The lessors submitted before the high court that denial of deregistration by the Directorate General of Civil Aviation (DGCA) is "illegitimate". Justice <keyword id="14907621" type="General" weightage="50" keywordseo="tara-vitasta-ganju" source="Orion">Tara Vitasta Ganju</keyword>, who heard the arguments advanced by the petitioner lessors for over an hour and half, listed the matter for May 30 for hearing the submissions of the respondents. The high court also asked the parties to file written submissions a day before the next hearing. The lessors who have approached the high court are Accipiter Investments Aircraft 2 Limited, EOS Aviation 12 (Ireland) Limited, Pembroke Aircraft Leasing 11 Limited and SMBC Aviation Capital Limited. With a moratorium in force on financial obligations and transfer of assets of Go First in the wake of the insolvency resolution proceedings, the lessors are unable to deregister and take back the aircraft leased to the carrier. The lawyers for the lessors said they had approached the civil aviation regulator for deregistration of their aircraft but it rejected their pleas. They said they have not received any communication from the DGCA, but having checked the status of their applications on the regulator's website, they found their requests have been rejected. Senior advocate <keyword id="195903" type="General" weightage="50" keywordseo="mukul-rohatgi" source="Orion">Mukul Rohatgi</keyword>, appearing for one of the lessors, said the aircraft was its property and an interim resolution professional (IRP) has no power to take over assets of a third party. Senior advocate <keyword id="251871" type="General" weightage="50" keywordseo="dayan-krishnan" source="Orion">Dayan Krishnan</keyword>, representing EOS Aviation 12 (Ireland) Limited, said NCLAT cannot deal with the issue of deregistration of aircraft and the remedy lies under Article 226 of the Constitution as the issue is between the lessor and the DGCA. Another lawyer contended that under Irrevocable De-registration and Export Request Authorisations (IDERA), it was mandatory for the DGCA to deregister the aircraft at their request. The National Company Law Tribunal (NCLT) had on May 10 allowed the voluntary insolvency resolution plea by Go First. On May 22, the NCLAT upheld the order of the Delhi-based principal bench of NCLT, which had earlier this month admitted the plea of Go First to initiate voluntary insolvency resolution proceedings, and appointed an interim resolution professional (IRP) to suspend the company's board. Several lessors have approached aviation regulator for deregistration and repossession of Go First's 45 planes. Go First stopped flying from May 3. DGCA required to deregister aircrafts, Go First lessors tell Delhi HC

Senior advocates Mukul Rohatgi, A.M Singhvi, and Shyam Divan, represented the gaming companies' associations, submitted before a bench of Justices S. Abdul Nazeer and V. Ramasubramanian that the issue was whether it was game of skill or chance or gambling. The Karnataka government contended that cybercrime has become a major issue and cited filing of 28,000 cases in the last three years, while emphasising the need for a law against online gaming to maintain public order. It further argued that people have died by suicide and the online gaming has ruined many families, therefore it was necessary to deal with its ill effects. The state government's plea said: "The Karnataka Police (Amendment) Act, 2021 made criminalised wagering, betting or risking money on the unknown result of an event." On February 14 this year, the high court struck down the government's ban and the legal provision which criminalised playing games of skill, including online games, and betting. The top court issued notice to online gaming industry body All India Gaming Federation and skill-based gaming firms. It directed to tag this matter with a similar matter, where the Tamil Nadu government has challenged the judgment by the Madras High Court. The Karnataka High Court had said that the Act was unconstitutional and there cannot be any ban on online games of skill. The state government contended before the apex court that the high court had grossly erred in not taking into account the material produced by it in connection with cases registered by the police authorities. SC admits Karnataka govt plea on online gaming

The Supreme Court will give its order to end Karnataka’s political crisis tomorrow

As many as 10.52 lakh "bogus" PAN cards of individual <keyword id="6354751" type="COMPANY" weightage="20" keywordseo="Income-Tax">income tax</keyword> assesses, which is around 0.4 per cent of the total such documents, cannot be termed a "minuscule" number to harm the country's economy, the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> has said, according to a <keyword id="6367495" type="COMPANY" weightage="20" keywordseo="PTI">PTI</keyword> news report. The apex court said that it has come on record that 11.35 lakh duplicate or fraudulent permanent account numbers have been detected and out of these, 10.52 lakh cases pertain to individual assesses. It made the observations in a 157-page judgement while upholding the validity of section 139AA of the Income Tax Act making Aadhaar mandatory for allotment of PAN cards and filing of tax returns. The court, however, put a partial stay on its implementation till its Constitution Bench addressed the larger issue of right to privacy related to Aadhaar. Section 139AA of the Act provides for mandatory quoting of Aadhaar or enrolment ID of Aadhaar application form for filing of income tax returns and making application for allotment of PAN with effect from July 1 this year. "It was sought to be argued (by the petitioners) that persons found with duplicate/bogus PAN cards are hardly 0.4 per cent and, therefore, there was no need to have such a provision," a bench headed by <keyword id="391378" type="UNKNOWN" weightage="20" keywordseo="Justice-A-K-Sikri">Justice A K Sikri</keyword> said on Friday. "We cannot go by percentage figures. The absolute number of such cases is 10.52 lakh, which figure, by no means, can be termed as minuscule to harm the economy and create adverse effect on the nation," the bench, also comprising Justice <keyword id="247734" type="PERSON" weightage="20" keywordseo="Ashok-Bhushan">Ashok Bhushan</keyword>, said. Dealing with the submissions advanced by Attorney General <keyword id="195903" type="PERSON" weightage="20" keywordseo="Mukul-Rohatgi">Mukul Rohatgi</keyword> that duplicate PANs were used to divert funds to shell companies, the bench said, "The fact remains that companies are after all floated by individuals and these individuals have to produce documents to show their identity." It said if introducing Aadhaar in tax regime was one of the measures to check black money or money laundering, the scheme cannot be "denounced" only because of the reason that the purpose would not be achieved fully. "Such kind of a menace, which is deep-rooted, needs to be tackled by taking multiple actions and those actions may be initiated at the same time. "It is the combined effect of these actions which may yield results and each individual action considered in isolation may not be sufficient," it noted.

10.52 lakh bogus PAN cards will hurt economy badly

Senior Supreme Court advocate <keyword id="195903" type="PERSON" weightage="100" keywordseo="Mukul-Rohatgi">Mukul Rohatgi</keyword> has been appointed the new <keyword id="43805" type="POSITION" weightage="100" keywordseo="Attorney-General">Attorney General</keyword> of the country. Rohatgi was the front-runner for the post as he is considered to be close to Prime Minister Narendra Modi. 
 
“My priority would be to streamline the litigation process and cut down litigation between government departments and public sector undertakings. The new government will co-operate in this aspect as this government wants to change a lot,” said Rohatgi. 
 
Rohatgi was the BJP’s lawyer and defended the party in several cases, including the Babri Masjid demolition case. He also defended the BJP general secretary, Varun Gandhi, in a case regarding his alleged provocative speech in Uttar Pradesh in 2011. Only recently, the senior lawyer appeared for the yoga guru Baba Ramdev in a case related to his ‘honeymoon’ comment against Congress vice-president Rahul Gandhi. 
 Rohatgi had served as Additional Solicitor General in the Vajpayee government. He is also considered to be close to Finance Minister Arun Jaitley and Law Minister <keyword id="6354886" type="PERSON" weightage="60" keywordseo="Ravi-Shankar-Prasad">Ravi Shankar Prasad</keyword>. 
 
“They are my good friends. They will help me in my endeavour,” said Rohatgi about the ministers.

Mukul Rohatgi Appointed New Attorney
General

Senior Supreme Court lawyers <keyword id="195903" type="PERSON" weightage="80" keywordseo="Mukul-Rohatgi">Mukul Rohatgi</keyword> and <keyword id="6372817" type="PERSON" weightage="80" keywordseo="Harish-Salve">Harish Salve</keyword> have emerged as front-runners for the post of <keyword id="43805" type="POSITION" weightage="80" keywordseo="Attorney-General">Attorney General</keyword> for India. Both of them bring plenty of legal acumen to the table. 
 
Harish Salve's heavy professional commitment will be taken into consideration before finalising the decision, people familiar with the discussions about picking the Attorney General told The Economic Times. 
 
"I have also read news stories that suggest that I am a front-runner (for the A-G's post). I am sure it has some basis," Salve told ET. 
 
He also said due process demands that there should be a law minister first who can make the offer. 
 
Salve had served as the Solicitor General of India from November 1, 1999, to November 3, 2002. He succeeded Santosh Hegde, after the latter was appointed as a judge to the Supreme Court. 
 
Mukul Rohatgi, the other choice for the A-G's post, said he had not been approached yet. However, he is one of the busiest lawyers in the Supreme Court and need not chase anything. 
 
Rohatgi, considered to be close to Jaitley, has been counsel in many significant cases that involved BJP interests.

Salve, Rohatgi Front-runners For Attorney General’s Post

NEW DELHI: The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> on Wednesday cancelled 214 <keyword id="6356966" type="ORGANIZATION" weightage="100" keywordseo="Coal">coal</keyword> block allocations, giving the owners six months time to wind up their work. 
 A bench, headed by <keyword id="42759" type="POSITION" weightage="60" keywordseo="Chief-Justice">Chief Justice</keyword> RM Lodha, saved only four blocks — one belonging to <keyword id="45179" type="CITY" weightage="60" keywordseo="NTPC">NTPC</keyword> and SAIL each and two allocated to Sasan ultra mega power projects — from being cancelled.
 The bench, also comprising justices Madan B Lokur and <keyword id="108280" type="PERSON" weightage="80" keywordseo="Kurian-Joseph">Kurian Joseph</keyword>, granted six months breathing time to mining companies to wind up their operations in the coal blocks.
The saved four coal mines' allottes will pay government an additional levy of Rs 295 per tonne of coal extraction. 
 
The top court said it has given six months breathing time to functioning plants to arrange for coal from other sources. 
 
SC said government’s stand that it was prepared for cancellation of allocation as logical consequence of the court’s judgment declaring all allocations illegal and arbitrary helped it in arriving at a decision quickly on fate of coal blocks.

The bench also directed the companies, which were allocated coal blocks but had not operationalized them, to pay a compensation to the government for the loss of exchequer. It accepted the findings of the CAG which came to the conclusion that the loss of Rs 295 per tonne was caused due to the non-operation of the mines. 
 
The apex court had on August 25 held that all coal blocks allocation since 1993 by various regimes at the Centre have been made illegally and arbitrarily. 
 
During an earlier hearing in the case, the UPA govt had opposed cancellation of coal blocks allocation saying that around Rs 2 lakh crore had been invested by various companies after blocks were alloted to them.

Supreme Court Cancels All But Four Coal Blocks Allocated Since 1993

Due to the power shortage in the country, the Centre has requested the <keyword id="6354977" type="ORGANIZATION" weightage="100" keywordseo="Supreme-Court">Supreme Court</keyword> exempt 46 coal mines that it had pronounced illegal from cancellation as they were either producing or were close to producing power. 
 <keyword id="43805" type="POSITION" weightage="60" keywordseo="Attorney-General">Attorney General</keyword> <keyword id="195903" type="PERSON" weightage="60" keywordseo="Mukul-Rohatgi">Mukul Rohatgi</keyword> said that the government was open to re-auction the <keyword id="122769" type="UNKNOWN" weightage="100" keywordseo="coal-blocks">coal blocks</keyword> in case allocations are cancelled. 
According to a media report, Rohatgi asked the court not to refer the issue to a committee as “it would further delay coal auctions.” 
 
The Supreme Court had earlier said that all the coal blocks allocated between 1993 and 2011 were illegal. "All allocations were done in an illegal manner and it suffers from vice of arbitrariness," it pronounced. 
 
A bench headed by Chief Justice R M Lodha said that the allocation by the screening committee was not “fair and transparent.” 
 
However, it gave its nod to the continuation of the coal blocks allocations to ultra mega power projects but forbade them from using the coal for any purpose. 
 
According to analysts, large-scale cancellation of coal blocks would further escalate the shortage of coal for power plants.

Govt Requests SC To Refrain
From Cancelling 46 Coal Blocks

Expanding the scope of its hearing in the <keyword id="19980518" type="General" weightage="20" keywordseo="Patanjali" source="keywords">Patanjali</keyword> Ayurved case, the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="266" meta.entityid="Supreme Court">Supreme Court</keyword> on Tuesday took a stern view of <keyword id="20610549" type="General" weightage="20" keywordseo="misleading-advertisements" source="keywords">misleading advertisements</keyword> by FMCG firms and asked three Union ministries to inform it about the steps they have taken to curb the practice which takes "public for a ride" and adversely affects their health. The court passed the order after Yoga guru Ramdev and his aide Balkrishna of Patanjali Ayurved Ltd. told a bench of Justices Hima Kohli and Ahsanuddin Amanullah that they have issued unqualified public apology in as many as 67 newspapers over misleading advertisements and are willing to issue additional advertisements expressing their contrition. The bench said the public apology published in newspapers were not on record and asked those to be filed within two days. It posted the matter for April 30 for further consideration. While hearing the Patanjali case, the apex court said the implementation of the relevant provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, the Drugs and Cosmetics Act and the Consumer Protection Act and the related rules also needed a closer examination. It said the issue was not limited to Patanjali but extended to all Fast-Moving Consumer Goods (FMCG) firms which have been issuing "misleading advertisements and taking the public for a ride, in particular affecting the health of babies, school-going children and senior citizens who have been consuming products on the basis of the said misrepresentation". "We must clarify that we are not here to gun for a particular party or a particular agency or a particular authority. This is a PIL, and in the larger interest of the consumers, public should know which way they are going and how and why they can be misled, and how authorities are acting to prevent it," the bench said. The court asked the Union ministries of consumer affairs, information and broadcasting, and information technology to explain what action they have taken to prevent the misuse of consumer laws. It also sought an explanation from the Centre over an August 2023 letter issued by the Ministry of Ayush to the licencing authorities of all states and Union Territories and drug controllers of Ayush asking them to not initiate any action under rule 170 of Drugs and Cosmetics Rules, 1945. The bench also asked the <keyword id="20083252" type="General" weightage="20" keywordseo="Indian-Medical-Association" source="keywords" meta.keywordsubtype="org" meta.entityname="Indian Medical Association" meta.hostid="266" meta.entityid="Indian Medical Association">Indian Medical Association</keyword> (IMA), the petitioner in the Patanjali advertisements case, to "put its house in order". It said several complaints have been made about alleged unethical acts by members of the IMA who prescribe highly expensive medicines and line of treatment. The bench also ordered impleading the National Medical Commission (NMC) as a respondent in the matter for effective assistance to the court. At the outset, senior advocate Mukul Rohatgi, appearing for Ramdev and Patanjali Ayurved Ltd managing director Balkrishna, told the bench they have issued on Monday unqualified apology for the "lapses" on their part. "Where? Why it is not filed?" the bench asked. Rohatgi said it was issued on Monday in 67 newspapers across the country. When the court asked the senior advocate why did the respondents wait for a whole week before publishing the public apology, Rohatgi said, "Its language had to be changed". The court also quizzed him about the size of advertisements. "Is it the same size of advertisements that you normally issue in newspapers?" it asked Rohatgi, who submitted "It costs tens of lakhs (of rupees)". The bench ordered that the apology published be filed on record and added it wanted to see the actual advertisement published in newspapers. "The said advertisements are not on record. It is submitted that the same have been collated and shall be filed in the course of the day with copies to counsel for the parties. Needful shall be done within two days with copies to counsel for the parties," it said. The counsel said additional advertisement shall be issued by Ramdev and Balkrishna tendering unqualified apology for the lapses on their part. The bench said it was necessary to implead the three central ministries in order to examine the steps taken to prevent the abuse of the Drugs and Magic Remedies (Objectionable Advertisements) Act and rules, the Drugs and Cosmetics Act and the Consumer Protection Act. It said these ministries shall file affidavits enunciating the action they have taken to prevent the misuse/abuse of these statutes along with the relevant data since 2018. The bench said licencing authorities of all states and UTs shall also be impleaded as co-respondents in the matter. The bench told the IMA's counsel that while they are pointing fingers at Patanjali, "the other four fingers are also pointing at you (IMA)". On April 16, the apex court had warned Ramdev and Balkrishna against any attempt to "degrade allopathy" and permitted them to tender a "public apology and show contrition" within a week in the contempt proceedings in the misleading advertisements case against Patanjali Ayurved Ltd. The apex court is hearing a plea filed in 2022 by the IMA alleging a smear campaign against the Covid vaccination drive and modern systems of medicine. Ramdev and Balkrishna had earlier tendered an "unconditional and unqualified apology" before the top court over advertisements issued by the firm making tall claims about the medicinal efficacy of its products. Supreme Court expands Patanjali misleading ads hearing to include FMCG companies

The <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords">Supreme Court</keyword>, on Tuesday, granted one-week time to yoga guru <keyword id="20055079" type="General" weightage="100" keywordseo="Ramdev" source="keywords">Ramdev</keyword>, his aide <keyword id="21172332" type="General" weightage="20" keywordseo="Balkrishna" source="keywords">Balkrishna</keyword> and <keyword id="20083247" type="General" weightage="20" keywordseo="Patanjali-Ayurved" source="keywords" meta.keywordsubtype="org" meta.entityname="Patanjali Ayurved" meta.hostid="261" meta.entityid="Patanjali Ayurved">Patanjali Ayurved</keyword> to issue a <keyword id="114576" type="General" weightage="20" keywordseo="public-apology" source="Orion">public apology</keyword> in the misleading advertisements case, but said it was not letting them "<keyword id="2308348" type="General" weightage="20" keywordseo="off-the-hook" source="Orion">off the hook</keyword>" now. Both Ramdev and Balkrishna were present during the hearing and personally tendered an unqualified apology to the apex court. A bench of Justices Hima Kohli and Ahsanuddin Amanullah took note of their apologies, but made it clear that at this stage it has not decided to "let them off the hook". "You are doing good work but you can't degrade allopathy," the bench told Balkrishna while interacting with him. Ramdev, who also interacted with the bench, said he had no intention to show disrespect to the court in any manner. However, the bench told Balkrishna that they (<keyword id="6356684" type="General" weightage="20" keywordseo="patanjali" source="Orion">Patanjali</keyword>) are not so innocent that they didn't know what the top court had said in its earlier orders in the case. "I am willing to give a public apology," senior advocate Mukul Rohatgi, appearing for Ramdev and Balkrishna, told the bench at the outset. The apex court asked Ramdev and Balkrishna, both of whom were present in the court, to come forward for an interaction with the bench. "They should feel they have a connect with the court," the bench said. The apex court has now posted the matter for further hearing on April 23. Ramdev and Balkrishna had last week tendered an "unconditional and unqualified apology" before the top court over advertisements issued by the firm making tall claims about the medicinal efficacy of its products. In two separate affidavits filed in the court, Ramdev and Balkrishna have tendered an unqualified apology for the "breach of the statement" recorded in the November 21 last year order of the apex court. In the November 21, 2023 order, the top court had noted that counsel representing Patanjali Ayurved had assured it that "henceforth there shall not be any violation of any law(s), especially relating to advertising or branding of products manufactured and marketed by it and, further, that no casual statements claiming medicinal efficacy or against any system of medicine will be released to the media in any form". The top court had said Patanjali Ayurved Ltd is "bound down to such assurance". The non-observance of the specific assurance and the subsequent media statements irked the apex court, which later issued a notice to them to explain why contempt proceedings be not initiated against them.
