<ul class="summary-list"><li>Civil rights groups are suing the <keyword id="11917126" type="UNKNOWN" weightage="60" keywordseo="south-carolina" source="Orion">South Carolina</keyword> Department of Juvenile Justice.</li><li>They allege "nightmarish" and inhumane conditions where children live in filth and are victims of routine violence.</li></ul>Children detained at a South Carolina <keyword id="11906530" type="UNKNOWN" weightage="60" keywordseo="youth" source="Orion">youth</keyword> detention facility live with feces on the floor, mold on the walls, and cockroaches in their food, according to a new lawsuit filed against the state's juvenile justice agency.But worst of all, the kids — who range in age from 13 to 19 – are subjected to routine violence by other inmates or staff, the suit says. "These kids are in danger. The risk comes from a whole number of sources that we outline in the lawsuit, but the biggest one is just endemic violence in these facilities," said Previn Warren, from the law firm of Jenner &amp; Block. "There are not enough staff and the staff that are there are not adequately trained to contain the amount of violence that is going on … kids are just getting hurt." The lawsuit, which was filed Tuesday, alleges that the South Carolina Department of Juvenile Justice is violating the civil rights of children detained at the Broad River Road Complex and four other state detention facilities. It also states that staff at the facilities use solitary confinement — in cells with no natural light — as a way to "protect" them from violence, which is rampant in the facilities. Some children spend months in isolation, and there is no meaningful educational or mental health services for the detained youth, according to the lawsuit, which was filed on behalf of the South Carolina State Conference of the NAACP, Disability Rights South Carolina, and Justice 360.More than 250 children are in custody, and they are disproportionately Black and from families that live below the federal poverty line, according to the suit.<div type="image" title="Violence DJJ" height="361" width="723" msid="91158881" hostid="261"></div><h2>Endemic violence </h2>The lawsuit details documented cases of violence against the detainees, by each other, as well as staff. Between July 2018 and May 2019, there were "134 fights and 71 assaults that resulted in 99 injuries to youth in a facility with an average daily population of just over 100," according to the lawsuit, which cited a recent Justice Department report. The civil rights groups allege that when children are assaulted, staff does little to investigate or record the incidents. In cases where they believe a child will continue to be assaulted, they use solitary confinement to keep them away from the attackers.There, they are held for 23 hours a day with no sunlight. Earlier this year, one unnamed 16-year-old detained at the BRRC was assaulted by three other kids who entered his room. He was left "bleeding profusely." "Rather than intervening in the attack, the officer on duty told Child 1 to stay away from the facility's cameras so that he could not be seen bleeding," the lawsuit said.In another case, a 15-year-old detained at the state's <keyword id="12330258" type="UNKNOWN" weightage="60" keywordseo="juvenile-detention" source="Orion">Juvenile Detention</keyword> Center was assaulted by several boys who kicked him in the head as he laid on the floor, according to the suit. There was one correctional officer nearby and he was unable to break up the fight, and had to call for backup. Eventually, he was taken to the infirmary and was only treated with Tylenol, despite severe injuries, according to the suit. Since then, the same group of assailants have been allowed to "approach, taunt, and menace him," the suit says.First quarter of 2021, there were 25 instances of inappropriate sexual contact, with a majority at BRRC. There were a total of 178 injuries to youth at that five facilities during the same time period. Staff was responsible for five assaults, according to the lawsuit. <div type="image" title="DJJ juvenile detention" height="740" width="688" msid="91158882" hostid="261"></div><h2>"Nightmarish" conditions </h2>The civil rights groups allege inhumane conditions at the facilities, where rooms are overrun with odor, trash, and bugs. When toilets back-up, for example, they have been left unfixed for weeks. On one occasion, sprinklers went off, and the children continued to be housed in standing water, as their clothes and bodies were soaked, the suit says."In certain facilities, maggots and cockroaches come up through the drains," the suit alleges.Some of these allegations have been documented in the media. During a staff walk-out last summer protesting worker conditions at BRRC, correctional employees spoke out about a broken sewage system that left waste all over the floor.Lt. Ricky Dyckes Jr., told reporters, according to the suit, that there were tissues, feces, urine on the floor. "You can smell it when you come to lock up," he is quoted saying in the lawsuit. "Those kids are inhaling it and living in those conditions. This is just unacceptable." <div type="image" title="Eden Hendrick listens as Gov. In the 1990s, a group of law firms and civil rights organizations representing children incarcerated in the facilities successfully sued the agency over the use of solitary confinement, and was put under a consent decree, which required monitoring from an outside agency.The state ended up paying $1.1 million to settle 9 nine claims alleging that children as young as ten years old had been sexually assaulted at DJJ facilities at the time."One thing that really shocks my conscience about this case is just how long these abuses have been going on and how many attempts there have been to fix them that have not ultimately resulted in lasting change for this very vulnerable population," Warren told Insider.For the last year, walk-outs, audits, and a DOJ report resulted in the resignation of the former executive director Freddie Pough.  In February Eden Hendrick was named as new director, after working as the acting director for the five months prior.She has publically acknowledged failures of the department. "We're not here to indict the current leader. We're here to task for the systemic changes that current leadership is acknowledged needs to happen," Warren said. "These are systemic failings that predate director Hendrick's tenure by years and decades, so this isn't about any lack of leadership on her part. It's about ensuring that the changes that she has indicated she wants to implement do get implemented and are appropriately resourced, and happen fast because these kids are in danger and they need the help right now." Donna Scott Davenport, a judge in Rutherford County's juvenile court, said she didn't plan to seek reelection for the position that she's held since 2000. "After prayerful thought and talking with my family, I have decided not to run for re-election after serving more than twenty-two years on the bench," Davenport said in a statement. Her office did not respond to requests for comment. "I will always look back at my time as Judge as one of the greatest honors of my life, and I am so proud of what this Court has accomplished in the last two decades and how it has positively affected the lives of young people and families in Rutherford County," she said. "I wish my successor the best and hope that this job provides them the same fulfillment it has provided me over the years."Davenport's term ends in September. Her retirement announcement came one day after state legislators in Tennessee <a href="https://www.newschannel5.com/news/lawmakers-issue-resolution-to-remove-judge-donna-scott-davenport">issued a resolution</a> to remove her from the bench. So far, <a href="https://www.wgnsradio.com/article/72713/andrae-crismon-announced-his-candidacy-for-juvenile-court-judge">two</a> <a href="https://www.murfreesboropost.com/news/candidate-announcement-jacob-flatt-for-juvenile-court-judge/article_84a56c10-4887-11ec-9c2b-5bb7c645c5eb.html">candidates</a> have announced that they're running to fill her position. <h2>A system of illegally jailing children</h2>Last October, an extensive report by <a href="https://www.propublica.org/article/black-children-were-jailed-for-a-crime-that-doesnt-exist">ProPublica and Nashville Public Radio</a> found that Davenport orchestrated a system to arrest and jail children, many of whom were Black.Davenport used a process that included an "always arrest" policy, in which children were arrested by police and taken to a <keyword id="12990670" type="UNKNOWN" weightage="60" keywordseo="juvenile-detention-center" source="Orion">juvenile detention center</keyword> where a jailer — who was appointed by Davenport — used a "filter system" to decide which children to hold. The children later appeared before Davenport in juvenile court.Jacob Somers, who told Insider that Davenport threatened to lock him up until he was 18 if he didn't straighten up, said the judge appeared to be "retiring to avoid guilt."Somers was one of almost <a href="https://www.insider.com/former-child-detainees-tennessee-detention-center-rutherford-county-judge-2021-11">1,500 plaintiffs</a> in a class-action lawsuit against Rutherford County that was settled for $11 million.Kyle Mothershead, one of the attorneys in the class-action lawsuit, said hundreds of claims for settlement money were submitted to the claims administrator following the lawsuit. Plaintiffs who were illegally arrested could get $1,000, and those who were illegally detained could get about $4,800, he said. Mothershead also said the "filter system" used by jailers to decide which children to detain was no longer in place at Rutherford County Juvenile Detention Center. A 2017 preliminary injunction on the system was made permanent as part of the settlement agreement for the lawsuit."The 'always arrest' policy is no longer in effect either. This was not the result of a court order, but rather the law-enforcement agencies changing their juvenile-arrest policies in response to our lawsuit," Mothershead said. <h2>Former child detainees demand accountability </h2>Akira Lawrence, 22, said she was arrested dozens of times between ages 11 to 17, and that she appeared before Davenport many times. She said none of the charges against her was for drugs or violence. "We were treated like animals, and we were just kids," Lawrence said. "I was treated like I murdered someone, and that was never the case. They acted like I was just horrible."Lawrence said she was traumatized by her experience at Rutherford County Juvenile Detention Center, and that it was one of the reasons she moved out of the county. "I have PTSD from my childhood there," she said.Lawrence said Davenport retiring meant there was no accountability for how children like her were treated. "There's no way that they should just let her retire," Lawrence said. "How could you say that you helped us?"Following initial reports of Davenport's practices while on the bench, Tennessee Gov. Bill Lee <a href="https://wpln.org/post/governor-says-rutherford-county-judge-should-be-reviewed-after-report-on-the-juvenile-justice-system/">called for a review</a> of the judge. Such a review would be conducted by the <a href="https://www.tncourts.gov/boards-commissions/court-judiciary/disciplinary-actions">Board of Judicial Conduct</a>, which can file public reprimands on judges as well as formal charges. Davenport <a href="https://www.tncourts.gov/sites/default/files/docs/judge_donnasdavenport_-_public_reprimand2016may23.pdf">received a public reprimand</a> in 2016 after she referred to a parent as a "sneaky snake" in court and called his attorneys "conniving." Barbara Peck, the communications director for the board, previously told Insider that she couldn't comment on whether there was an investigation into Davenport because of confidentiality."If an investigation leads to public disciplinary action, such as a public reprimand, the reprimand will be posted on the board's webpage. If formal charges are filed against a judge, that would likewise be made public." In a comment to Insider, Peck said the board loses jurisdiction to reprimand or charge a judge if they retire."Once a judge retires or resigns, the Board of Judicial Conduct loses jurisdiction and cannot take any further action in a pending matter. Thus, it is not possible to formally charge a judge with an ethics violation or for discipline to be imposed once a judge leaves office. Sometimes, however, a resignation or retirement is the end result of an investigation or the form of discipline imposed," Peck said. For Lawrence, the <keyword id="11893589" type="UNKNOWN" weightage="100" keywordseo="news" source="Orion">news</keyword> of Davenport retiring, seemingly without consequences, made her feel helpless. She said the judge's comments on how she "positively affected the lives of young people" were false. "It's not positively. I'm about to cry. Children's rights advocates and health experts have warned state officials for weeks that it was just a matter of time before the virus took off inside juvenile facilities. They have called on Gov. Ralph Northam to start releasing as many children as safely possible from centers, including at the newly hit Bon Air Juvenile Correctional Center outside Richmond. "Unfortunately, those sworn to protect our vulnerable youth have failed," said Liz Ryan, head of the Washington-based nonprofit Youth First Initiative. "It's clear that refusing to listen to public health experts has put our youth and communities at extreme risk." So far, 97 kids have tested positive nationwide, more than half of them in Virginia and Louisiana. On April 2, officials in Virginia announced two staffers at Bon Air had tested positive, but contact with residents was limited. A day later, a kid started showing symptoms and later tested positive. Chris Moon, chief physician at Virginia's Department of Juvenile Justice, said 21 of the 25 infected kids in Bon Air exhibited no outward symptoms and only four showed signs that were more severe than a cold or a flu. The facility has around 280 kids, from 11 years old to 20. "Any resident who tested positive was immediately placed in medical isolation," Moon said, adding that 13 have already been released. America locks up more people than any other country in the world, with more than 2.2 million men, women and children in detention. Experts say that prisons and jails can act as petri-dishes for the coronavirus. Social distancing is almost impossible, many institutions have only recently started providing inmates with masks and many do not have access to hand sanitizer. She was charged with two counts of violating Montgomery's segregation ordinance and one felony count of assaulting a police officer.She was later convicted in a juvenile court of all three counts. However, on appeal, the segregation convictions were overturned. Can it be more shameful for us to learn that India has seen a 288 per cent increase in the arrest of juveniles for committing rapes in 10 years - from 2003 to 2013. Even more disturbing is the fact that arrests of juveniles in the age group 16-18 has increased to almost 60% in this period, which is the highest among all three juvenile age groups. 
 Despite such alarming facts staring at us, we still required a brutal and horrifying Delhi gangrape-murder of a female paramedical student on Delhi streets to realize the threat from rising <keyword id="6793720" type="UNKNOWN" weightage="20" keywordseo="Juvenile-crimes">juvenile crimes</keyword> in the country. It wasn’t until the spine-chilling details of the crime emerged and we learnt that the youngest rapist in the case (17 years’ old) was infact the most brutal one, that we stood up against unfair constitutional concession to dangerous minors like him in India which says those under 18 to be sentenced only to a maximum of three years in a reform facility. That meant no strict trial for him and others like him. 
 
You will be surprised to know that even before the Delhi gangrape incident took place, the statistics on juvenile crimes were startling. 
 
-In 2011, 33,887 juveniles were arrested for crime. Of these, 21,657 fell in the 16-18 years age group. In Delhi itself, of the 925 boys arrested for juvenile crimes in 2011, 567 were in the 16-18 years age group. -The next year 2012 which saw the <keyword id="1499530" type="UNKNOWN" weightage="20" keywordseo="Nirbhaya-gangrape">Nirbhaya gangrape</keyword> had the number of juvenile offenders steadily increasing. There were 39,822 juvenile arrests and the highest increase in the incidents of crimes committed by them was reported under assault on woman to outrage her modesty (132.3%) followed by insult to the modesty of women (70.5%) and <keyword id="39493" type="ORGANIZATION" weightage="20" keywordseo="Rape">rape</keyword> (60.3%). Notably, the debate about the trial age of juveniles between 16 and 18 years first began after the 2012 Delhi gang-rape case, in which one of the main accused was a juvenile. While the others accused in the case were given death (one committed suicide), the minor accused was sent to a remand home for three years. 
-In 2013, the number of juvenile arrests increased to 43,506 which further up to 48,230 in 2014 when a total of 48,230 juvenile boys and girls were arrested. 
 Despite such a situation, <keyword id="42851" type="PERSON" weightage="20" keywordseo="Maneka-Gandhi">Maneka Gandhi</keyword> introduced the Juvenile Justice (Care and Protection of Children) Amendment Bill in Parliament only in August last year. Yes, we did finally wake up to the need of a stricter juvenile law, one that would consider those above 16 who commit “heinous crimes” as adults. Finally, a gruesome rape case had led to massive debates in the political corridors, which were echoing in the Parliament. It was a welcome change for sure, but the crucial Bill passed in Rajya Sabha merely two days after the now 20-year-old ‘juvenile’ rapist of Nirbhaya walked out of jail amid vociferous protests, still awaits President’s assent to become a law. 
 
Had it not been for the narrow scope of the prevailing law, and the new Bill being stuck in the Rajya Sabha due to the Parliament logjam, the consequent new law could have prevented the juvenile rapist, from getting out of jail. The new law would have set an unprecedented example to begin with. Justice was however not only delayed, but denied in one of the most gruesome case the country has ever witnessed. We wish no more Nirbhayas being raped and in the face of increasing crimes by juveniles, all India direly needs now is the Juvenile Justice Act.

Call him a schoolyard bully if you want. It won't matter. He knows who he is, and he'll hit you first and dirty.But it's not easy to pretend to be a bully. You either have the instinct or you don't. Trump's the real deal. And perhaps his greatest trick since entering political life has been to coax his political enemies into acting as juvenile and boorish as he is.Senate Minority Leader Chuck Schumer provided the latest example this week when <a href="https://www.realclearpolitics.com/video/2020/03/04/schumer_to_kavanaugh_gorsuch_you_will_pay_the_price.html" target="_blank" rel="noopener">speaking at a Center for Reproductive Rights rally</a>, where he addressed two Supreme Court justices by name with what can only be reasonably interpreted as a threat."I want to tell you, Gorsuch. I want to tell you, Kavanaugh. You have released the whirlwind, and you will pay the price! You won't know what hit you if you go forward with these awful decisions."Does anyone truly believe that Schumer "has brought great danger to the steps of the United States Supreme Court," as Trump <a href="https://twitter.com/realDonaldTrump/status/1235588587690676224" target="_blank" rel="noopener">put it in a tweet</a>? Unlikely.But it was a wildly inappropriate and bizarre display of tough-guy posturing, and Chief Justice John Roberts was completely correct to issue a rare public rebuke of the minority leader, saying: "Justices know that criticism comes with the territory, but threatening statements of this sort from the highest levels of government are not only inappropriate, they are dangerous."Schumer didn't do himself any favors with the mealymouthed statement put out by his office, which accused Roberts of following "the right wing's deliberate misinterpretation of what Sen. Schumer said."OK, then: So what was the correct interpretation?<a href="https://thehill.com/homenews/senate/486029-schumers-office-says-he-was-referencing-justices-paying-political-price" target="_blank" rel="noopener">According to Schumer's office</a>, he was referencing "the political price Senate Republicans will pay for putting these justices on the court, and a warning that the justices will unleash a major grassroots movement on the issue of reproductive rights against the decision."That's patently ridiculous. Schumer didn't say Senate Republicans "won't know what hit them." The grammar makes it clear the "you" was in reference to Gorsuch and Kavanaugh.But the whole sadly comical episode is indicative of how Trump has influenced so many political figures into acting like him through pro-wrestling-style insults, childish tweets, and theatrical attempts at viral moments.<h2>'If you can't beat Trump, act like Trump' has become a political maxim</h2>Trump's been known for his <a href="https://www.youtube.com/watch?v=SEPs17_AkTI" target="_blank" rel="noopener">brash, plain-spoken style</a> since he became a national figure following the publication of his bestselling ghostwritten book, "The Art of the Deal."Later, as his business fortunes crumbled, he was forced to rebrand as a <a href="https://www.youtube.com/watch?v=fgPxjDjAKyg&amp;t=1538s" target="_blank" rel="noopener">somewhat self-deprecating TV commercial pitchman</a> to maintain relevance. Then, Mark Burnett cast him in the fictitious reality-TV role of a competent businessman in "The Apprentice," where Trump really started to lean into the role of indomitable <a href="https://www.businessinsider.com/top-heroes-babyfaces-good-guys-in-wwe-history-2017-8" target="_blank" rel="noopener">heel</a>.But it wasn't until Trump joined Twitter in May 2009 that he unleashed his true id.With a completely unfiltered bullhorn of global reach, he was free to spread fake conspiracy theories about President Barack Obama's birthplace, level gross insults on female celebrities' appearances, and make easily debunkable boasts about his own accomplishments.Almost a decade to the day later, a lot of lawmakers have calibrated a "be like Trump" approach to fighting Trump.During a desperate last-gasp attempt at survival in the 2016 Republican primary, Sen. Marco Rubio of Florida fought back against Trump's "Little Marco" insults by saying Trump has small hands, adding, "And you know what they say about men with small hands? You can't trust them."Rubio may have thought he landed a direct hit, but Trump's got no shame, and was quite happy to play in the gutter. <a href="https://www.cnn.com/2016/03/03/politics/donald-trump-small-hands-marco-rubio/index.html" target="_blank" rel="noopener">At a debate</a> days after Rubio's insult, Trump addressed the audience: "He referred to my hands - 'if they're small, something else must be small.' I guarantee you there's no problem. I guarantee."House Speaker <a href="https://www.businessinsider.com/nancy-pelosi-2013-3" target="_blank" rel="noopener">Nancy Pelosi</a>, widely considered one of the most patient and effective political tacticians in congressional history, has never quite sunk into Trump-level vulgarity or made intimation toward violence, but that doesn't mean she's above fighting Trump with a petty stunt.The speaker grabbed headlines in February when <a href="https://www.businessinsider.com/nancy-pelosi-rips-pages-of-trump-state-of-the-union-2020-2" target="_blank" rel="noopener">she tore up a copy</a> of Trump's State of the Union address moments after the speech concluded. This came after Trump pointedly snubbed her attempt at a handshake before the address. Pelosi said afterward that "it was the courteous thing to do considering the alternatives."And, more recent, the vanquished 2020 candidate, billionaire, and former New York City Mayor Mike Bloomberg, <a href="https://twitter.com/MikeBloomberg/status/1230147743760486401" target="_blank" rel="noopener">responded in February</a> to Trump's "Mini Mike" insult with a tweet reading simply: "Impeached president says what?"Bloomberg's social-media team also used the @Mike2020 account to "satirically" go after Bernie Sanders following his comments in support of deceased Cuban dictator Fidel Castro, though they were forced to delete the thread after at least one of them was <a href="https://news.avclub.com/mike-bloombergs-social-media-goons-delete-tweets-after-1841914472" target="_blank" rel="noopener">widely reviled as homophobic</a>.<h2>Trump didn't make politics uncivil, but he's helped make it even less dignified</h2>US politics has never been civil.Take the presidential campaign of 1800, when Thomas Jefferson reportedly <a href="https://www.merriam-webster.com/words-at-play/are-presidential-campaigns-getting-nastier-not-really/hermaphroditical" target="_blank" rel="noopener">hired a journalist</a> to describe his opponent, John Adams, as "a hideous hermaphroditical character which has neither the force and firmness of a man, not the gentleness and sensibility of a woman."Trump would never apply such literacy to his barbs, which has worked well for him.Rubio's double entendre about Trump's hands didn't work because it was a one-off and rang false. He's still young enough to be part of the GOP's future, and if he ever gets comfortable enough in his own skin <a href="https://www.nytimes.com/2016/02/07/us/politics/chris-christie-marco-rubio-gop-debate.html" target="_blank" rel="noopener">not to come off like a robot</a>, maybe an authentic version of himself could be compelling to the national electorate.Pelosi's not a naturally theatrical showboater; she's the ultimate poker player. Ripping up the State of the Union speech isn't much of a bluff. It's <a href="http://www.pokerology.com/lessons/understanding-tilt/" target="_blank" rel="noopener">going on tilt</a>. In the past three years, she's shown an ability to <a href="https://apnews.com/9e91c2875ef244b494b8a5921b1a2138" target="_blank" rel="noopener">ingratiate herself to</a> Trump and <a href="https://www.politico.com/story/2019/05/22/pelosi-trump-meeting-1340123" target="_blank" rel="noopener">score some political victories off him</a>, but she did it by playing cool.Bloomberg ran for president on his reputation as a technocratic CEO who ran New York with the same kind of humorless efficiency that made him his fortune. Yet he couldn't hire people to effectively cut Trump to pieces on Twitter, and became the source of online ridicule himself.That's the whole point: Trump is Trump. His enemies are not.Chuck Schumer's threat - and it was a threat, however empty - to Gorsuch and Kavanaugh has ginned up the predictable partisan outrage, but it was an inauthentic attempt to out-Trump Trump.As a communicator, Trump can be <a href="https://www.nytimes.com/interactive/2019/05/26/us/politics/trump-tweets-democrats.html" target="_blank" rel="noopener">a shameless and vulgar</a> thug. But unlike his opponents trying to ape his style, it's rightfully perceived as authentic.Schumer's clearly passionate about reproductive rights and wants to make an upcoming Supreme Court decision into an issue that resonates with voters.
