Mumbai, Former Lok Sabha Speaker and ex-Maharashtra Chief Minister Manohar G. <keyword id="19952829" type="General" weightage="20" keywordseo="joshi" source="keywords">Joshi</keyword>, a senior <keyword id="19905334" type="General" weightage="20" keywordseo="shiv-sena" source="keywords">Shiv Sena</keyword> (UBT) leader, passed away following a heart attack early on Friday morning. "Our family is deeply saddened to inform you that <keyword id="20281058" type="General" weightage="20" keywordseo="manohar-joshi" source="keywords">Manohar Joshi</keyword> passed away today morning at 3 a.m. following prolonged age related health issues," his family said in a terse announcement at dawn. Joshi, 86, was rushed to the Hinduja Hospital in Mahim after suffering a heart attack late on Thursday. 'Sir', as he was popular in political circles because of his teaching background and a stern demeanour, succumbed during treatment around 3 a.m., plunging the state political fraternity into gloom. His family said that Joshi's mortal remains will be kept at their home in Matunga to enable people to pay their last respects from 11 a.m. - 2 p.m., and then taken in a procession for the funeral at Dadar Crematorium around 3 p.m. One of the closest confidantes of the late Shiv Sena founder Balasaheb Thackeray, Joshi had over six decades in politics starting as a Municipal Corporator, then Mayor, Maharashtra CM, Union Minister, then crowning glory as the Speaker of Lok Sabha. Joshi had been suffering from certain old-age related ailments for the past several months and largely kept out of public glare, but remained with the SS-UBT, till he breathed his last. Top leaders across the political spectrum have paid rich tributes to Joshi who headed the first-ever saffron government in the state comprising the undivided Shiv Sena-Bharatiya Janata Party (1995-1999), in an era when politics was more principled and less unscrupulous. Manohar Joshi: The 'Sir' with a stern demeanour

Ahead of his possible resignation, Chief Minister <keyword id="53973" type="General" weightage="20" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword> started making 'final calls' after his emotional challenge to the rebels previous evening that he was ready to quit the post (CM) as well as <keyword id="110829" type="General" weightage="20" keywordseo="shiv-sena-chief" source="Orion">Shiv Sena chief</keyword>, here on Thursday. "About 20 MLAs are in touch with us... When they come to Mumbai, you will get to know. We will reveal soon under what circumstances and pressures these (rebel) MLAs left us," declared Raut. Uddhav Thackeray starts making farewell calls ahead of possible resignation

The move came hours after his emotional appeal to the rebel group of Shiv Sena MLAs, led by Minister Eknath Shinde, that he (Thackeray) was ready to quit both as as CM and as party President, provided the rebels met him and made the demand. Thackeray - who tested Covid-19 positive this morning - also said that he had kept his resignation letter ready and any of the rebels could go and hand it over to the Governor. On his part, Shinde responded by saying that steps would have to be taken for Hindutva and reiterated his demand to break off with the Nationalist Congress Party and Congress to form the government with the Bharatiya Janata Party. The crisis shows no sign of defusing despite effects by the MVA allies, the offer to quit by the CM, and even his decision to vacate his official residence.

CM Uddhav Thackeray 'quits' official residence, returns to private home

New Delhi, The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> Thursday held the Maharashtra governor was not justified in calling upon then chief minister <keyword id="53973" type="General" weightage="20" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword> to prove majority in the Assembly on June 30 last year but refused to order status quo ante, saying he did not face the floor test and resigned. It, however, said since Thackeray had resigned without facing the floor test, the governor was justified in inviting Shinde to form government at the behest of the BJP which was the largest political party in the House. In a unanimous verdict on a batch of pleas related to the political crisis that led to the fall of the Maha Vikas Aghadi (MVA) government led by Thackeray following a revolt by the <keyword id="193503" type="General" weightage="20" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword> faction, a five-judge Constitution bench headed by Chief Justice of India D Y Chandrachud held that House speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal". "The governor was not justified in calling upon Thackeray to prove his majority on the floor of the House because he did not have reasons based on objective material before him to reach the conclusion that Thackeray had lost the confidence of the House," said the bench which also comprised Justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha. "However, the status quo ante can't be restored because Thackeray did not face the floor test and tendered his resignation. The governor was, therefore, justified in inviting Shinde to form the government at the behest of the BJP which was the largest political party in the house," it said. The top court also referred the 2016 Nabam Rebia verdict by a five-judge constitution bench, which relates to the power of speaker on disqualification of MLAs, to a larger bench of seven judges.

While the <keyword id="6358821" type="General" weightage="20" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> legislators had no access to the chief minister, the Congress and NCP, which are the "real opponents" of the Sena, were getting all the attention, he claimed in the letter, dated June 22. The Sena shares power with the NCP and Congress in Maharashtra. Shirsat, the MLA from Aurangabad (West) Assembly constituency, in the letter claimed that despite the Shiv Sena being in power and having its own chief minister, the coterie around Thackeray never allowed them access to 'Varsha', the CM's official residence. There was no question of going to 'Mantralaya', the state secretariat, because the chief minister never came there, he said. The letter was posted by Shinde on his Twitter handle, claiming these were the sentiments of the Sena MLAs. Shinde is currently camping with some rebel MLAs in Assam's Guwahati city, plunging the Sena-led Maharashtra government into a crisis. In the letter, Shirsat said Eknath Shinde opened doors for the party MLAs to listen to their grievances, issues about development work in their constituencies and related fund, and problems with allies Congress and NCP. "Only Shinde heard us out and took steps to resolve all the problems. The party MLAs persuaded Shinde to take this step (of revolt) for the rights of all the legislators," Shirsat said in the letter. While the Shiv Sena legislators had no access to the chief minister, the Congress and NCP, which are the "real opponents" of the Shiv Sena, were getting all the attention, he claimed. "The Shiv Sena votes did not split in the Rajya Sabha polls, then why so much distrust in us for the Legislative Council polls?" he asked. The Shiv Sena-led tripartite Maha Vikas Aghadi (MVA) in Maharashtra was trumped by the BJP in the Rajya Sabha polls to six seats from the state on June 10, when the Sena's second candidate, Sanjay Pawar, lost to BJP's Dhananjay Mahadik. In the MLC polls to 10 seats held on June 20, the MVA again suffered a setback when it lost one out of the six seats it contested. The opposition BJP in the state won all the five seats which it had contested. Maharashtra Chief Minister Uddhav Thackeray on Wednesday night moved out of his official residence 'Varsha' in south Mumbai and shifted to Matoshree, the Thackeray family's private bungalow in suburban Bandra, amid high drama, as the Shiv Sena asserted he will not resign in the wake of rebellion by Shinde. Referring to the show of strength by Shiv Sainiks at 'Varsha' on Wednesday, Shirsat in the letter said, ''The doors of Varsha opened for the common people in the real sense yesterday. These doors were closed for us despite being the Shiv Sena MLAs." "The cotorie around you never allowed us access to you. Whenever we got a call from 'Varsha' that you would like to meet us, we were made to wait for several hours by your cotorie. They never took our calls...why should we be humiliated like this despite being elected by three to four lakh people?" the legislator sought to know. Shirsat also said the party MLAs were not allowed to accompany Maharashtra cabinet minister Aaditya Thackeray (the CM's son) to Ayodhya (in Uttar Pradesh during his visit on June 15). Maha crisis: Fadvanis, Shinde to decide the next course of action

The plea challenging the Governor's direction was mentioned before a vacation bench of Justices Surya Kant and J B Pardiwala who took note of submissions of senior advocate A M Singhvi that an urgent hearing was needed and is scheduled to hear the matter at 5 pm. The petition contended that Governor Bhagat Singh Koshyari vide communication dated June 28, 2022 (which was received today i.e., on June 29 at about 9:00 am) has decided to hold a floor test in complete defiance of the fact that this court is seized of the issue of the disqualification proceedings. "Such undue haste is manifestly arbitrary and therefore violative of Article 14," said the plea and sought directions seeking setting aside of the impugned communication sent by the Governor to the Chief Minister as well as to the secretary of the Assembly. "It is submitted that this Court is considering the validity of the disqualification proceedings and has kept the matter for hearing on July 11, 2022. The issue of disqualification is directly connected/interlinked with the issue of floor tests. "It is submitted that the impugned communications are entirely based on media reports with no concrete material whatsoever. None of the 39 MLAs, it appears, have individually or collectively written to the Hon'ble Governor about their decision to withdraw support from the MVA-led government," the plea said. Prabhu submitted in his plea that the impugned directions ought not to have been issued without the aid and advice of the council of the ministers led by the Chief Minister. "It is surprising that the leader of the opposition admittedly meets the Governor at 10:00 pm on June 28, 2022, and the impugned communications are also of the same date. This only shows the undue haste with which the Hon'ble Governor has acted without even asking the CM for his views in respect of the political scenario in the State. "The impugned directions, it seems, have been issued on the 'aid and advice of the leader of the opposition, which is clearly not contemplated under the constitution," the plea said. The petition stated that there is absolutely no ground or material to call for an urgent floor test on June 30, 2022, when this court is already seized of parallel proceedings and wherein constitutional issues are to be decided. An equally concomitant consideration and constitutional imperative in the Tenth Schedule of the Constitution which prescribes and outlines who can be entitled to vote or be a part of the Assembly," the plea said. Prabhu contended that the respondents in the disqualification petitions have already lost their membership on the day they voluntarily gave up their membership from Shiv Sena. "The disqualification proceedings under the Tenth Schedule are only a formal adjudication of this fact or otherwise of disqualification. The order of the Speaker/Deputy Speaker is an ex post facto recognition of the event of disqualification which had occurred at an anterior point of time," it said.
