The <keyword id="6360667" type="General" weightage="20" keywordseo="madras-high-court" source="Orion">Madras High Court</keyword> on Thursday stayed two sub-sections under <keyword id="10826959" type="General" weightage="20" keywordseo="IT-rules-2021" source="Orion">IT Rules 2021</keyword>'s Rule 9, which provide for a three-tier structure for addressing the grievances made in relation to publishers, under the Code of Ethics annexed to the rules. A bench of Chief Justice Sanjib Banerjee and Justice P.D. Audikesavulu passed the order on two petitions that were filed challenging the validity of the <keyword id="645424" type="General" weightage="20" keywordseo="it-rules" source="Orion">IT Rules</keyword>. Carnatic musician T.M. Krishna had filed a public interest litigation, while the Digital News Publishers Association, and journalist Mukund Padmanabhan had also filed a writ petition in the matter. "There is a substantial basis to the petitioners' assertion that there may be a violation of Article 19 (1)(a) (of the Constitution) in how the Rules may be coercively applied to intermediaries....," the court observed. Earlier, the same sub-section of Rule 9 had been stayed by the Bombay High Court on August 14. With the Supreme Court scheduled to take up transfer petitions next month, the Madras High Court posted further hearing of the case to October 27. Madras High Court stays 2 sub-sections of the new IT Rules

<keyword id="6354742" type="General" weightage="20" keywordseo="Flipkart" source="Orion">Flipkart</keyword> co-founder <keyword id="225032" type="General" weightage="20" keywordseo="Sachin-Bansal" source="Orion">Sachin Bansal</keyword> has moved the Madras High Court challenging a show cause notice (SCN) dated July 1 this year issued by the Enforcement Directorate (ED), which held that he and another individual were personally responsible for the alleged violation of FDI policy involving a staggering amount of approximately ₹23,000 crore. Justice R Mahadevan, before whom the writ petition from Bansal came up for hearing on Friday, pulled up the authorities for the delay of 12 years in issuing the notice and adjourned the matter by three weeks, after directing the ED and its officials to file the counters. The petition sought to quash the notice as illegal and arbitrary, insofar as he is concerned. The interim prayer is to stay its operation. The SCN was issued on the basis of a complaint filed by the Deputy Director of Enforcement in Bengaluru, for instituting adjudication proceedings under Sec.16 of the Foreign Exchange Maintenance Act (FEMA) against the petitioner, another co-founder Binny Bansal of the e-commerce giant, Accel, Tiger Global, Subrata Mitra (nominee director of Accel) and Lee Fixel (nominee director of Tiger Global) on the alleged contravention of the various provisions of the FEMA. The notice was issued pursuant to an alleged non-compliance with a condition prescribed vide the Consolidated Foreign Direct Investment Policy of 2010 dated April 1, 2010 in respect of issuance of shares of certain Flipkart group companies to foreign investors during 2009-14. According to Bansal, he ceased to have any association with Flipkart and its group of companies, pursuant to his unanticipated exit following the acquisition of Flipkart by Wal-mart International Holding, Inc. on August 17, 2018. Among other things, he contended that issuance of the SCN was arbitrary, unreasonable and patently a perverse one, as it was issued after 12 years. The complaint followed an investigation by the Directorate of Enforcement in New Delhi, which commenced in 2012, i.e. 9 years ago. He had proactively participated and cooperated in the investigation undertaken by the ED. Given the substantial lapse of time following the inquiry, the petitioner has conducted himself under the bonafide belief that after due study of the materials obtained during the course of the probe, the ED had concluded that no action was warranted in the matter. And, he had effected bonafide transfers to third parties in the intervening period and had completely exited from the Flipkart group in August 2018. However, to the utter shock and dismay, the ED issued the notices, he contended. Specifically, there is no statutory period prescribed under FEMA within which the authorities concerned were required to file the complaint for initiating the adjudication proceedings. In the absence of any period of limitation under the statute, it has been settled by the <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> in various judgments that the Constitution requires every authority, including the ED, to exercise its power to file a complaint within a reasonable time, failing which the actions taken by the statutory authority will be amenable to the writ jurisdiction of constitutional courts, petitioner said.  TikTok was banned in the south Indian state of Tamil Nadu for ‘encouraging porn’ last week by the Madras High Court. The Indian high court’s <a href="https://www.businessinsider.in/tiktok-ban-in-india-for-hosting-porn/articleshow/68720430.cms">interim order</a> also included a request to the central government of India to advocate a ban nationwide. The Chinese video-based social networking app then <a href="https://www.businessinsider.in/tiktoks-appeal-against-ban-for-hosting-porn-in-indian-supreme-court/articleshow/68851962.cms">filed a petition</a> with India’s supreme court citing their concern that the ban on TikTok will “amount to curtailing the rights of the citizens of India.” They also expressed that they’re not responsible for third-party content on their platform and the Information Technology (Intermediaries Guidelines) Rules, 2011 gives TikTok conditional legal safeguards in that regard. TikTok even <a href="https://www.gadgetsnow.com/tech-news/tiktok-removes-over-6-million-videos-for-violating-community-guidelines-in-india/articleshow/68865656.cms">removed</a> 6 million videos from its service last week to address the problem of inappropriate content on the app. When the matter finally came up in front of the court on Monday, the Supreme Court <a href="https://www.livemint.com/technology/tech-news/supreme-court-refuses-to-stay-ban-on-tiktok-app-use-1555312603858.html">refused</a> to implement a stay against the Madras High Court’s ban. Abhishek Manu Singhvi, a senior advocate and law council for ByteDance, explained that the ban was causing irreparable damage to the company. He further contested that the Indian High Court in Madras had issued an interim order without giving TikTok the opportunity to defend itself. The matter will be heard on April 16 by the Madras High Court. And, the three-person Supreme Court bench headed by Chief Justice Ranjan Gogoi will hear the case on April 22 after observing the proceedings tomorrow. <ul><li>The <keyword id="6360667" type="UNKNOWN" weightage="20" keywordseo="madras-high-court">Madras High Court</keyword> on Monday directed the Central government to constitute a committee to decide on the issue of providing OBC reservation in all-India seats (AIQ) surrendered by Tamil Nadu for medical admission.</li><li>Such a committee comprising representatives from Centre, state and Medical Council of India should be constituted within three months, the court said.</li><li>The first bench of Chief Justice AP Sahi and Justice Senthilkumar Ramamoorthy also made it clear that any decision made by the committee shall be applicable only from the next academic year. </li></ul> The Madras High Court on Monday directed the Central government to constitute a committee to decide on the issue of providing OBC reservation in all-India seats (AIQ) surrendered by Tamil Nadu for medical admission. Disposing of the petitions, the court also observed that it is open for the Centre to pass any legislation to provide OBC reservation in AIQ seats for medical admission. Madras High Court directs Centre to form committee to decide on OBC reservation in all-India quota

<ul><li><keyword id="6360667" type="General" weightage="20" keywordseo="madras-high-court" source="Orion">Madras High Court</keyword> reiterated that <keyword id="790242" type="General" weightage="20" keywordseo="whatsapp" source="Orion">WhatsApp</keyword> <keyword id="4484267" type="General" weightage="20" keywordseo="group-admin" source="Orion">group admin</keyword> are not liable for member’s posts.</li><li>Justice GR Swaminathan referred to a similar judgement given by the <keyword id="48485" type="General" weightage="20" keywordseo="bombay-high-court" source="Orion">Bombay High Court</keyword> before giving his orders.</li><li>The Court asked the respondent to bear in mind the ruling of the Bombay High Court.</li></ul>The Madurai bench of the Madras High Court reiterated the Bombay High Court’s finding of a previous case that a <keyword id="6407380" type="General" weightage="20" keywordseo="whatsapp-group" source="Orion">WhatsApp group</keyword> administrator cannot be held liable for objectionable content posted by members of the groups. Justice GR Swaminathan referred to the <a href="https://www.barandbench.com/news/litigation/whatsapp-group-administrator-no-vicarious-liability-content-group-member-bombay-high-court">Kishore v. State Maharashtra</a> of the Bombay High Court which ruled that a WhatsApp group admin must be deleted from the list of accused if he did not play any part in the crime committed by group members other than being an admin. However, the Court also held that if another material is gathered that shows the admin being involved in the crime, he may be tried according to the law. The order was given on a plea that seeks to cancel a First Information Report (FIR) against the group admin in which offensive messages were circulated by a member that could cause animosity between communities. The petition claimed that the petitioner was only the administrator of the WhatsApp group and he could not be held responsible for the messages sent by the group members. As per the complainant, the petitioner lacked honesty, claiming that there was a conspiracy between the group admin and the member since the member was first removed from the group and then re-added. The Court disposed of the complaint and asked the respondent to bear in mind the ruling of the Bombay High Court in Kishore vs. State Maharashtra, where a similar case on the liability of a WhatsApp group admin was discussed. In that ruling, the Bombay High Court had held, “a group administrator cannot be held vicariously liable for an act of a member of the group, who posts objectionable content unless it is shown that there was a common intention or pre-arranged plan acting in concert pursuant to such plan by such member of a Whatsapp group and the administrator.” The Bombay High Court also stated that the group admin had limited powers of adding and deleting members and cannot be expected to have advanced knowledge of what the members of the group may post. In light of the above order, the Madras High Court judge declared that if the petitioner's only role in the case was that of a group admin, then the name must be deleted from the chargesheet. Madras High Court reaffirms that WhatsApp group admin isn’t liable for a member’s posts

<keyword id="2451412" type="UNKNOWN" weightage="100" keywordseo="Narang-International-Hotels">Narang International Hotels</keyword>, a Mumbai-based chain of hotels, has moved the <keyword id="6360667" type="ORGANIZATION" weightage="80" keywordseo="Madras-High-Court">Madras High Court</keyword>, seeking to wind up budget carrier <keyword id="6358032" type="CITY" weightage="100" keywordseo="SpiceJet">SpiceJet</keyword> for not paying the accumulated in-flight service charges, which are about Rs 8 crore. 
 
The court has issued notices to the SpiceJet management asking it to file its reply in four weeks. 
 
Narang has been handling catering services for SpiceJet flights on Delhi and Mumbai sectors since May 12, 2005, said the petition. It added that the airline’s management was contractually mandated to settle payment every 15 days.

Situation in the state capital has worsened with four major reservoirs that used to supply Chennai its water, have gone bone dry. According to a <a href="http://www.newindianexpress.com/states/tamil-nadu/2019/jul/03/woman-spots-missing-hubby-on-tiktok-reunites-with-him-1998662.html">reports</a>, Jayapradha who hails from Villupuram had filed a complaint about her missing husband Suresh in 2016. Three years later, a relative spotted someone who looked like Suresh and when she checked with Jayapradha it turned out to be Suresh indeed. Jayapradha then alerted Villapuram police who then tracked down Suresh at Hosur. An unhappy Suresh had apparently fled from his home to Hosur. He had taken up the job of a mechanic and was living with a transwoman. However, these are not the only bizarre cases of TikTok reported from the state of Tamil Nadu. Earlier in <a href="https://www.wionews.com/india-news/asked-to-stop-using-tiktok-tamil-nadu-woman-kills-self-records-act-on-app-226740">June 2019</a>, a 24-year old woman from Ariyalur took her own life after her husband stopped her from using the app. In Tamil Nadu, the craze for TikTok has not just been a problem with the people but with the government too. The Madras High Court had banned the app in the state stating that the video-sharing app encouraged pornography. It had also said that they will ask the Supreme Court to further support the ban. However, the ban was soon lifted on the condition of quality control.

SR Technics is a maintenance, repair and operations service provider for aircraft, engines and components. <ul><li>India’s Supreme Court has given the government until January 15 to lay out the rules and regulations for social networking sites like Facebook and Twitter. </li><li>The Supreme Court has also pulled in petitions related to social networks that were pending with various high courts. </li><li>It has promised to resolve the pending cases by the end of January. </li></ul>Hate speech and fake news are extremely common across social media in India. To deal with this menace, Indian Supreme Court has asked the government to come out with new rules and regulations by 15 January 2020. The bench, headed by Justices Deepak Gupta and Aniruddha Bose, also directed all pending cases pertaining to social media filed with various high courts to be transferred to the Supreme Court. There are four petitions in the fray. Two filed with the Madras High Court, one with the Madhya Pradesh High Court and another with the Bombay High Court. The primary issue at the helm was the linking of Aadhaar cards with social networks and WhatsApp-- which is pending with the Madras High Court. The petition filed by Facebook argues that disclosure of Aadhaar details will infringe user privacy. The bench also clarified that India’s Information Technology Act allows the government to ask for decryption of data. At the same time, it does not allow the government to force intermediaries to decrypt the data. It added that while national interest is important, it must be balanced against privacy.
