A jury gave the verdict on Tuesday in a civil case hinging on an attack in a fitting room in a high-end store decades ago and Trump defaming her by calling her accusations a "hoax". The jury did not accept her claim of rape, but declared him liable for sexual abuse and defamation. E. Jean <keyword id="319153" type="General" weightage="80" keywordseo="carroll" source="Orion">Carroll</keyword>, 79, brought the case against the front-runner to be the Republican Party's presidential candidate next year, Trump, who she said had raped her decades ago, but was not sure when it happened. In a post on Truth Social media, Trump characteristically called the verdict a "continuing of the greatest witchhunt of all time" and said he would appeal. There was a large crowd of demonstrators outside the courthouse denouncing his treatment of women when the verdict came down. Carroll was a columnist for the Elle magazine at the time she said she was attacked around 1996. Trump is facing a criminal case brought by a local prosecutor in New York accusing him of falsifying business records to cover up payments made to a woman who claimed to have had an affair with him. If convicted in that case, he could be sentenced to prison time, although that would not bar him from running for election under the US Constitution. The first former President to face criminal charges, Trump was arrested and produced in court last month but was released pending the trial that could take place early next year. The latest opinion poll by ABC News and The Washington Post taken before the verdict showed him six percentage points ahead of President Joe Biden. Trump, who is busy campaigning for his presidential run, did not take the witness stand to contest Carroll's case. Several women have accused him of rape and sex abuse, but the thrice-married Trump, who once revelled in the image of a playboy, has not faced criminal charges. A damning piece of evidence introduced against him related to a video of him using an obscenity and saying, "When you're a star, they let you do it. You can do anything, grab 'em by the (genitals)." During a deposition - testimony and cross-examination outside a court to speed up the trial - he defended the statement saying that "historically that is true" when asked about it by Carroll's lawyer. A video of his statement made during the cross-examination was shown to the jury, a citizens' panel made up of three women and six men, which gave the verdict in less than three hours of deliberations after eight days of the trial. Carroll herself took the stand at the trial as did two other women who said that they had been abused by Trump, one of them while on a plane. "I'm here because Donald Trump raped me," Carroll told the jury and gave a graphic description of Trump abusing her with his fingers before raping her. She said that the encounter took place in the lingerie department of the department store when he approached her on the pretext of trying to find a gift for a woman friend. He banged her head on the wall of a fitting room before the attack, she said. Carroll first made the accusations public while the presidential race was heating up in 2019 in a magazine excerpt ahead of the publication of her book, What do We Need Men For"? in which she wrote about the assault more than two decades after the attack. He was unaffected by the disclosure and he contested the election next year, even as other women made accusations against him. Trump's lawyer Joe Tacopina questioned Carroll's credibility, saying that she did not report the attack to the police, didn't remember the day it took place and brought it up decades later. From the witness stand in Manhattan federal court at the trial against the former president, Lisa Birnbach — who is a writer herself and best known for penning "The Official Preppy Handbook" — said that Carroll told her on the call that she ran into Trump at the luxury department store. Carroll told Birnbach she was helping him shop for a friend, when he led her to a dressing room, pinned her against the wall, and penetrated her with his penis, she testified.Birnbach said she was feeding her two young children dinner at the time, and walked out of the room to speak further with Carroll."I whispered, 'E. Jean, he raped you,'" Birnbach recalled on the stand.She said that Carroll didn't use the term "rape" at all during the call, instead describing it as a "fight." Birnbach said she encouraged Carroll to go to the police, but Carroll was adamant she didn't want to report the alleged assault. The trial began last week, and Carroll finished testifying on Monday.The ex-president's legal team has argued that Carroll invented the rape accusation, and suggested that she was motivated to do so because of his political positions.Birnbach recalled she hosted an election night party in November 2016, which Carroll attended, and recalled being in dismay that Trump had raced ahead of Hillary Clinton in the election results. Jean Carroll, Lisa Birnbach, and Carol Martin hated Donald Trump, loathed Donald Trump politically, not because anyone got raped, but just politically they hated him," Tacopina told jurors in his opening statement.<h2>Carroll and her friends did not like Trump's politics, to put it mildly</h2>The diagnosis of "Trump Derangement Syndrome" came into vogue during the 2016 election, as Trump's defenders — or at least critics of his opponents — tried to paint liberals as obsessing and overreacting to his many controversies.Carroll, Birnbach, and Martin also happened to be journalists — or as Trump likes to call them, "enemies of the people" who can't be trusted. Birnbach and Natasha Stoynoff, <a href="https://www.businessinsider.com/trump-calls-e-jean-carroll-accusation-a-disgusting-story-2023-5">another woman who accused Trump of rape and who testified in the trial</a>, even wrote magazine articles about Trump's personal life in the years that he was a tabloid fixture. Jessica Leeds, yet another accuser <a href="https://www.businessinsider.com/jessica-leeds-testifies-e-jean-carroll-trial-trump-sexual-assault-2023-5">who testified in the case</a>, said she consistently voted for Democrats in major elections.After Trump became a presidential candidate in 2015, and in 2016, Birnbach was a prolific podcaster and occasional radio show and cable news guest.During cross-examination, <a href="https://www.businessinsider.com/e-jean-carroll-friend-urged-trump-rape-report-police-2023-5">Trump's lawyer brought up</a> some pointed comments she made about the now-former president.Did she call him a "narcissistic sociopath"? "That sounds right," Birnbach answered. Birnbach previously said she thought about Trump "every hour, every day that I'm awake, and unfortunately when I sleep.""The guy had done a lot of bad things and I was hoping that there would be — at some point he would have to account for them," Birnbach said.<h2>A plot against Trump — or a stuffed squirrel?</h2>Martin <a href="https://www.businessinsider.com/e-jean-carroll-rape-corroborator-addresses-anti-trump-views-2023-5">did not have anything nice to say about Trump, either</a>. In emails and text messages, she said Trump was "demonic" and "spreading his stank" over the country, and made jokes about an uncorroborated claim that Trump enjoyed women urinating on him. She called Trump's daughter Ivanka Trump and son-in-law Jared Kushner "two junior grifters sashaying into meetings with world leaders."In a 2017 email shown at trial, Martin called Trump "Orange Crush" and made a reference to meeting up with Carroll to "scheme," saying "we must both do our patriotic duty." Carroll responded with "TOTALLY!!! I have something special for you when we meet."Asked about that email by Tacopina, Martin testified she believed "scheme" was a reference to supporting Democratic party causes, and the "something special" Carroll promised was a stuffed squirrel that was a gift for her granddaughter.<div type="image" title="e jean carroll courtroom sketch trump deposition" height="2268" width="3024" msid="100036740" hostid="261" sizebytes="988110"></div>But even Martin seemed — at least for a brief time — ambivalent about Carroll's intentions behind the lawsuit. Tacopina suggested Carroll enjoyed the attention her accusations against Trump brought her."It's gone to another level and not something I can relate to," Martin said. "For her sadly, I think this quest has become a lifestyle."In none of the unfavorable descriptions of Trump, Tacopina pointed out, did Martin describe him as "a rapist."<h2>"You can't beat up on me for not screaming"</h2>Trump's lawyers have taken pains to note that, while Carroll hated Trump, she went public with her story through a book and magazine article, not a call to the police. She also <a href="https://www.businessinsider.com/trump-lawyer-questions-e-jean-carroll-scream-alleged-rape-2023-4">didn't scream or cry while Trump allegedly raped her</a>, Tacopina noted.Michelle Simpson Tuegel, an attorney who's represented hundreds of sexual violence victims, including the victims of Olympic gymnast coach Larry Nassar, says the "victim blaming" approach could backfire with the jury. Neither would lie to "stop the Trump train," they said."I am here because my friend — my good friend who is a good person — told me something terrible that happened to her, and as a result she lost her employment and her life became very, very difficult," Birnbach testified. "I am here because I am her friend and I want the world to know that she was telling the truth."<h2>Carroll is well-connected in the #Resistance</h2>Carroll's own politics were a focal point in her testimony. In a moment that made US District Judge Lewis Kaplan stifle laughs, Carroll talked about how she jokingly suggested in one of her books that all men should be rounded up, brought to Montana, and "retrained." Tacopina also pressed her about her votes for Democrats, and her comments that Trump could get bogged down by investigations."Ms. Carroll has said that if Donald Trump has to deal with so many lawsuits, he won't be able to run for office," Trump's attorney Joe Tacopina said in his opening statement last week. "And here we are."Tacopina brought up emails where Carroll referenced friendships with a murderer's row of MSNBC fixtures. In her emails to friends, Carroll talks about hanging out with Mary Trump, columnists Molly Jong-Fast and Margaret Sullivan, and legal and political commentators Joyce Vance, Katie Phang, and Jen Taub. Carroll discussed planning to hold a sort of listening party for one of her own court hearings, where the group would dial in from the Ruth Bader Ginsburg conference room in the Empire State Building.By Trump's attorneys lights, this made Carroll a part of <a href="https://www.nytimes.com/2017/01/31/magazine/a-resistance-stands-against-trump-but-what-will-it-stand-for.html">the #Resistance:</a> the big-tent political movement that sought to stop Trump. It was through these anti-Trump circles that Carroll met George Conway, a Republican lawyer who despised Trump and was at the time married to Kellyanne Conway, one his chief advisors. It's not true," he snarled. "An you know it's not true, too — you're a political operative. You're a disgrace."That claim — that Carroll is a politically motivated liar — is precisely the thing that Carroll is suing him over by bringing a defamation lawsuit. The subject has become a sticking point for Trump's lawyers in their questions. Why sue Trump and not, say, former CBS CEO Les Moonves, who Carroll also accused of rape? (Moonves has denied the allegation.)"Donald Trump called me a liar, said I was pulling a scam, said I was running a con, that I was a Democratic operative, that I had accused other men of rape, that I was in it for the money, that I was in it for the attention," Carroll said on the stand. "And Les Moonves stayed quiet."Will any of this play well with a jury? Probably not, Simpson Tuegel said."It's hard for me to imagine that someone would be willing to be under that level of public scrutiny, and being under such a painstaking microscope, and to relive the worst moments of their life, for political reasons," she said. "The recent narrative regarding this trial being a liberal scheme is offensive not just to the women in this case, but to all survivors of sexual assault who are impacted regardless of your politics."Carroll herself has said she likes being in the spotlight. But not as a rape victim."I like attention. There is no question, I like attention," she said in response to Tacopina's questions. "I don't particularly like attention because I'm suing Donald Trump. Jean Carroll in the 1990s, and that he defamed her by denying it. After two weeks of trial testimony and arguments, jurors arrived at their verdict after about 2 1/2 hours of deliberating. The jury has awarded Carroll $5 million total in damages. The jury didn't find that Trump raped Carroll, which was a verdict it could have returned. In court, Carroll hung her head when the jury returned a not-liable verdict for rape, but lifted it again when they found that Trump was liable for sexually abusing her in the Bergdorf Goodman dressing room. The biggest chunk of the awarded damages is $2 million for the sexual abuse finding. Then, $1.7 million was awarded for reputational damage. Carroll left court without speaking to reporters. In an emailed statement later Tuesday afternoon, she said the verdict was a victory for all women whose accusations of abuse were not believed."I filed this lawsuit against Donald Trump to clear my name and to get my life back," Carroll said. "Today, the world finally knows the truth. This victory is not just for me but for every woman who has suffered because she was not believed."Trump responded to the verdict in a Truth Social post, where he continued to deny knowing Carroll. I wouldn't tell anybody this," Martin said on the podcast.Ultimately, Carroll said she decided to stay silent for decades because she blamed herself for the incident.She wrote that the accusations against former Hollywood mogul Harvey Weinstein and the Me Too movement led her to speak out. On Thursday, the White House did not immediately respond to a request from Business Insider to comment on Birnbach's and Martin's accounts.Trump has strenuously denied Carroll's accusations, claiming she was "totally lying" about the incident."I'll say it with great respect: Number one, she's not my type.
