Homme did not respond to Insider's request for comment about which airline she was flying or to find out more about her flight experience. The video, posted July 13, has accumulated 7.4 million views — and thousands of comments calling out the bizarre seat structure."Absolutely not. Full refund," one of the top-liked comments said. According to the <keyword id="10036463" type="UNKNOWN" weightage="20" keywordseo="new-unlock-guidelines">new unlock guidelines</keyword> issued on Saturday schools and hostels will reopen from January 22 for students of class 10 and 12. The guidelines said churches will be allowed to open with 50% sitting capacity or 200 <keyword id="2278432" type="ORGANIZATION" weightage="20" keywordseo="attendees">attendees</keyword> on every Saturday and Sunday noon time from first February. Churches in Christian majority Mizoram are closed since March 22 last year due to COVID-19 pandemic. The new guidelines also said any student intending to join his or her hostel must produce a COVID-19 negative certificate obtained within 96 hours before entry into the hostel. Higher institutions for undergraduate and postgraduate students will be allowed to open from February and training or coaching institutes will also open with either 50 per cent sitting capacity or not more than 50 students from now onwards, the order said. The <keyword id="2378610" type="PERSON" weightage="20" keywordseo="maximum-number">maximum number</keyword> of attendees in funeral and marriage reception has been raised from 35 to 100. The number of attendees in indoor games, cinema hall, auditorium, community hall and social events (indoor) is fixed at 50. In any function related to organisation or party, the number of attendees allowed is 100 but deputy commissioners can allow up to 150 attendees by special permission. The lines between influencer’s personal content and paid content have become blurry, almost indistinguishable from regular posts. As per the guidelines, all advertisements published by social media influencers or their representatives, on such influencers’ accounts will be expected to carry a disclosure label that clearly identifies it as an advertisement. Disclosure is required if there is anything of value given to mention or talk about the advertiser’s product or service and it is supposed to be placed in a manner that is hard to miss. Influencer marketing has been witnessing an exponential growth in India in the past few years. According to digital marketing agency AdLift, India's influencer market is estimated at $75-150 million a year, as compared to the global market of $1.75 billion. And the year 2020 pushed businesses of various kinds and sizes to further experiment with digital solutions as all activities from attending concerts and birthday parties to fitness sessions moved from the physical realm to digital. Today, Indian audiences are watching more online videos than ever before. Nielsen studies show that home-bound consumers have led to a 60% increase in the amount of video content watched globally. So, as more and more Indians get connected to the internet, they discover and interact with a multitude of brands on a daily basis. ASCI’s new guidelines, experts said, will help give a structure to the industry, will elevate the level of trust between customers, influencers and brands. However, every new initiative will face questions on its practicality. That debate is necessary to create a sustainable solution. Hence, in my opinion, the current recommendations might not be applicable to every influencer or every tool of influencer marketing. The lines are a little blurred. For instance, a non-monetary association under which an influencer shares an unbiased product review will be labeled as an AD, leaving consumers in a tough spot. This will be difficult to implement for a tech or an auto influencer as they cannot buy every product for review as they are of high monetary value, and in fact, not all the reviews are positive as well so they cannot be labeled as an AD. Furthermore, organic and value-added content creation with genuine product integration is being given priority by the brands, agencies as well as influencers at the moment and the current recommendations might not be aligned with this objective. For a YouTube content creator with long-format vlogs labeling the entire integration section as an AD will lead the audience to ignore the content even if it is adding value to them. A mention of 5-10 seconds should suffice rather than a full-length mention. I believe platform labels like ‘Includes paid promotion’ and ‘Paid partnership with’ on YouTube and Instagram respectively, offer that clarity for sponsored posts. This is sufficient to highlight that the integration is paid. However, additionally, the creators can put a supplementary hashtag to make it more visible. So, we will have to wait and watch how this unfolds.” <cmsannotation type="cmsannotation" annotationid="Rajni Daswani, Director, SoCheers:" text="Rajni Daswani, Director, SoCheers:">Rajni Daswani, Director, SoCheers:</cmsannotation> The guidelines are a good guardrail in the industry that has been unregulated so far. The fact that the guidelines are not extremely stringent and do rely on influencers to see that they do justice, leaves room for brands to explore ways to circumvent around it. A lot will depend on how influencers &amp; brands adapt to it. Many brands are averse to the whole #Ad &amp; #Sponsored and may now start drawing parallel compares to paid media, which might see the investment in influencer marketing take a slight hit, after the phenomenal growth year that it has had. These guidelines will be like a double-edged sword for creators as well. While they will get a lot more say in putting out content that will work on their pages, influencers/creators who are doing a lot of branded content might see a hit in their engagement &amp; reach numbers. Quality content will continue to win nonetheless. It is the night light to keep nightmares away. But, that may no longer be the case with India’s new social media regulations. The Indian government thinks that it has found a loophole. It claims that it does not care about what messages are being passed around, but if an incident is found to have been instigated through social media, they want to know who started it all — they want to find the ‘first originator’. <div type="Article" hostid="261" msid="81208643" title="Facebook and Twitter have a ton of new rules to abide by in India ⁠— WhatsApp may find itself in the toughest spot of all" mstype="2" mssubtype="0"></div> “We don’t want the content, because the content is already out there in the form of tweets or messages. But, who began the mischief? This, they [social media platforms] will have to disclose,” said the Minister of Electronics and Information Technology (MeitY), <keyword id="6354886" type="PERSON" weightage="20" keywordseo="Ravi-Shankar-Prasad">Ravi Shankar Prasad</keyword>, while announcing India’s new IT rules on February 26. The catch-22 here is, “Who came first, the chicken or the egg?” Without being able to peep at the content, how can one know who started a particular incident? To break or not break encryption End-to-end encryption is a fairly simple concept. This means that no-one except for you and the person you are sending messages to, can peep into your conversations. The content is private and according to India’s Supreme Court, <a href="https://www.businessinsider.in/indias-supreme-court-judgements-2018/articleshow/67253782.cms">privacy is a fundamental right</a>. However, if platforms like WhatsApp do not adhere to the new IT rules, they will be answerable to the Indian government. “Failure to do so will make these intermediaries liable for any illegal third-party information that is made available or hosted by them without their consent and may even lead to an end of their operations,” Neeraj Dubey, partner of corporate law at Singh and Associates, told Business Insider. Like the tech giant Apple told the Federal Bureau of Investigation (<a href="https://www.businessinsider.in/tech/everything-you-need-to-know-about-apples-heated-battle-with-the-fbi-over-the-locked-san-bernardino-iphone/slidelist/51230781.cms">FBI</a>) back in 2016, if the encryption is strong enough, even the companies implementing it have no say in unlocking it. According to the Silicon Valley firm, creating a backdoor that voids encryption would <a href="https://www.businessinsider.in/John-Oliver-explains-why-the-Apple-FBI-debate-is-more-complicated-than-it-seems/articleshow/51398803.cms">unlock</a> a whole new set of security threats for users. “We don't know how the government expects platforms to comply with this requirement without breaking encryption,” noted Mishi Choudhary, the legal director of the Software Freedom Law Centre (SFLC). “It will limit the choices of users who have now come to expect encrypted messaging services as an essential part of their communications habits.” In the past, when the government has asked WhatsApp to identify the origin of messages, the Facebook-owned messaging service has always <a href="https://www.businessinsider.in/indias-demands-to-whatsapp-are-easier-said-than-done/articleshow/65497255.cms">turned down such requests</a> citing end-to-end encryption. “You can only tell how many times a thing has been forwarded. You can’t go back and trace the source in that context. If you are doing that, then it means you are reading the content,” Tarun Pathak, associate director with global analysis firm Counterpoint Research, told Business Insider. Even if a platform like WhatsApp were to break encryption in order to adhere with the government guidelines, it would be violating its own rules and regulations. “For an intermediary to collect the content of the messages, which it would need to trace the first originator of information, this would mean breaking encryption and storing the content of messages on servers, which would constitute violation of privacy guidelines,” explained Dubey. Social media may not be entirely doomed According to Induslaw’s Avimukt Dar, the underlying intent of the law is not to break encryption. “In the event the identity of the person sending the message is already visible to the messaging platform under its data harvesting protocols then it can be shared on lawful request without breaking double encryption,” he told Business Insider. WhatsApp offers users the option to back up their chats and messages onto the cloud — a change the company brought in <a href="https://www.businessinsider.in/whatsapp-data-may-shift-to-the-cloud-but-may-no-longer-be-as-encrypted/articleshow/65475359.cms">three years ago</a>. “Once the chats are backed up on a cloud storage platform, they are no longer protected by end-to-end encryption and can be accessed by Intermediary or any other third party,” said Dubey. Moreover, in the past, the Indian government has suggested alternative means of tracing messages like <a href="https://www.businessinsider.in/whatsapp-fingerprint-messages-to-avoid-encryption-issues-with-indian-government/articleshow/69836927.cms">digital fingerprints </a>or <a href="https://www.businessinsider.in/whatsapp-messages-origin-can-be-traced-says-iit-madras-professor/articleshow/70603973.cms">embed a user’s information within the messages themselves</a>. Not that WhatsApp has complied because until now, intermediary platforms — like Whatsapp, Telegram, and Signal — have benefitted from the safe harbour protection available to them. “However, the safe harbour rules are also subject to compliance with the IT Act and the rules framed by the government,” explained Tanu Banerjee, a partner at legal consultancy firm Khaitan &amp; Co. Terms and conditions apply The government has mandated that finding the ‘first originator’ will only be in cases where the penalty is greater than five years. This includes instances where there may be a threat to India’s national sovereignty, security of state, public order, and other scenarios laid out under Section 69 of the IT act. This also implies that there has to be a valid court order in order to ask for the ‘first originator’. “The rules clarify that such an order should not be passed if less intrusive means are effective in identifying the originator,” explained Banerjee. Encryption is a hurdle that these companies will have to address on their own. For users, the bigger question is around freedom of speech. Section 69 of the IT Act is not very clear with respect to what constitutes a valid threat. What may be right for me, may not be right for you. “It is something that is needed but it should be executed in a way that the framework is clear at least,” said Pathak. Within the new rules, India has not specified who will be making the decision of whether or not the line has been crossed. With a wiggle of three months, it is possible that the guidelines can be tweaked to find a balance between what companies like WhatsApp are capable of, what users want and what the government is hoping to achieve at the end of the day. Influencer marketing has been witnessing a steady growth in India in the past few years. Today, Indian audiences are watching more online videos than ever before. It was time to take a step forward towards building a transparent advertising ecosystem. <keyword id="6456080" type="COMPANY" weightage="20" keywordseo="nielsen">Nielsen</keyword> studies show that home-bound consumers have led to a 60% increase in the amount of video content watched globally. ASCI, in its statement said that the guidelines for influencers advertising on digital media will be available for all stakeholders, including industry, digital influencers as well as consumers for feedback till March 8, 2021. Based on the feedback and inputs, the final guidelines will be issued by ASCI by 31st March, 2021. This guideline will be applicable to all promotional posts published on or after 15th April 2021. The most important guideline on prominent labelling has been rightfully specified for each social media channel – will help the consumer from getting misguided by influencer advertisements. The guidelines have ensured three prominent things: • Any content where the brand has paid the influencer and has had reasonable control over the content needs to be called out as 'advertisement'. • Influencer must make it obvious that the content is an 'advertisement'.
