Ather Energy sold just 1,279 EV two-wheelers for the full month of July from selling 3,829 vehicles in June -- a massive drop in numbers -- followed by <keyword id="4393078" type="General" weightage="50" keywordseo="ola-electric" source="Orion">Ola Electric</keyword> which sold 3,852 vehicles from 5,891 vehicles in June. Ampere Vehicles Pvt Ltd, which sold 6,542 vehicles in June, saw a minor drop at 6,312 vehicles last month. Based on the information of fire incidents available, the Ministry of Road Transport and Highways issued a show-cause notice to the CEOs and MDs of the electric two-wheeler manufacturers concerned, to explain the reasons as to why the relevant sections of the <keyword id="6377804" type="General" weightage="50" keywordseo="motor-vehicles-act" source="Orion">Motor Vehicles Act</keyword> should not be invoked against them. The Central Consumer Protection Authority (CCPA), which comes under the Ministry of Consumer Affairs, said this week that it issued notices to four to five EV two-wheeler makers in the light of several complaints raised by the consumers over battery explosions and fire incidents. The CCPA received several complaints from the EV two-wheeler buyers. The Defence Research and Development Organisation (DRDO) has also been informed. A DRDO probe had revealed defects in battery cells as well as battery design in nearly all EV fires. The government has granted permission to the Telangana Prohibition and Excise department to allow sale of liquor at retail outlets till midnight. It has also given permission for liquor to be served in bars, New Year events and in-house parties till 1 a.m. The department made it clear that this will be subject to observance of <keyword id="162487" type="COMPANY" weightage="20" keywordseo="Standard-Operating-Procedures">Standard Operating Procedures</keyword> (SOP) for Covid-19. All the three police commissionerates have announced a slew of measures to check drunken driving and New Year revelry on the roads. "So what are your plans tonight? Will meet you at special drive on drunken driving," the Hyderabad police tweeted. <keyword id="483117" type="ORGANIZATION" weightage="20" keywordseo="traffic-movement">Traffic movement</keyword> has been restricted on NTR Marg, Necklace Road and Tank Bund Road around Hussain Sagar lake. All flyovers in the city, except Begumpet flyover, will be closed on the intervening night of December 31 and January 1. Traffic will be diverted at various points to prevent gathering of revellers around the lake in the heart of the city. Buses, lorries, and heavy vehicles will not be allowed inside the city limits till 2 a.m. Hyderabad Police Commissioner Anjani Kumar said that extensive checks will be undertaken to curb drunken driving, rash and negligent driving, over speeding, and triple riding on two-wheelers and other traffic violations. Cyberabad Police Commissioner V. C. Sajjanar appealed to people to celebrate the New Year at home with family. "We all know that we are fighting Covid-19 and during these pandemic times it is important that we first think about our safety. Let's not celebrate New Year by organising social gathering, mass gathering, musical programmes and musical events. This time let us spend the New Year with our family and near and dear ones. Stay Home-Stay Safe." Every year, the Commissioner used to celebrate New Year Eve with police personnel by cutting a cake at the Cyber Towers junction. However, the celebration will not take place this tear due to the pandemic. Voicing his concern over the growing number of accidents due to drunken driving, the Commissioner announced that an intensive drive will be conducted to check the menace. Rachakonda Police Commissioner Mahesh Bhagwat also advised people to stay home safely and restrict their movements. Kamineni flyover, LB Nagar flyover, Sagar Ring Road flyover, LB Nagar underpass and Chintalkunta underpass will be closed for light motor vehicles, two-wheelers and passenger vehicles from 10 p.m. to 5 a.m. Police have warned that stringent action will be taken against those found driving under the influence of alcohol. The violators will be booked under section 185 of the <keyword id="6377804" type="DEFINITION" weightage="20" keywordseo="motor-vehicles-act">Motor Vehicles Act</keyword>, 1988. The offenders may face a penalty of ₹10,000 and/or imprisonment of up to 6 months for the first offence and a penalty of ₹15,000 and/or imprisonment up to 2 years for a second or subsequent offence. The police also warned that their driving licenses will be seized and sent to concerned road transport officers for suspension as per section 19 of the Motor Vehicles Act, 1988. For the first offence, the driving license will be suspended for 3 months and for second and subsequent offences, the driving license will be revoked permanently making the person ineligible to drive in India. New Delhi, Jan 8 () The Cabinet has been apprised of the amendments to the motor vehicles law that will ensure concurrence of state governments while formulating the National Transport Policy, the government said on Wednesday.
The new Motor Vehicles Act with stricter penalties for violation of traffic laws has come into force Pan-India from September 1, 2019.
"The Union Cabinet, chaired by Prime Minister Narendra Modi, has been apprised of information about the amendments moved to the Motor Vehicles (Amendment) Bill, 2019 as passed by the Rajya Sabha," the Ministry of Road Transport and Highways said in a statement.
Amendments will ensure concurrence of state governments while formulating the National Transport Policy and making schemes for national, multimodal and inter-state transportation of goods and passengers by the Centre, it said.
The Motor Vehicles (Amendment) Bill, 2019 was approved by the Cabinet in its meeting held on June 24, 2019 for re-introduction in the Lok Sabha. The Bill was passed in the Lok Sabha on July 23. Later, the Bill was taken into consideration by the Rajya Sabha on July 31 and was passed the same day.

COVID-19: Govt extends validity of Motor Vehicle Act related documents till Jun 30

Recently, the Union cabinet approved the Motor Vehicles (Amendment) Bill that has proposed some heavy penalties for traffic rules violations. The amendment now comes with some strict measures to deal with traffic violations in order to bring down the increasing number of road accidents and to cultivate responsible practices in how the roads are used by the Indian citizens. Here are some important implications of the motor vehicles amendment act 2019 you will have to know. Motor vehicles amendment Act 2019 The Motor Vehicles (Amendment) Bill 2019 has brought in some amendments to the provisions found under the <keyword id="674989" type="PERSON" weightage="20" keywordseo="Motor-Vehicles-Act-1988">Motor Vehicles Act, 1988</keyword>. Earlier the same bill had been passed in the Lok Sabha in the April of 2017. Since it could not get the clearance of the <keyword id="48510" type="COMPANY" weightage="20" keywordseo="Rajya-Sabha">Rajya Sabha</keyword>, it lapsed eventually with the dissolution of the 16th Lok Sabha. <keyword id="26680" type="PERSON" weightage="20" keywordseo="Nitin-gadkari">Nitin Gadkari</keyword>, the Union Minister for Road Transport and Highways tabled the bill in the Lok Sabha and the same was now passed this time successfully. How does a challan work before and after the Motor Vehicle Amendment Act 2019? A challan is an official text that the traffic controlling officer writes in a piece of paper and issues to the violator of traffic rules in India. If the challan is issued in an individual’s name, he or she is liable to pay the traffic fine as listed in the Motor Vehicles Act, 1988. The <keyword id="182080" type="PERSON" weightage="20" keywordseo="e-challan">e-challan</keyword> system introduced by the new amendment replaces the use of physical paper. Right from the breaking of traffic rules by the person and issuing of the challan through the payment of the corresponding traffic fine, there are several stages involved in the process and all of them have now been digitized by the amendment. The new e-challan system is a CCTV enabled one. The CCTV cameras installed in important locations on the Indian roads continuously record the footages of the ongoing traffic. When a motorist is seen violating the traffic, it will be recorded by the CCTV camera. The police will then trace the number of the vehicle from the footage recorded and register the offense in the records. The traffic police will find out the details of the vehicle and its owner from the Regional Transport Office (RTO). Once the details are received, the traffic police will send an SMS on the registered mobile number of the violator detailing the kind of violence, date, time and the details of fine or punishment according to the existing laws. The owners of the vehicle can pay the fine on the e-challan either online or offline. The traffic authority in India has created a dedicated website for paying the e-challan directly. The e-challan issued to the vehicle owner will have a unique serial number. This number has to be entered in the box provided on the site and the payment has to be made online. Alternatively, you can also pay the e-challan in offline mode by visiting the nearby police station. Third party insurance The government will launch a scheme for treating the road accident victims during the golden hour. Yet another scheme will also be launched to provide interim relief to the claimants who seek compensation under the third party insurance. The minimum compensation has been now increased from Rs. 25,000 to 2 lakh rupees in case of death and from Rs. 12,500 to Rs. 50,000 in case of grievous injury. The bill also needs that the government will institute a Motor Vehicle Accident Fund to provide compulsory cover to all the road users in India. The fund will be used to compensate the victims of hit and run accident.

Some important implications of Motor Vehicle Amendment Act 2019

New Delhi, Jan 6 () No state can lower traffic penalties below the level prescribed under the new Motor Vehicles Act, the central government said on Monday.
In an advisory to states, the road, transport and highways ministry said the Motor Vehicles (Amendment) Act, 2019 is a parliamentary legislation and the state governments cannot pass any law or take executive action to lower penalty below the prescribed limit unless President's assent has been been obtained to related state law.
The transport ministry had sought legal advice on this from the law ministry after one of the states had notified amounts for compounding of certain offences lower to what has been prescribed in the new Act.
The new Act with stricter provisions has come into force in the country from September 1, 2019.
"Ministry of Law and Justice has tendered their advice after seeking opinion of Attorney General of India. The Attorney General has inter alia observed as under: "The Motor Vehicles Act, 1988 (as amended by Motor Vehicles (Amendment) Act, 2019) is a Parliamentary legislation, the state governments cannot pass any law/take executive action to lower the penalty/fine below that prescribed under the statutory provisions of the Motor Vehicles Act, unless the assent of the President is obtained to such state law," the ministry said in an advisory to states.
The advisory to the principal secretaries of states also mentioned the legal opinion that in case of the failure of states to implement the Act, reference may be made to Article 256 of the Constitution that authorises the Union of India to issue directions to a state as may be necessary for the purpose.
Article 256 provides that the executive power of every state shall be so exercised as to ensure compliance with the laws made by Parliament and any existing laws which apply in that state, and the executive power of the Union shall extend to the giving of such directions to a state as may appear to the Government of India to be necessary for that purpose.
The advisory also quoted Attorney General's opinion that "the disobedience of these directions could well attract the provisions of Article 356 of the Constitution of India, and one could therefore proceed on the basis that the central law would implicitly be obeyed by the state governments".
The ministry said the objective of the Act and enhancement of penalties for traffic violations was to ensure greater compliance and enhancing deterrence for violation of traffic rules which is intended to provide for better road safety resulting in reduction of accidents and fatalities on roads. 
Earlier, the government had said that for certain offences Gujarat, Karnataka, Manipur and Uttarakhand had reduced the penalties.
Under the amended Act, violations such as drunken driving and dangerous driving attract fines of Rs 10,000 and/or imprisonment of six months to two years.
Penalty for driving without licence was increased to Rs 5,000 from Rs 500 earlier, while riding two-wheeler without helmets will not only attract fine of Rs 1,000 but could lead to suspension of licences for the next three months. NAM MKJ

States cannot lower fines below prescribed limits under Motor Vehicles Act: Centre

New Delhi, Nov 21 () As many as 38 lakh challans involving a total amount of Rs 577.5 crore have been issued since the implementation of the new motor vehicles law, Road Transport Minister Nitin Gadkari said on Thursday.
 However, in a reply to the Lok Sabha, Gadkari said the "challans are being referred to courts. Actual revenue is not available".
 "As per information available in the database of NIC (Vahan, Sarathi), 38,39,406 traffic challans in 18 states and union territories were issued," according to the reply.
 The challans involved a total amount of Rs 5,77,51,79,895, Gadkari said.
 The data is available for Chandigarh, Pondicherry, Assam, Chhattisgarh, Uttar Pradesh, Odisha, Delhi, Rajasthan, Bihar, Dadra and Nagar Haveli, Punjab, Goa, Uttarakhand, Tamil Nadu, Gujarat, Maharashtra, Himachal Pradesh, and Haryana.
 Tamil Nadu saw the highest number of challans at 14,13,996, While the least number of challans were recorded in Goa at 58.
 The government recently said it has no information about any state not implementing the Motor Vehicles (Amendment) Act, 2019.
 However, some states have reduced penalties in accordance with the powers granted to them under the Act.

Rs 577-crore challans issued so far since rollout of new Motor Vehicles Act: Govt

A three-day deadline has been has been set by the <a href="http://www.businessinsider.in/searchresult.cms?query=Transport+Department&amp;sortorder=effectivedate">Transport Department</a> for app-based cab aggregators to stop offering <a href="http://www.businessinsider.in/searchresult.cms?query=carpool&amp;sortorder=effectivedate">carpool</a> or shared services to consumers as the services are in violation of the <a href="http://www.businessinsider.in/searchresult.cms?query=Motor+Vehicles+Act&amp;sortorder=effectivedate">Motor Vehicles Act</a> and hence cannot be allowed. 
 
According to the Transport Commissioner MK Aiyappa after holding an hour-long meeting with the representatives of aggregators and sections of drivers, told the media that the cabs cannot pick up from and drop passengers at multiple locations before closing each trip. 
 
He also said that the aggregators have asked for three days to make changes in the software that powers the app t which the ministry has conceded the demand and said the transport officials will start booking the violators after the period. 
 The department's decision also follows strong protests from the city's transport utility <keyword id="6371543" type="COMPANY" weightage="100" keywordseo="BMTC">BMTC</keyword>. The letter from BMTC managing director Ekroop Caur says revenues have been hit because of carpool offered by aggregators as well as by other private operators. 
 
"They are also offering services with fixed schedules on specific routes - for example Hebbal to Marathahalli. That is not allowed at all," she told ET. 
 
The cab aggregators, operates under the contract carriage licence which doesn’t allow others to board the cab midway. The stage carriage permit, on the other hand, allows the vehicle (bus) to pick up and drop passengers along its scheduled route. 
 
So this means that BMTC has the exclusive right to pick up and drop a pool of commuters in the city and the permits are issued under the Motor Vehicles Act which is a Union Government legislation. 
 The aggregators also have plans to approach the Union Government to amend <keyword id="54414" type="ORGANIZATION" weightage="100" keywordseo="Motor-Vehicle-Act">Motor Vehicle Act</keyword>. 
 
At the meeting with the Transport Commissioner, drivers also requested the department's intervention with the aggregators on the minimum trips they are required to make and the drop in incentives.

As per industry executives, a new rule is going to make tax collection at source (TCS) compulsory, even when a vehicle costing 10 lakh or more is sold in the second-hand market. This has confused the automotive industry to no end. 
 
The reason behind this confusion is that the rule was originally expected to cover only new passenger vehicles; however, the rule that has been approved as part of the Finance Bill covers all types of vehicles. It will come into effect on June 1. 
 
It was in his budget speech that the finance minister had proposed to collect a 1% tax at source on luxury cars that were priced above 10 lakh, saying that it would be levied on the ex-showroom price from the dealer’s end, which would then be paid it to the government. This payment was also said to be able to set off against the total tax liability of the buyer. 
 
"From the budget speech, it was perceived that it would be implemented only on passenger vehicles priced above 10 lakh, but what has come prima facie in the language of the approved budget (Finance Bill 2016), it seems that TCS is applicable on all types of motor vehicles including trucks, buses, two-wheelers and cars sold by manufacturers, exports, dealers and government," said Sugato Sen, deputy director-general of the Society of Indian Automobile Manufacturers. 
 
The Finance Bill reads, "Every person, being a seller, who receives any amount as consideration for sale of a motor vehicle of the value exceeding 10 lakh, shall, at the time of receipt of such amount, collect from the buyer, a sum equal to 1% of the sale consideration as income-tax." 
 
Until further clarified, this means that even an individual selling his old vehicle for above 10 lakh will have to collect 1% of the value from the buyer and pay it to the government, while purchasing parts for 2 lakh or more will also attract this tax provision. 
 
Sen feels that there is a possibility of a language error in the Bill. "We have sought a clarification from the government and hope to meet them (government officials) soon," he said. 
 
However, this is not where the confusion ends. 
 
"From the budget, it was thought that it (TCS) will be collected from the end customers only. But now, it will be collected from the dealers also," said Nikunj Sanghi, former president of the Federation of Automobile Dealers Association. He added, "The biggest problem for us is that we will have extra burden on working capital." 
 
Automobile manufacturers are of the view that this new tax rule would further complicate business transactions, while there were promises from the Modi government that doing business would be made easy. 
 
Under this rule, manufacturers would deposit TCS on behalf of dealers, who could adjust this payment against their income tax. Similarly, dealers would have to collect tax from buyers and deposit that in their names. This tax would be adjusted while the vehicle buyers pay their income tax. 
 
Rakesh Batra, national leader-automotive at consultancy firm EY, called this an administrative burden on both manufacturers and buyers, while also forcing customers to put a little more cash in advance, given that no financing company won’t fund this. 
 
As of now, when you buy a vehicle, you have to pay for excise duty, central sales tax, R&amp;D cess, education cess, value-added tax, Octroi/entry tax, national calamity contingent duty, road tax and Swach Bharat cess. Besides, the insurance cover also forces the buyer to pay Krishi Kalyan tax, service tax and Swachh Bharat cess. 
 
Another burden on manufacturers, dealers and buyers is certainly uncalled for, feels the automotive industry.

The new tax collection-at-source rule is so absurd that it might actually be a language mistake

The <a href="http://www.businessinsider.in/searchresult.cms?query=National+Green+Tribunal">National Green Tribunal</a> (NGT) has questioned the <a href="http://www.businessinsider.in/searchresult.cms?query=Delhi+government">Delhi government's</a> odd-even plan for vehicles. According to the <a href="http://www.businessinsider.in/searchresult.cms?query=National+Green+Tribunal">NGT</a>, it’ll only force Delhiites to buy two cars. The government however, is moving ahead with the plan. 
 
Starting 1st January, breaking the odd-even rule could cost you Rs 2,000 or more. The <a href="http://www.businessinsider.in/searchresult.cms?query=Delhi+government">Delhi government</a> is also extending a provision of the <keyword id="6377804" type="UNKNOWN" weightage="80" keywordseo="Motor-Vehicles-Act">Motor Vehicles Act</keyword> that currently applies to commercial vehicles to private ones. 
 
The legislation in question is Section 194 of the <a href="http://www.businessinsider.in/searchresult.cms?query=Motor+Vehicles+Act">Motor Vehicles Act</a>. The government is also looking at other sections, including Section 115, which allows the government to ‘restrict the use of vehicles’ of specified classes in certain areas or roads in the interest of ‘public safety’ and ‘convenience’. 
 In case you don’t know, the <keyword id="6354952" type="ORGANIZATION" weightage="60" keywordseo="Delhi-Government">Delhi government</keyword> wants to restrict private cars between 8 am and 8 pm, Monday to Saturday as a measure to curb pollution. Odd-numbered cars will run on odd dates and those with even numbers on even dates.

The government would soon finalise a mechanism for taxi hailing apps such as <keyword id="1042120" type="PERSON" weightage="80" keywordseo="Uber">Uber</keyword> and <keyword id="6354720" type="PERSON" weightage="80" keywordseo="Ola">Ola</keyword>. The mechanism would include setting up of <keyword id="6682479" type="UNKNOWN" weightage="80" keywordseo="call-centres">call centres</keyword> and permanent Global Positioning System (<keyword id="6362652" type="TECHNOLOGY" weightage="80" keywordseo="GPS">GPS</keyword>) in cars instead of a mobile phone device. 
 

	The government would also devise a mechanism to control the maximum price to be charged by these operators. Thus, Ola and Uber may have to soon conform to such rules framed for radio taxi operators. The <keyword id="335681" type="ORGANIZATION" weightage="80" keywordseo="Road-Ministry">road ministry</keyword> has already classified these services as transport aggregators and wants such apps to follow all rules laid down for any other cab operator under the <keyword id="6377804" type="UNKNOWN" weightage="80" keywordseo="Motor-Vehicles-Act">Motor Vehicles Act</keyword>, officials said. "The regulatory architecture for a cab should apply to Uber as well," a senior official told the Economic Times, adding that these apps are like any other taxi provider. The ministry had issued a draft advisory of dos and don'ts to the states on dealing with the <keyword id="2637500" type="UNKNOWN" weightage="80" keywordseo="app-based-taxi-services">app-based taxi services</keyword> earlier this month. However, after receiving <keyword id="154361" type="PERSON" weightage="60" keywordseo="feedback">feedback</keyword> from state governments, including Delhi on the advisory, it will issue a final note after two weeks to the states, the official said. 
	 

	The government is also evaluating whether it should do away with the "minimum price" benchmark followed by radio taxis in some states. The taxi apps have been able to take advantage by offering cheaper fares and free rides, much to the dismay of radio taxis, which often follow a minimum floor price. 
	 

	"The states are empowered to draft these rules under the Motor Vehicles Act. The radio taxi scheme is therefore practised in many states but we are telling them to think twice before taking any step which throttles competition," the official said. The apps, according to officials, come within the purview of the Motor Vehicles Act under Section 93 for soliciting services for transport. 
	 

	This section empowers the state government to set rules under the contract carriage permit which covers cabs, buses and autorickshaws. 

	The ministry in its proposed draft road safety bill has also included and defined the term 'aggregators' to bring the IT-enabled apps under the legal framework of the proposed legislation which has been sent for cabinet approval.

<keyword id="2123426" type="UNKNOWN" weightage="20" keywordseo="Indian-Motor-Vehicles-Act">Indian Motor Vehicles Act</keyword>, 1914: This Act requires that a person needs to have ‘well brushed teeth’ in order to be eligible to become an inspector in Andhra Pradesh. A person with dirty, pale teeth cannot become an inspector in the state! 
 
The <keyword id="75223" type="ORGANIZATION" weightage="20" keywordseo="Indian-Penal-Code">Indian Penal Code</keyword>, 1860 (Section 497): Under this law, a married man can ‘legally’ have sex with an unmarried girl, a divorcee or a widow. It will not be treated as adultery. 
 
If you wish to have sex with a married woman, you need to have her husband’s prior approval! The law states, “Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.”

The innkeeper is also required “to thoroughly cleanse the rooms and verandahs, and drains of the sarai (hotel), and the wells, tanks, or other sources from, which water is obtained for the persons or animals using it, to the satisfaction of, and so often as shall be required by, the Magistrate of the District, or such person as he shall appoint in this behalf.” 
 
Moreover, he must “remove all noxious vegetation on or near the sarai (hotel), and all trees and branches of trees capable of affording to thieves means of entering or leaving the sarai.”

The Supreme Court on Wednesday asked the Union government if a change in law is warranted on the legal question of whether a person holding a driving licence for a light motor vehicle is entitled to legally drive a <keyword id="1049502" type="General" weightage="20" keywordseo="transport-vehicle" source="Orion">transport vehicle</keyword> of a particular weight. Observing that these are policy issues impacting the livelihood of lakhs of people, a five-judge constitution bench headed by Chief Justice <keyword id="445662" type="General" weightage="50" keywordseo="d-y-chandrachud" source="Orion">D Y Chandrachud</keyword> said the government needs to take a "fresh look" at the matter while asserting that it needs to be taken up at the policy level. The top court asked the Centre to wrap up the exercise within two months and apprise it about the decision taken. It said any interpretation of the law must duly take into account valid concerns of road safety and the safety of other users of public transport. The top court had earlier sought the assistance of Attorney General R Venkataramani in dealing with a legal question about whether a person holding a driving licence for a light motor vehicle is entitled to legally drive a transport vehicle of a particular weight. The constitution bench had said knowing the position of the Ministry of Road Transport and Highways will be necessary after it was argued that the apex court's 2017 verdict in the case of Mukund Dewangan versus Oriental Insurance Company Limited was accepted by the Centre and rules were amended to align them with the judgement. In the Mukund Dewangan case, a three-judge bench of the top court had held that transport vehicles, the gross weight of which does not exceed 7,500 kg, are not excluded from the definition of LMV. "There may be lakhs of drivers across the country who are working on the basis of Dewangan judgment. This is not a constitutional issue. It is purely a statutory issue," the bench, also comprising Justices Hrishikesh Roy, P S Narasimha, Pankaj Mithal and Manoj Misra, said. "This is just not the question of law but also the social impact of the law... Road safety has to be balanced with the social purpose of the law and you have to see if this causes serious hardships. We cannot decide issues of social policy in a constitution bench," it said. The apex court said once the government informs its stand to the court, the hearing in the constitution bench will be taken up thereafter. The Constitution bench is dealing with a legal question which reads: "Whether a person holding a driving licence in respect of 'light motor vehicle' could on the strength of that licence, be entitled to drive a 'transport vehicle of light motor vehicle class' having unladen weight not exceeding 7,500 kg." On July 18, the constitution bench commenced hearing as many as 76 petitions to deal with the legal question. It had then heard the arguments of senior advocate Siddharth Dave, appearing for one of the petitioners, on alleged anomalies in the Motor Vehicle Act with regard to regimes for dealing with the grant of driving licenses for different categories of vehicles. The lead petition was filed by M/s Bajaj Allianz General Insurance Co Ltd. The legal question has given rise to various disputes over payment of claims by insurance companies in accident cases involving transport vehicles being driven by those having licences to drive LMVs. The Motor Vehicle Act provides for different regimes for the granting of driving licences for different categories of vehicles. The matter was referred to the larger bench on March 8, 2022, by a three-judge bench headed by Justice U U Lalit, since retired. It was said that certain provisions of the law were not noticed by the apex court in the Mukund Dewangan judgement and "the controversy in question needs to be revisited".
