the two flats owned by Modi and others in one of the cases filed by Punjab National Bank (<keyword id="47268" type="General" weightage="80" keywordseo="pnb" source="Orion">PNB</keyword>) -- but at a slashed rate now. The e-auction of these properties is considered another desperate attempt to recover a part of the PNB's staggering dues of nearly Rs 11,777 crore, calculated till March 20, 2023. Incidentally, the PNBs figure of outstanding was Rs 11,653 crore till February 2023 which has increased by Rs 124 crore. The assets to be e-auctioned are: two adjoining flats (Nos. 1601 &amp; 1602) on the F1 building, 16th floor of the YOOPUNE housing scheme at Hadapsar, Pune, measuring 398 sq. metres and 395 sq. metres. The PNB has set a reserve price of Rs 8.10 crore (down from Rs 8.99 crore) and Rs 8.04 crore (down from Rs 8.93 crore), for the two flats, respectively, which shall go under the e-hammer on March 20. The DRT-I has issued an auction notice on February 9 to the defaulter companies: Stellar Diamonds, Solar Exports, Diamond R US, ANM Enterprises Pvt. Ltd, NDM Enterprises Pvt. Ltd. Besides these companies, the others named are their promoters, owners, directors like Nirav D. Modi, Ami Nirav Modi, Rohin N. Modi, Ananya N. Modi, Apasha N. Modi, Purvi <keyword id="1727509" type="General" weightage="50" keywordseo="mayank-mehta" source="Orion">Mayank Mehta</keyword>, Deepak K. Modi, Neeshal D. Modi and Nehal D. Modi, who have been issued notices as certified debtors owing a whopping Rs 7,029-crore to the PNB. The e-auction may help the PNB and a consortium of around 15 other banks recover a tiny portion of their massive dues, unpaid for the past five years since the country's mega-banking scam was admitted in February 2018, a month after Nirav, his wife Ami and others fled India. After the PNB's complaint on the estimated scam of over Rs 14,000 crore, the Central Bureau of Investigation (CBI) registered the first offences in January 2018 and others like Enforcement Directorate (ED) and Income Tax Department (ITD) also entered the picture. The targets of the central probe agencies were the two prime accused - Nirav D. Modi and his maternal uncle Mehul C. Choksi - both having flown the coop well before the scam erupted and shook the foundations of India's banking sector. Later, it came to light that Modi was holed up in London and Choksi had cosily settled as a citizen of Antigua &amp; Barbuda Isles in the West Indies, both awaiting their extradition to India - probably, soon. On the upcoming e-auction, the PNB said it is not aware if these two properties have any liabilities, encumbrances, dues, or any claims made on them and shall be on 'As is where is basis' and 'As is what is basis', as usual. In the past, the ED-ITD have managed to auction off certain movable and immovable assets - certain properties, expensive paintings, artefacts, high-end vehicles, etc., - to recover small parts of the banks' dues. Last week, the DRT-I Recovery Officer Ajeet Tripathi put up the <keyword id="14764280" type="General" weightage="50" keywordseo="hcl-house" source="Orion">HCL House</keyword> in Marol for e-auction - plus three other lots of properties - to recover a portion of the outstanding of a staggering Rs 22,13,16,39,411. When it went on the block in September 2022, the unsold HCL House, comprising the entire building with the land, carried a reserve price tag of Rs 52 crore, which has now been slashed to Rs 40 crore, as per the DRT-I announcement. Besides, the DRT-I has put on the auction block other assets of Modi, including Offices No. 2001-2002 on the 20th floor of the posh Peninsula Park B in Lower Parel with a reserve price of Rs 66 crore, plus over Rs 1.72 crore outstanding maintenance dues till December 2021. Another property of Modi, the 6th floor of the Mafatlal Centre in Nariman Point along with four parking slots will also go under the e-hammer with a reserve price of Rs 62 crore, besides unpaid maintenance charges for five years coming to over Rs 1.17 crore till May 2022. Modi's huge residential 4-BHK flat in Grosvenor House at Peddar Road is going up for auction sale with a reserve price of Rs 15.87 crore, further details of which are not available. Modi also has another address in the prestigious Al Shera Towers, Dubai. The encumbrances or outstandings of HCL House and Grosvenor House are not known and all the properties shall be auctioned off on the basis of 'as is where is' and 'as is what is'. The e-auction is scheduled for February 10 - a week after the DRT-I ordered the sale of Modi's two tony flats in the YOOPUNE housing scheme in Pune, valued at a total of Rs 18 crore, on February 3. The income tax department of India, today, auctioned the seized artwork paintings at the Saffron Art Gallery in Mumbai. <a href="https://www.indiatoday.in/india/story/nirav-modi-paintings-go-under-hammer-fetch-over-rs-54-crore-for-income-tax-department-1487311-2019-03-27">According to media reports</a>, the government recovered nearly ₹548 million by selling 55 of the 68 paintings during the bidding session that went on for more than two hours. However, the income tax department expected to recover ₹970 million from the event. The collection, in total, fetched ₹609 million. The auction included bidders from London, New York and New Delhi among others, bidding online for the paintings. As the auction took place, on Wednesday, Camelot Enterprises. Nirav Modi’s company, has filed a petition against the auction of paintings in the Bombay High Court calling the move unlawful. The company also said a few of those paintings are actually company’s assets, demanding to restrict the auction. Ranging from thousands to millions, the paintings were the artwork by renowned Indian painters including Raja Ravi Verma, FN Souza, Jogen Chowdhury, VS Gaitonde and Akbar Padamsee. For instance, Raja Ravi Verma’s oil on canvas from 1881 was sold at ₹140 million. Of the 55 painting sold during the auction, the highest amount fetched from a painting was recorded at ₹220 million and nearly 10 paintings touched the ₹<a href="https://indianexpress.com/article/india/nirav-modi-in-london-prison-his-art-under-mumbai-hammer-i-t-recovers-rs-54-8-crore-5644486/">10 million mark</a>. While, the 13 unsold paintings include a few by Chinese painters including a Miao Xiaochun piece. The paintings were sold at a Goods &amp; Services Tax (GST) of 12% along with a 15% commission for the auction house. Nirav Modi’s legal team is expected to file the second bail application in the UK court on Friday since he denied the first bail application on March 20. The CBI will send a team to Londom for the hearing on 29 March, ANI reported. The auction was conducted by Saffronart on behalf of the deputy director, Enforcement Directorate, and was expected to garner a minimum of Rs 40 crore in proceeds.A collection of 112 prized assets of Modi were put up for live and online auctions from March 3 to 5, which included major artworks by contemporary and modern Indian artists, designer handbags, luxury watches and cars.While the online auction on March 3-4 garnered Rs 2.04 crore against the expected proceeds of Rs 52 lakh, the live auction on Thursday garnered Rs 51.41 crore more.These assets, seized by the ED, were put on auction in an attempt to recover a part of the dues Modi owes to various banks.According to officials from Saffronart, the ED would get Rs 53.45 crore from the proceeds of these two auctions. The Director General of the Central Industrial Security Force (CISF) and officers from the Directorate General of Civil Aviation (DGCA) and Bureau of Civil Aviation Security (BCAS) also attended the meeting. According to sources, recent incidents of misbehaviour in airlines also emerged during the meeting that lasted nearly 30 minutes. The meeting was held in view of the news regarding misbehaviour by an Air India flyer, who allegedly urinated on a co-passenger in an inebriated state on a flight from New York to Delhi. Mumbai-based <keyword id="290030" type="General" weightage="50" keywordseo="shankar-mishra" source="Orion">Shankar Mishra</keyword> has been accused of urinating on an elderly passenger in the November 26 New York to Delhi flight. Apart from expressing anger against the man, the elderly woman had reportedly also accused the Air India staff of being 'deeply unprofessional' in her complaint. Mishra was later arrested by the Delhi Police from Bengaluru. The arrest came a day after he was sacked by his California-headquartered employer Wells Fargo. The Air India case has triggered outrage on social media. A similar incident was reported on another recent flight of Air India. On Friday, the Delhi Commission for Women (DCW) had issued a notice to the Delhi Police over alleged harassment and misconduct by passengers. The company also announced that its 149cc-155 cc bike range in the country would now come with <keyword id="8136580" type="General" weightage="80" keywordseo="traction-control-system" source="Orion">Traction Control System</keyword> (TCS) as a standard feature. Yamaha used to offer only R15M and R15V4 with the TCS and now FZS-Fi V4 Deluxe, FZ-X and MT-15 V2 Deluxe would also come with the technology. The traction control system controls the ignition timing and fuel injection volume to instantly adjust engine power output to avoid excessive slippage. This ensures efficient delivery of power to the wheel and minimising wheelspin. The company stated that the 2023 motorcycle line-up now comes equipped with onboard diagnostics (OBD-II) system, a requirement for the upcoming stricter emission norms which will kick in from April 1 this year. "While our present strategy is filled with action to keep customers engaged and excited, we also never forget our responsibility to provide a carbon-neutral future for mobility. Entire motorcycle range to be E-20 compliant by end of the year: Yamaha

<keyword id="2573" type="General" weightage="20" keywordseo="air-india" source="Orion">Air India</keyword>'s handling of an incident in which an inebriated male flier allegedly urinated on a woman co-passenger suggests an urgent need for stricter rules to deal with <keyword id="128966" type="General" weightage="20" keywordseo="unruly-passengers" source="Orion">unruly passengers</keyword>, according to legal and aviation experts. Instances of inappropriate conduct on <keyword id="6367662" type="General" weightage="20" keywordseo="flights" source="Orion">flights</keyword> have gone up in the recent past because airlines try to cover up such incidents due to their commercial interests, the experts said. According to police, the male passenger, Shankar Mishra, allegedly urinated on a woman co-passenger in her 70s in the business class of the Air India flight from New York to Delhi on November 26 last year. Delhi Police registered an FIR against him on January 4 on a complaint given by the woman to Air India and arrested him from Bengaluru on Saturday. To prevent such incidents in future, the experts said, the Civil Aviation Requirements (CAR) of 2017 for handling of unruly passengers should be amended. The Directorate General of Civil Aviation (DGCA) framed the rules in 2017 after the then Shiv Sena MP Ravindra Gaikwad assaulted an Air India staff member. Under these rules, unruly behaviour by a passenger onboard a flight is a punishable offence. Supreme Court lawyer Ujjawal Anand Sharma said lodging an FIR in all cases of unruly behaviour by passengers onboard flights should be made compulsory under CAR, 2017. "I think there is a need to amend it (CAR, 2017) and make it compulsory to lodge an FIR in all cases of unruly behaviour onboard (flights) irrespective of the level of seriousness (of the offence)," said Sharma, who had represented stand-up comedian Kunal Kamra in the alleged unruly behaviour case in the Delhi High Court. Sharma, who is also a Partner at Lawmen &amp; White law firm, said, "It should be made part of the SoP (standard operating procedure) to inform the local police after the aircraft lands. Also, I believe that instead of an internal committee of an airline, there should be an independent committee under the DGCA which should be informed about every case of unruly behaviour." This will also help airlines avoid allegations of hushing up the matter. According to CAR, 2017, the captain and the crew of a flight are supposed to inform the airline about a passenger's unruly behaviour once the aircraft lands at its destination airport. The airline will present the case before its internal committee which comprises a retired district session judge and two independent members. "Pending decision of the Internal Committee, the concerned airline may ban such unruly passenger from flying, but such period may not exceed a period of 30 days," the rules state. According to the rules, "The Internal Committee shall give the final decision in 30 days by giving the reasons in writing. The decision of the Internal Committee shall be binding on the airline concerned. In case the Internal Committee fails to take a decision in 30 days, the passenger will be free to fly." CAR, 2017 grades offences into three categories and once the internal committee decides the level of offence and imposes a ban on the passenger, the decision has to be communicated to the DGCA/other airlines and the person should be put on the no-fly list. Such a passenger can be banned for a minimum of three months in case of a level 1 offence and a maximum of two years for a level 3 offence. The rules necessitate lodging an FIR only in extreme cases of aggressive behaviour by a passenger which may cause the aircraft to make an emergency landing. Nishant Kr. Srivastava, a criminal lawyer and Founder of Actus Legal Associates &amp; Advocates, said an unruly passenger should be barred from flying with any airline till the inquiry is pending. "The present norms say that an unruly passenger will be banned from flying for 30 days till the Internal Committee of that particular airline decides his/her case. Meanwhile, he can fly with other airlines. It should be made more deterrent by banning him from flying with any airline," he said. Mohit Chand Mathur, a senior advocate in the Delhi High Court, underlined the need for timely implementation of the existing legal provisions to avoid a repeat of such incidents. On January 5, the DGCA pulled up the Tata Group-owned Air India, saying prima facie it emerges that provisions related to handling of unruly passengers were not complied with. It said Air India's conduct appeared to be "unprofessional". A US-based doctor who was seated next to the accused spoke out about the November 26 incident, alleging the flight crew showed "no compassion" and failed in their responsibility on several counts as they made the woman talk to the man after his "indecent exposure" and she was made to go back to her soiled seat. Aviation professionals also stressed the need for stricter punishment to bring down instances of unruly behaviour by passengers. "It is the responsibility of the government and the industry to impose and implement strict rules against such offenders," said Sharad Kumar, director, Chennai Airport. Crew members should be better trained to handle such situations, he said. "The male passenger (who urinated on his co-passenger on the Air India flight) should be banned across airports. He should not be allowed to enter any airport for at least a year," said industry expert R Ramkumar. Air India has issued show cause notices to four cabin crew and one pilot of its New York-Delhi flight and de-rostered them pending investigation. The airline's CEO and Managing Director Campbell Wilson said on Sunday that "we fell short of addressing this situation the way we should have". He said the airline will "review and repair every process to prevent or address any incidents of such unruly nature".
