The RBI’s stance on loan moratorium In its affidavit, the RBI told the Supreme Court that extending the moratorium beyond six months will impact overall credit discipline and have a ‘debilitating impact’ on the credit creation process. On the issue of compound interest, the RBI asserted that waiver of the same would result in ‘significant economic costs’ for banks to absorb. The larger ripple effect may lead to implications for borrowers and undermine broader financial stability. Central government’s take on loan moratorium The central government asserted that it would waive compound interest (interest on interest) during the moratorium period for MSMEs and personal loans up to ₹2 crore in its affidavit filed ahead of the last hearing. However, Senior Advocate C. Aryama Sundaram argued that the real estate sector is completely left out of the scope. The bench was also not pleased, highlighting that the central government’s affidavit did not provide the necessary details regarding the questions asked by the court earlier. SBI, HDFC Bank, Axis Bank and other bank stocks tread caution as they wait with bated breath for Supreme Court verdict on moratorium

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> Tuesday deferred to November 5 the hearing on a batch of pleas relating to charging of interest on interest by banks on EMIs which were not paid by the borrowers who availed of the RBI <keyword id="6840678" type="UNKNOWN" weightage="20" keywordseo="loan-moratorium">loan moratorium</keyword> scheme in view of the COVID-19 pandemic. The <keyword id="6354335" type="ORGANIZATION" weightage="20" keywordseo="reserve-bank-of-india">Reserve Bank of India</keyword> and the Finance Ministry have already filed separate additional affidavits in the apex court saying that the banks, financial and non-banking financial institutions will credit into the accounts of eligible borrowers by November 5 the difference between compound and simple interest collected on loans of up to Rs 2 crore during the <keyword id="117489" type="PERSON" weightage="20" keywordseo="moratorium">moratorium</keyword> scheme period. A bench of Justices Ashok Bhushan, R Subhash Reddy and M R Shah was requested by Solicitor General Tushar Mehta that the hearing in the loan moratorium case be deferred as he would be busy arguing on behalf of the Centre in other matter relating to the Central Vista project. "These moratorium matters were listed yesterday but they came up today. I am requesting for an adjournment considering I have a case (Central Vista) where I will be arguing" the law officer said. A letter seeking deferment of the hearing in the case was also circulated by advocate-on-record Anil Katiyar for the Centre to the parties and the bench. The top court acceded to the request and adjourned the hearing on pleas including the one filed by Gajendra Sharma on November 5. The pleas pertained to charging of interest on interest by banks on EMIs which have not been paid by borrowers after availing the loan moratorium scheme of RBI during March 1 to August 31. Earlier, the RBI had filed the affidavit saying that it has asked all banks, financial and non-banking financial institutions to take "necessary actions" to credit into the accounts of eligible borrowers the difference between compound and simple interest collected on loans of up to Rs 2 crore during the moratorium scheme. Prior to this, the central government had told the apex court that lenders have been asked to credit into the accounts of eligible borrowers the difference between compound and simple interest collected on loans of up to Rs 2 crore during the RBI's loan moratorium scheme by November 5. The government had said that the ministry has issued a scheme as per which lending institutions would credit this amount in the accounts of borrowers for the 6-month loan moratorium period which was announced following the COVID-19 pandemic situation. On October 14, the apex court had observed that the Centre should implement "as soon as possible" the interest waiver on loans of up to Rs 2 crore under the RBI's moratorium scheme and had said that the common man's Diwali is in the government's hands. The RBI had on March 27 issued the circular which allowed lending institutions to grant a moratorium on payment of instalments of term loans falling due between March 1, 2020, and May 31,2020, due to the pandemic. Airtel and Vodafone surge after reports that government may defer AGR payments

<ul><li>The <keyword id="6354335" type="ORGANIZATION" weightage="20" keywordseo="reserve-bank-of-india">Reserve Bank of India</keyword>’s (RBI) <keyword id="9861168" type="UNKNOWN" weightage="20" keywordseo="six-month-moratorium">six-month moratorium</keyword> came to an end on August 31, and payments are set to come due, starting today.</li><li>The Supreme Court is yet to announce its verdict on whether the interest accrued during that time will be waived, leaving many borrowers wondering what they should do. </li><li>Those who aren’t in a position to make payments, waiver or not, have the option to go for a one-time restructuring of loans.</li></ul>The Reserve Bank of India’s (RBI) pause on repayment of interest on loans for the past six months came to an end yesterday, August 31. Even though the government is yet to take a stand on whether or not the interest accrued during the moratorium period will be waived off, the payments for borrowers are going to start coming due from today. <div type="Article" hostid="261" msid="77758597" title="Loan moratorium still ends on Aug 31 while Supreme Court gives the government another week to clarify if accrued interest should be waived" mstype="2" mssubtype="0"></div> As a borrower, you fit into one of three categories: <ol><li>Someone who didn’t avail the moratorium</li><li>Someone who availed the moratorium and is still facing financial difficulties</li><li>Someone who availed the moratorium but only for the sake of keeping liquidity on hand</li></ol>Someone who didn’t avail the moratorium If you’re a borrower that did not avail the moratorium facility offered by the RBI over the last six months, nothing changes. Your monthly payments continue as is, and there is no change in your overall loan payments scheme. Someone who availed the moratorium but can afford to pay Not everyone who availed the moratorium was facing a financial crisis. Someone did it to ensure that there was some extra cash on hand in case things took a turn for the worse. Even with the matter of interest waiver pending with the Supreme Court, banks are likely to recommend a one-time payment rather than letting interest accrue further. According to the RBI, an interest waiver could lead to a loss of ₹2 lakh crore for banks in India. “If you have taken a moratorium, the bank will suggest depositing as much amount as you can,” a bank manager at one of India’s leading public sector banks told Business Insider. According to them, even if the Supreme Court decides to waive interest, the amount will go towards advance loan paid. Someone who availed the moratorium and is still facing financial difficulties Not every business has been impacted equally during the coronavirus lockdown — some have taken a bigger hit than others. Take the tourism industry as an example. The thoughts expressed are those of the author.</li></ul>Two weeks ago, a federal court in Washington, DC ruled that the Centers for Disease Control and Prevention (CDC) <a href="https://www.washingtonpost.com/dc-md-va/2021/05/05/federal-judge-vacates-cdcs-nationwide-eviction-moratorium/">overstepped its authority</a> in issuing a nationwide <keyword id="6356416" type="UNKNOWN" weightage="60" keywordseo="eviction">eviction</keyword> moratorium and threw it out. The Justice Department announced that it would <a href="https://thehill.com/homenews/administration/551967-justice-dept-to-appeal-judges-order-vacating-cdc-eviction-moratorium">appeal the verdict</a> and the judge has allowed the moratorium to <a href="https://www.reuters.com/world/us/federal-court-vacates-us-eviction-moratorium-2021-05-05/">remain in place</a> while litigation continues. Still, the ruling has caused chaos across the country, as tenants grapple with the possibility of being evicted during the pandemic. In addition to the CDC moratorium, the country has been covered with a patchwork of state, county, and city-level bans on evictions. However, despite these protections - and thanks in part to a system of loopholes - thousands have been evicted over the last year of the pandemic. The chaos caused by this ruling has only reaffirmed the need for Congress to act and pass real relief for tenants. It's time to cancel rent.<h2>Eviction conviction</h2>Prior to the pandemic, evictions were already an epidemic in the United States - around 900,000 evictions take place in an average year, which is around four<a href="https://www.npr.org/2018/04/12/601783346/first-ever-evictions-database-shows-were-in-the-middle-of-a-housing-crisis"> evictions per minute</a> - and not everyone is affected equally. <a href="https://evictionlab.org/demographics-of-eviction/">According to statistics</a> collected by the Eviction Lab at Princeton University, Black, Latinx and women renters are disproportionately targeted by evictions and removed from their homes. Households with children, particularly <a href="https://newrepublic.com/article/161578/landlords-target-mothers-eviction-crisis-covid">single mother households</a>, are especially at risk. <a href="https://scholar.harvard.edu/files/mdesmond/files/social_forces-2013-desmond-303-27.pdf">A study</a> by the Eviction Lab shows that neighborhoods with higher amounts of children have increased evictions and that in court, tenants with children are more likely to receive a judgement ordering their eviction.Evictions are a disruptive force in the lives of Americans. Once someone is evicted, it is harder for them to rent in a similar neighborhood -even an eviction filing can have the same impact without the actual eviction. Since landlords <a href="https://www.texasobserver.org/evictions-texas-housing/">refuse to rent</a> to them, people who have been evicted are often <a href="https://www.publicsource.org/eviction-collateral-impact-displacement-employment-transit-school-mental-health/">pushed into</a> housing that is substandard, often in areas that are far from their workplaces, transit, and more. Even worse, some end up without a home at all. Merely being threatened with an eviction <a href="https://www.sciencedirect.com/science/article/abs/pii/S0277953617300102?via%3Dihub">is associated</a> with worse physical and mental health. Evictions can be blamed for some spread of the novel coronavirus too. They've been deemed an infection risk during the pandemic, which is what caused the CDC to institute the moratorium in the first place. <a href="https://www.vox.com/22160179/study-covid-19-eviction-moratoriums-deaths-cases-coronavirus-rent-stimulus-state-congress">A study</a> published in December found that 11,000 <keyword id="8763838" type="UNKNOWN" weightage="60" keywordseo="covid-19">COVID-19</keyword> deaths and 433,700 infections could have been prevented had states that lifted their eviction moratoriums kept them in place. When you don't have stable housing, you aren't able to stay at home and isolate from others. People who are evicted may go live with extended family, causing crowding in housing, which has been associated with COVID-19 cases and deaths. Similarly, a <a href="https://nlihc.org/resource/eviction-and-utility-disconnection-moratoriums-led-fewer-covid-19-cases-and-deaths">working paper</a> published in the National Bureau of Economic Research found that maintaining moratoriums reduced COVID infections by 3.8% and deaths by 11%. As cases, deaths, and hospitalizations decrease in the coming weeks, politicians may use this opportunity to declare the pandemic over and rescind the moratoriums. While the moratoriums need to be extended for the considerable future, they do not address the accumulating amount of unpaid rent that is piling up for those who are at risk of eviction. By this month, 7 million renters in America will collectively owe <a href="https://www.reuters.com/world/us/special-report-giant-us-landlords-pursue-evictions-despite-cdc-ban-2021-04-23/">$40 billion</a> in unpaid rent - these unpaid fees will kick off a cascade of evictions once the moratoriums expire. This is why Congress needs to act to not only pass a lengthy moratorium but also to cancel outstanding rent so that tenants are not evicted once that moratorium expires.Representative Ilhan Omar has proposed a bill that would do just that. <a href="https://omar.house.gov/media/press-releases/rep-ilhan-omar-introduces-bill-cancel-all-rent-and-mortgage-payments-during">The Rent and Mortgage Cancellation Act</a> wouldn't just cancel all missed rental and mortgage payments, it would also cause missed payments to have no effect on people's credit scores. Additionally, it would establish a fund that would allow landlords and mortgage holders to recuperate their losses, providing both owners and renters with a win-win situation. Since some landlords <a href="https://www.usatoday.com/story/news/investigations/2020/11/20/landlords-use-intimidation-tricks-push-renters-out-amid-pandemic/6284752002/">have been evicting tenants</a> throughout this period, it would be important that such a fund reward landlords who have not evicted tenants and not compensate landlords' for losses in general. These provisions however only address temporary issues caused by the pandemic, and aren't a permanent solution to housing insecurity. <a href="https://www.vox.com/22264268/covid-19-housing-insecurity-housing-prices-mortgage-rates-pandemic-zoning-supply-demand">Housing</a> and <a href="https://fortune.com/2021/02/24/covid-rent-prices-spike-housing-crisis/">rental costs</a> across the country have skyrocketed in recent months and the pandemic has increased homelessness across the country; cities across the country are grappling with a rise in encampments, which has prompted <a href="https://www.kxan.com/news/texas-politics/how-a-statewide-camping-ban-would-impact-austins-response-to-prop-b/">public backlash</a> and <a href="https://www.npr.org/2021/03/25/981309861/los-angeles-sparks-tension-with-shutdown-of-echo-park-homeless-encampment">police-led sweeps.</a> Even before the pandemic, homelessness increased by 2% <a href="https://endhomelessness.org/new-report-shows-rise-in-homelessness-in-advance-of-covid-19-crisis/">from the year prior.</a> Researchers say that over the next four years, the economic impact from the pandemic is expected to <a href="https://www.marketwatch.com/story/covid-19-will-cause-twice-as-much-homelessness-as-great-recession-study-finds-11610482333">increase homelessness by 49%.</a> When someone lacks secure housing, it makes it harder for them to access services like healthcare; considering that COVID-19 is now expected to become <a href="https://www.nytimes.com/live/2021/05/09/world/covid-vaccine-coronavirus-cases">an endemic disease</a> that will require routine vaccination, a sizable homeless population that has precarious access to care should cause us concern. Rep. Omar's bill would also create funds to facilitate the public purchase of some rental properties - a good start. Further solutions have been proposed by housing advocates in the form of a "<a href="https://homesguarantee.com/">Homes Guarantee</a>", which among other things - like universal rent control - calls for 12 million social housing units to be built. When the pandemic hit more than a year ago, society made some quick rapid changes thinking the virus would only be with us for a while. Among these were programs like <a href="https://www.cdss.ca.gov/inforesources/cdss-programs/housing-programs/project-roomkey">Project Roomkey</a>, which were designed to house people in hotels so they did not have to stay in congregate settings like homeless shelters. The funding for these programs is now running out, and our focus is now on "getting back to normal," but the virus and the problems it exacerbated will still be with us. Ending the pandemic can't happen without ending evictions, which needlessly increase infections

India is believed to have challenged in a court in The Hague an <keyword id="10983799" type="UNKNOWN" weightage="20" keywordseo="arbitration-tribunal-verdict">arbitration tribunal verdict</keyword> that overturned its demand for ₹10,247 crore in <keyword id="172303" type="PERSON" weightage="20" keywordseo="back-taxes">back taxes</keyword> from <keyword id="128650" type="COMPANY" weightage="20" keywordseo="Cairn-Energy">Cairn Energy</keyword> Plc -- the second time in three months that it has refused to accept an <keyword id="603715" type="COMPANY" weightage="20" keywordseo="international-award">international award</keyword> against retrospective tax. The appeal was filed on Monday, a source with knowledge of the matter said. The <keyword id="47209" type="COMPANY" weightage="20" keywordseo="Finance-Ministry">Finance Ministry</keyword> spokesperson did not immediately respond to an e-mail sent for comments. The appeal against a three-member tribunal at the Permanent Court of Arbitration at The Hague invalidating India's Rs 10,247 crore tax claim on Cairn Energy and ordering the government to return the value of shares it had sold, dividends seized and tax refunds withheld, comes weeks before UK Prime Minister Boris Johnson's visit to India. The British Prime Minister is widely expected to broach India honouring international arbitration awards during his April 26 visit, another source said. In December, the government had challenged in a <keyword id="211440" type="ORGANIZATION" weightage="20" keywordseo="Singapore-court">Singapore court</keyword> an international arbitration tribunal verdict that overturned its demand for ₹22,100 crore in back taxes from Vodafone Group Plc. Since the seat of Vodafone arbitration was Singapore, an appeal was filed in a court in that country. In the case of Cairn, the seat was The Hague and so an appeal has been filed in a court in the Netherlands, the first source said. The appeal was filed on a day when Minister of State for Finance Anurag Singh Thakur had told the Lok Sabha in a written reply that "any such decision on filing of appeal or otherwise is taken only after careful consideration of all aspects of the matter." The tribunal's 582-page detailed verdict that asked India to return USD 1.2 billion-plus interest and cost to Cairn was registered in the Netherlands on January 8 and New Delhi acknowledged it on January 19, the source said. Finance Minister Nirmala Sitharaman had earlier this month indicated the government's intent of appealing against the award on grounds of it questioning the sovereign powers of India to levy taxes. Her ministry feels taxation is not a subject of bilateral investment treaties, like the UK-India Bilateral Investment Treaty under which Cairn had sought rescinding of the tax demand raised, and so the award should be appealed. It is of the opinion that Cairn set up a tax abusive structure in 2006 when it reorganised its India business to list the local unit, and did not pay taxes anywhere in the world on the gains that it made in India, they said, adding India had made an unsuccessful case of tax not being part of the treaty before the arbitration panel as well. However, the arbitration award specifically made it clear the base of the judgment was not a challenge to the 2012 law or India's sovereign right to tax. "The issue at stake is thus not a matter of domestic tax law, it is rather whether the fiscal measures taken by the state, valid or not under its own tax laws, violate international law," the tribunal had said in a unanimous verdict. The Hague panel found that a 2012 law passed by the Indian Parliament was a new tax, not a clarification of prior law that could be applied to earlier years. Cairn has moved courts in nine countries to enforce the award against India. The award has already been recognised by courts in the US, the UK, Netherlands, Canada and France and the same is in the process in Singapore, Japan, the United Arab Emirates and the Cayman Islands. The registration of the award is the first step towards its enforcement in the event of the government not paying the firm. Once the court recognises an arbitration award, the company can then petition it for seizing any Indian government assets such as bank accounts, payments to state-owned entities, airplanes and ships in those jurisdictions, to recover the monies due to it, sources said. Sources said the government believes that taxation is not covered under investment protection treaties with various countries and the law on taxation is a sovereign right of the country. While the treaties are primarily aimed at the protection of investments, the tax is levied on 'returns' earned by entities. But the Hague tribunal had gone into this claim and rejected it. Vodafone had challenged before the arbitration tribunal the demand for ₹7,990 crore in capital gains taxes (₹22,100 crore after including interest and penalty) under the Netherlands-India Bilateral Investment Treaty (BIT). The demand pertained to Vodafone's USD 11-billion acquisition of 67 per cent stake in the mobile phone business owned by Hutchison Whampoa in 2007. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra was urged by a battery of lawyers that the plea be heard urgently keeping in mind the subsequent developments in the case. The plea was mentioned by senior advocate NK Kaul, appearing for the ed-tech major, that the case needed to be heard at the earliest. The submission was supported by Solicitor General Tushar Mehta, appearing for the BCCI, and senior lawyer Abhishek Singhvi, also appearing for the ed-tech firm. Kaul said another plea in the case has also been filed and that is listed for hearing on September 17 and hence, the present plea be either heard on that day or the hearings in both the cases be advanced to this Friday. "We will hear both the pleas on September 17," the CJI said. Senior advocate Shayam Divan, appearing for the US-based creditor, said let the matters be heard together on September 17. Earlier on August 22, the bench had refused to pass an interim order to ensure that the committee of creditors (CoC) does not hold any meeting in pursuance of the insolvency proceedings against the embattled ed-tech firm. The August 2 verdict of the NCLAT had come as a huge relief for Byju's as it had effectively put its founder Byju Raveendran back in control. The top court, however, had prima facie termed the NCLAT verdict as "unconscionable" and stayed its operation while issuing notices to Byju's and others on the appeal of the ed-tech firm's US-based creditor against the judgment of the insolvency appellate tribunal. The case stemmed from Byju's default on a Rs 158.9 crore payment related to a sponsorship deal with the BCCI. The top court had directed the BCCI to keep a sum of Rs 158 crore it had received from Byju's after a settlement in a separate escrow account till further orders. "Issue notice. Pending further orders there shall be a stay of the impugned order of August 2 of NCLAT. In the meantime, BCCI shall maintain the amount of Rs 158 crore, which shall be realised in pursuance of a settlement, in a separate escrow account until further orders," the bench had said. Byju's had entered into a "Team Sponsor Agreement" with the BCCI in 2019. The company met its obligations till the middle of 2022 but defaulted on subsequent payments of Rs 158.9 crore. <ul><li>IndusInd Bank, Tata Motors, Kotak Mahindra Bank, and Bajaj Finance are leading the charts among <keyword id="66115" type="PERSON" weightage="20" keywordseo="Nifty-50">Nifty 50</keyword>’s <keyword id="10324401" type="UNKNOWN" weightage="20" keywordseo="top-10-gainers">top 10 gainers</keyword> in the last three months.</li><li>Interestingly, financial firms account for seven of the top 10 gainers.</li><li>The Supreme Court’s order on standstill of NPA recognition provided a relief rally in financials and, more recently, the RBI panel recommendations came as a boost for NBFC and small finance bank stocks. </li></ul>The bulls are in charge on Dalal Street and the market has seen a record run with the Nifty 50 hitting the 13,000 mark in trade today. The surprising factor is that financials have played a significant role in the rally. Over the last three months, seven of the top ten best performing stocks on the Nifty 50 have been financial companies, with IndusInd Bank leading the charge. banking shares rally in the last three months? The winds were already on the uptake with not enough shares of HDFC Bank, IndusInd Bank and Kotak Mahindra Bank for foreign investors to pick up back in August. This after the London based FTSE Global Index <a href="https://www.businessinsider.in/stock-market/markets/news/there-arent-enough-shares-of-hdfc-bank-indusind-bank-and-kotak-bank-that-foreign-investors-can-buy/articleshow/77798108.cms">chose to no longer list the banks on its indices.</a> The shortage of shares was partly due to the Reserve Bank of India’s (RBI) moratorium that held off the expected onslaught of defaulters when the nationwide lockdown was announced. But, that isn’t what drove the rally in the last three months. A critical change occurred at the end of September when the moratorium technically had expired. One, that the banks’ balance sheets will be protected for a little while longer. And, two, because it meant the Supreme Court would be hearing arguments for waiving off the compound interest loans. A verdict it eventually granted just before Diwali. <div type="image" title="Copy of KMB1 (1)" msid="79386169" hostid="261" caption="&amp;lt;p&amp;gt;India&amp;#39;s credit growth over the last three months&amp;lt;/p&amp;gt;"></div> Other factors like HDFC Bank’s denial of allegations by a US-based law firm that filed a class action lawsuit against the bank, fund raising exercises, the shoring up of capital to fend against any bad loans, and the uptake of collections in the second quarter also cast a net of optimism on the banking sector. The more recent rally Over the last two days, one announcement has overshadowed all others — the RBI’s new rules for how private sector banks can be owned. While there are <a href="https://www.businessinsider.in/finance/banks/news/former-rbi-governor-raghuram-rajan-and-viral-acharya-believe-its-a-bad-idea-to-allows-companies-to-own-banks/articleshow/79370513.cms">varying opinions</a> on whether or not large companies and NBFCs should be allowed to own banks, one thing most seem to agree on is that increasing the cap for promoters’ stake from 15% to 26% is a good move. IndusInd Bank’s share price rallied by more than 4% yesterday and opened on high in trade this morning as well. The promoters of the Bank, the Hinduja Group, had expressed its interest to pump in more money. And, if the RBI’s proposed change is accepted, it would be fresh capital infusion for the private sector bank. Uncertainty over what lies ahead The stock market’s rally may paint a rosy picture, but analysts believe that the worst is yet to come. Once the Supreme Court announces its final verdict, the stay on accounts being declared NPA will end and the true situation will reveal itself. The time is also ticking against borrowers who may have dipped into their savings to make payments as the unemployment rate continues to rise. Meanwhile, a storm may be approaching with a second wave of COVID-19 likely to hit the country in winter. Many states have already begun bringing back <a href="https://www.businessinsider.in/india/news/checkout-which-states-have-reimposed-curfews-and-restrictions-again-as-second-covid-19-wave-hits-india/articleshow/79366320.cms">restrictions</a> like night curfews and shutting down markets to limit the spread of the infection.
