Mumbai (Maharashtra) [India], February 20 (ANI): The Maharashtra government on Tuesday approved a bill, extending reservation to Marathas above the 50 per cent mark in a special session of the state legislature. The bill for 10 per cent <keyword id="19936356" type="General" weightage="20" keywordseo="maratha" source="keywords">Maratha</keyword> quota that the Mahayuti government of <keyword id="19913631" type="General" weightage="20" keywordseo="eknath-shinde" source="keywords">Eknath Shinde</keyword> has approved on Tuesday is similar to the Socially and Educationally Backward Classes Act, 2018, introduced by the then Devendra Fadnavis government. This is the third time in a decade that the state has introduced legislation for the Maratha quota. The decision to convene a special session was prompted by Maratha quota activist Manoj Jarange Patil, who is on a hunger strike at Antarwali Saarati village in Jalna district. The reservation has been extended based on a report submitted to the state government by the Maharashtra Backward Class <keyword id="19933395" type="General" weightage="20" keywordseo="commission" source="keywords">Commission</keyword> (MBCC) headed by chairman Justice (Retired) <keyword id="20654823" type="General" weightage="20" keywordseo="sunil-shukre" source="keywords">Sunil Shukre</keyword>. The state already has a 10 per cent quota for the Economically Weaker Section (EWS) in which the Marathas are the biggest beneficiaries, claiming 85 per cent of the reservation. The Maharashtra State Backward Class Commission on Friday submitted a report on the social and educational backwardness of the Maratha community for which it had undertaken a survey of around 2.5 crore homes within a span of only nine days. The committee proposed a 10 per cent reservation for Marathas in education and jobs, similar to that given in 2018 by the then-state government. In June 2017, the then Devendra Fadnavis government had constituted the Maharashtra State Backward Class Commission (MSBCC) headed by Justice (retired) <keyword id="20654824" type="General" weightage="20" keywordseo="mg-gaikwad" source="keywords">MG Gaikwad</keyword> to study the social, financial and educational status of the Maratha community. The Commission submitted its report in November 2018, classifying Marathas as a socially and educationally backward class (SEBC). Notably, Maharashtra Chief Minister Eknath Shinde stressed on Friday that reservation to Marathas will be given according to the terms of the law after presenting the report in during the special assembly session called for Tuesday. Maharashtra govt approves bill to extend 10% reservation to Marathas

Chhatrapati Sambhajinagar, <keyword id="19936356" type="General" weightage="20" keywordseo="maratha" source="keywords">Maratha</keyword> quota activist <keyword id="19986660" type="General" weightage="20" keywordseo="manoj-jarange" source="keywords">Manoj Jarange</keyword> on Tuesday said it doesn't matter if the Maharashtra government grants 10 per cent or 20 per cent reservation to the community, the quota must be under the Other Backward Classes (<keyword id="19997887" type="General" weightage="20" keywordseo="obc" source="keywords">OBC</keyword>) category and not separate. Speaking to reporters at Antarwali Sarati village in Jalna district, the activist said he would wait and see if the state government converts its draft notification on 'blood relatives' of <keyword id="20617373" type="General" weightage="20" keywordseo="kunbi-marathas" source="keywords">Kunbi Marathas</keyword> into law and then decide on the course of his agitation. The state government is holding a special session of the state legislature on Tuesday to discuss the reservation and other demands of the Maratha community. "The government is giving us what we don't want. We want a reservation in the Other Backward Classes (OBC) category, but they are giving us a separate quota instead. If the government doesn't discuss and implement the draft notification on the reservation for blood relatives of Kunbi Marathas, we will decide on the course of the agitation tomorrow," the activist said. Asked about the state government's proposal for a separate 10 per cent reservation to Marathas, <keyword id="19914886" type="General" weightage="20" keywordseo="jarange" source="keywords">Jarange</keyword> said it doesn't matter if the government grants 10 per cent or 20 per cent reservation for the community, the quota must be under the OBC category and not separate. He further criticised the government for trying to divert the quota issue and alleged that it was acting under the influence of Minister Chhagan Bhujbal, who has been opposing the "backdoor entry" of Marathas in the OBC quota. "A separate reservation outside the OBC category might pose legal challenges, as it could exceed the 50 per cent reservation cap," he said. Jarange has been on a hunger strike since February 10. This is the fourth time in less than a year that Jarange has observed a hunger strike demanding the inclusion of the Maratha community in the OBC grouping.

Jarange reiterates demand for Maratha quota under OBC category

The <keyword id="6354977" type="COMPANY" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Wednesday quashed the <keyword id="13126" type="COMPANY" weightage="20" keywordseo="Maharashtra">Maharashtra</keyword> law granting <keyword id="6361164" type="UNKNOWN" weightage="20" keywordseo="reservation">reservation</keyword> in jobs and admissions to <keyword id="6389157" type="COMPANY" weightage="20" keywordseo="maratha">Maratha</keyword> community. The top court said it did not find any exceptional circumstance to justify exceeding the 50 per cent cap set by Indra Sawhney judgment. A five-judge <keyword id="69719" type="PERSON" weightage="20" keywordseo="Constitution-bench">Constitution Bench</keyword> headed by Justice Ashok Bhushan allowed no breach of 50 per cent ceiling to give more reservation, as it refused to consider reviewing Indra Sawhney verdict of 1992. "Exceeding ceiling limit of 50 percent laid down by Indra Sawhney is violative of <keyword id="875349" type="COMPANY" weightage="20" keywordseo="Articles">Articles</keyword> 14 and 15," said the top court. The top court said the people from Maratha community cannot be declared as educationally and socially backward. The unanimous judgment was delivered by a bench also comprising Justices L. Nageswara Rao, S Abdul Nazeer, Hemant Gupta and S. Ravindra Bhat. The top court made it clear that there were no extraordinary circumstances to grant reservation to Maratha community over and above 50 per cent ceiling. The top court struck down the Maharashtra State Reservation for Socially and Educationally Backward Classes (SEBC) Act, 2018 which extends reservation to the Maratha community in public education and employment. The top court emphasized that exceeding the 50 percent limit in without exceptional circumstances violates Article 14, and it held that 2018 act as amended in 2019 exceeds the limit without any exceptional circumstances. The top court held that SEBC Act, which extends reservation to the Maratha community in public education and employment is unconstitutional. Supreme Court quashes the law granting reservation for Maratha community in jobs and education exceeding 50%

He will pay floral tribute to the statue of Chhatrapati Shivaji Maharaj, after which he will address the gathering. Stating that the Maharashtra government has accepted their request, Patil who started his hunger strike on Friday, said the protest was over now. "Chief Minister Eknath Shinde has done a good job. Our protest is now over. Our request has been accepted. We will accept the letter from him. I will drink juice at the hands of the Chief Minister," Patil said this while addressing a press conference on Friday night. Referring to the demands of giving Kunbi certificates to all 54 lakh people whose data has been found till now, Patil said that they will be given the certificates soon. "54 lakh entries were found for our fight. They will be given the certificate soon," he said. Earlier on Friday, Patil warned the state government that if their demands were not met, then protestors would march towards Mumbai on Saturday morning. He also urged the Maharashtra government to withdraw all the cases registered by the police regarding the demand for Maratha reservations in the state. Meanwhile, Maharashtra Minister Mangal Prabhat Lodha said that the ordinance that was passed has the solution to all the problems, so there is no need to continue the protests. "A movement that was going on in Maharashtra for the Maratha reservation under the leadership of Manoj Jarange Patil has reached a solution. The ordinance that was passed has the solution to all the problems. Manoj Jarange Patil has announced that since the solution has been received, there is no need to continue the protests. CM Eknath Shinde will end Manoj Jarange Patil's fast with juice. The movement has reached a solution," Lodha said on Friday. On May 5, 2021, the Supreme Court struck down reservations for the Maratha community in colleges, higher educational institutions, and jobs after noting that there was no valid ground to breach a 50% reservation while granting a Maratha reservation. Maratha reservation activists celebrate after Maha govt accepts their demands

<keyword id="1851542" type="General" weightage="20" keywordseo="maratha-groups" source="Orion">Maratha groups</keyword> continued their protests for the third day across several districts in the state to press for reservation for the community here on Tuesday. Alarmed by the spread of agitation, Chief Minister Eknath Shinde has convened an all-party meeting in Mumbai on Wednesday to discuss and resolve the issue. Maratha legislators from all political parties staged a protest near the Gandhi statue outside Mantralaya in Nariman Point and are likely to meet Governor Ramesh Bais later demanding a special legislature session to finalise the community quotas. The great grandson of Mahatma Gandhi, Tushar A. Gandhi said that the Centre had very successfully engineered violence in New Delhi to scuttle the anti-CAA-NRC protests that had become a big embarrassment for the government. "Now the same modus operandi has been employed in Maharashtra to defame and derail the Maratha reservation agitation," said <keyword id="97377" type="General" weightage="50" keywordseo="tushar-gandhi" source="Orion">Tushar Gandhi</keyword> sharply. Another incident of arson on a government office was reported from Jalna where a village panchayat office was torched by some unknown persons raising pro-quota slogans. Scores of Maratha activists lay down on the railway tracks in Solapur and blocked the passage of at least one long-distance train even as police attempted to clear the railway lines. A local office of the Bharatiya Janata Party was set ablaze at Naiknagar in Hingoli district, while a large number of Maratha activists got down in a stream in Pune for a 'jal-samadhi' protest. Public bus services remained shut for the second day in parts of Parbhani district and in Malkapur, Buldhana district, protestors smeared black paint on posters of the CM on a vehicle. Scores of Marathas launched relay hunger strikes at Chunabhatti in Mumbai and Mungse village in Nashik district demanding immediate announcement of quotas. Schools and colleges remained shut on Tuesday in Shevgaon, Ahmednagar district and students participated in the protests. In Pune, protestors blocked the Pune-Bengaluru Highway by throwing burning truck tyres on the Navale Bridge and squatting on the road, raising anti-government slogans, as 10-km long traffic snarls developed on both sides of the important thoroughfare. A large number of activists took out a symbolic 'funeral' procession of the state government in Tembhurni, Solapur district, while half a dozen services of the Nagpur-Pune sleeper bus services were suspended for the day. In Beed, which was rocked by large-scale arson and violence on Monday, a Nationalist Congress Party (SP) activist <keyword id="13209654" type="General" weightage="80" keywordseo="yogesh-kshirsagar" source="Orion">Yogesh Kshirsagar</keyword> alleged that the torching of his MLA brother Sandeep R. Kshirsagar was "a pre-planned conspiracy". "Before setting our house on fire, someone had snapped off the power supply here, the miscreants who indulged in stone-pelting were carrying bottles filled with petrol, and the police proved totally incapable of stopping them," claimed Yogesh Kshirsagar. The Shivba Sanghatana President Manoj Jarange-Patil, whose indefinite hunger strike entered the seventhday on Tuesday, again appealed to his supporters in the state to refrain from any violence and carry out a peaceful agitation.

Arson, roadblocks rock Maha on third day of Maratha pro-quota protests

Nashik Commissioner of Police <keyword id="20496135" type="General" weightage="20" keywordseo="sandeep-karnik" source="keywords">Sandeep Karnik</keyword> will be the head of the SIT. The SIT was formed on the instructions of the Maharashtra assembly speaker after the matter of threats issued to Deputy Chief Minister Fadanvis was raised in the Assembly by BJP MLAs. On February 28, speaking in the Maharashtra Legislative Council, CM Eknath Shinde said ""Many leaders have become big on the issue of Martha reservation, <keyword id="20040954" type="General" weightage="20" keywordseo="jarange-patil" source="keywords">Jarange patil</keyword> raised demands for Maratha reservation he didn't had any political background and even I went to him. Keeping all the protocols aside I visited him twice. But now he is making remarks against DCM, our ministers and on the government... why? He is using low level language against the DCM, this language is not of karaykarta it's a political language. There are many other castes leaving in the state but this is an attempt to creat conflict between castes too. We won't tolerate such language against anyone. So let SIT investigate the matter and let the truth come out (doodh ka doodh paka pani hone do)" "We have given reservation to Maratha and it will stand in the court too all the guidelines and norms of court has been studied properly and accordingly. We have given reservation, there is no injustice done on any other community but people are spreading rumours that this reservation won't stand in court why? Who is spreading this?" the Maharastra CM said. Jarange-Patil's Maratha reservation campaign is accused of receiving financial support from 'political associates,' and it is alleged that he made inflammatory remarks during the course of the campaign. The Maharashtra State Government had indicated that if Jarange Patil's agitation for the Maratha Reservation is politically motivated, funded, and intended to cause unrest, a comprehensive SIT inquiry would be conducted to assess its implications on law and order in the state. The demand for an inquiry was raised by BJP MLA Ashish Shelar, after which Mharashtra Legislative Assembly Speaker <keyword id="20924374" type="General" weightage="20" keywordseo="rahul-narvekar" source="keywords">Rahul Narvekar</keyword> ordered a SIT probe. Jarange Patil's appeal reportedly led to a significant road blockade in Beed district, causing inconvenience to the public. The police responded by registering a case against him. Maharashtra govt constitutes SIT to probe violence during Maratha agitation

Deshmukh, who is the state medical education minister, said his department will move a proposal in this regard before the state cabinet. The Supreme Court in September this year stayed the implementation of <keyword id="1643654" type="PERSON" weightage="20" keywordseo="Maratha-quota">Maratha quota</keyword> in jobs and education and referred the matter to a larger bench. The Maharashtra government later filed an application before a larger bench of the SC, seeking vacation of the stay on implementation of the quota. The state government is thinking of how students who have been affected by the Supreme Court's interim stay on implementation of Maratha quota can be given relief in admissions to medical education, Deshmukh told a TV channel. Asked if the government will reimburse their fees, he said, "...this (reimbursing fees) could be an option and the proposal will be moved before the cabinet by the medical education department." "Chief Minister Uddhav Thackeray ji will take a final call on the same after the cabinet discusses it," he said. Deshmukh also said the Maha Vikas Aghadi government -- comprising the Shiv Sena, NCP and Congress -- is committed to ensure that Maratha community students do not suffer. The <keyword id="13126" type="COMPANY" weightage="20" keywordseo="Maharashtra">Maharashtra</keyword> education department on Monday started <keyword id="1017385" type="PERSON" weightage="20" keywordseo="free-online-classes">free online classes</keyword> for 11th standard students to prevent loss of the academic session due to the COVID-19 outbreak, an official said. The classes have begun on YouTube and over 60,000 first-year junior college (FYJC or Class 11) students have so far enrolled for these classes, State Council of Educational Research and Training (SCERT) Director Dinkar Patil said. The decision to start online classes free of charge for FYJC Arts, Science and Commerce students was taken to avoid the academic loss till colleges start functioning normally, he said. The admission process for the FYJC currently stands suspended due to the COVID-19 pandemic and the Supreme Court order staying the implementation of reservation for Marathas in jobs and education. "Schools and colleges in the state are shut due to COVID-19 outbreak. Besides the pandemic, the admission process for FYJC is suspended due to the ongoing Maratha quota issue," Patil noted. "To avoid the academic loss, we decided to start free online classes for Arts, Science, Commerce students through YouTube," he said. Patil said till Sunday evening, they received around 62,000 registrations from 11th standard students for the online classes across the state. The registration is still going on, he added. As per the SCERT's data, over 9,000 FYJC students from Pune and 7,600 from Mumbai have registered for the online classes.
