The apex court had earlier highlighted the aspect of misleading advertisements being published or displayed in media contrary to the provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and the rules, the <keyword id="21538574" type="General" weightage="20" keywordseo="Drugs-and-Cosmetics-Act" source="keywords">Drugs and Cosmetics Act</keyword>, 1940, and the <keyword id="20003685" type="General" weightage="20" keywordseo="Consumer-Protection-Act" source="keywords">Consumer Protection Act</keyword>, 1986. A bench of Justice Hima Kohli and Justice Sandeep Mehta was hearing a plea filed by the <keyword id="20083252" type="General" weightage="20" keywordseo="Indian-Medical-Association" source="keywords" meta.keywordsubtype="org" meta.entityname="Indian Medical Association" meta.hostid="261" meta.entityid="Indian Medical Association">Indian Medical Association</keyword> (IMA) alleging a smear campaign by <keyword id="21257004" type="General" weightage="20" keywordseo="Patanjali-Ayurved-Ltd" source="keywords" meta.keywordsubtype="org" meta.entityname="Patanjali Ayurved Ltd" meta.hostid="261" meta.entityid="Patanjali Ayurved Ltd">Patanjali Ayurved Ltd</keyword> against the Covid vaccination drive and modern systems of medicine. The bench noted that the lack of proper data regarding action taken on the complaints received leaves the consumers helpless and in the dark. "The Ministry of Ayush must set up a dashboard citing complaints received... so that the data comes in the public domain," the bench observed. It added that the data can also help in addressing the issue of prosecution under the Drugs and Cosmetics Act. The top court was informed that in several states, a number of complaints regarding misleading advertisements were forwarded to other states as the firms manufacturing those products were based there. The bench noted that the number of complaints made by the consumers, which was over 2,500 earlier, has gone down to only around 130 and the main reason appears to be that the grievance redressal mechanism for dealing with such complaints has not been properly publicised. It asked the ministry concerned to look into this issue and file an affidavit within two weeks. The apex court bench also dealt with the aspect concerning manufacturing licences of 14 products of Patanjali Ayurved Ltd and Divya Pharmacy. The Uttarakhand State Licensing Authority (SLA) on April 15 issued an order suspending the manufacturing licences of 14 products of Patanjali Ayurved Ltd and Divya Pharmacy. However, the state licensing authority later filed an additional affidavit in the apex court stating the suspension order has been cancelled following a report by a high-level committee which examined the grievances of Patanjali Ayurved Ltd in the wake of the row. On May 17, it said the operation of the April 15 order was paused and the suspension order was cancelled on July 1. During the hearing on Tuesday, the counsel appearing for the IMA told the apex court bench about the cancellation of the suspension order. "What is the status today?" the bench asked. The counsel appearing for Uttarakhand said that after the July 1 order, a fresh notice was issued to Patanjali and the SLA received a reply from Patanjali on July 19. When the state's counsel said they have sought legal opinion in the matter, the bench asked, "How much time do you need to wrap up the matter after hearing them?". When the counsel said they needed three to four weeks, the bench asked, "Why?". It told the state to pass an order pursuant to the show cause notice before the next date of hearing and communicate the same to Patanjali. It also dealt with the issue related to its May 7 directive, which said that before an advertisement was printed, aired or displayed, a self-declaration shall be submitted by the advertiser or advertising agency on the lines contemplated in Rule 7 of the Cable Television Networks Rules, 1994. Rule 7 of the 1994 rules deals with the advertisement code and stipulates that advertisements carried in the cable service shall be designed to be in conformity with the laws and should not offend the morality, decency and religious susceptibilities of the subscribers. The top court on May 7 said self-declaration shall be uploaded by the advertiser or advertising agency on the 'Broadcast Sewa Portal' run under the aegis of the Ministry of Information and Broadcasting. During the hearing on Tuesday, Additional Solicitor General K M Nataraj informed the bench that the ministry had convened a meeting of all stakeholders on June 30 in which 40-odd parties participated to discuss the issue. He said another meeting was held in July and some time was needed to collate all the information and give recommendations. The bench granted two weeks to the ministry to do the needful. When Nataraj said some stakeholders have sought more time to give suggestions, the bench said, "They have to hurry up and pull up their socks." On May 14, the apex court reserved its order on the contempt notice issued to yoga guru Ramdev, his aide Balkrishna and Patanjali Ayurved Ltd in the misleading advertisements case. Patanjali Ayurved Ltd assured the top court on November 21 last year that it will not violate any law, especially those relating to advertising or branding of products manufactured and marketed by it. It had also assured the bench that "no casual statements claiming medicinal efficacy or against any system of medicine will be released to the media in any form". The top court had said Patanjali Ayurved Ltd is "bound down to such assurance".

Apple’s poor performance has been attributed to the absence of new models from the company and the overall economy. Samsung on the other hand reported a decline of 5.8% from 7.1 million units shipped in Q1 2023 to 6.7 million units in Q1 2024. Similar to Apple, the lack of new products is the reason for Samsung’s decline in shipments. Huawei shipped 2.9 million units in Q1 2024, up from 2 million units in Q1 2023, recording a 43.6% growth in shipments. Large smartphones, such as foldables and thinner laptops have reduced the popularity of tablets. While companies like Samsung, Huawei and Xiaomi have their foldable phones, Apple is still lagging in this department. “The attrition driven by competition from PCs and smartphones will contribute to a lacklustre outlook for the tablet market. That said, there is potential upside driven by AI capabilities similar to what's expected in other device types,” added Nataraj. Worldwide tablet shipments grow in Q1 2024 after two years of decline

"With no significant improvements to the economy and consumers allocating their money to things beyond consumer electronics, tablets may not be very high on the priority list. Tablet shipments hit a 12-year low declining by over 20% in 2023

Nataraj also quarterbacked cybersecurity firm NortonLifeLock's roughly $8.5 billion merger with digital-security firm Avast last August.This year, he helped Vocera Communications in its $3 billion sale to Stryker in January, and in March, Nataraj advised healthcare firm Intelligent Medical Objects in its sale to investor Thomas H. Apple shipped 10.8 tablets with 35.2 per cent share in Q1, followed by Samsung at 23.1 per cent share and shipping 7.1 million units. Huawei was third with 6.6 per cent share (2 million units), according to preliminary data from from the International Data Corporation (IDC). Worldwide tablet shipments posted decline of 19.1 per cent (year-over-year) in the first quarter of 2023, reaching 30.7 million units. The low shipment volume is now comparable to pre-pandemic levels. Shipment volume in 1Q23 was comparable to the 30.1 million units shipped in Q1 2019 and 31.6 million in Q1 2018. "Tablet vendors entered the first quarter of 2023 with caution. As expected, both commercial and consumer volumes were low as macro environment remained uncertain throughout Q1," said Anuroopa Nataraj, senior research analyst with IDC's Mobility and Consumer Device Trackers. According to the report, sell-in shipment in the first half of 2023 is expected to be low, with vendors focusing on clearing out their inventory before the launch of newer models. Chromebook shipments also continued to contract in Q1 with shipments totalling 3.8 million units for a year-over-year decline of 31 per cent year over year. "Despite the downturn in tablet shipments, there's some reason for optimism as more vendors are paying attention to the space," said <keyword id="1591500" type="General" weightage="50" keywordseo="jitesh-ubrani" source="Orion">Jitesh Ubrani</keyword>, research manager. "<keyword id="2210217" type="General" weightage="50" keywordseo="oneplus" source="Orion">OnePlus</keyword>' recent launch and the upcoming Pixel Tablet from Google are clear signs that there's appetite from the supply side," he added. Wall Street: Coinbase flew too close to the sun

The Centre assured the <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> on Monday that the counselling process of NEET-PG will not commence till the top court decides the challenge to 27 per cent reservation for <keyword id="45661" type="General" weightage="20" keywordseo="OBC" source="Orion">OBC</keyword> and 10 per cent for <keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword> category in PG All India Quota seats (MBBS/BDS and MD/MS/MDS) from the current academic session. A bench of Justices D Y Chandrachud and B V Nagarathna recorded the assurance given by Additional Solicitor General (ASG) K M Nataraj, appearing for the Centre, and observed that students will be in serious problem if the counselling process goes ahead as scheduled. The assurance by Nataraj was given after senior advocate Arvind Dattar, appearing for some NEET candidates, mentioned that as per the schedule announced by the Director General of Health Services, the counselling process for the NEET-PG is to commence from October 25. He said that by the time the court decides the pending batch of petitions, challenging the July 29 notification, introducing the reservation from academic year, the entire process of admission will be over and serious prejudice would be caused to the students. Nataraj said the communication which counsel for petitioner is referring to was sent only to the medical colleges for verification of seats and one more clarificatory notification has been issued on Monday. The counselling process will not begin till the court decides the pending batch of petitions, the ASG submitted. The bench said that it is taking the word on record. We will take your word on record that counselling process will not start till we decide the batch of petitions one way or the other. You know, students will be in serious problem, if the process continues, the bench said. Nataraj agreed with the observation of the court and said that if there is any problem at all in the future, the petitioner's counsel can contact him directly. On October 21, the top court had asked the Centre whether it would like to revisit the limit of rupees eight lakh annual income, fixed for determining the Economically Weaker Sections (EWS) category for reservation in NEET admissions for medical courses. The top court had clarified that it is not embarking into the policy domain but is only trying to ascertain whether constitutional principles have adhered or not. It had asked the Ministry of Social Justice and Empowerment and the Department of Personnel and Training (DOPT) to file their affidavits in a week's time and had formulated questions to be answered by the Centre. The top court had said, Tell us if you want to revisit the criteria or not. If you want us to discharge our duties, then we are ready to do so. We are formulating questions which you need to answer them . It had added, We may stay the government notification fixing rupees eight lakh criteria for determining the EWS and you can keep filing the affidavits . The top court was hearing a batch of pleas challenging the Centre and Medical Counselling Committee (MCC) July 29 notice providing 27 per cent reservation for Other Backward Class (OBC) and 10 per cent for EWS category in the National Eligibility cum Entrance Test (NEET) admissions for medical courses. It had asked searching questions from Centre, and asked whether any exercise was undertaken before fixing a limit of Rs 8 lakh annual income for determining the EWS category. It had said the court is not going to tell the government as to what should be the limit whether it should be rupees four lakh or rupees six lakh because it is for the executive to decide but all it wants to know is on what basis Rs. 8 lakh criteria was fixed. For determining creamy layer in Other Backward Classes (OBC) category the limit was fixed as Rs 8 lakh annual income and they were considered progressed class among OBCs and they were excluded from reservation benefits. Here, for the EWS category, the limit is the same Rs 8 lakh annual income but it was for inclusion in the reservation benefits, the top court had said. On October 7, the top court had posed searching questions to the Centre on its decision to fix a limit of rupees eight lakh annual income for determining the EWS category for reservation in NEET admissions. The Centre had then said fixing a limit of Rs eight lakh annual income for the EWS category is a matter of policy based on the National Cost of Living Index. On September 17, the top court has agreed to hear a batch of pleas of students against the July 29 notice providing 27 per cent reservation for OBC and 10 per cent for EWS category in 15 per cent UG and 50 per cent PG All India Quota seats (MBBS/BDS and MD/MS/MDS) with effect from the current academic session 2021-22. New Delhi, May 8 () The Supreme Court Friday asked states to consider non-direct contact or online sales and home delivery of liquor during the lockdown period to prevent the spread of coronavirus on account of crowding at the shops. A bench of Justices Ashok Bhushan, Sanjay Kishan Kaul and B R Gavai, which took up the matter through video conferencing, disposed of the plea challenging the guidelines issued by Ministry of Home Affairs (MHA) on May 1, allowing sales of liquor through direct contact sales during the lockdown period."The bench directed that States may consider allowing non-direct contact sales or online sales or home delivery of liquor during these times," advocate Sai Deepak, appearing for petitioner Guruswamy Nataraj said after the hearing.During the hearing, he argued that there are 70,000 liquor vends across the country and over five crore people have till now purchased liquor from these shops.He said that due to social distancing norms not being followed at the liquor vends and shops, there has been rise in Covid-19 cases.Deepak contended that the results, which have been achieved in over a month-long nationwide lockdown will be nullified as the coronavirus graph, which was earlier flattening, is now showing a sharp rise.He sought issuance of fresh MHA guidelines or directions for prohibition of sale of liquor at vends and shops through direct contact during the lockdown period or till the National Disaster Management Authority announces India to be Covid-19 free.To this, the bench said that discussion is already going on for allowing online sale of liquor or its home delivery.Deepak said he only wanted that life of a common man should not be affected due to this direct sale from vends and MHA should issue clarificatory guidelines and states should abide by it. The bench then directed the state to consider online sales or home delivery of liquor during the lockdown period and disposed of the matter. On May 1, the MHA has issued fresh guidelines while announcing a "limited" lockdown which includes suspension of air, train and inter-state road travel for two more weeks from May 4 across the country, but some activities was allowed after classifications of districts into 'Red', 'Orange' and 'Green' zones based on COVID-19 risk profiling.According to the health ministry, there are 130 'Red' zones in the country with maximum of 19 in Uttar Pradesh, followed by 14 in Maharashtra in the country. The number of 'Orange' Zone is 284 and 'Green' is 319. All the districts of the national capital have been put under 'Red' zone.As per the new guidelines, sale of liquor, paan, tobacco to be allowed after ensuring minimum six-feet social distancing; not over 5 persons at one time at shop. The number indicates that business conditions in the region moved into expansion mode from contractionary territory last month.
Economists were expecting a slighter gain – to -3.0 – which would have indicated a continued contraction in the region.

<h3 style="padding-left: 30px;">Indicators Suggest Increased Activity</h3>
The survey’s broadest measure of manufacturing conditions, the diffusion index of current activity, increased from a reading of -12.5 in February to 2.0 this month (<a href="http://www.phil.frb.org/research-and-data/regional-economy/business-outlook-survey/2013/bos0313chart.jpg" title="Chart of General Activity" class="colorboxImage cboxElement">see Chart</a>).* The demand for manufactured goods also showed improvement this month: The new orders index increased from a reading of -7.8 in February to 0.5, its first positive reading in three months. The shipments index showed continued improvement: The index remained positive and edged higher to 3.5. The percentage of firms reporting increased shipments (25 percent) was still only slightly greater than the percentage reporting declines (22 percent).
Labor market conditions showed continued signs of stability, but little overall growth. The employment index increased from 0.9 in February to 2.7 this month, its second consecutive positive reading. The percentage of firms reporting employment increases (17 percent) narrowly exceeded the percentage reporting decreases (14 percent). Firms also reported a decline of average work hours this month. The workweek index declined 11 points.
<h3 style="padding-left: 30px;">Indexes Indicate Little Price Pressure</h3>
The survey’s price indexes suggest little price pressures again this month. For the third consecutive month, the prices received index was slightly negative. The percentage of firms reporting lower prices for their own manufactured goods (9 percent) exceeded by a slim margin the percentage reporting higher prices (8 percent). With regard to purchased inputs, 17 percent of firms reported paying higher prices for inputs, compared with 13 percent last month. The prices paid index edged slightly lower and is now at its lowest reading in nine months.
<h3 style="padding-left: 30px;">Six-Month Indicators Improve</h3>
The survey’s future indicators suggest that firms expect growth in business over the next six months. The future general activity index increased slightly from a reading of 32.1 to 32.5, its fourth consecutive monthly increase (<a href="http://www.phil.frb.org/research-and-data/regional-economy/business-outlook-survey/2013/bos0313chart.jpg" title="Chart of General Activity" class="colorboxImage cboxElement">see Chart</a>). The percentage of firms expecting increases in activity over the next six months (46 percent) exceeded the percentage expecting decreases (13 percent). The indexes for future new orders and shipments showed a mixed pattern this month. The future new orders index decreased 4 points, while the future shipments index increased 1 point. The future employment index fell notably, from 14.9 to 8.1. Twenty-four percent of firms expect to increase employment over the next six months; 16 percent expect to decrease it.
In special questions this month, firms were asked about their expectations for capital spending for 2013 compared with 2012 (<a href="http://www.phil.frb.org/research-and-data/regional-economy/business-outlook-survey/2013/bos0313.cfm#sp">see Special Questions</a>). Over 39 percent of the firms indicated that total capital spending would increase this year compared with 2012; 32 percent indicated that spending would decrease. With the exception of noncomputer equipment, most categories of planned capital spending were being scaled back this year. Among firms that did not plan to increase capital spending, the most cited reasons were low sales growth, low capacity utilization, and limited need to replace capital and technology equipment.

The March Business Outlook Survey indicated an improvement in the region’s manufacturing sector this month. Most notably, the indicators for general activity and new orders improved markedly, and the survey broadly recorded positive readings this month. Responses suggest that firms expect further increases in business over the next six months. Although firms are generally optimistic, restrained capital spending plans are in evidence.
