"At the outset we are surprised to note the contents of your email which are baseless, unsubstantiated and far from the truth. We deny the same," IDBI Trustee said in the letter to Reliance Capital administrator. "We note that said purported allegation has been raised as the said letter supposedly refers to the concerns raised in our letter dated August 16. It is stated that merely because the said article refers to the concern raised in our aforesaid letter does not in any manner whatsoever establish or even suggest, to say the least, that the same has been published at our behest. You are strictly put to proof in this regard. On the contrary, this only reflects that your email (including the allegations made therein) have been made without taking any efforts to verify the factual position," IDBI Trustee said. "As a reputable professional trustee company, we are diligent about the sensitivity of the information involved and are bound by the undertaking furnished by us in relation to the same. IDBI Trustee asks RCap administrator to withdraw allegations of breach of confidentiality

A bench comprising Chief Justice D Y Chandrachud and Justice J B Pardiwala said the voluminous objections to the draft constitution by various stakeholders can be taken care of by Justice <keyword id="6619" type="General" weightage="20" keywordseo="rao" source="Orion">Rao</keyword> after hearing parties concerned. "We are of the view that it will be appropriate to defer this exercise (of finalising the constitution) since these are not issues of law but matters of policy dealing with running sport of football in India. Bearing in mind that the case of Indian Olympic Association was handled by Justice L N Rao, we entrust Justice Rao with the task of formulating the AIFF constitution. We request him to take the draft constitution prepared and finalise a report. In finalising the report Justice Rao is requested to hear all stakeholders," the court said. It said the exercise of considering the draft constitution and preparing a comprehensive report be completed by July 31. Earlier, the top court on April 5 had said that it will hear on May 2 a batch of pleas on issues related to the AIFF, including objections raised to certain aspects of its draft constitution. The stakeholders include the Federation Internationale de Football Association (FIFA) and sports bodies in the country. SC entrusts ex-judge Rao with task of preparing report on finalisation of constitution of AIFF

The <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> on Thursday set aside a Punjab and <keyword id="41646" type="General" weightage="100" keywordseo="haryana" source="Orion">Haryana</keyword> High Court order granting an interim stay on a Haryana law providing 75 per cent <keyword id="13194078" type="General" weightage="20" keywordseo="Quota-In-Private-Sector-Jobs" source="Orion">quota in private sector jobs</keyword> for residents of the state. A bench of justices <keyword id="4368791" type="General" weightage="20" keywordseo="L-Nageswara-Rao" source="Orion">L Nageswara Rao</keyword> and <keyword id="13194079" type="General" weightage="20" keywordseo="Pamidighantam-Sri-Narasimha" source="Orion">Pamidighantam Sri Narasimha</keyword> also directed the Haryana government not to take coercive action against employers. "We do not intend to deal with merits of matter as we propose to request the high court to decide expeditiously and not later than four weeks. Parties are directed not to seek adjournment and be present before court for fixing the schedule for hearing. "In the meanwhile, Haryana is directed not to take coercive action against employers. The impugned order passed by the high court is set aside as the high court has not given sufficient reasons for staying the legislation," the bench said. At the outset, Solicitor General Tushar Mehta, appearing for the Haryana government, informed the bench that similar laws have been passed in four states Andhra Pradesh, Jharkhand, Maharashtra and Haryana. The bench then asked Mehta what his instructions were as it had earlier sought to know whether parties concerned are agreeable that cases pertaining to quota in the private sector on the basis of domicile be considered together. "Do you want us to transfer all the pending cases back here? Should we decide or decide on the stay and send the matter back to the high court," the bench asked. The solicitor general suggested that the top court should examine the issue and meanwhile the Punjab and Haryana High Court order should be stayed. He said the law only applies to those who get a salary less than Rs 30,000 and it is not for high-paid jobs. He further submitted that the Haryana State Employment of Local Candidates Act, 2020 was a means to regulate migrants from settling in other states. Mehta referred to several judgements in which it has been held that there is presumption of legality of statute and it not stayed unless prima facie illegal. "We are only concerned with employment as we have migrant labour of over four crore in this country. We are first concerned with livelihood," the bench said. Senior advocate Dushyant Dave, appearing for the Faridabad Industries Association, submitted this has far-reaching consequences in the economic sector and the core issue is whether the government can impose reservation in the private sector on the basis of domicile. Dave said there has been application of mind in staying of the legislation and the high court was prima facie satisfied that the legislation is unconstitutional for which it was stayed. He said over 48,000 companies registered in Haryana would be put to suffering as they cannot employ anybody from outside the state from the date of commencement of the Act. "This is private sector reservation which has no basis in the Constitution... Is this the way the legislature can act? If this law is applicable for even a day, then there will be daily prosecutions. The law provides serious penalties. There are nine lakh companies," Dave said, adding that even associations can raise the issue of the public. The bench intervened, and said, "We are not on merits. What we are on is how the high court immediately delivered an interim order." Representing the Manesar Employees Association, senior advocate Shyam Divan said it will have a destructive effect on ongoing businesses. "It will have a profound impact on business...The division bench (of the high court) considered it correctly. Let this be treated as an interim order. Do not vacate this order...Assuming there is no stay to be granted, they ought not to take any coercive steps," Divan said. The order came on an appeal filed by the Haryana government challenging the Punjab and Haryana High Court order granting an interim stay on its law providing 75 per cent quota in private sector jobs for residents of the state. The high court on February 3 had granted an interim stay on the Haryana government law on pleas filed by various industry associations from Faridabad and other bodies in the state including in Gurugram. The high court admitted multiple petitions against the implementation of the Haryana State Employment of Local Candidates Act, 2020, the counsel of one of the petitioners had said. The Act provides 75 per cent reservation in the private sector to job seekers from the state and came into force from January 15 after being notified in November last year. It applies to jobs offering a maximum gross monthly salary or wages of Rs 30,000. The Act is applicable to employers of private sector companies, societies, trusts, limited liability partnership firms, partnership firms, and any person who employs 10 or more persons on salary, wages, or other remuneration for manufacturing, carrying on business, or rendering any service in Haryana. In March 2021, Haryana Governor Bandaru Dattatreya had given his assent to the Haryana State Employment of Local Candidates Bill, 2020. The claim of Rs 659 crore was rejected by the administrator which has been challenged in NCLT which is currently hearing the case. However, Torrent Investments was made aware that a competing resolution applicant Hinduja Group had belatedly submitted a revised financial proposal on December 22 after completion of the challenge process on December 21 and after having learnt that Torrent Investments had emerged as the highest bidder. The apex court's May 31 order, uploaded on its site on Wednesday, was critical of the Centre's decisions on liberalized vaccination policy, differential pricing of vaccines for Centre, states and private hospitals, basis of such a norm and mandatory registration on CoWIN App for booking slots for jabs in view of huge digital divide between rural and urban India and sought response from the government on its queries in in two weeks. The apex court said that in grappling with the second wave of the COVID pandemic, it does not intend to second-guess the wisdom of the executive when it chooses between two competing and efficacious policy measures. The court, however, added that it will continue to exercise jurisdiction to determine "if the chosen policy conforms to the standards of reasonableness, militates against manifest arbitrariness and protects the right to life of all persons". "Constitution does not envisage courts to be silent spectators when constitutional rights of citizens are infringed by executive policies", the bench said in its order in a hard hitting response to the Centre's submissions in an affidavit that the judiciary should not enter into the policy making domain. "The Union Budget for Financial Year 2021-2022 had earmarked ₹35,000 crore for procuring vaccines. In light of the Liberalized Vaccination Policy, the <keyword id="6357307" type="COMPANY" weightage="20" keywordseo="Central-Government">Central Government</keyword> is directed to clarify how these funds have been spent so far and why they cannot be utilized for vaccinating persons aged 18-44 years," said a special bench of Justices D Y Chandrachud, L Nageswara Rao and S Ravindra Bhat. "We direct the Union of India(UoI) to undertake a fresh review of its vaccination policy addressing the concerns raised," said the order which is a part of a series of judicial decisions rendered on the suo motu case on COVID-19 management in the country. Finding fault with the vaccination policy, it said unlike the previous one, it did not prioritize persons with comorbidities and this became important in view of the fact that in the second wave, persons between 18-44 years of age have suffered severe effects of infection including deaths in unfortunate cases. "Due to the changing nature of the pandemic, we are now faced with a situation where the 18-44 age group also needs to be vaccinated, although priority may be retained between different age groups on a scientific basis. "Hence, due to the importance of vaccinating individuals in the 18-44 age group, the policy of the Central Government for conducting free vaccination themselves for groups under the first 2 phases, and replacing it with paid vaccination by the State/UT Governments and private hospitals for the persons between 18-44 years is, prima facie, arbitrary and irrational," Justice Chandrachud said in the 32-page order. <keyword id="6354525" type="COMPANY" weightage="20" keywordseo="healthcare">Healthcare</keyword> workers and those above 45 years figured in the first two phases. The court asked the Centre to provide the data on the percentage of population that has been vaccinated (with one dose and both doses), as against eligible persons in the first three phases of the vaccination drive. "This shall include data pertaining to the percentage of rural population as well as the percentage of urban population so vaccinated," it said asking the Centre to furnish each and every detail sought. The bench also sought "complete data" of the Centre's purchase history of all the COVID-19 vaccines-- <keyword id="9485939" type="PERSON" weightage="20" keywordseo="covaxin">Covaxin</keyword>, <keyword id="9617748" type="LOCATION" weightage="20" keywordseo="covishield">Covishield</keyword> and Sputnik V-- till date. "The data should clarify: (a) the dates of all procurement orders placed by the Central Government for all 3 vaccines; (b) the quantity of vaccines ordered as on each date; and (c) the projected date of supply; and an outline for how and when the Central Government seeks to vaccinate the remaining population in phases 1, 2 and 3." The court has sought information on the steps being taken by the Centre to ensure drug availability for mucormycosis which is also called 'Black Fungus'. Taking note of the Centre's reply that states and UTs will provide vaccination free of cost to its population, the court said it is important that individual states and UTs may "confirm or deny" this position before this Court. "Further, if they have decided to vaccinate their population for free then, as a matter of principle, it is important that this policy is annexed to their affidavit, so that the population within their territories can be assured of their right to be vaccinated for free at a state vaccination centre. "Hence, we direct each of the State/UT Governments to also file an affidavit within 2 weeks, where they shall clarify their position and put on record their individual policies," the bench said. Trashing the Centre's objection that judiciary should not enter into the policy making domain, the bench said it is trite to state that separation of powers is a part of the basic structure of the Constitution and policy-making continues to be in the sole domain of the executive. "The judiciary does not possess the authority or competence to assume the role of the executive, which is democratically accountable for its actions and has access to the resources which are instrumental to policy formulation. However, this separation of powers does not result in courts lacking jurisdiction in conducting a judicial review of these policies. "Our Constitution does not envisage courts to be silent spectators when constitutional rights of citizens are infringed by executive policies. Judicial review and soliciting constitutional justification for policies formulated by the executive is an essential function, which the courts are entrusted to perform." The top court asked the Centre to clarify its stand on the roadmap of the projected availability of vaccines till 31 December 2021, the preparedness with respect to specific needs of children in the event of a third wave of the pandemic in terms of medical infrastructure, vaccination trials and regulatory approval, and compatible drugs. It has sought information whether under the Centre's policy, it is permissible for the states and UTs or individual local bodies to access vaccine supplies of foreign manufacturers. The court also sought numbers of crematorium workers vaccinated in phase one and asked whether a targeted drive can be conducted for vaccination of the remaining workers in this category. "The State/UT Governments are diverting the vaccines (procured by them at a higher price than Central Government) for the persons in the age group of 18-44 years to vaccinate persons above 45 years of age, due to a shortage of vaccines being supplied by the Central Government. "The manner in which the Central Government will factor this quantity and price differential into their subsequent allocation and disbursal of vaccines to States/UTs for the persons above 45 years of age; and the mechanism for redistribution, if the 25:25 quota in a particular State/UT is not picked up by the State/UT Government or the private hospitals," the order said while seeking details. Supreme Court slams Centre's COVID-19 vaccination policy for being 'arbitrary and irrational' — demands to know details on money spent on vaccine shots

New Delhi, Apr 6 () Court hearing in congregation must become an "exception" during the "extraordinary outbreak" of COVID-19 pandemic and it is necessary that all courts respond to the call of social distancing to ensure they do not contribute to the spread of virus, the Supreme Court said on Monday.Passing a slew of directions for all courts across India, it said that the apex court and all the high courts are authorised to adopt measures required to ensure robust functioning of judicial system through the use of video conferencing.Observing that "technology is here to stay", the top court passed the directions by exercising its plenary power under Article 142 of the Constitution and said that all the measures which shall be taken by the courts to reduce physical presence of stakeholders within its premises "shall be deemed to be lawful".A bench headed by Chief Justice S A Bobde said, "consistent with the peculiarities of the judicial system in every state and the dynamically developing public health situation", every high court would be authorised to determine the modalities suitable to the temporary transition to the use of video conferencing technologies."All measures that have been and shall be taken by this court and by the high courts, to reduce the need for the physical presence of all stakeholders within court premises and to secure the functioning of courts in consonance with social distancing guidelines and best public health practices shall be deemed to be lawful," said the bench, also comprising Justices D Y Chandrachud and L Nageswara Rao.The bench said the outbreak of coronavirus or COVID-19 in several countries including India has necessitated immediate adoption of measures to ensure social distancing to prevent transmission of the virus, and the apex court as well as the high courts have adopted measures to reduce physical presence."Access to justice is fundamental to preserve the rule of law in the democracy envisaged by the Constitution of India. The challenges occasioned by the outbreak of COVID-19 have to be addressed while preserving the constitutional commitment to ensuring the delivery of and access to justice to those who seek it," the bench said, adding, "Court hearings in congregation must necessarily become an exception during this period."The top court directed that district courts in each states shall adopt the mode of video-conferencing prescribed by the concerned high court."The concerned courts shall maintain a helpline to ensure that any complaint in regard to the quality or audibility of feed shall be communicated during the proceeding or immediately after its conclusion failing which no grievance in regard to it shall be entertained thereafter," it said.The bench directed that courts shall duly notify and make available the facilities for video-conferencing for such litigants who do not have the means or access to such facilities. "If necessary, in appropriate cases courts may appoint an amicus-curiae and make video conferencing facilities available to such an advocate," it said, adding, "Until appropriate rules are framed by the high courts, video conferencing shall be mainly employed for hearing arguments whether at the trial stage or at the appellate stage."The apex court made it clear that in "no case shall evidence be recorded without the mutual consent of both the parties by video-conferencing".The bench said if it is necessary to record evidence in a courtroom, the presiding officer shall ensure that appropriate distance is maintained between any two individuals in the court.It directed that the presiding officer shall have the power to restrict entry of persons into the courtroom or the points from which the arguments are addressed by the advocates. "No presiding officer shall prevent the entry of a party to the case unless such party is suffering from any infectious illness. However, where the number of litigants are many the presiding officer shall have the power to restrict the numbers. The presiding officer shall in his discretion adjourn the proceedings where it is not possible to restrict the number," the bench said.While making it clear that "these directions shall operate until further orders", the top court said that these directives have been issued in "furtherance of the commitment to the delivery of justice."It said that cooperation of all the concerned stakeholders, like judges, lawyers and litigants, is indispensable in successful implementation of these directions to ensure that the judiciary rises to face the unique challenge presented by the outbreak of COVID-19. The bench has listed the matter for hearing after four weeks.It said that every individual and institution is expected to cooperate in the implementation of measures designed to reduce the transmission of coronavirus and the scaling down of conventional operations within the precincts of courts is a measure in that direction. SC issues guidelines for functioning of courts through video conferencing during COVID-19 pandemic

Expressing concern about over 1.5 lakh road mishaps, the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> has ordered a ban on all liquor shops on national as well as state highways across in India. 
 
The licenses of present shops at these highways will not be renewed after March 31 next year. 
 
A three-judge bench headed by Chief Justice T S Thakur also ordered to remove all signages indicating presence of liquor vends. 
 
The bench also comprising Justices D Y Chandrachud and L Nageswara Rao said the existing licenses of liquor shops across the highways will not be renewed after March 31, 2017. 
 
The top court took cognizance of more than 1.5 lakh fatalities every year in road mishaps. 
 
The apex court, while reserving verdict on December 7 on a batch of pleas seeking a direction to amend excise laws to ensure that no liquor is sold alongside highways, came down heavily on the Punjab government for seeking relaxation and permitting liquor shops near highways if they are "elevated" ones and the vend are under or near it. 
 
"Look at the number of licences you (Punjab) have given. Because the liquor lobby is so powerful, everyone is happy. The excise department is happy, the excise minister is happy and the state government is also happy that they are making money. If a person dies due to this, you give Rs one or 1.5 lakh. That is it. You should take a stand which is helpful for the society," the bench had said. 
 
Reminding the state government of its constitutional obligation to prohibit liquor sale, the bench had asked the state to do something for general public considering that nearly 1.5 lakh people were dying every year. 
 
The bench had also expressed unhappiness over alleged inaction by various states in removing liquor shops alongside roads which give rise to drunken driving and consequential fatalities.
