In all the twenty-nine states and two union territories on India, the Chief Minister is the head of the elected government. While the constitution of India recognizes the Governor as the de jury head of the state, the de facto executive authority exists with the Chief Minister. General Elections are conducted for the Vidhan Sabha or the State Legislative Assembly and the Governor invites the winning party or the coalition that has got the majority of seats to form the government. During a ceremonial proceeding, the Governor appoints the Chief Minister who takes charge of the State Assembly along with the Council of Ministers. If the Chief Minister can successfully retain the confidence of the Assembly, he or she can last as the executive head of the state for a term of six years in case of Jammu and Kashmir and five years in case of all the other states in India. Here we discuss the powers and role of the Governor of a state in choosing the chief minister of the state. Powers of the Governor In India, the Governor of a state enjoys three kinds of powers namely executive powers, legislative powers and discretionary powers. The Executive powers of the Governor empower him to administrate, appoint and remove. It works as follows. Appointment of the Chief Minister The Constitution of India vests a set of executive powers in the Governor of the State. The Governor appoints the Chief Minister following the general elections. Once the general elections are over for the state assembly, the process of forming the government begins. The Governor invites the person who has the support of the majority of members in the Legislative Assembly to take charge as the Chief Minister. Once the Chief Minister is appointed, the Governor also appoints the Council of Ministers and as per the advice of the Chief Minister, distributes the portfolios to the appointed ministers. The Chief Minister and the Council of Ministers cannot be dismissed as long as they enjoy a majority in the Legislative Assembly. If no party has won the majority seats in the Assembly during the General Elections, the Governor can use his discretionary powers to select a candidate to become the Chief Minister who will have to prove his or her majority at the earliest possibility. The other powers of the Governor The Governor has the power to appoint a large number of top-level officials in the state including the Advocate General, Chairman and Members of the State Public Service Commission, and the State Election Commissioner. The President of India consults the Governor in the appointment of High Court Judges while the Governor appoints the judges of the District Courts himself. Where the powers of the Governor supersede the powers of the Chief Minister The Chief Minister has no powers to advise the Governor on the functions that he exercises under his discretion. Article 192 empowers the Governor to disqualify a given member of the state Legislature if the Election Commission finds that the legislator is not complying with the provisions found in the article 191. Enabled by the powers given to the Governor by Articles 165 and 177, the Governor can depute the Advocate General to watch the proceedings of both the houses of the State’s Legislature and report if there had been any unlawful functioning.

What are the powers of a Governor?

The Congress coalition government in Karnataka is facing the risk of losing its majority in the state assembly since as many as 13 Congress MLAs and 3 JD MLAs submit their resignations to the Speaker. The total strength of the JD(S)-Congress coalition in Karnataka including those who have submitted their resignations is 118 (Congress-78, JD(S)-37, BSP-1 and Independents-2), in addition to the Speaker. On the other hand, the BJP has a strength of 105 MLAs in the State Assembly. The list of Congress MLAs who were spotted at the Speaker’s office for submitting their resignations are Ramesh Jarkiholi (elected from Gokak), Pratap Gowda Patil (won from Maski), Shivram Hebbar (won from Yellapur), Mahesh Kumathalli (voted from Athani), B C Patil (won from Hirekerur), Byratibasavaraj (elected from K R Puram), S T Soma Shekar (from Yashwanthpur constituency) and Ramalinga Reddy (BTM Layout constituency). The JD(S) MLAs who have resigned are: A H Vishwanath (won from Hunsur), who recently quit his position as the party’s state chief, Narayana Gowda (elected from K R Pet), and Gopalaiah (won from Mahalakshmi Layout). Commenting on the repercussions of the situation, Assembly Speaker Ramesh Kumar said, “Whether the government will fall or survive would be decided in the Assembly“. He also added, “11 of them have submitted resignation letters. I told officials to take the letters and issue acknowledgement...on Tuesday I will go to office and take further action in accordance with rules.” Later, Congress MLA Munirathna who was elected from Rajarajeshwari Nagar also submitted his papers as per the sources of the Assembly Secretariat.

Bangalore also ranked in the top 30 global tech hubs (#23 globally) and Delhi made it into the top 40 list, coming in at 36th. Mumbai maintained its first position in the Emerging Ecosystems ranking (ecosystems in earlier stages of growth that have high potential to be global performers in the future), outperforming other fast-growing ecosystems in areas of funding, performance, market research and talent. Released to coincide with London Tech Week, the largest tech event in Europe, the report ranks the leading 140 startup ecosystems based on seven success factors including Performance, Talent and Connectedness. The findings revealed that London is the most attractive destination to set up a tech startup outside of Silicon Valley, with an overall ecosystem value of 142.7bn. London has risen up the league table in the last few years, climbing from number eight in 2012 when the first rankings were released to number two in 2020. Silicon Valley held onto the top spot this year while Beijing and Boston came in fourth and fifth respectively. The research shows that Indian startups raised 12.1 billion in the first half of this year, demonstrating the rapid growth of India as a global hub for tech and innovation. As of August 2021, India has produced 24 unicorns in 2021, including 6 in just 4 days in April. The city of Bengaluru and the surrounding state of Karnataka is also the world's 4th largest technology and innovation cluster and home to more than 400+ global R&amp;D centres. Compared with other international tech hubs, the research found that startups in London have access to deeper pools of capital, with an average seed round of 653k, ahead of the global average of 494k. Congress MLA Ramalinga Reddy, has decided to vote in favour of the HDK government. “I will take part in the assembly session tomorrow and vote in favour of the party. I will continue to remain in the party and serve as MLA,” Reddy told PTI. The move has come hours before the Karnataka assembly is set for a trust vote. In the meanwhile, a Section 144 is imposed around Vidhan Soudha area, where assembly of more than four people is banned, ahead of the vote. Supreme Court in its ruling yesterday in the Karnataka political crisis case had said that the MLAs cannot be forced to take part in the trust vote. While all the rebel MLAs were residing in Mumbai, Reddy was the only one who stayed back in Bengaluru and there were speculations that he may have been approached by the Congress for taking his resignation back. Congress also did not include Reddy’s name in the list of MLAs for disqualification saying he was an ‘exception’. Reddy while giving his resignation on July 6 had said that he is only resigning from the assembly and will continue to be in the party. Now the faith of the Congress-JD(S) alliance government in Karnataka is completely dependent on the trust vote, as the rebel MLAs in Mumbai are showing no sign of melt down. If this continues the HDK government will be reduced to a minority with 102 members after Reddy’s return. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. Governor is interfering: Cong JD(S) spokesman Ramesh Babu said that the CM’s counsel will move the Supreme Court today for a stay on the Governor's Thursday’s order asking him to prove majority by the deadline. “The Governor is interfering in the workings of the Legislative Assembly, which is the domain of the Speaker under the provisions of the Constitution,” Babu said. Congress-JD(S) alliance is to petition on the basis that CM Kumaraswamy had moved the confidence motion in the house on Thursday and the debate had started and so setting a deadline should be stayed by the court. In the meanwhile, one of the Congress MLAs Shreemant Patil is admitted in a hospital in Mumbai, after he complained of chest pains. Yesterday, Congress alleged that BJP has kidnapped them. Delayed Trust The trust vote which was supposed to happen yesterday, was relentlessly delayed by the ruling Congress-JD(S) coalition which might be facing an end of its run. Kumaraswamy will have to prove that his government has majority to carry on, as MLAs have been leaving his fold. BJP party members had staged an overnight dharna or protest over the delay of trust vote. Accusations, speeches and allegations between both Congress and BJP managed to delay the vote, yesterday. Finally, the state’s Governor wrote a letter to CM Kumaraswamy regarding the trust vote after senior BJP MLAs met him at the Raj Bhawan. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was disrupted throughout the day on the issue of trust vote and when it was finally adjourned till today, BJP announced a night long strike in the assembly itself till the voting was not done. “We are demanding voting on the motion but the chief minister is reluctant to take it up as he has confirmed himself that he has lost confidence of the House and the people. Everybody knows Congress-JD(S) coalition has only 98 MLAs, we have 105,” said B S Yeddyurappa, BJP party president. Crisis mode The Karnataka state government went into a crisis mode earlier this month, after 16 of its MLAs from both the parties of the coalition government resigned. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs, Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, a few days back.

Two policemen were injured in the stone pelting, an officer from Palakkad Town North police station said and added that an FIR was lodged the same day and on Monday 22 persons were arrested in the case. "They will be produced in court today," the officer said. He said there was no permission obtained for carrying out the procession which was using unauthorised sound and speaker systems to play music and that coupled with the large number of fans led to the road being blocked and traffic movement disrupted. When the procession organisers were asked by police to move away in view of the road being blocked, they got into an argument with the officers and then started pelting stones. "Two officers were injured. Their health is stable now," he said. On the flip side, a prominent Kerala-based businessman -- Boby Chemmanur -- decided to travel to Qatar with a golden statue of Maradona which commemorates the legendary footballer's 'Hand of God' goal. "It will be open to all. We bought the house a month back. We have already put in place some games, like carrom, that people coming here can play. The house is presently registered in our name, but we will ensure it is accessible to all," he added.
