The Supreme Court on Wednesday asked the Union government if a change in law is warranted on the legal question of whether a person holding a driving licence for a light motor vehicle is entitled to legally drive a <keyword id="1049502" type="General" weightage="20" keywordseo="transport-vehicle" source="Orion">transport vehicle</keyword> of a particular weight. Observing that these are policy issues impacting the livelihood of lakhs of people, a five-judge constitution bench headed by Chief Justice <keyword id="445662" type="General" weightage="50" keywordseo="d-y-chandrachud" source="Orion">D Y Chandrachud</keyword> said the government needs to take a "fresh look" at the matter while asserting that it needs to be taken up at the policy level. The top court asked the Centre to wrap up the exercise within two months and apprise it about the decision taken. It said any interpretation of the law must duly take into account valid concerns of road safety and the safety of other users of public transport. The top court had earlier sought the assistance of Attorney General R Venkataramani in dealing with a legal question about whether a person holding a driving licence for a light motor vehicle is entitled to legally drive a transport vehicle of a particular weight. The constitution bench had said knowing the position of the Ministry of Road Transport and Highways will be necessary after it was argued that the apex court's 2017 verdict in the case of Mukund Dewangan versus Oriental Insurance Company Limited was accepted by the Centre and rules were amended to align them with the judgement. In the Mukund Dewangan case, a three-judge bench of the top court had held that transport vehicles, the gross weight of which does not exceed 7,500 kg, are not excluded from the definition of LMV. "There may be lakhs of drivers across the country who are working on the basis of Dewangan judgment. This is not a constitutional issue. It is purely a statutory issue," the bench, also comprising Justices Hrishikesh Roy, P S Narasimha, Pankaj Mithal and Manoj Misra, said. "This is just not the question of law but also the social impact of the law... Road safety has to be balanced with the social purpose of the law and you have to see if this causes serious hardships. We cannot decide issues of social policy in a constitution bench," it said. The apex court said once the government informs its stand to the court, the hearing in the constitution bench will be taken up thereafter. The Constitution bench is dealing with a legal question which reads: "Whether a person holding a driving licence in respect of 'light motor vehicle' could on the strength of that licence, be entitled to drive a 'transport vehicle of light motor vehicle class' having unladen weight not exceeding 7,500 kg." On July 18, the constitution bench commenced hearing as many as 76 petitions to deal with the legal question. It had then heard the arguments of senior advocate Siddharth Dave, appearing for one of the petitioners, on alleged anomalies in the Motor Vehicle Act with regard to regimes for dealing with the grant of driving licenses for different categories of vehicles. The lead petition was filed by M/s Bajaj Allianz General Insurance Co Ltd. The legal question has given rise to various disputes over payment of claims by insurance companies in accident cases involving transport vehicles being driven by those having licences to drive LMVs. The Motor Vehicle Act provides for different regimes for the granting of driving licences for different categories of vehicles. The matter was referred to the larger bench on March 8, 2022, by a three-judge bench headed by Justice U U Lalit, since retired. It was said that certain provisions of the law were not noticed by the apex court in the Mukund Dewangan judgement and "the controversy in question needs to be revisited".

The last date for public comment on the draft is October 20. According to the draft , the central government may, "waive in part or full any fee, including entry fees, license fees, registrations fees or any other fees or charges, interest, additional charges or penalty" for any licence holder or registered entity under the telecom rules. The bill proposes to exempt "press messages that are intended to be published in India" of correspondents accredited to the central or state government from interception. However, the exemption will not be granted in case of any public emergency or in the interest of the public safety, sovereignty, integrity or security of India, friendly relations with foreign states, public order, or to prevent incitement to an offence, according to the draft. In such cases "any message or class of messages, to or from any person or class of persons, or relating to any particular subject, brought for transmission by, or transmitted or received by any telecommunication services or telecommunication network, shall not be transmitted, or shall be intercepted or detained or disclosed" to the authorized officer, according to the draft bill. Despite the recent increase in drone attacks in the union territory of Jammu and Kashmir, the Ministry of Civil Aviation (MoCA) has abolished several approvals from the latest drone policy. MoCA has also increased the coverage of drones under the New Drone Policy of 2021 from 300 kilograms to 500 kilograms to include heavy payload-carrying drones and drone taxis. Other takeaways from Drone Rules, 2021: <ol><li>Number of permissions reduced from 25 to 5.</li><li>Maximum penalty under Drone Rules, 2021, reduced to ₹1 Lakh. This will not be applicable on penalties in respect to other laws.</li><li>No security clearance required before registration or licence issuance.</li><li>Fees for permissions will be reduced to nominal levels.</li><li>Interactive airspace maps with green, yellow and red zones will be displayed on the digital sky platform. Red zones are prohibited areas, yellow zones are controlled airspace and green zones are airspace from the ground up to a vertical distance of 400 feet.</li><li>The yellow zone has been reduced from 45 kilometre (km) to 12 km from the airport perimeter.</li><li>No permission required to operate a drone in green zone, upto 200 feet, between 8-12 KM from airport perimeter.</li><li>Online registration of all drones shall happen through the Digital Sky Platform.</li><li>Easy process prescribed for transfer and deregistration of existing drones in the country.</li><li>Safety features like ‘no permission-no takeoff (NPNT), real-time tracking beacon, geofencing to be notified from now. A minimum six-month lead time will be provided for compliance.</li><li>All drone training and examination to be carried out by an authorised drone school. The Directorate General of Civil Aviation (DGCA) will prescribe training requirements, oversee drone schools and provide pilot licenses online.</li><li>No requirement of type certificate, unique identification number, prior permission and remote pilot licence for R&amp;D entities.</li><li>No pilot license is required for operating nano and micro stones for non-commercial use.</li><li>Drone corridors will be developed for cargo deliveries.</li><li>Import of drones to be regulated by the Directorate General of Foreign Trade (DGFT).</li><li>Unmanned Aircraft Systems Promotion Council to be set up to facilitate a business-friendly regulatory regime.</li></ol>Earlier, there were many permissions required to operate drones in India but they have now been abolished. The Ministry of Road Transport and Highways has decided to extend the validity of driving licences and required documents of motor vehicles till December 30, 2020, in wake of the coronavirus pandemic, an official statement said on Monday. The ministry had earlier extended the validity of the documents till September 30. "Ministry of Road Transport and Highways has decided to extend the validity of Fitness, Permits, Licenses, Registration or other documents under Motor Vehicles Act, 1988 and Central Motor Vehicle Rules, 1989 till the 30th of December 2020," said the statement. It has further advised that all concerned documents whose extension of validity could not or not likely be granted due to the lockdown and which had expired since February 1, 2020 or would expire by December 31, 2020, may be treated to be valid till December 31, 2020. The Ministry of Road Transport and Highways (MoRTH) has invited suggestions and comments from all stakeholders including the general public on the proposed amendment in the Motor Vehicle Rules for enabling colour blind people procure driving licence, MoRTH said in a statement on Monday."It was brought to the notice of the ministry that the colour blind citizens were not being able to get the driving licence made although they are able to perform all functions properly except from identifying colours. The matter was sympathetically examined consulting the medical experts," the statement said. New Delhi, Dec 4 () The Securities Appellate Tribunal (SAT) has asked the NSE to take a decision by Friday in the matter of suspension of trading licence of Karvy Stock Broking Ltd.
 This comes after Karvy moved to SAT against the NSE's directive which suspended the broker's licence on Monday due to non-compliance of regulatory provisions of the exchange.
 This suspension pertains to its trading in capital market, futures &amp; options, currency derivatives, debt and commodity derivatives segments.
 Karvy had allegedly misused securities of over 95,000 clients which it was holding on behalf of the clients to raise over Rs 600 crore in loans from various lenders.
 In an order passed on Tuesday, the tribunal said that Karvy would be at liberty to file an appeal under the NSE Rules.
 "In case, if such an appeal is filed, appellant (Karvy) shall be heard as expeditiously as possible and in any event shall be decided by December 6, 2019.
 "In case the relevant authority would not be able to decide the appeal within the period, the decision on the temporary stay to the impugned order may be taken by the relevant authority on or before December 6, 2019," it added.
 The National Stock Exchange (NSE) in its report to Sebi on November 22 had said that Karvy was misusing the clients' securities and various other misappropriation of the clients' securities.
 Following this, markets regulator on the same day had barred Karvy from taking new clients in respect of its stock broking activities and also prevented it from using the power of attorney (PoA) given by clients after the broker was found to have allegedly misused clients' securities.
 Separately, the tribunal on Tuesday asked NSDL not to transfer any more shares to the clients of the crippled Karvy Broking.
 The SAT order came on a plea from affected lenders -- HDFC Bank, ICICI Bank, Indusind Bank and Bajaj Finance-- which challenged NSDL's Monday decision to transfer shares from now-banned Karvy Broking back to 83,000 clients, which helped almost 90 percent of the demat accountholders of brokerage to recover their investments.
