Section 144 CrPC was clamped in and around 3,444 examination centres across the state and tight security arrangements were made at all examination centres to avoid any showdown or untoward incidents. As many as 8,73,846 students - 4,52,732 boys and 4,21,110 girls students - were enrolled for the exams this academic year. Four students belonging to the third gender and 5,307 specially-abled children also took up exams. The state government had also set up helplines for the students. SSLC results to be announced in Karnataka on May 19

The Congress coalition government in Karnataka is facing the risk of losing its majority in the state assembly since as many as 13 Congress MLAs and 3 JD MLAs submit their resignations to the Speaker. The total strength of the JD(S)-Congress coalition in Karnataka including those who have submitted their resignations is 118 (Congress-78, JD(S)-37, BSP-1 and Independents-2), in addition to the Speaker. On the other hand, the BJP has a strength of 105 MLAs in the State Assembly. The list of Congress MLAs who were spotted at the Speaker’s office for submitting their resignations are Ramesh Jarkiholi (elected from Gokak), Pratap Gowda Patil (won from Maski), Shivram Hebbar (won from Yellapur), Mahesh Kumathalli (voted from Athani), B C Patil (won from Hirekerur), Byratibasavaraj (elected from K R Puram), S T Soma Shekar (from Yashwanthpur constituency) and Ramalinga Reddy (BTM Layout constituency). The JD(S) MLAs who have resigned are: A H Vishwanath (won from Hunsur), who recently quit his position as the party’s state chief, Narayana Gowda (elected from K R Pet), and Gopalaiah (won from Mahalakshmi Layout). Commenting on the repercussions of the situation, Assembly Speaker Ramesh Kumar said, “Whether the government will fall or survive would be decided in the Assembly“. He also added, “11 of them have submitted resignation letters. Congress MLA Ramalinga Reddy, has decided to vote in favour of the HDK government. “I will take part in the assembly session tomorrow and vote in favour of the party. I will continue to remain in the party and serve as MLA,” Reddy told PTI. The move has come hours before the Karnataka assembly is set for a trust vote. In the meanwhile, a Section 144 is imposed around Vidhan Soudha area, where assembly of more than four people is banned, ahead of the vote. Supreme Court in its ruling yesterday in the Karnataka political crisis case had said that the MLAs cannot be forced to take part in the trust vote. While all the rebel MLAs were residing in Mumbai, Reddy was the only one who stayed back in Bengaluru and there were speculations that he may have been approached by the Congress for taking his resignation back. Congress also did not include Reddy’s name in the list of MLAs for disqualification saying he was an ‘exception’. Reddy while giving his resignation on July 6 had said that he is only resigning from the assembly and will continue to be in the party. Now the faith of the Congress-JD(S) alliance government in Karnataka is completely dependent on the trust vote, as the rebel MLAs in Mumbai are showing no sign of melt down. If this continues the HDK government will be reduced to a minority with 102 members after Reddy’s return. The ruling government went into a crisis mode after 16 of its MLAs from both the parties of the coalition government resigned early this months. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, yesterday. Karnataka floor test promises to be interesting after a last minute U-turn by a rebel MLA

In all the twenty-nine states and two union territories on India, the Chief Minister is the head of the elected government. While the constitution of India recognizes the Governor as the de jury head of the state, the de facto executive authority exists with the Chief Minister. General Elections are conducted for the Vidhan Sabha or the State Legislative Assembly and the Governor invites the winning party or the coalition that has got the majority of seats to form the government. During a ceremonial proceeding, the Governor appoints the Chief Minister who takes charge of the State Assembly along with the Council of Ministers. If the Chief Minister can successfully retain the confidence of the Assembly, he or she can last as the executive head of the state for a term of six years in case of Jammu and Kashmir and five years in case of all the other states in India. Here we discuss the powers and role of the Governor of a state in choosing the chief minister of the state. Powers of the Governor In India, the Governor of a state enjoys three kinds of powers namely executive powers, legislative powers and discretionary powers. The Executive powers of the Governor empower him to administrate, appoint and remove. It works as follows. Appointment of the Chief Minister The Constitution of India vests a set of executive powers in the Governor of the State. The Governor appoints the Chief Minister following the general elections. Once the general elections are over for the state assembly, the process of forming the government begins. The Governor invites the person who has the support of the majority of members in the Legislative Assembly to take charge as the Chief Minister. Once the Chief Minister is appointed, the Governor also appoints the Council of Ministers and as per the advice of the Chief Minister, distributes the portfolios to the appointed ministers. The Chief Minister and the Council of Ministers cannot be dismissed as long as they enjoy a majority in the Legislative Assembly. If no party has won the majority seats in the Assembly during the General Elections, the Governor can use his discretionary powers to select a candidate to become the Chief Minister who will have to prove his or her majority at the earliest possibility. The other powers of the Governor The Governor has the power to appoint a large number of top-level officials in the state including the Advocate General, Chairman and Members of the State Public Service Commission, and the State Election Commissioner. The President of India consults the Governor in the appointment of High Court Judges while the Governor appoints the judges of the District Courts himself. Where the powers of the Governor supersede the powers of the Chief Minister The Chief Minister has no powers to advise the Governor on the functions that he exercises under his discretion. Article 192 empowers the Governor to disqualify a given member of the state Legislature if the Election Commission finds that the legislator is not complying with the provisions found in the article 191. Enabled by the powers given to the Governor by Articles 165 and 177, the Governor can depute the Advocate General to watch the proceedings of both the houses of the State’s Legislature and report if there had been any unlawful functioning.

Finally, the state’s Governor wrote a letter to CM Kumaraswamy regarding the trust vote after senior BJP MLAs met him at the Raj Bhawan. The case of a kidnapped legislator Yesterday, the Speaker had refused to conduct the trust vote amid allegations by the Congress against the BJP for kidnapping its MLA Shreemant Patil, who had decided to take his resignation back. Speaker Ramesh Kumar had asked home minister MB Patil to give a detailed report of Shreemant after talking to his family. The Speaker said that he had received a letter in this regard named in Patil’s name, saying he would abstain from coming to the house due to health related issues. However, the Speaker asked the present Home Minister of Karnataka, MB Patil to contact Shreemath Pati’s family and give a detailed report by tomorrow. “What kind of a Speaker would I be if I proceed with a document which has no date or letterhead,” said K R Ramesh Kumar. The house was disrupted throughout the day on the issue of trust vote and when it was finally adjourned till today, BJP announced a night long strike in the assembly itself till the voting was not done. “We are demanding voting on the motion but the chief minister is reluctant to take it up as he has confirmed himself that he has lost confidence of the House and the people. Everybody knows Congress-JD(S) coalition has only 98 MLAs, we have 105,” said B S Yeddyurappa, BJP party president. Crisis mode The Karnataka state government went into a crisis mode earlier this month, after 16 of its MLAs from both the parties of the coalition government resigned. For the last two weeks, the political crisis in the state raged on, as Speaker of the Assembly refused to accept them, taking them to court. One of the rebel MLAs, Roshan Baig was also detained at Bengaluru airport and questioned, as he was stopped from taking a chartered flight, a few days back. One of the most important constitutional mechanisms, a floor test is a kind of motion through which the executive head of the state is put to test if he or she still has the confidence of the legislation. As per the mandates of the Indian Constitution, the Governor appoints the Chief Minister of a State. When a floor test is called for during some critical situations in the state assembly, The Chief Minister of the State has the responsibility to prove that he has the support of the majority of members in the legislature bypassing the floor test. Why a floor test is necessitated If a single party gets the majority of seats in the Assembly that is sufficient to form the government as per the guidelines issued by the Constitution, the Governor invites the person recommended by the winning candidates of the party to take charge as the Chief Minister. If no party is in a position to form the government due to the lacking majority, the Governor appoints the leader heading the single largest party or coalition to pass a vote of confidence to be able to continue as the executive leader of the house. When the Governor orders for a floor test, the chief minister is required to prove that he or she has the support of the majority members and hence has successfully retained the confidence of the house. The floor test is conducted with the participation of the members present and voting. If the floor test or confidence motion fails, the Chief Minister will have to resign his position. Composite floor test Composite floor test happens when more than one person makes a claim to form the government under circumstances when the majority is not clear. A composite floor test is a special session that will assess who has the majority based on the voting of those present and voted and at times, it happens via voice voting also. What happens in a floor test The Chief Minister is expected to move a motion of confidence and win the majority among the members present and voted. The objective of the floor test is to ensure the constitutional process happens in a transparent manner. How voting is conducted in a floor test There are three modes in which the floor test can be administered. In a voice vote, the legislators are asked to respond orally. In case a division vote is ordered for, the voting is done with the use of electronic gadgets, ballot box or slips. A ballot vote is done if secret voting is necessitated. This is similar to how the general elections are conducted. The outcome of a floor test If the floor test fails, the Chief Minister has to resign. If a composite floor test happens and more than one member takes up the floor test, the winning person with the majority will be asked to form the government. If there is a tie, the speaker can cast his or her vote. The role of the pro-tem speaker Before a floor test is conducted, the Governor of the State appoints the longest-serving member of the house as the pro tem speaker who will conduct the floor test.

One of those 16 has now returned into the Congress-JDS fold, leaving the number of rebels at 15, a day before the Supreme Court verdict. The question in front of the Supreme Court was whether these resignations should be accepted by the Speaker of the Legislative Assembly, who had decided that the rebellion was unconstitutional.
